Whole Waste Disposal Procurement Specification Final version 3 22 Sept 08 SB PART A: INTRODUCTION/GENERAL INFORMATION
Part D of the Contract Specification provides a full outline of information that must be provided by Tenderers within their tender proposal if they wish to be considered for this contract.
1. INTRODUCTION
1.1 This contract will be for the supply of whole waste disposal - healthcare waste (including infectious clinical waste/hazardous waste/ offensive/hygiene waste/dangerous for carriage), domestic hazardous and other waste disposal including confidential waste services to 4 Cornish NHS organisations known as Royal Cornwall Hospitals NHS Trust, Cornwall and Isles of Scilly Primary Care NHS Trust, Cornwall Partnership NHS Trust and Cornwall Hospice Care plus any commissioned services, as applicable
1.2 It should be noted that whilst this specification is for a Whole Waste Disposal contract the final outcome will be based on set weighting criteria and if the best solutions for the Cornish Trusts is a number of contracts for different waste streams with a 5 or 8 years duration then that will be evaluated and compared with other tenders
1.3 The contract will encompass the segregation, recycling, collection, treatment and final disposal of whole waste disposal - healthcare waste (including infectious clinical waste/hazardous waste/ offensive/hygiene waste/dangerous for carriage), domestic hazardous and other waste disposal services The successful contractor/s will provide contract monitoring information to the Trust elected representative, this will include all waste disposal routes from collection to final disposal, where applicable.
1.4 The contract specification alongside the NHS Terms and Conditions of Contract for Services and Supplementary Terms and Conditions of Contract outlines the service, parameters and requirements of the above named organisations Trusts required from the nominated Contractor(s) during the course of this contract.
1.5 This contract specification details the activities to be carried out throughout the duration of the contract. The overriding principal must be adherence to the intent of the specification to undertake the services, meeting with the satisfaction of each of the trusts authorised officers.

1.6 The contract specification is split in to five specific sections, these are as follows: a) Introduction/General Information (Part A) b) Technical Requirements of the Contract (Part B) c) Trust Service Schedule/Waste Data (Part C) d) Evidence/Supporting Information Required from Tenderers (Part D) e) Contract Award Criteria/Weighting (Part E)
1.7 If Tenderers cannot perform any of the services or requirements outlined within the contract specification or NHS Terms and Conditions of Contract for the Supply of Services and/or the Supplementary Terms and Conditions of Contract, they must notify the trust in writing via their tender proposal.
1.8 This specification must be read in conjunction with Offer Schedule, for the supply of all labour, waste containers (e.g. wheelie/static bins), materials, transport and associated facilities to provide, for the collection, transportation and re-cycling/disposal of all Healthcare / Hazardous Healthcare / Domestic, General, Hazardous (Non Healthcare) and other waste streams for the Cornwall Healthcare Community.
1.9 The tender will be costed on the basis of a decant bin or a bin exchange arrangement according to the type of waste and collection schedule listed in Part C of this specification.
1.10 Tenderers must complete Offer Schedule in the format provided. Within Part C of the contract specification, are subject to change/alteration during the duration of the contract. The Tenderers who do not complete the Offer Schedule in the format provided will not be considered for the contract.
1.11 Where deemed necessary by any of the participating trusts, the Contractor(s) will be obliged to carry out Criminal Records Bureau (CRB) checks on their operatives who are employed within the contract provision and by any sub- contractors.
1.12 All Tenderers can by arrangement and schedule, visit of all Cornwall Healthcare Community sites applicable to this contract, during the tendering process.
1.13 Locations/collection frequencies and other details specified by Cornwall Healthcare Community are provided within part C of the contract

specification, are subject to change/alteration during the duration of the contract. Cornwall Healthcare Community reserves the right to add or deduct sites as appropriate. It should be noted that significant development will take place on the Royal Cornwall Hospitals (Treliske) site
1.14 It is expected that adherence to the principles of Reduce, Reuse, Recycle will be explored and implemented as far as is practical during the term of the contract and that significant shifts in waste volume could occur.
2. PARTICIPATING TRUSTS
2.1 The trusts who will be participating within this contract are as follows:
2.1.1 Trust A – Royal Cornwall Hospitals NHS Trust – acute healthcare provider
2.1.2 Trust B – Cornwall and Isles of Scilly Primary Care NHS Trust 2.1.3 Trust C – Cornwall Partnership NHS Trust – mental health and learning disability trust
2.1.4 Trust D – Cornwall Hospice NHS Care Trust – hospice care 2.1.5 All Tenderers are notified that the consortium of these 4 Trusts has no legal identity. All contracts established for the delivery of waste services outlined within this specification will be formed between Contractor/s and the individual organisations as outlined in 2.1 or other commissioned NHS service providers as appropriate.
3. AIMS AND OBJECTIVES OF THE CONTRACT
3.1 The main aim of this specification is to identify all waste streams generated within the Cornwall Healthcare Community with a view to establishing contract/s that can effectively control the expenditure, ensure legal compliance and provide comprehensive data on all waste streams across all sites which will assist in identifying new disposal options as the contract/s develop.
3.2 Healthcare Waste
3.3 Healthcare Waste (includes infectious clinical waste; hazardous waste; offensive/hygiene waste and wastes that are dangerous for carriage). This document uses the unified definitions as set out in the Department of Health

“Health Technical Memorandum 07-01: Safe management of healthcare waste” and terms used herein are as per that document.
3.4 The contract is for the provision of a healthcare waste collection (as identified) and disposal service across the Cornwall Healthcare Community.
3.5 Hazardous (non healthcare) Waste
3.6 Healthcare Waste (includes; but is not exhaustive; batteries, aerosols, solvents, acids, alkalines, photochemicals, pesticides, florescent tubes and bulbs, oils, paints, detergents, wood containing dangerous substances, fridges/freezers etc). .
3.7 The contract is for the provision of a hazardous (non healthcare) waste collection and disposal service for Cornwall Healthcare Community.
3.8 Some of these services will require a liquid waste collection and disposal
3.9 Standard Domestic and General Waste:
3.10 The contract is for the provision of a Domestic and General waste collection and disposal service for the Cornwall Healthcare Community and includes the recycling of domestic waste where possible
3.11 It should be noted that .all waste (with the exception of clinical waste) generated at a hospital site, inpatient unit or teaching facility is classified as municipal waste under the Environmental Protection Act and therefore Cornwall County Council will be responsible for the disposal of this waste. Systems should be in place for this waste to be reused/recycled where possible in the most cost effective manner.
3.12 Standard Miscellaneous Waste:
3.13 The contract is for the provision of miscellaneous waste collection and disposal services for Cornwall Healthcare Community. This includes items such as catering waste, confidential waste (paper, CD’s, tapes, DVD, video tapes etc), garden waste, scrap metal, sewerage cleaning, septic tank sludge) it is not exhaustive and some of these services may be a liquid collection.
3.14 Option for Whole Waste Disposal Contract:
3.15 There is an option in this contract for the provision of a Whole Waste Disposal service for Cornwall Healthcare Community. The Contractor(s) will manage the disposal (and collection where applicable) of all waste streams

highlighted within the contract specification on behalf of Cornwall Healthcare Community.
3.16 It is the intention of Cornwall Healthcare Community to work in partnership with the Contractor(s) to develop and demonstrate the following valued adding services during the contract life:
3.16.1 The Introduction of a formal, effective audit and monitoring system for healthcare waste across Cornwall Healthcare Community;
3.16.2 Systems for the effective segregation of waste; 3.16.3 Introducing sustainable systems to minimise waste, meet carbon reduction targets and embrace new technology as appropriate; 3.16.4 Deliver sustainable recycling/reuse opportunities; 3.16.5 Develop effective Key Performance Indicators
4. CONTRACT PERIOD
4.1 The contract period will be initially for 5 or 8 years commencing 1 April 2009 until 31 March 2014 or 31 March 2017
4.2 Cornwall Healthcare Community holds an option to extend the contract for a further 2 years commencing 31 March 2014 or 2017
5. REFERENCES
5.1 Tenderers are required to provide the names, address and contact details of all contracts currently in place, preferably with NHS links. Where possible this should be contracts within a close proximity of the South West of England and the Cornwall Healthcare Community. These contracts should provide comparable services required under this specification
5.2 Tenderers should provide details of the approximate value of the reference contracts and the level of services provided to these customers.

PART B: TECHNICAL REQUIREMENTS OF THE CONTRACT
NOTE: Where a section heading is marked with a *, Tenderers are required to provide either a written statement/outline or further information/evidence within their tender proposal document. Part D of the Contract Specification provides a full outline of information that must be provided by Tenderers within their tender proposal if they wish to be considered for this contract.
9. LEGISLATION, REGULATION AND GUIDANCE
9.1 Tenderers must provide full details of any convictions or prosecutions brought against the company for the failure to comply with waste legislation and regulations during the past three years within their tender proposal.
9.2 The Contractor(s) will be required to comply with all current and future legislation, regulations and guidelines during the term of the contract. Cornwall Healthcare Community recognises that legislative and regulative compliance from Contractor(s) does not absolve Cornwall Healthcare Community from their own specific responsibility to comply with legislation and regulations. The Cornwall Healthcare Community will require the appointed Contractor(s) to ensure that it notifies and advises the participating trusts to all relevant current/future legislation, regulation and guidelines in order to ensure that the participating trusts meets their individual Duty of Care as stipulated in the Environmental Protection Act 1990, as amended.
9.3 Attached for information is Appendix A, which is a list of legislation and guidelines that are applicable to this contract. This list is not exhaustive and will be regularly reviewed and updated inline with new legislation, regulation and guidelines during the term of the contract to ensure the participating trusts meets their individual duty of care.
9.4 Tenderers must provide a written statement of conformity within their tender proposal on how they comply with current waste regulations/guidance.
9.5 Attached as Appendix B, is a list of regulations and best practice guidance that will be introduced and/or revised during the term of the contract. Tenderers are requested to provide a written statement within their tender

proposal on how these changes may affect their ability to operate the contract or if there will be an impact on costs provided within their tender submission in future1:
9.6 The Contractor(s) will be required prepare and present proposals to Cornwall Healthcare Community to encompass new legislation, regulation and best practice as and when enacted.
9.7 If any statutory requirements or regulations are found to be contravened by the Contractor(s) or any sub-contractor working on his behalf, Cornwall Healthcare Community will reserve the right to terminate the contract in accordance with NHS Conditions of Contract for the Supply of Services for any material breach.
9.8 Tenderers must provide details of any trade bodies/associations they are accredited to or members of (Sanitary Medical Disposal Services Association, Chartered Institute of Waste Management, Environmental Services Association etc).
10. LICENCES
10.1 The Tenderers must submit to the Cornwall Healthcare Community copies of all certificates and licences, as relevant to the contract tendered for, in particular:
10.1.1 Waste Carrier Registration Certificate(s)
10.1.2 Waste Broker Registration Certificate 10.1.3 Mobile Plant Licence(s) 10.1.4 Exemption(s) from waste management licensing 10.1.5 Local Authority Authorisation(s)
10.1.6 Transfer Station Licence(s)
10.1.7 Waste Management Licence(s) and/or Environmental Permitting
10.1.8 Integrated Pollution Prevention and Control (IPPC) Permits & Pollution Prevention and Control (PPC) Permit(s)
10.2 Tenderers must provide full details of the primary treatment site(s) (including location, capacity, permits etc) that are proposed to service Cornwall Healthcare Community contract.

10.3 Tenderers must provide details of the local Environment Agency office that issued the licence(s) for all primary treatment sites proposed to service Cornwall Healthcare Community contract.
10.4 Full details of all backup treatment/disposal sites or facilities to be used by the Tenderer in the event of a primary site being unavailable and a written agreement to this effect.
10.5 Details (copies of) any other licences the Tenderer believes are relevant to the contract.
10.6 The Contractor(s) shall ensure that waste must be treated by methodologies that are authorised by the Environment Agency and/or local authority. Treatment processes operating without appropriate authorisation must not be used.
10.7 The Contractor(s) shall immediately advise Cornwall Healthcare Community of any suspension, withdrawal or refusal to renew any licence, certificate or permissions applicable to carrying out the requirements of this contract during the term of the contract.
10.8 The Contractor(s) will be responsible for all costs associated with finding an alternative Contractor(s)/treatment facility if there is a failure on their part to undertake the services outlined within the specification at any time during the contract period.
10.9 Cornwall Healthcare Community will require sight of the original licences and other relevant documents on a regular basis and will reserve the right to inspect any transit station and disposal facilities at any reasonable time, as implied under the Code of Practice ‘Waste Management the Duty of Care’.
10.10 Tenderers are advised that Cornwall Healthcare Community will not award any part of the contract to a Contractor(s) or Sub-Contractor(s) who are unable to provide formal evidence of any of the required licences necessary to operate this contract within their tender proposal.
11. DUTY OF CARE
11.1 To ensure that the individual trusts Duty of Care in respect of waste is adequately discharged Tenderers are required to:
11.1.1 Visit the sites, prior to tendering in order to establish the suitability of their proposed arrangements for the removal of waste.

11.1.2 Provide comprehensive written documentation relating to all aspects of the contract. 11.1.3 Provide a fully detailed audit trail relating to the collection of all waste streams - including appropriate method statements where significant risk is identified. 11.1.4 Provide details of weighbridge facilities and waste tracking processes. 11.1.5 Produce a complete procedure, which covers all the requirements of the Environmental Protection Act 1990, as amended, the Environmental Protection (Duty of Care) Regulations 1991, as amended, including Code of Practice on Duty of Care, COSHH and the requirements of the Health and Safety at Work Act. This must include formal Risk Assessment documentation and Method statement/procedures.
11.2 Tenderers are requested to provide a ‘Duty of Care’ report for any organisation that they propose to use during the execution of this contract either frequently or on a contingency basis. Reports provided must be no older than 12 months old.
11.3 Adherence to Duty of Care principles will be a continuing process throughout the duration of the contract. Tenderers are required to amend this procedure and their reporting requirements in line with any regulatory or statutory guidance changes as applicable thorough the life of the contract.
12. WASTE CATEGORIES
12.1 The separate waste streams the Contractor(s) will be required to manage under this contract are specified in sections 13 to 17 (and listed in the EWC list shown in Appendix C) of this specification. This list is not exhaustive and may be subject to change throughout the life of the contract.
12.2 Any changes and potential cost implications will be negotiated between the Contractor(s) and Cornwall Healthcare Community.
12.3 Tenderers are required to provide pricing for each of the separate groups of waste, which are included within the contract specification. All costs and prices must be included within the Offer Schedule attached with this contract specification.
12.4 Tenderers must inform Cornwall Healthcare Community of their intention to sub-contract or the utilisation of a third party to service or manage any of the waste streams included within this contract on their behalf, within their tender

proposal. Annual audit will be undertaken on contract arrangements with the third party.
12.5 If Tenderers who do not intend to manage individual waste streams covered within the contract specification either by their company or via sub- contracted/third party arrangements, then this should be clearly stated in writing via their tender proposal.
13. HEALTHCARE WASTE
The Definition of Healthcare waste is set out in the Health Technical Memorandum 07-01. As stated in Clause 10.4 Tenderers must provide a written statement of conformity within their tender proposal on how they comply with current waste regulations/guidance and the Health Technical Memorandum 07-01: Safe Management of Healthcare Waste.
13.1 Infectious Waste
13.2 Infectious waste is essentially waste that poses a known or potential risk of infection, regardless of the level of infection posed. Even minor infections are included within the definition of infections.
13.3 Healthcare waste generated from healthcare practices, or produced by healthcare workers in the community is considered to be infectious waste unless assessment has taken place. This assessment is based on item- and patient- specific clinical assessment by a healthcare practitioner.
13.4 Municipal waste from domestic minor first-aid and self-care – of a type that does not involve recourse to a health care practitioner – is assumed to be non –infectious unless a health care practitioner indicates otherwise. Therefore soiled waste such as nappies, sanitary products and plasters are not considered to be infectious unless a healthcare practitioner gives the producer advice to the contrary.
13.5 Similarly, municipal type waste from industrial and commercial premises is assumed to be non-infectious providing that a risk assessment has been conducted. Therefore, soiled waste such as sanitary products and plasters are not considered to be infectious unless a healthcare practitioner gives specific advice to the contrary.
13.6 Waste contaminated with non-infectious bodily fluids is capable of causing offence and therefore requires appropriate packaging to alert those in the

waste management chain of the contents. This document identifies such waste as offensive/hygiene waste.
13.7 Waste within 4 Cornish Trusts that fall into these categories is colour coded accordingly and in line with disposal options as shown in figure 1

Infectious waste (yellow bag or bin)
Minimum treatment/disposal is incineration in a licensed or permitted facility. Suitable
for lab cultures, body tissue, blood products or Category A infection waste.
Infectious waste (orange bag or bin)
Minimum treatment/disposal required is to be ‘rendered safe’ in a suitably licensed or
permitted facility. Suitable for dressings and any other infectious clinical waste.
13.8 Medicinal waste
13.9 Medicinal waste includes expired, unused, spilt, and contaminated pharmaceutical products, drugs, vaccines, and sera that are no longer required and need to be disposed of appropriately.
13.10 The category also includes discarded items contaminated from use in the handling of pharmaceuticals, such as bottles or boxes with residues, gloves, masks, connecting tubing, syringe bodies and drug vials.
13.11 Memorandum 07-01 divides medicines into three broad groups:
13.11.1 Cytotoxic and cytostatic;
13.11.2 Pharmaceutically active, but not cytotoxic and cytostatic;
13.11.3 Not pharmaceutically active and possessing no hazardous properties (examples include saline and glucose).
13.12 Medicinal waste is listed in both Chapter 18 and Chapter 20 of the EWC. The term “cytotoxic and cytostatic” relates to the classification of waste medicines in the EWC
13.13 Only cytotoxic and cytostatic medicines are classified as a hazardous waste, although other medicines often possess hazardous properties and therefore require appropriate treatment and disposal.

13.14 A cytotoxic and cytostatic medicine is a medicinal product possessing any one or more of the hazardous properties:
13.14.1 H6: Toxic;
13.14.2 H7: Carcinogenic; 13.14.3 H10: Toxic for reproduction; 13.14.4 H11: Mutagenic.
13.15 Medicines other than cytotoxic and cytostatic medicines may have hazardous properties that should be identified to subsequent holders for the purposes of duty-of-care and for transport.
13.16 To establish whether a medicinal product has the above-mentioned hazardous characteristics, pharmacists should refer to the products material safety data sheets (MSDS; sometimes referred to as “COSHH sheets”).
13.17 In England, Wales and Northern Ireland, the Hazardous Waste Regulations place prohibitions on producers mixing waste types. The mixing of a cytotoxic and cytostatic medicine with any other medicine, including other cytotoxic and cytostatic medicines, is prohibited where: they are chemically incompatible; or the necessary treatment/disposal of the waste is affected.
13.18 Waste within 4 Cornish Trusts that fall into these categories is colour coded accordingly and in line with disposal options as shown in figure 2

Minimum treatment/disposal is incineration in a licensed or permitted facility. Suitable for waste contaminated with Cytotoxic/cytostatic medicines
13.19 Offensive/Hygiene Waste

13.20 The term offensive/hygiene waste describes waste which is non-infectious and which does not require specialist treatment or disposal, but which may cause offence to those coming into contact with it.
13.21 Offensive/hygiene waste includes waste previously described as human hygiene waste and “sanpro” waste, and does not need to be classified for transport.
13.22 Examples of offensive/hygiene waste include:
13.22.1 Incontinence and other waste produced from 13.22.2 Human hygiene; 13.22.3 Sanitary waste; 13.22.4 Nappies; 13.22.5 Medical/veterinary items and equipment which do not pose a risk of infection, including gowns, 13.22.6 Plaster casts etc; 13.22.7 Animal faeces and soiled animal bedding 13.22.8 Syringes used for administering food products
13.23 For the purpose of identification under HTM 07-01 the following colour coding is used (shown in figure 3)

Offensive/Hygiene waste (yellow bag with black stripe) Minimum treatment/disposal required is landfill in a suitably licensed or permitted site. This waste should not be compacted. Suitable for any non-infectious incontinence products, nappies, sanpro or uncontaminated plaster casts gloves etc
13.24 Dental amalgam waste
13.25 The term Dental Amalgam Waste is waste amalgam that contains mercury
13.26 It is generated as part of dental procedures and can be unused amalgam or contaminated with bodily fluids
13.27 For the purpose of identification under HTM 07-01 the following colour coding is used (see Figure 4)

It is possible for the mercury element of dental amalgam to be recycled through an authorised facility.
14. HAZARDOUS HEALTHCARE WASTE
14.1 Hazardous Health Care waste included within this contract is that defined by current and any future legislation
14.2 Specific categories of Hazardous Health Care Waste included within this contract include the following and are referenced in the preceding section 13:
• Healthcare waste contaminated with radioactive material
• Infectious waste contaminated with cytotoxic and/or cytostatic medicinal products
• Sharps contaminated with cytotoxic and cytostatic medicinal products
• Infectious and other waste requiring incineration including anatomical waste, diagnostic specimens, reagent of test vials and kits containing chemicals
• Amalgam waste from dental healthcare
14.3 Subject to revised legislation and regulations, these categories are subject to alteration during the course of the contract
15. HAZARDOUS NON HEALTHCARE WASTE

16.1 Where appropriate, waste is segregated from other waste streams and subject to separate containment and labelling.
16.2 This consists of Domestic and General Waste and should not be contaminated therefore does not require incineration.

18. CONTAINER POLICY
18.1 The colour coding adopted by Cornwall Healthcare Community for containers, is that recommended by Health Technical Memorandum 07-01: Safe Management of healthcare waste and is outlined in Section 7 of that document.
18.2 Existing containers should be replaced as stocks become worn / depleted by new colour coded waste receptacles in line with the colour coding set out in Memorandum 07-01
18.3 All hazardous healthcare waste bags / containers are labelled for identification purposes and ideally should be stored in a uniquely identifiable (bar-coded) container for audit purposes and to reduce any risks associated with its handling.
19. STORAGE OF HEALTHCARE WASTE
19.1 The Contractor(s) is required to provide clean, individually numbered (where appropriate), lockable and wheeled (where appropriate) containers at all times for all areas. The purpose is to store bagged healthcare wastes and sharps containers prior to transportation
19.2 These container specifications must be submitted for approval by the Trust’s Fire Officers
19.3 The containers, subject to the approval of the trust’s authorised officer(s), shall minimise the handling of waste and be compatible with both the trusts and the Contractor’s transportation systems. Tenderers shall fully describe, at the time of tendering, the type, size and estimated number of containers to be provided on site/s to store waste awaiting collection. Included in this should be the availability of wheelie bins with foot-operated pedals to reduce loading difficulties where risk assessment identifies the need. The additional costs associated with this provision must be included in Offer Schedule (additional costs).
19.4 Containers that become unsuitable for continued use through wear, loss or any other reasonable reason shall be withdrawn immediately from service and replaced as necessary at the Contractor’s expense.

19.5 The containers will remain the property of and be maintained by the Contractor(s) throughout the contract. The containers must be promptly removed from the hospital site on the expiry or termination of the contract.
19.6 The Contractor(s) shall ensure that there are an agreed number of containers available at all times, to meet the requirements of the collection of Healthcare waste across Cornwall Healthcare Community during the length of the contract.
19.7 The Contractor(s) will be required to provide containment in excess of normal requirements to accommodate emergency overflow of Healthcare waste. Documented evidence must be provided of contingency plans in the event of major plant or transport failure.
19.8 All containers used for healthcare waste collection should be colour coded and labelled as per Section 7 of the Health Technical Memorandum 07-01 Safe Management of Healthcare Waste and meet all requirements of current legislation (i.e. UN Guidance and Markings).
19.9 The Contractor(s) shall be responsible for the internal and external cleaning of the containers, with an agreed cleaning schedule established with the Cornwall Healthcare Community prior to the contract commencing that is approved by the Infection control teams.
19.10 Each Tenderer must identify how containers would be cleansed and disinfected before being returned visibly clean and dry to the various collection points for re-use. Tenderers shall include full details of the proposed method of cleansing, which shall comply with the Environment Agency requirements.
19.11 The container shall have no rough or inaccessible surfaces, to ensure total internal and external cleansing. The container should withstand frequent cleansing without deterioration in quality and not be liable to corrosion.
19.12 Tenderers should describe how their cleaning process would minimise cross infection. Tenderers must take into account the relevant Health and Safety Executive and Environment Agency regulatory standards.
19.13 Each container must be uniquely identified by a number / code, as part of the Contractor(s) recording system. This should be detailed in the Tenderer’s tender submission.

19.14 The Contractor(s) is to provide the agreed number of hooks, towing bars etc where applicable to enable the containers to be towed. The Contractor(s) is also required to provide replacements as required throughout the contract, due to normal wear and tear. The cost is to be included in the contract price, with price details provided in Offer Schedule (Additional Costs).
19.15 The Contractor(s) is to provide the agreed number of container keys, to the trusts/consortiums (delete non applicable) authorised officers and all replacement keys required for the duration of the contract. The cost of issuing an initial set of keys at the commencement of the contract is to be included in the contract price, with price details provided in Offer Schedule (Additional Costs).
19.16 The Contractor(s) is to provide replacement keys as and when required by Cornwall Healthcare Community authorised officers upon request. The Contractor(s) may levy a charge for replacement key(s) (unless otherwise stated in their tender proposal). Costs for replacement keys must be included in Offer Schedule (Additional Costs).
20. STORAGE OF HAZARDOUS HEALTHCARE WASTE
20.1 The Contractor(s) is to provide a collection and disposal service for UN type approved rigid containers containing discarded sharps, chemicals, pharmaceuticals, medicines and radio-isotopes from Cornwall Healthcare Community sites colour coded as indicated in Section 7 of Health Technical Memorandum 07-01: Safe Management of Healthcare waste.
20.2 Hazardous healthcare waste will be collected from Cornwall Healthcare Community sites in appropriate containers in either 60 Litre one-way burn bins or reusable wheelie bins, Tenderers are requested to provide details within their tender submission of containers they believe would best suit the needs of Cornwall Healthcare Community and should include a method of safely keeping the wheelie bin open while being loaded (refer to section 20.3). Cornwall Healthcare Community reserves the right to accept or reject any proposals provided by Tenderers.
20.3 The Contractor(s) will be required to strictly adhere to all documentation in relation to the safe and correct disposal of Hazardous Healthcare waste.
20.4 All Tenderers must provide a comprehensive breakdown of costs associated with the disposal of Hazardous Healthcare waste (i.e. cost of bins,

transportation, hazardous waste consignment note, disposal etc) within Document 5 – Offer Schedule but provide a simplified billing proposal.
21. STORAGE OF HAZARDOUS (NON HEALTHCARE) WASTE
21.1 The Contractor(s) will be required to provide appropriate containers for the safe storage of these waste streams.
21.2 The Contractor(s) will be required to strictly adhere to all documentation in relation to the safe and correct disposal of Hazardous waste.
21.3 All Tenderers must provide a comprehensive breakdown of costs associated with the disposal of Hazardous waste (i.e. transportation, hazardous waste consignment notes, disposal etc) within Offer Schedule but provide a proposal for a simplified billing proposal.
22. STORAGE OF DOMESTIC AND GENERAL WASTE
22.1 The Contractor(s) will be required to provide appropriate containers for the safe storage of Domestic and General Waste.
22.2 The containers, subject to the approval of the trust’s authorised officer(s), shall minimise the handling of waste and be compatible with both the trusts and the Contractor’s transportation systems. Tenderers shall fully describe, at the time of tendering, the type, size and estimated number of containers to be provided on site(s) to store waste awaiting collection.

23.3 The containers, subject to the approval of the trust’s authorised officer(s), shall minimise the handling of waste and be compatible with both the trusts and the Contractor’s transportation systems. 23.6 The Contractor(s) shall ensure that there are the agreed number of containers at all times, to meet the requirements of the collection of Miscellaneous waste across the Cornwall Healthcare Community during the length of the contract.
24. SERVICE SCHEDULE
24.1 The service schedule requirements of Cornwall Healthcare Community are listed in Part C of the contract specification.
24.2 Tenderers are advised that Cornwall Healthcare Community seek a decant bin service or a bin exchange service dependant on the type and volume of waste produced

24.3 Details of existing waste holding/storage equipment either owned or leased by Cornwall Healthcare Community are listed in Part C of the contract specification.
24.4 Cornwall Healthcare Community encourages Tenderers to provide any suggestions to improve the service schedules or the use of alternative waste holding/storage equipment. Proposals should be outlined in writing within the tender proposal and any associated costs should be included in Offer Schedule (Additional Costs).
25. SERVICE VARIATION
25.1 Variations in service requirements will be notified to the Contractor(s) as and when required but will be limited to notification by the contract lead for the Trusts
25.2 The period of notice for variations will be subject to individual service criteria.
25.3 A mechanism for agreeing variations will be agreed between Cornwall Healthcare Community and the Contractor(s) prior to the contract award. Tenderers are required to provide a proposed mechanism for agreeing variations as part of their submission for the trusts to consider.
26. COLLECTION POINTS
26.1 Full details of all sites, collection points and current arrangements for each organisation are shown in Schedule C. Each trust is abbreviated as follows:

26.3 The clearance of sites must be cleared as per the agreed schedule on each collection.
27. COLLECTION TIMES
27.1 Waste collections at each site must be agreed in advance however, due the size and activity levels on the Royal Cornwall Hospitals – RCH site this will

need to between 7.00 – 9.00 hours or17.30 and 19.00 hours unless agreed otherwise with the authorised officers for the site
27.2 Due to the location of waste storage areas at St Austell Hospital, waste collections must be undertaken prior to 9.00 and Newquay Hospital access must be gained from the rear access road.
27.3 All other sites should be cleared between 9.00 – 17.00 to ensure paperwork is duly signed
27.4 Waste collections where identified will include collections over 7 day per week
27.5 It is the individual Trusts responsibility to ensure access to site(s) is maintained in accordance with the agreed service schedule.
27.6 Each of the identified Collection Point(s) shown in Schedule C must be cleared on each collection.
27.7 The Contractor(s) will be required to nominate a competent person(s) who can be contacted in the event of an emergency. An out of hour’s phone number will be required.
27.8 The trusts will supply the Contractor(s) with similar out of hours contact names for each of the sites included within the contract.
28. COLLECTION OF HEALTHCARE WASTE
28.1 The Royal Cornwall Hospital Trust shall provide a collection point at each site identified in Schedule C, with the exception of St Michaels Hospital where there are currently 4 locations across site.
28.2 The Contractor(s) shall collect containers and replace them with cleansed empty containers in accordance with an agreed schedule, by each of the authorising officers of the Cornwall Healthcare Community.
28.3 The Cornwall & Isles of Scilly PCT and the Cornwall Partnership NHS Trust requires the Contractor(s) to provide an appropriately sized container at each of the agreed locations as detailed in Part C of the contract specification.
28.4 The Contractor(s) shall collect used containers and replace them with cleansed empty containers as per the agreed schedule.

28.5 The Contractor(s) must ensure that all replacement empty containers are functional as per relevant legislation prior to their return to the site.
28.6 Healthcare waste will be delivered to the agreed collection / storage areas on each site by the user in accordance with the schedule provided agreed at the start of the contract. The schedule, to be agreed by the Cornwall Healthcare Community, shall reflect the hours of business and needs of the individual trust(s).
28.7 Each Tenderer shall identify a sufficient number of containers to be supplied, to be agreed with the Cornwall Healthcare Community prior to the commencement of the contract.
28.8 Contractor(s) will ensure that exact quantities of Healthcare waste generated can be reported to each of the Cornwall Healthcare Community on a monthly basis.
28.9 The Contractor(s) must provide itemised details of charges on a monthly basis for the disposal of healthcare waste.
28.10 Where sub-contractors/third parties are used to manage various waste streams on behalf of the Cornwall Healthcare Community via the Contractor(s), the Contractor(s) is responsible for managing and coordinating all invoicing arrangements. Proposed methods of managing invoicing arrangements between sub-contracted Supplier(s) and/or third parties must be provided in writing to the Cornwall Healthcare Community within the tender proposal.
28.11 Containers supplied by the Contractor(s) (wheeled carts or rigid plastic/steel) must be UN performance tested to meet the appropriate requirements, and packaged in accordance with the ADR (as set out in Section 8 of Health Memorandum 07-01: Safe Management of Healthcare waste.) It is the contractor’s responsibility to adopt any improvements or changes in regulation, which may supersede this document and provide details of such in writing to the Cornwall Healthcare Community.
28.12 In respect of 28.11 the appointed Contractor(s) to supply a copy of the relevant Test Certificate to each of the trusts and to comply with the conditions stated within the Certificate.
28.13 In respect of 28.11 above the appointed Contractor(s) is required to correctly mark and label the packaging with Proper Shipping Name, UN number and

Class 6.2 Danger Label before they are loaded onto a vehicle for the purpose of carriage on public roads.

29.8 Contractor(s) will ensure that exact quantities of hazardous healthcare waste generated can be reported to each Cornwall Healthcare Community on a monthly basis.
29.9 The Contractor(s) must provide itemised details of charges on a monthly basis for the disposal of hazardous healthcare waste.
29.10 Where sub-contractors/third parties are used to manage various waste streams on behalf of the Cornwall Healthcare Community via the Contractor(s), the Contractor(s) is responsible for managing and coordinating

all invoicing arrangements. Proposed methods of managing invoicing arrangements between sub-contracted Supplier(s) and/or third parties must be provided in writing to the Cornwall Healthcare Community within the tender proposal.
29.11 Containers supplied by the Contractor(s) (wheeled carts or rigid plastic/steel) must be UN performance tested to meet the appropriate requirements, in the case of UN3291 Clinical Waste, Unspecified, N.O.S., of packaging instructions P621. IBC 520 and LP621 and meet the requirements of the trusts Fire Officers
29.12 In respect of 29.11 the appointed Contractor(s) to supply a copy of the relevant Test Certificate to each Trust and to comply with the conditions stated within the Certificate.
29.13 In respect of 29.11 above the appointed Contractor(s) is required to correctly mark and label the packaging with Proper Shipping Name, UN number and Class 6.2 Danger Label before they are loaded onto a vehicle for the purpose of carriage on public roads.
30. COLLECTION OF HAZARDOUS NON HEALTHCARE WASTE
30.1 The Royal Cornwall Hospital Trusts shall provide a central collection area for each site shown in Schedule C.
30.2 The Contractor(s) shall collect containers and replace them with cleansed empty containers in accordance with an agreed schedule, by each of the authorising officers of the Cornwall Healthcare Community.
30.3 The Cornwall & Isles of Scilly PCT, the Cornwall Partnership NHS Trust, Cornwall Hospice Care and commissioned services requires the Contractor(s) to provide an appropriately sized container at each of the agreed locations as detailed in Part C of the contract specification.
30.4 The Contractor(s) shall collect used containers and replace them with cleansed empty containers as per the agreed schedule.
30.5 The Contractor(s) must ensure that all replacement empty containers are functional as per relevant legislation prior to their return to the site.
30.6 Hazardous waste will be delivered to the agreed collection / storage areas on each site by the user in accordance with the schedule provided agreed at the start of the contract. The schedule, to be agreed by the Cornwall Healthcare

30.10 Where sub-contractors/third parties are used to manage various waste streams on behalf of the Cornwall Healthcare Community via the Contractor(s), the Contractor(s) is responsible for managing and coordinating all invoicing arrangements. Proposed methods of managing invoicing arrangements between sub-contracted Supplier(s) and/or third parties must be provided in writing to the Cornwall Healthcare Community within the tender proposal.
30.11 Containers supplied by the Contractor(s) (wheeled carts or rigid plastic/steel) must be UN performance tested to meet regulatory requirements of Hazardous waste.
30.12 In respect of 30.11 the appointed Contractor(s) to supply a copy of the relevant Test Certificate to the trust/consortium (delete non applicable – please note if a consortium each participant must receive a copy), and to comply with the conditions stated within the Certificate.
30.13 In respect of 30.11, above, the appointed Contractor(s) is required to correctly mark and label the container in accordance to regulations for the Hazardous waste collected.
31. COLLECTION OF DOMESTIC/GENERAL WASTE
31.1 The Royal Cornwall Hospitals NHS Trust shall provide a central collection area at each site identified in Schedule C
31.2 The Contractor(s) shall collect containers in accordance with an agreed schedule, by each of the authorising officers of the Cornwall Healthcare Community.

31.3 Contractor(s) shall clean all bins at every clearance in accordance with an agreed schedule by each of the authorising officers of the Cornwall Healthcare Community. Tenderers are requested to provide a cleaning schedule within their tender proposal. The additional costs associated with this provision must be included in Offer Schedule (additional costs).
31.4 . The Cornwall Healthcare Community reserves the right to accept or reject proposals provided by Tenderers.
31.5 The Cornwall & Isles of Scilly Primary Care Trust, the Cornwall Partnership NHS Trust, Cornwall Hospice Care and commissioned services requires the Contractor(s) to provide an appropriately sized container at each of the agreed locations as detailed in Part C of the contract specification.
31.6 The Contractor(s) shall collect containers in accordance with an agreed schedule, by each of the authorising officers of the Cornwall Healthcare Community2.
31.7 The Contractor(s) must ensure that all replacement empty containers are functional as per relevant legislation prior to their return to the site.
31.8 Domestic and General waste will be delivered to the agreed collection / storage areas on each site by the user in accordance with the schedule provided agreed at the start of the contract. The schedule, to be agreed by the Cornwall Healthcare Community, shall reflect the hours of business and needs of the individual trust(s).
31.9 Each Tenderer shall identify a sufficient number of containers to be supplied, subject to the agreement of the Cornwall Healthcare Community prior to the commencement of the contract.

31.11 Where sub-contractors/third parties are used to manage various waste streams on behalf of the Cornwall Healthcare Community via the Contractor(s), the Contractor(s) is responsible for managing and coordinating all invoicing arrangements. Proposed methods of managing invoicing arrangements between sub-contracted Supplier(s) and/or third parties must be provided in writing to the Cornwall Healthcare Community within the tender proposal.

32.6 Miscellaneous waste will be delivered to the agreed collection / storage areas on each site by the user or delivered to an agreed disposal site according to the schedule provided agreed at the start of the contract. The schedule, to be agreed by the Cornwall Healthcare Community, shall reflect the hours of business and needs of the individual trust(s).
32.7 Each Tenderer shall identify a sufficient number of containers to be supplied, to be agreed with the Cornwall Healthcare Community prior to the commencement of the contract.
32.8 Contractor(s) will ensure that exact quantities of miscellaneous waste(s) generated can be reported to each Cornwall Healthcare Community on a monthly basis.
32.9 The Contractor(s) must provide itemised details of charges on a monthly basis for the disposal of miscellaneous waste(s).
32.10 Where sub-contractors/third parties are used to manage various waste streams on behalf of the Cornwall Healthcare Community via the Contractor(s), the Contractor(s) is responsible for managing and coordinating all invoicing arrangements. Proposed methods of managing invoicing arrangements between sub-contracted Supplier(s) and/or third parties must

be provided in writing to the Cornwall Healthcare Community within the tender proposal.
32.11 Containers supplied by the Contractor(s) (wheeled carts or rigid plastic/steel) must be UN performance tested to meet regulatory requirements.
32.12 Containers used for the transportation of confidential waste must be kept secure
32.13 In respect of 32.11 the appointed Contractor(s) to supply a copy of the relevant Test Certificate or documents to each trust, and to comply with the conditions stated within the Certificate.
32.14 In respect of 32.11 above the appointed Contractor(s) is required to correctly mark and label the container in accordance to the relevant regulations for the Miscellaneous waste(s) collected.
33. RECORDING OF WASTE COLLECTION AND DISPOSAL
33.1 All waste collected will be covered by a Waste Transfer Note in accordance with the Environmental Protection Act 1990 and show the applicable European Waste Catalogue number (EWC). Details of applicable charges for the provision of Waste Transfer Notes must be stated in Offer Schedule (Additional Costs).
33.2 All Hazardous waste collected will be covered by a Hazardous Waste Consignment Note and in accordance with the Environmental Protection Act 1990 and the Hazardous Waste (England and Wales) Regulations 2005. Details of applicable charges for the provision of Hazardous Waste Consignment Notes must be stated in Offer Schedule (Additional Costs).
33.3 A certificate of destruction must be provided as appropriate for confidential material
33.4 All Waste Transfer Notes and Hazardous Waste Consignment Notes must be signed by the NHS Trusts representative(s) before waste is removed from the Cornwall Healthcare Community premises.
33.5 The weight of each consignment must be established by the use of a weighbridge or other approved and calibrated weighing method which is weights and measures endorsed by HM Customs and Excise.
33.6 A consignment note system is to be used for each collection and consignment data must be provided to the named representative for the Trust

but consignment notes must be left and signed at the collection premise. The Contractor(s) shall provide a receipt recording the time and date of collection, the identification of bags/containers collected, the registration number of the vehicle and the final destination of the waste.
33.7 After the delivery of each load the operator of the waste treatment facility shall issue to the Contractor(s) a receipt recording the time, date and disposal method/point of the load and the weight of the individual containers. A copy of the previous month’s receipts shall be forwarded together with the monthly invoices to the trust/consortiums representative(s) (delete non applicable).
33.8 All consignment and receipt notes shall be numbered
33.9 Consignee returns should be sent quarterly to the Trusts representative
33.10 All tonnage data and invoicing for MSW (hospitals and teaching units) must be provided to the County Council
34. TRANSPORTATION OF WASTE
34.1 Contractor(s) shall at all times maintain a comprehensive Transportation Plan giving details of routes, collection points, timetables, vehicles and driver details. The Transportation Plan should allow sufficient flexibility to accommodate any reasonable special needs that the Cornwall Healthcare Community may have. The Contractor(s) shall consult the Cornwall Healthcare Community regarding any alterations.
34.2 Tenderers must provide details within their written proposal details of how they propose to transport waste from collection points to waste treatment facilities and if applicable how treated waste is transported to final disposal sites.
34.3 All vehicles used for providing the services are to be roadworthy in accordance with the Road Traffic Acts and as appropriate be properly licensed by the Local Authority and where appropriate be of a type that conforms to current Motor Vehicle Regulations (i.e. Motor Vehicles (Construction and Use) Regulations, the Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2004 etc) and future regulations during the course of the contract.

34.4 Vehicles must be maintained to a high standard of reliability and roadworthiness and will be subject to inspection at any reasonable time and may (but not unreasonably or vexatiously) instruct the Contractor(s) not to use the said vehicles in the provision of the services. All vehicles used must conform to the Motor Vehicles (Construction and Use) Regulations.
34.5 The interior and exterior of all vehicles must be kept clean and tidy.
34.6 The Contractor(s) will be required to demonstrate that they can provide adequate cover for the non-availability of vehicles for any reason.
34.7 The vehicles shall at all times, at the expense of the Contractor(s), be appropriately licensed and insured.
34.8 The Contractor(s) shall provide evidence of insurance and breakdown cover for all vehicles. Evidence of insurance and breakdown cover provision will be required to be produced to the Cornwall Healthcare Community representative(s) upon request.
34.9 The Contractor(s) shall provide evidence of current registration by the appropriate authority, as a waste carrier for the transportation and disposal of all of the waste streams covered by this contract.
34.10 Tenderers shall provide details of their company’s Dangerous Goods Safety Advisor (DGSA) including evidence of qualifications, certification and technical competence together with a copy of their most recent Dangerous Goods Safety Advisor Report within their tender submission.
34.11 Contractor(s) will provide the Cornwall Healthcare Community representative(s) with a copy of the Dangerous Goods Safety Advisor report on an annual basis.
34.12 The Contractor(s) shall ensure that the necessary Transport Documentation required to support the carriage of UN3291, Clinical Waste, Unspecified and N.O.S. (as required under the CDG Road Regulations 13(2) is completed in order to ensure that each trust are not in breach of their Duty of Care.
35. VEHICLE ACCESS
35.1 The Cornwall Healthcare Community will ensure that adequate access and space for the Contractor(s) for the collection of waste streams in accordance with the agreed service schedule.

35.2 All contractors or sub contractor vehicles must comply with Site Rules on transportation which will be provided at implementation of the contract
35.3 Vehicle access for all sites will be between 8.00-17.00 unless other wise identified. In particular the Royal Cornwall Hospitals Trust (Treliske site) will require collection between 7.00 – 9.00 or 17.30 – 19.00 and St Austell Hospital prior to 9.00. Site parking will only be permitted during the period of loading and unloading.
35.4 Access to Newquay Hospital must be from the rear entrance.
35.5 The Contractor(s) will ensure vehicles used to collect waste/serve this contract will avoid the blocking/disruption to vehicles or public access to any site
35.6 Any necessary Site Rules will be circulated to the successful Tenderer prior to implementation and must be adhered to at all times.
36. WASTE TRANSFER/TREATMENT/DISPOSAL FACILITIES
36.1 Tenderers are required to provide full details of the Healthcare waste/Hazardous Healthcare Waste/Hazardous non Healthcare Waste/ Domestic and General, Miscellaneous waste transfer, treatment and disposal processes they propose to use during the course of the contract
36.2 Where MSW is collected for billing to County Council, disposal sites must clearly indicate usage of .current PFI contracted services
36.3 Sites used for the Secure destruction of confidential material must conform to the Code of Practice and BS8470:2006
36.4 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification
36.5 Tenderers are required to provide full details regarding the performance history of all proposed facilities (including contingency facilities) that will be used to service the contract. Information should include:
36.5.1 Use and performance;
36.5.2 Efficiency testing; 36.5.3 Ash residue (if incinerator/if appropriate); 36.5.4 Microbiological treatment standard (non incineration only);

36.5.5 Material testing (non incineration only); 36.5.6 Storage and testing of shredded material (non incineration only).
37. DISPOSAL OF HEALTHCARE WASTE*
37.1 Tenderers must confirm within their tender proposal full details of where healthcare waste will be disposed of/treated. Tenderers must advise the Cornwall Healthcare Community of the full name and address(s) of the site(s) / facilities that apply to the contract.
37.2 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification
37.3 The Tenderer is to comply with the current relevant legislations relating to the disposal of healthcare waste, in accordance with Department of Health guidelines including Health Technical Memorandum 07-01: Safe Management of Healthcare Waste.
37.4 In the event that the Contractor(s) wishes to utilise alternative site(s)/facilities the Cornwall Healthcare Community must be notified in writing. Prior notification must be received at least one month before the alternative site/facility is utilised
37.5 All waste management operations must be carried out in accordance with all current relevant legislation. Evidence to this must be auditable and available on demand by the authorised officers of the Cornwall Healthcare Community.
37.6 The Cornwall Healthcare Community reserves the right to visit the specified site(s)/facilities(s) in accordance with its “Duty of Care” responsibilities under the Environmental Protection Act 1990.
37.7 In the event of a waste facility being unavailable, all Tenderers must provide clear and detailed contingency plans within their tender proposal. The successful Contractor(s) will be expected to continue to fulfil their obligations to the Cornwall Healthcare Community in such circumstances without any further increase in cost, unless identified at the outset of this contract.
37.8 If the Contractor(s) contingency plans are reviewed/updated during the course of the contract, written confirmation must be provided to the Cornwall Healthcare Community.

37.9 Tenderers shall provide written confirmation that any designated waste disposal plant/facility or standby facilities named within their tender proposal are permitted/authorised by the Environment Agency/Local Authority to receive Healthcare waste from the Cornwall Healthcare Community.
38. DISPOSAL OF HAZARDOUS HEALTHCARE WASTE
38.1 The Tenderer is to allow for the separate collection of hazardous healthcare wastes and provide suitable disposal systems to ensure their safe disposal, details to be included in the tender.
38.2 Tenderers must confirm within their tender proposal full details of where hazardous healthcare waste will be disposed of/treated. Tenderers must advise the Cornwall Healthcare Community of the full name and address(s) of the site(s)/facilities that apply to the contract.
38.3 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
38.4 The Tenderer is to comply with the current relevant legislations relating to the disposal of Cytotoxic and other drugs, foetal tissue and part or whole limbs, in accordance with Department of Health guidelines including Health Technical Memorandum 07-01: Safe Management of Healthcare Waste. In particular this waste must be incinerated
38.5 In the event that the Contractor(s) wishes to utilise alternative site(s)/facilities the Cornwall Healthcare Community must be notified in writing. Prior notification must be received at least one month before the alternative site/facility is utilised3.
38.6 In relation to radioactive waste the Royal Cornwall Hospitals Trust is authorised for disposal at Viridor Waste Management, Derriford, Plymouth and Grundon Waste Management, Lakeside Rd, Colnbrook, Slough SL3 OEG
38.7 All waste management operations must be carried out in accordance with all current relevant legislation. Evidence to this must be auditable and available on demand by the authorised officers of the Cornwall Healthcare Community.
38.8 The Cornwall Healthcare Community reserves the right to visit the specified site(s)/facilities(s) in accordance with its “Duty of Care” responsibilities under

the Environmental Protection Act 19904 and the Hazardous Waste (England and Wales) Regulations 2005.
38.9 In the event of a waste facility being unavailable, all Tenderers must provide clear and detailed contingency plans within their tender proposal. The successful Contractor(s) will be expected to continue to fulfil their obligations to the Cornwall Healthcare Community in such circumstances.
38.10 If the Contractor(s) contingency plans are reviewed/updated during the course of the contract, written confirmation must be provided to the Cornwall Healthcare Community.
38.11 Tenderers shall provide written confirmation that any designated waste disposal plant/facility or standby facilities named within their tender proposal are permitted/authorised by the Environment Agency/Local Authority to receive hazardous healthcare waste from the Cornwall Healthcare Community.
39. DISPOSAL OF HAZARDOUS NON HEALTHCARE WASTE
39.1 The Tenderer is to allow for the separate collection of hazardous wastes and provide suitable disposal systems to ensure their safe disposal, details to be included in the tender.
39.2 The Tenderer must provide suitable containment for a range of hazardous materials from each site, this includes UN packaging where applicable
39.3 Tenderers must confirm within their tender proposal full details of where hazardous waste will be disposed of/treated/recycled. Tenderers must advise the Cornwall Healthcare Community of the full name and address(s) of the site(s)/facilities that apply to the contract5.
39.4 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
39.5 In the event that the Contractor(s) wishes to utilise alternative site(s)/facilities the Cornwall Healthcare Community must be notified in writing. Prior notification must be received at least one month before the alternative site/facility is utilised6.

39.8 In the event of a waste facility being unavailable, all Tenderers must provide clear and detailed contingency plans within their tender proposal. The successful Contractor(s) will be expected to continue to fulfil their obligations to the Cornwall Healthcare Community in such circumstances.
39.9 If the Contractor(s) contingency plans are reviewed/updated during the course of the contract, written confirmation must be provided to the Cornwall Healthcare Community.
39.10 Tenderers shall provide written confirmation that any designated waste disposal plant/facility or standby facilities named within their tender proposal are permitted/authorised by the Environment Agency/Local Authority to receive Hazardous waste from the Cornwall Healthcare Community.
40. DISPOSAL OF DOMESTIC AND GENERAL WASTE
40.1 In accordance with existing relevant legislation Domestic and General waste classified as MSW should be disposed of at licensed waste disposal site(s) and / or transfer station(s). that form part of the County Council PFI arrangement.
40.2 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
40.3 The Cornwall Healthcare Community reserves the right to visit the specified site(s) in accordance with its “Duty of Care” responsibilities under the Environmental Protection Act 1990.
40.4 Tenderers must advise the Cornwall Healthcare Community of the full names and address(s) of the proposed waste disposal site(s)/facilities(s) and / or transfer station(s) in writing within their written tender proposal.

40.5 In the event that the Contractor(s) wishes to utilise alternative site(s)/facilities(s) the Cornwall Healthcare Community must be notified in writing. Prior notification must be received at least one month before the alternative site/facility is utilised.
40.6 In the event of a waste facility being unavailable, all Tenderers must provide clear and detailed contingency plans within their tender proposal. The successful Contractor(s) will be expected to continue to fulfil its obligations to the Cornwall Healthcare Community in such circumstances.
40.7 If the Contractor(s) contingency plans are reviewed/updated during the course of the contract, written confirmation must be provided to the Cornwall Healthcare Community.
40.8 Tenderers shall provide written confirmation that any designated waste disposal plant/facility or standby facilities named within their tender proposal are permitted/authorised by the Environment Agency/Local Authority to receive Domestic and General waste from the Cornwall Healthcare Community.
41. DISPOSAL OF MISCELLANEOUS WASTE
41.1 In accordance with existing relevant legislation miscellaneous waste should be disposed of at licensed waste disposal site(s) and / or transfer station(s).
41.2 Sites used for the Secure destruction of confidential material must conform to the Code of Practice and BS8470:2006 and shredded material should be pulped
41.3 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
41.4 The Cornwall Healthcare Community reserves the right to visit the specified site(s) in accordance with its “Duty of Care” responsibilities under the Environmental Protection Act 1990.
41.5 Tenderers must advise the Cornwall Healthcare Community of the full names and address(s) of the proposed waste disposal site(s)/facilities(s) and / or transfer station(s) in writing within their written tender proposal.
41.6 In the event that the Contractor(s) wishes to utilise alternative site(s)/facilities(s) the Cornwall Healthcare Community must be notified in

writing. Prior notification must be received at least one month before the alternative site/facility is utilised.
41.7 In the event of a waste facility being unavailable, all Tenderers must provide clear and detailed contingency plans within their tender proposal. The successful Contractor(s) will be expected to continue to fulfil its obligations to the Cornwall Healthcare Community in such circumstances.
41.8 If the Contractor(s) contingency plans are reviewed/updated during the course of the contract, written confirmation must be provided to the Cornwall Healthcare Community.
41.9 Tenderers shall provide written confirmation that any designated waste disposal plant/facility or standby facilities named within their tender proposal are permitted/authorised by the Environment Agency/Local Authority to receive Miscellaneous waste from the Cornwall Healthcare Community.
42. RECYCLING/WASTE MINIMISATION*
42.1 All Tenderers are required to provide a proposal within their tender submission, which will address the issue of recycling and waste minimisation within the Cornwall Healthcare Community. A key aim for the successful Contractor(s) will be their ability to develop existing recycling activity as well as proposals to increase the recycling activity in all waste streams.
42.2 It should be remembered that educational establishments and hospital inpatient units are considered to generate household waste/MSW and council arrangements should be followed using existing PFI registered sites.
42.3 Recycling credits and tonnages should be clearly identified for the respective organisations to claim
42.4 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
42.5 The Cornwall Healthcare Community welcome proposals from Tenderers on alternative methods of disposal (i.e. Materials Reclamation Facility (MRF) route or alternative procedures) of un-segregated Domestic and General waste to landfill or other immediate disposal.

42.6 The Cornwall Healthcare Community reserves the right to visit the specified site(s) in accordance with its “Duty of Care” responsibilities under the Environmental Protection Act 1990.
42.7 The Cornwall Healthcare Community must be advised of the locations of the proposed recycle site(s) and or transfer station(s). Any subsequent changes during the contract period must be notified in writing in advance to the Cornwall Healthcare Community. This prior notification must be received at least one month before the subsequent changes take place.
43. DISPOSAL OF MISCALLANEOUS WASTE STREAMS
43.1 There is the opportunity for Tenderers to submit proposals for the disposal of items that do not currently form part of the contract specifications above, so long as such proposals are in accordance with current relevant legislation, and contain full details of the disposal sites and/or transfer stations.
43.2 Examples of such waste items would be:
43.2.1 Catering Waste (currently macerated and disposed of to sewer)
43.2.2 Confidential waste 43.2.3 Feminine Hygiene waste (to be treated as non infectious healthcare waste but the additional costs of containers associated with this provision must be included in Offer Schedule (additional costs). 43.2.4 Gardening waste
43.2.5 Mattresses 43.2.6 Recording Media (i.e. CD’s, Dictation Tapes, DVD’s, Video Tapes etc) 43.2.7 Scrap Metal 43.2.8 X-ray films (current arrangements exist for the sale of these)
43.3 Tenderers must provide copies of licences/permits of any disposal/treatment sites that are proposed for use to service this contract – as stipulated in Section 11 (Licences) of the contract specification.
43.4 Confidential waste and other recording media must meet the minimum security to the standard BS 8470:2006 and be accredited with the BSIA or UKSSA
43.5 The Cornwall Healthcare Community reserves the right to visit the specified site(s) in accordance with its “Duty of Care” responsibilities under the Environmental Protection Act 1990.

43.6 The Cornwall Healthcare Community must be advised of the locations of the proposed waste disposal site(s)/facilities(s) and / or transfer station(s). Any subsequent changes during the contract period must be notified in writing in advance to the Cornwall Healthcare Community. Prior notification must be received at least one month before the alternative site/facility is utilised.
44. EQUIPMENT
44.1 Tenderers shall indicate within their tender submission a written proposal of additional equipment (i.e. waste storage/holding/baling/compacting), which could form part of the contract. The Cornwall Healthcare Community reserves the right to accept or reject all or part of the proposals submitted.
44.2 Written proposals for additional equipment should include the following information:
44.2.1 Perceived benefits / opportunities for each Trust if equipment is utilised. 44.2.2 Service / Maintenance Schedule for each piece of equipment proposed 44.2.3 Call out / response rates if equipment out of use or temporary unavailable
44.3 Tenderers must provide full cost details of any costs for additional equipment within Offer Schedule (Additional Costs).
45. MAJOR INCIDENTS
45.1 In the event of a major incident occurring the Contractor(s) will be responsible for disposing of the waste generated by the Cornwall Healthcare Community.
45.2 Waste generated during a major incident may consist of healthcare/ hazardous healthcare/ hazardous non healthcare/ Domestic and General and Miscellaneous waste
45.3 The Cornwall Healthcare Community in conjunction with emergency services and the Environment Agency will advise the Contractor(s) of the nature of the waste.
45.4 Contractor(s) should note that subject to the major incident in question, additional bins/containers maybe required in addition to bins/containers already on site(s).

46. SUB-CONTRACTING
46.1 Tenderers shall indicate within their tender proposal aspects of the contract they would intend to sub-contract and/or employ a third party to fulfil the service(s) specified within the contract specification.
46.2 Tenderers shall provide name(s), addresses(s) and contact details of proposed sub-contacted suppliers and/or third parties to be employed within the contract in their tender proposal together with all relevant licences and requirements as detailed in Section 11.
46.3 The Contractor(s) shall not sub-contract the collection, transportation or disposal of waste with out the prior consent in writing of the Cornwall Healthcare Community.
46.4 Where sub-contracting arrangements do exist, the Contractor(s) shall arrange for all invoices to be co-ordinated with the each Trust receiving one consolidated monthly invoice.
46.5 Any associated administration charges for the management of third parties and/or sub-contracted services (including the consolidation of collections, invoicing arrangements etc) must be indicated in Offer Schedule in the (Additional Costs).
47. CONTRACT IMPLEMENTATION ACTION PLAN
47.1 Tenderers are required to provide a comprehensive Contract Implementation Action Plan within their tender proposal describing how they propose to implement the contract if they are successful and liaise with the outgoing contractor for a streamlined change over.
47.2 The Contract Implementation Action Plan will outline the following:
47.2.1 The proposed collection schedule for each individual site within the Cornwall Healthcare Community once the contract commences 47.2.2 Must clearly demonstrate that Cornwall County Council disposal sites are utilised
47.2.3 Proposed plan for the ordering, delivery of new bins/containers to the Cornwall Healthcare Community and the collection of existing bins 47.2.4 The method of transportation to be used for the collection of waste 47.2.5 Details of recruitment, training and development and mobilisation of staff to service/deliver the contract

47.2.6 The co-ordination of any sub-contracting/third party arrangements required to fully service the contract as specified 47.2.7 Proposed timetable to complete duty of care visits for the relevant Cornwall Healthcare Community representatives
47.3 Tenderers are at liberty to nominate a revised collection frequency if this suits the Cornwall Healthcare Community and does not adversely affect the overall cost of the contract. Proposals will be agreed in with the Cornwall Healthcare Community prior to the contract commencing.
47.4 The Contractor(s) is at liberty to nominate a revised collection frequency during the course of the contract. Proposals will not adversely affect the overall cost of the contract and must be provided in writing to the Cornwall Healthcare Community a month before the proposal is due to commence. The Cornwall Healthcare Community reserves the right to reject requests to alter collection frequencies.
47.5 The Implementation Plan provided by Tenderers is subject to alteration and agreement between the successful Contractor(s) and the Cornwall Healthcare Community.
48. SPILLAGE/ACCIDENTS
48.1 Spillages and/or accidents must be immediately reported to the Cornwall Healthcare Community contact/s and confirmed in writing within 48 hours.
48.2 Tenderers must provide a method statement for dealing with any spillage, burstage or accident within their proposal.
48.3 Costs arising to clear spillages, burstages or accidents that occur shall be included within the Offer Schedule (Additional Costs).
48.4 Costs associated with clearing spillages, burstages or accidents were the Contractor(s) has been at fault, must be met by the Contractor(s).
49. NOISE CONTROL
49.1 The Contractor(s) shall ensure that all measures are taken to control the noise levels produced by his operations on the Cornwall Healthcare Community site(s) required under or by virtue of any enactment, regulation or Codes of Practice or by the working rules of any industry.

49.2 The Contractor(s) attention is drawn in particular to Part III of the Control of Pollution Act 1974, Part III of the Environmental Protection Act 1990 and any Regulation made or Codes of Practice approved there under, the Noise and Statutory Nuisance Act 1993 and Directive 92/97/EEC amending Directive 70/157/EEC on the approximation of the laws of the Member States relating to the permissible sound level and the exhaust system of motor vehicles and the UK regulations made there under.
49.3 The Contractor(s) is to note that they will be working in a hospital environment. All noise levels are to be kept down to a minimum.
50. CONTRACTOR’S STAFF
50.1 The Contractor(s) shall ensure that every person employed by the Contractor(s) and / or sub-contractor(s) employed for the provision of waste management services, is at all times properly and sufficiently trained by having participated in a formal training programme prior to commencing work. Details of training records should be available as requested by the Cornwall Healthcare Community.
50.2 All staff involved with the handling of clinical waste shall be offered the appropriate immunisation, including hepatitis B and tetanus. The Tenderer shall establish arrangements for dealing with staff that decline the immunisation.
50.3 All staff who are likely to come into contact with patients or confidential waste must be vetted by the Criminal Records Bureau and copies provided to each Trust
50.4 The contractor and his staff must not disclose to any person (other than a person authorised by the Trust) any information acquired by them in the course of the contract. Without prejudice to the generality of this condition, the contractor and his staff must not disclose to any unauthorised person any information which concerns –
50.4.1 The trust, it’s staff or procedures
50.4.2 The identity of any patient at any of the Trust’s hospitals or other sites
50.4.3 the medical condition of, or treatment received by, any patient
50.5 Staff appointed by the Contractor(s) and / or sub-contractor(s) and / or temporary staff must be aware of all relevant rules and procedures

concerning Health and Safety at Work and the recording of all accidents and untoward occurrences involving waste disposal procedures from the Cornwall Healthcare Community sites.
50.6 Reportable incidences (i.e. RIDDOR) whilst undertaking work on behalf of the Cornwall Healthcare Community, must be reported on the appropriate Accident/Incident Form and copies forwarded to the authorised officer(s) for the Cornwall Healthcare Community.
50.7 The Contractor(s)’s staff shall be required to carry and display a form of identification for any period during which they are working on the Cornwall Healthcare Community premises.
50.8 The Contractor(s) shall provide suitable uniforms for their staff at all times while on the trusts premises and ensure that staff are dressed in appropriate protective uniforms/work wear and use any personal protective equipment provided.
50.9 The Cornwall Healthcare Community expect the highest standards of personal hygiene, courtesy and consideration from all of the Contractor(s)/sub-contractor(s) staff at all times.
50.10 The Contractor(s) shall prohibit their staff from smoking on Cornwall Healthcare Community property.
50.11 The Contractor(s) shall ensure that mobile phones or radio devices will not be used within Cornwall Healthcare Community properties without first securing the permission of the relevant trust representative(s).
50.12 The Cornwall Healthcare Community reserves the right to request the removal of staff who fail to carry out the service to the standards required by the Cornwall Healthcare Community as outlined within the contract specification.
50.13 The Contractor(s) shall fulfil the requirements of the contract with a minimum of disruption. Specific attention should be drawn to the following:
50.13.1 Not to convey any articles to or from a patient or have any dealing with any patient unless so requested by the authorised officer.
50.13.2 Not to trespass on Cornwall Healthcare Community property but confine themselves strictly to the locality of their work.

50.13.3 The Contractor(s) attention is drawn to the provisions of the Mental Health Act 1983 which, lays down penalties to which persons employed in Mental Health Hospitals are liable upon conviction for misconduct with patients. A copy of the Act may be seen in the office of the Unit Manager and Contractor(s) are reminded that ignorance of the law is not regarded as a defence in the Courts. 50.13.4 The Contractor(s) and relevant staff employed on this contract must at all times be mindful of the need to respect patient confidentiality, and should not interact verbally or physically with patients.
50.14 The Contractor(s) shall be liable for both authorised and unauthorised acts of its employees whilst carrying out their duties in line with the contract specification whilst they are on the Cornwall Healthcare Community premises.
50.15 The Contractor(s) shall ensure that:
50.15.1 Every person newly recruited to be employed by the Contractor(s) and / or sub-contractor(s) in and about the provision of the services shall, at the Contractor(s)’s expense, at the commencement of the contract period or that person’s employment (whichever shall be the latter) be medically screened. 50.15.2 Any employee shall be excluded from the site when suffering from any infectious or communicable disease.
50.16 In the event of Contractor’s staff who have, or who may have, access to the Cornwall Healthcare Community sites during the course of the Contract being criminally prosecuted for a serious offence (as defined in the Police and Criminal Evidence Act 1984), the Contractor(s) must immediately supply the authorised officer with a full report of the circumstances and, ultimately, of the outcome of any judicial procedures.
51. MONITORING OF THE CONTRACT
51.1 The Contractor(s) and the authorising officers of the Cornwall Healthcare Community will be responsible for monitoring the quality and effectiveness of the service. This may include authorised officers from Cornwall County Council for minitoring of MSW. All Tenderers must submit with their tender a statement on how these standards will be achieved and monitored in

practice. This will be agreed between the Contractor(s),the Cornwall Healthcare Community And Cornwall County Council
51.2 Tenderers must provide a written outline of how they propose to monitor, trace and audit the contract during the life of the agreement within their tender proposal.
51.3 The Cornwall Healthcare Community, in accordance with its Duty of Care principles will agree a formal monitoring system with the Contractor(s), to commence at the start of the contract and be based on a continuous assessment process throughout the life of the contract.
51.4 The Cornwall Healthcare Community, reserves the right to inspect with or without prior notice, all records relating to the performance of the contract.
51.5 The Cornwall Healthcare Community reserves the right to visit any specified holding / waste disposal site (s) with or without prior notice during the contract period.
51.6 A contract review meeting will be held on a quarterly basis between the Contractor(s) and the Cornwall Healthcare Community representatives. This review meeting can be increased or decreased according to the issues arising at the time
51.7 Tenderers must provide a method of arbitration for any or all such matters that may cause dispute between both parties under this contract, within their tender proposal. The Cornwall Healthcare Community reserves the right to accept or modify this method prior to acceptance of the agreement with the successful Contractor(s).
52. PRICE, PAYMENT AND SUPPORTING INVOICE/MANAGEMENT INFORMATION
52.1 Each trust will require the following management information pertaining to their waste collections in support of the monthly invoice.
52.1.1 Site Location
52.1.2 Date of Uplift
52.1.3 Number and size of each container collected from each site 52.1.4 Total weight for each site per collection 52.1.5 Any bin or other equipment rental where appropriate

52.1.6 All the above data for all waste uplifts 52.1.7 Copies of all waste transfer notes/hazardous waste consignment notes (either electronic or paper)
52.1.8 Where relevant certificates of destruction
52.2 All invoices must quote the current price per tonne/unit, or unit cost, for the collection and relevant Waste Transfer Notes / Consignment Notes and Certificates of Destruction but should be simplified and minimise waste with supporting documents available by disk or email, as agreed. This includes invoices submitted to Cornwall County Council
52.3 Where sub-contracting arrangements do exist, the Contractor(s) shall arrange for all invoices to be co-ordinated with the trust receiving one consolidated monthly invoice.
52.4 Any associated administration charges for the management of third parties and/or sub-contracted services (including the consolidation of collections, invoicing arrangements etc) must be indicated in Offer Schedule (Additional Costs).
52.5 The Contractor(s) must have in place a fully auditable identification and tracking system from point of collection to disposal
52.6 The provision of individually numbered tags for the closure of confidential waste will also be the responsibility of the successful Contractor(s) and form part of this offer
52.7 A computerised/web-based tracking system is desirable albeit not essential.
53. QUALITY ASSURANCE/ENVIRONMENTAL POLICY
53.1 Tenderers shall provide details of the quality assurance system and/or accreditations (including copies of certificated evidence) operated by their company, which are applicable to this contract.
53.2 Tenderers shall provide details of the quality assurance system and/or accreditations (including copies of certified evidence) for the proposed sub- contractors who form part of the Tenderers offer to deliver this contract.
53.3 Tenderers shall provide details of any environmental policies and/or accreditations (including copies of certificated evidence) developed/received by their company, which are applicable to this contract.

53.4 Tenderers shall provide details of the environmental policies and/or accreditations (including copies of certified evidence) for the proposed sub- contractors who form part of the Tenderers offer to deliver this contract
53.5 Tenderers shall provide details of any carbon reduction plans proposed for the contract duration.
54. SERVICE RESPONSE TIMES
54.1 In addition to scheduled waste collections services the tender shall provide a reactive collection service on an emergency, urgent, routine/planned basis. The Tenderer shall respond to such service requests as indicated in the table below:

55. PUBLIC HOLIDAYS
55.1 The Contractor(s) must ensure that service schedules and staffing levels are unaffected by Public Holidays.
56. CONTRACT MANAGEMENT
56.1 All Tenderers are asked to provide a written proposal within their tender submission for the provision of a Contract Manager, together with their current qualifications and experience, who will be a single point of contact for the Cornwall Healthcare Community.

56.2 In the absence of the Contract Manager the contractor(s) will notify the authorised officer, in writing, of a named representative who is nominated to deputise, together will their current qualifications and experience.
56.3 The Contractor(s) will be required to nominate a competent person(s) who can be contacted during operational hours.
56.4 The Contractor(s) will be required to nominate a competent person(s) who can be contacted in the event of an emergency. An out of office out of hour’s phone number will be required.
56.5 The Cornwall Healthcare Community will supply the Contractor(s) with similar out of hours contact names for each of the sites included within the contract.
57. INNOVATIONS/ADDITIONAL SERVICES
57.1 The Cornwall Healthcare Community welcome any initiatives/innovations from Tenderers to help minimise waste levels, embrace recycling and help to progress carbon reduction within the service provision as it emerges with a progressive carbon Management plan. These initiatives should be sustainable and cost effective in the provision of environmental best practice. Tenderers should include all proposals in writing via their tender proposal and will be reviewed annually
57.2 Tenderers are encouraged to provide written proposals for any additional services they believe should be added to the contract. Proposals should be provided in writing via their tender proposal.
57.3 Costs associated with the development/inclusion of these services should be included in the Other Costs section of Offer Schedule (Additional Costs).
57.4 The Cornwall Healthcare Community reserves the right to accept or reject any proposed innovations/additional services prior to acceptance of an offer.

EXPLANATORY NOTES
The Cornwall Healthcare Community is made up of the following organisations:
• The Royal Cornwall Hospitals Trust (RCH) which is an acute treatment provider
• The Cornwall and Isles of Scilly Primary Care Trust (CIOS) which is a community care provider and also a commissioner of Healthcare services
• The Cornwall Partnership Trust is a provider of specialist services for mental health and learning disabilities. They also host Cornwall Healthcare Estates and Support Services who provide healthcare waste services to GP’s, Dentist and other small producers. This waste is collected and delivered directly to disposal site
• The Cornwall Partnership Trust are a charity organisation providing support and pallative care to terminally ill patients
In addition, for this contract specification the following have been included as commissioned services:
• Ramsay Healthcare, (who also run Mount Stewart Hospital in Torquay)
• Collection of patient returned redundant drugs from identified chemists/pharmacies
Whilst this contract specification includes all waste streams identified for disposal within the organisations listed above these individual waste streams may be tendered for separately to ensure that the evaluation process can identify ‘best value’
Please note that the site St Mary’s Hospital on the Isles of Scilly transports all but domestic waste by sea to the Docks at Penzance. Subsequently documentation for hazardous waste must meet IMDG (International Maritime Dangerous Goods) Regulations. Domestic waste is incinerated on the island

In addition, domestic waste designated as Municipal Solid Waste (MSW) produced by inpatient units or teaching facilities where disposal is paid for by the County Council must be disposed of at PFI providor (SITA) disposal sites in accordance with contractural arrangements within the County. This however does not apply to waste streams outside of that criteria.
