1.0 PREFACE

1.1 COMMITTEE MANDATE

The Sectoral Committee on Lands, Housing, Physical Planning and Urban Development is mandated to: - a) To investigate, inquire into, and report on all matters relating to the mandate, management, activities, administration, operations and estimates of the assigned departments; b) To study the programmes and policy objectives of departments and the Effectiveness of their implementation; c) To study and review all legislation referred to it; d) To study, assess and analyse the relative success of the departments measured by the results obtained as compared with their stated objectives; e) To investigate and inquire into all matters relating to the assigned departments as may be deemed necessary, and as may be referred to it by the County Assembly; f) To vet and report on all appointments where the Constitution or any law requires the County Assembly to approve, except those under Standing Order 188 (Committee on appointments); and g) To make reports and recommendations to the Assembly as often as possible, including recommendations of proposed legislation.

1.6 Message from His Excellency the Governor of

His Excellency the Governor for Homa Bay County forwarded to the Hon. Speaker of the County Assembly a message of nomination of Homa Bay Municipality Board members vide a letter ref. HB/CTY/CA4/4VOL.IV/ (129) dated 27th December, 2018 (Appendix 1).

1.7 Committal to the Committee During a plenary sitting held on 23rd April, 2019 through a communication No. 29 of 2019, the Hon. Speaker notified members of the nomination from His Excellency the Governor. Pursuant to Section 13 and 14 of the Urban Areas and Cities Act, No. 13 of 2011 and Standing Orders No. 42 (1) (2) (3) and (4), the following nominees for membership of Homa Bay Municipality Board were committed to the committee on Lands, Housing, Urban Development and Physical Planning:

The committee was directed to report to the House within 21 days from the date on which it first sits to consider the nomination in accordance with Section 9 (1) of Public Appointment (County Assemblies Approval) Act, 2017.

2.0 BACKGROUND

2.1 Notification to the Public Section 7 (5) of the Public Appointments (County Assemblies Approval) Act, 2017 provides that the committee shall by notice in at least one newspaper of national circulation; notify the public of the time and place for holding an approval hearing of at least seven days prior to the hearings.

Further, Section 7 (10) of the same Act provides that any person may, prior to the approval hearing, and by written statement on oath, provide to the Clerk with evidence contesting the suitability of a candidate to hold the office to which the candidate has been nominated.

Consequently, the Clerk placed an advertisement on the Standard Newspaper dated 27th April, 2019 (Appendix 2) informing members of the public and the nominees of the date of the hearing, and inviting the public to submit to the office of the Clerk a memorandum in writing in conformity with Section 7 (10) of the Public Appointment (County Assemblies Approval) Act, 2017. The submissions were to be received on or before Thursday 2nd May, 2019.

2.2 Submission of documents by the nominees

The Committee through the office of the Clerk wrote to the nominees requesting them to collect vetting forms under First Schedule of the Public Appointments (County Assemblies Approval) Act, 2017 from his office and submit them, duly filled to the same office on or before Thursday 2nd May, 2019.

Further, the nominees were requested to submit copies of the following documents on or before Thursday 2nd May, 2019 and bring the original documents on the approval hearing day:

i. ID/passport ii. Curriculum vitae, personal credentials and academic certificates iii. Current Tax Compliance Certificate from the Kenya Revenue Authority (KRA)

9 | Page iv. Current Compliance Certificate from the Higher Education Loans Board (HELB) v. Current Clearance Certificate from the Credit Reference bureau (CRB) vi. Current Police Clearance from the Directorate of Criminal Investigation (DCI) vii. Current Clearance from the Ethics and Anti-Corruption Commission (EACC)

2.3 Criteria for the Approval Hearing The committee was guided by Chapter Six and Article 195, 196 (1) and (2) of the Constitution of Kenya, Section 13 and 14 of the Urban Areas and Cities Act, No. 13 of 2011 and Sections 7, 8, 9 and 10 of the Public appointments (County Assemblies Approval) Act, 2017.

On composition of the Municipality Board, Section 13 as read together with Section 14 of the Urban Areas and Cities Act, No. 13 of 2011 gives the following guidelines; 1. A board of a city shall consist of not more than nine members, four shall be appointed and five elected in the prescribed manner. 2. Of the members referred to in sub- (1) at least five shall be nominated by: a. an association representing the private sector in the area; b. a cluster representing registered associations of the informal sector in the area; c. a cluster representing registered neighborhood associations in the area; and d. an association of urban areas and cities, and appointed by the County Executive Committee with the approval of the County Assembly 3. The Executive committee shall while appointing members of the board ensure gender equity, representation of persons with disability, young and marginalized groups.

Section 13 (4) of the Urban Areas and Cities Act No. 13 of 2011, requires a nominee: 10 | Page

i. to be a citizen of Kenya ii. to be an ordinary resident or has a permanent dwelling in the city iii. to carry on business in the city, or iv. to have lived in the city for at least five years.

Section 14 of the same Act states that the provisions of Section 13 shall apply with respect to the board of a municipality except that such board shall comprise nine members of whom four shall be appointed and five elected in the prescribed manner.

Section 7 (12) of the Public Appointments (County Assemblies) Act, 2017 provides that a candidate may, at any time, by notice in writing addressed to the Clerk, withdraw from the approval process and the candidates nomination shall thereupon lapse.

Further, Section 8 of the Public Appointments (County Assemblies Approval) Act, 2017 provides that the issues for consideration by the relevant house in relation to any nomination shall be; i. The procedure used to arrive at the nominee ii. By constitutional or statutory requirements relating to the office in question and iii. The suitability of the nominee for appointment proposed having regard to whether the nominee’s abilities, experience and qualities meet the needs of the field to which nomination is being made.

2.4 Criteria for Assessment The Assessment of the nominees was guided by Section 13 and 14 of the Urban Areas and Cities Act, No. 13 of 2011 and Section 7, 8, and 10 and

11 | Page the assessment form set out in the second schedule of the Public appointments (County assemblies) Approval Act, 2017.

The committee set the pass mark for assessment as follows: 1. Competitive selection - 60% 2. Professional Associations - 45% 3. Private Sector Associations - 45% 4. Informal Sector Associations - 45% 5. Neighborhood Associations - 45% 6. Urban Areas & Cities Associations - 45%

The Second Schedule to the Public appointments (County Assemblies Approval) Act, 2017 outlines as follows: i. A nominee with work experience in Public and Community Service was awarded a maximum of 25 marks ii. A nominee with education/training and good leadership skills was awarded a maximum of 25 marks. iii. A nominee who demonstrated interest and knowledge relating to the position was awarded a maximum of 15 marks iv. A nominee who demonstrated good communication skills both written and oral was awarded a maximum of 10 marks. v. A nominee who satisfied the requirements from neatness of resume/application, appearance was awarded a maximum of 10 marks. vi. A nominee who demonstrated good skills in decision making and problem solving was awarded a maximum of 15 marks.

2.5 Integrity On the assessment of the nominees on matters of integrity, the committee was guided by Article 73 (2) of the Constitution of Kenya as read together with the Public Officer Ethics Act No. 4 of 2003 which provides the following guiding principles of leadership and integrity;

a) Selection on the basis of personal integrity, competence and suitability, or election in free, fair elections b) Objectivity and impartiality in decision making, and in ensuring that decisions are not influenced by nepotism, favoritism, other improper motive or corrupt practices. c) Selfless, service based solely on the public interest, demonstrated by; i. Honesty in the execution of public duties; and ii. the declaration of any personal interest that may conflict with public duties; d) Accountability to the public for decisions and actions; and e) Discipline and commitment in service to the people

3.0 VETTING OF THE NOMINEES

3.1 Legal Guidelines on the Nomination, Vetting and Approval of City/Municipality Board Member Nominees

 Article 80 (c) of the Constitution of Kenya 2012 as read together with 7 of the Public Officers Ethics Act which provides for the general code of conduct and ethics of public officers.  Section 13 as read together with 14 of the Urban Areas and Cities Act No. 13 of 2011. It provides for the membership of the board of municipality and the criteria to be met to qualify for that membership.  Section 20 of the Urban Areas and Cities Act No. 13 of 2011 which outlines the functions of the City/Municipality Board members.  Section 21 of the Urban Areas and Cities Act No. 13 of 2011 which outlines the powers of the City/Municipality Board members.  Section 8(1)(a) of the County Governments Act,2012 which outlines the roles of the County Assembly one of them being to vet and approve nominees for appointment to public offices.  Section 7 of Public Appointments (County Assemblies Approval) Act, 2017 outlines the procedure to be followed in conducting approval hearing/vetting of the nominees.  Section 8 of the Public Appointments (County Assemblies Approval) Act, 2017 provides for the issues of considerations for vetting of nominees.  Section 9 of Public Appointments (County Assemblies Approval) Act, 2017 provides for consideration and reporting of the outcome of vetting of the nominees.  Section 10 of the Public Appointments (County Assemblies Approval) Act, 2017 provides for how to handle the rejection of the nominees.  Section 11 of the Public Appointments (County Assemblies Approval) Act, 2017 outlines on the procedure of the County Assembly.  Section 12 of the Public Appointments (County Assemblies Approval) Act, 2017 outlines the powers of the committee undertaking vetting of the nominees.  The First Schedule of the Public Appointments (County Assemblies Approval) Act, 2017 provides for the schedule to be used outlining the criteria for vetting or approval of nominees for appointment to Public Office by County Assemblies by use of a Questionnaire.

 The Second Schedule of the Public Appointments (County Assemblies Approval) Act, 2017 provides for the Assessment Form to be filled independently by each panel member during the vetting of the nominees 3.2 Functions of the Municipality/City Board Member outlined in Section 20 (1) and (2) of the Urban Areas and Cities Act no. 13 of 2011 (1) Subject to the provisions of this Act a board of a city or municipality

Shall—

(a) oversee the affairs of the city or municipality;

(b) develop and adopt policies, plans, strategies and programmes, and

may set targets for delivery of services;

(c) formulate and implement an integrated development plan;

(d) control land use, land sub-division, land development and zoning by

public and private sectors for any purpose, including industry,

commerce, markets, shopping and other employment centres, residential areas, recreational areas, parks, entertainment, passenger transport, agriculture, and freight and transit stations

within the framework of the spatial and master plans for the city or

municipality as may be delegated by the county government;

(e) as may be delegated by the county government, promote and

undertake infrastructural development and services within the city or municipality;

(f) develop and manage schemes, including site development in collaboration with the relevant national and county agencies;

(g) maintain a comprehensive database and information system of the

administration and provide public access thereto upon payment of a nominal fee to be determined by the board;

(h) administer and regulate its internal affairs;

(i) implement applicable national and county legislation; 15 | Page

(j) enter into such contracts, partnerships or joint ventures as it may consider necessary for the discharge of its functions under this Act or other written law;

(k) monitor and, where appropriate, regulate city and municipal services

where those services are provided by service providers other than the board of the city or municipality;

(l) prepare and submit its annual budget estimates to the relevant

County Treasury for consideration and submission to the County

Assembly for approval as part of the annual County Appropriation

Bill;

(m) as may be delegated by the county government, collect rates, taxes levies, duties, fees and surcharges on fees;

(n) settle and implement tariff, rates and tax and debt collection policies as delegated by the county government;

(o) monitor the impact and effectiveness of any services, policies, programmes or plans;

(p) establish, implement and monitor performance management systems;

(q) promote a safe and healthy environment;

(r) facilitate and regulate public transport; and

(s) perform such other functions as may be delegated to it by the county government or as may be provided for by any written law.

(2) The functions performed by the board of a city or municipality under this Act shall, in the case of a town, be performed by a committee appointed by the county governor and approved by the county assembly

3.3 Requirements for Appointment as Municipality/City Board Member as outlined in Section 13 (4) of the Urban Areas and Cities Act no. 13 of 2011

i. to be a citizen of Kenya ii. to be an ordinary resident or has a permanent dwelling in the city iii. to carry on business in the city, or iv. to have lived in the city for at least five years.

In conducting the vetting process, the Committee examined the nominees against the following criteria, amongst others, as set out in the First Schedule of the Public Appointments (County Assemblies Approval) Act, 2017,: -

3.4. The Approval Hearings The committee held approval hearing of the nominees on Friday 3rd May, 2019. The hearing was held at the County Assembly Chambers and was open to the public in line with the provisions of Article 196 (1) (a) and (b) of the Constitution of Kenya. The public had been invited to participate in the hearing vide a notification placed by the Assembly in the Standard Newspaper of 27th April, 2019 pursuant to Section 7 (6) and 7 (7) of the Public Appointments (County Assemblies Approval) Act, 2017. Out of nine (9) nominees, one (1) did not turn up for the interview by the name, Mr. Peter Omondi Ogweno on account that he was not aware of the ongoing vetting process. 5.0 COMMITTEE’S GENERAL OBSERVATIONS

The Committee after ventilating through the presentations of the nominees observed the following:

1. That all the nominees were Kenyan citizens and residents of Homa Bay Municipality as required by Section 13 as read together with Section 14 of the Urban Areas and Cities Act No. 13 of 2011. 2. That the nominees have lived within Homa Bay Municipality for at least five years. 3. That all the nominees met the pass mark as set by the committee 4. That the nominees abilities, experience and qualifications meet the requirements of serving in the Municipality Board as member. 5. That the nomination took into account the provisions of Article 27 (6) which provides that the state shall take legislative and other measure to implement the principle that not more than two-thirds of the members of elective or appointive boards shall be of the same gender.

It is important to note that Mr. Paul Omondi Ogweno neither collected the vetting questionnaires nor appear for vetting/interview. This is true despite the fact that he was expected to be among the nine nominees.
