Rhode* This article explores the leadership challenges that arose in the wake of the 2020 COVID-19 pandemic and the widespread protests following the killing of an unarmed Black man, George Floyd. Lawyers have been key players in both crises, as politicians, general counsel, and leaders of protest movements, law firms, bar associations, and law enforcement agencies. Their successes and failures hold broader lessons for the profession generally. Even before the tumultuous spring of 2020, two-thirds of the public thought that the nation had a leadership crisis. The performance of leaders in the pandemic and the unrest following Floyd’s death suggests why. The article proceeds in three parts. Part I explores leadership challenges during the COVID-19 pandemic and the missteps that put millions of lives and livelihoods as risk. It begins by noting the increasing frequency and intensity of disasters, and the way that leadership failures in one arena—health, environmental, political, or socioeconomic—can have cascading effects in others. Discussion then summarizes key leadership attributes in preventing, addressing, and drawing policy lessons from major crises. Particular attention centers on the changes in legal workplaces that the lockdown spurred, and which ones should be retained going forward. Analysis also centers on gendered differences in the way that leaders addressed the pandemic and what those differences suggest about effective leadership generally. Part II examines leadership challenges in the wake of Floyd’s death for lawyers in social movements, political positions, private organizations, and bar associations. -

THE ITEM VETO IN STATE COURTS Richard Briffault * Contemporary debates about state constitutional law have concentrated on the role of state constitutions in the protection of individual rights and have paid less attention to the state constitutional law of government structure.' This is ironic since the emergence of a state jurisprudence of individual rights has been hampered by the similarity of the texts of the state and federal constitutional provisions concerning individual rights, whereas many state constitutional pro- visions dealing with government structure have no federal analogues, and thus state jurisprudence in this area is free to develop outside the dominating shadow of the Federal Constitution and the federal courts. Moreover, as the "laborato- ries of democracy" metaphor suggests, the study of the structural features of state constitutions can enable us to consider alternative means of organizing rep- resentative democratic governments, assess the efficacy of different mechanisms for governing, and illuminate the implications and consequences of aspects of the federal government's structure that we ordinarily take for granted. -

National Lieutenant Governors Association PRESS ADVISORY November 4, 2010 (updated 12 -14-10) Contact: NLGA Director Julia Hurst (859) 283-1400 ADVISORY ON SPLIT PARTY GOVERNOR / LIEUTENANT GOVERNOR SERVICE & ADVISORY ON COMPOSITION OF LIEUTENANT GOVERNOR- ELECT CLASS The nation will have twenty-six (26) new seconds-in-command across the states this year/in early 2011, as follows: Alabama, Alaska, Arkansas, California, Colorado, Connecticut, Florida, Hawaii, Illinois, Iowa, Kansas, Louisiana, Maine, Michigan, Minnesota, New Hampshire, New Mexico, New York, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Vermont, and Wisconsin. The territory of Guam also elected a new lieutenant governor. The following analysis includes the fifty known lieutenant governors / officials first in line of gubernatorial succession (as of December 14, 2010), who will be inaugurated through December of 2010 and January of 2011. Some lieutenant governors are elected to office in the general election on a ticket with the governor while others are elected independently of the governor in the general election. For this reason and sometimes due to other circumstance, a governor and lieutenant governor (or the official first in line of succession) may be of different parties. (see “Method of Election” on NLGA web site at www.nlga.us) . As of December 14, 2010, six states are slated to have a governor and lieutenant governor (or official first in line of succession) of opposite parties and one state with an official holding both positions. The states are as follows: Arkansas (D/R), Missouri (D/R), Montana (D/R), New Hampshire (D/R)*, Rhode Island (I/D), and Vermont (D/R). -

FROM JERRYRIGGED TO PETERED OUT: LESSONS FROM THE DEUKMEJIAN ERA FOR CONTEMPORARY CALIFORNIA STATE BUDGETING Daniel J.B. Mitchell, UCLA HoSu Wu Professor of Management and Public Policy The new governor took office in the midst of a major state budget crisis. At the time he took office, it was unclear that state could pay its bills if drastic action were not taken. Yet the incoming governor was committed to a notaxincrease program. Through borrowing, the state managed to surmount its budget crisis. As the economy recovered and resulting tax revenue flowed in, it even was able to engage in major construction projects. When he stood for re election, the governor was overwhelmingly returned to office for a second term. Sadly, however, the economy began to slow during that second term. Fears mounted that the state could face a renewed budget crisis. This description may seem to depict the career to date of Arnold Schwarzenegger. He inherited a budget crisis from Gray Davis who he replaced in the 2003 recall. But the introductory vignette actually refers to the story of George Deukmejian (“Duke”) who was first elected in 1982, inheriting a budget crisis from Jerry Brown. (Deukmejian’s construction projects leaned towards prisons for most of his terms in office, needed as state sentencing laws tightened, rather than the roads and other infrastructure pushed by Schwarzenegger.) And as it turned out, the economic downturn that began to take shape towards the end of Deukmejian’s second term indeed did produce a major budget crisis, a legacy he left for his successor, Pete Wilson. -

CHRONOLOGY OF MICHIGAN HISTORY 1618-1701 1618 Etienne Brulé passes through North Channel at the neck of Lake Huron; that same year (or during two following years) he lands at Sault Ste. Marie, probably the first European to look upon the Sault. The Michigan Native American population is approximately 15,000. 1621 Brulé returns, explores the Lake Superior coast, and notes copper deposits. 1634 Jean Nicolet passes through the Straits of Mackinac and travels along Lake Michigan’s northern shore, seeking a route to the Orient. 1641 Fathers Isaac Jogues and Charles Raymbault conduct religious services at the Sault. 1660 Father René Mesnard establishes the first regular mission, held throughout winter at Keweenaw Bay. 1668 Father Jacques Marquette takes over the Sault mission and founds the first permanent settlement on Michigan soil at Sault Ste. Marie. 1669 Louis Jolliet is guided east by way of the Detroit River, Lake Erie, and Lake Ontario. 1671 Simon François, Sieur de St. Lusson, lands at the Sault, claims vast Great Lakes region, comprising most of western America, for Louis XIV. St. Ignace is founded when Father Marquette builds a mission chapel. First of the military outposts, Fort de Buade (later known as Fort Michilimackinac), is established at St. Ignace. 1673 Jolliet and Marquette travel down the Mississippi River. 1675 Father Marquette dies at Ludington. 1679 The Griffon, the first sailing vessel on the Great Lakes, is built by René Robert Cavelier, Sieur de La Salle, and lost in a storm on Lake Michigan. ➤ La Salle erects Fort Miami at the mouth of the St. -

ARTICLES Welcome to the "Last Frontier," Professor Gardner: Alaska's Independent Approach to State Constitutional Interpretation RONALD L. NELSON* This article rebuts recent criticism of efforts by state supreme courts to interpret state constitutionalprovisions differently than the United States Supreme Court interprets analogous provisions in the United States Constitution. This area of law, sometimes called New JudicialFederalism, has been the subject of consider- able comment over the last twenty years. By focusing on equal protection, privacy, religious freedom and access to natural resources, the article examines Alaska's unique constitutional background and independent interpretation. This analysis of Alaskan constitutionalrights reveals a viable and active brand of New Judicial Federalism. The article concludes that Alaska's independent approachto state constitutionallaw is an example of a constitutionaldiscourse that is both uniquely local and national- ly valuable. I. I' I 1 Chapter 9 Governors and the Executive Branch Ethan Rarick The history of modem American politics cannot be written without discussing Cali~omia governors. One former governor (Ronald Reagan) went on to serve as president ofthe United States, of course, but in addition to that three others ran for president (Earl Warren, Jerry Brown, and Pete Wilson), one served as chief justice of the United States (Warren), and another was a global celebrity who could not seek the presidency only because he was a foreign-born immigrant (Arnold Schwarzenegger). The status of the office as a potential presidential launching pad caused at least two other national political figures-U.S. Sen. William Knowland and former Vice President Richard Nixon-to 'run for governor, and although Nixon lost his gubernatorial bid he ofcourse went on to eventually win the presidency. Aside from national elective politics, California's chief executive governs more Americans than anyone save the pre~ident, sits atop a state with the world's ninth largest economy, and often occupies a place on the world stage similar ta the leaders ofmiddle-sized nations. The incumbent as of 2013, Jerry Brown, is no exception to any of these trends.
