BISKUPIC Wisconsin Governor Scott Walker faced only the third gubernatorial recall in the nation’s history and was the first to survive. From a legal perspective, the 2012 Walker recall involved equally unique issues arising from the Wisconsin Constitution and obscure state statutes. This Article reviews the history of recall in Wisconsin and examines three significant legal issues that arose during the Walker recall: (1) litigation over review of submitted recall signatures; (2) unlimited campaign finance contributions; and (3) the scheduling of the recall election. The Article concludes that an assessment of the historical nature of the Walker recall is incomplete without consideration of the impact of these issues. -

Democracy in the United States The United States is a representative democracy. This means that our government is elected by citizens. Here, citizens vote for their government officials. These officials represent the citizens’ ideas and concerns in government. Voting is one way to participate in our democracy. Citizens can also contact their officials when they want to support or change a law. The process required to become a citizen is called naturalization. To become a U.S. citizen, you must meet legal requirements. You must complete an interview with a USCIS officer. You must also pass an English and Civics test. Then, you take the Oath of Allegiance. This means that you promise loyalty to the United States. WISCONSIN THEIR STORIES WOMEN MAKING OUR LEGACY HISTORY www.womeninwisconsin.org MARGARET FARROW 1934-present City: Kenosha County: Kenosha Margaret Farrow was the first woman to serve as lieutenant governor in Wisconsin. Farrow attended Dominican Sisters of St. Catherine High School in Racine before going to Rosary College in Illinois. She earned a bachelor's degree in political science and education from Marquette University. She began her career in government as the trustee (1976-1981) and then the president (1981-1987) of Elm Grove Village. Farrow was elected to the Wisconsin State Assembly in 1986. Three years later, she was elected to the Wisconsin State Senate from a district comprising most of Waukesha county. She was re-elected in 1990, !1994, and 1998. In 2001, Farrow, a Republican, was appointed the 42nd lieutenant governor of Wisconsin after Scott McCallum, who had held that office, became governor upon the departure of Tommy Thompson. Farrow was the first woman to hold the office, which is the first leadership position in the line of succession after the governor of Wisconsin. Farrow spearheaded two statewide commissions to advance reforms that reduce the cost of government, and she played a leadership role in reforming welfare and tax policy to encourage work, saving, investment, innovation, capital formation, labor force productivity, and economic growth. She chaired the Wisconsin Women’s Council for several years and served as a member during her tenure as lieutenant governor. Farrow also chaired the governor’s work-based learning board and co-chaired the governor’s task force on invasive species. She has chaired the board of WisconsinEye, a public affairs television network; and in 2013, !she was appointed to the University of Wisconsin System Board of Regents. -

Idaho Office of Lt. Governor Data Sheet As of July 21, 2016 History of Office The Office of the Lt. Governor of Idaho was created in 1890.1 Origins of the Office The Office of the Lt. Governor of Idaho was established in the Constitution of 1890 with statehood.2 Qualifications for Office The Council of State Governments (CSG) publishes the Book of the States (BOS) 2015. In chapter 4, Table 4.13 lists the Qualifications and Terms of Office for lieutenant governors: The Book of the States 2015 (CSG) at www.csg.org. Method of Election The National Lieutenant Governors Association (NLGA) maintains a list of the methods of electing gubernatorial successors at: http://www.nlga.us/lt-governors/office-of-lieutenant- governor/methods-of-election/. Duties and Powers A lieutenant governor may derive responsibilities one of four ways: from the Constitution, from the Legislature through statute, from the governor (thru gubernatorial appointment or executive order), thru personal initiative in office, and/or a combination of these. The principal and shared constitutional responsibility of every gubernatorial successor is to be the first official in the line of succession to the governor’s office. Succession to Office of Governor In 1890, Governor George L. Shoup resigned to take an elected seat in the U.S. Senate and Lt. Governor N. B. Willey served as Governor for the remainder of the term. The 2020 Presidential Election: Provisions of the Constitution and U.S. Code
PREFACE The National Archives and Records Administration (NARA) is proud to acknowledge its role in the Presidential election pro- cess. NARA’s Office of the Federal Register (OFR) acts as the administrator of the Electoral College and carries out the duties of the Archivist. In this role, the OFR is charged with helping the States carry out their election responsibilities, ensuring the completeness and integrity of the Electoral College documents submitted to Congress, and informing the public about the Presidential election process. The Electoral College system was established under Article II and Amendment 12 of the U.S. Constitution. In each State, the voters choose electors to select the President and Vice President of the United States, based on the results of the Novem- ber general election. Before the general election, the Archivist officially notifies each State’s governor and the Mayor of the District of Columbia of their electoral responsibilities. OFR provides instructions and resources to help the States and District of Columbia carry out those responsibilities. As the results of the popular vote are finalized in each state, election officials create Certificates of Ascertainment, which establish the credentials of their electors, that are sent to OFR. In December, the electors hold meetings in their States to vote for President and Vice President. The electors seal Certificates of Vote and send them to the OFR and Congress. In January, Congress sits in joint session to certify the election of the President and Vice President. In the year after the election, electoral documents are held at the OFR for public viewing, and then transferred to the Archives of the United States for permanent retention and access. -

The outdoor recreation economy is an essential part of our country’s well-being. According to a 2018 report by the Bureau of Economic Analysis, the outdoor recreation economy accounts for 2.2% of the American economy and supports 4.6 million jobs. In Idaho alone, it is responsible for $7.8 billion in consumer spending and 78,000 jobs. Many of these jobs are in rural areas that rely on Idaho’s accessible outdoor infrastructure and healthy wildlife habitats. You said it best in your recent State of the State address—Idaho’s public lands and waters are surely one of the state’s greatest assets. We applaud your commitment to expanding access, improving visitor experiences and addressing threats to Idaho’s outdoor treasures. Ten of your fellow governors across the country—many of them in neighboring Western states— have made similar commitments to grow the outdoor recreation economy and attract outdoor businesses to their states by creating offices of outdoor recreation. We encourage you to do the same, and offer knowledge, experience and support from the entire outdoor recreation industry. -

PLAINTIFFS’ BRIEF IN SUPPORT OF MOTION FOR A TEMPORARY INJUNCTION INTRODUCTION The Wisconsin Supreme Court recently held that “there is no pandemic exception … to the fundamental liberties that the Constitution safeguards.” Wisconsin Legislature v. Palm, 2020 WI 42, ¶ 53, 391 Wis. 2d 497, 531, 942 N.W.2d 900, 917 (quoting U.S. Department of Justice, Statement of Interest, Temple Baptist Church v. City of Greenville, No. 4:20-cv-64-DMB-JMV (N.D. Miss. April 14, 2020), ECF No. 6). Concurring, Justice Rebecca Grassl Bradley wrote that “fear never overrides the Constitution.” Id. at ¶ 145 n.11. In this case, Governor Tony Evers has declared a second and now a third state of emergency based upon for the same underlying public health problem – the COVID 19 pandemic.1 If these orders are allowed to stand, the state of Wisconsin will have spent over 170 days and counting under a state of emergency allowing the 1 The Plaintiffs are filing an amended complaint contemporaneously with the filing of the motion for a temporary injunction. Box 83720 Boise, Idaho 83720 Dear Governor Otter: Thank you for the recommendations provided by Toni Hardesty the Director of the Idaho Department of Environmental Quality dated May 16, 2011, on air quality designations for the State of Idaho for the 2010 revision to the primary National Ambient Air Quality Standard for sulfur dioxide (SO2). Reducing levels of sulfur dioxide pollution is an important part of the U. S. Environmental Protection Agency's (EPA) commitment to a clean, healthy environment. Exposure to SO2 can cause a range of adverse health effects, including narrowing of the airways which can cause difficulty in breathing and increased asthma symptoms. This letter is to notify you of the EPA's preliminary intentions regarding your recommended designations. On June 3, 2010, the EPA strengthened the health-based or "primary" standard for SO2 by establishing a standard for 1-hour average SO2 concentrations at a level of 75 parts per billion. The Clean Air Act requires the EPA to complete the initial designations process within two years of promulgating a new or revised standard. If the Administrator has insufficient information to make these designations, the EPA has the authority to extend the designation process by up to one year. On July 27, 2012, the EPA announced that it had insufficient information to complete the designations for the 1-hour SO2 standard within two years and extended the designations deadline to June 3, 2013. -
