Formation after first profession for non-clerical religious is an innovation of Vatican II. The document Renovationis causam recognizes the necessity and significance of post-novitiate formation in helping the temporarily professed religious attain the required growth towards maturity necessary for permanent commitment. With the promulgation of the 1983 Code of Canon Law, post-novitiate formation is accorded formal legislation and recognized as an intrinsic aspect of religious life. The Code specifies its aims, dimensions and pedagogy, leaving its structure and duration to be designed by individual institutes. The Church requires that each institute draw up a ratio which is structured according to the provisions of universal norms at the same time allowing some latitude for necessary adaptations of aspects which may require revision. Despite the provisions specified in the universal law, together with further directives given in subsequent Holy See documents, formation of religious continues to be a constant challenge to the Church as well as religious institutes. -

Book IV of the 1983 Code of Canon Law, title VII, chapter V and the Code of Canons of the Eastern Churches, title XVI, chapter VII, article VI govern the canonical form of marriage. In many ways the provisions of the two codes are similar; in some instances, however, they differ. Both the similarities and the differences have pastoral consequences, especially in cases of mixed marriages or in territories where a hierarchical organization of various Oriental Catholic churches sui iuris does not exist. The purpose of this dissertation is to examine the canonical form of marriage by comparing the Latin and Oriental canonical legislations and analyzing the pastoral consequences that arise when laws concerning canonical form of marriage are applied in specific areas, especially in light of recent political and social changes in Eastern Europe. This comparative study of the canonical form of the marriage in the Latin and in the Catholic Oriental law, especially within the Byzantine rite, begins with an historical overview of the issue in both the Latin and the Byzantine traditions focused on specific documents and circumstances that had a significant impact on the evolution of canonical form. -

Every person has the natural right to marriage which is, however, affected by cultural and social conditions. The pastors of the Church, therefore, have to make every effort to understand the particularity of situations within which marriage and family are lived today and respond accordingly through their pastoral action. Thailand is considered a Buddhist country due to the fact that the vast majority of its population is Buddhist. Most marriages celebrated in the Catholic Church are non- sacramental because a Buddhist is the spouse of the Catholic party. Canon 1086 of the 1983 Code states that due to the impediment of disparity of worship, a marriage between a person who was baptized in the Catholic Church or received into it and a non-baptized person is invalid. A dispensation from this impediment must be granted by the competent authority in order for the union to be valid. The conditions stated in cc. 1125–1126 must be taken into account for a dispensation to be granted. The thesis identifies the actual pastoral problems faced by persons in marriages with the disparity of worship and canonical questions faced by Church authorities; it also proposes canonical-pastoral responses to such cases. -

Pope Modifies Canon Law on Marriage, Deacons Clause Removed on Formal Renunciation of Church VATICAN CITY, DEC. 15, 2009 (Zenit.org).- Benedict XVI has made two changes in canon law, regarding marriage for those who have formally renounced the Church, and clarifying the ministry of deacons. The changes came in a statement issued "motu proprio" (on his own initiative), called "Omnium in mentem" (In the Mind of All). The document is dated Oct. 26 but was released today. Preparation of the statement began during the pontificate of Pope John Paul II and required lengthy consultations with episcopal conferences around the world. The document published today contains five articles modifying Canons 1008, 1009, 1086, 1117 and 1124. According to an explanatory note by Archbishop Francesco Coccopalmerio, president of the Pontifical Council for Legislative Texts, these variations "concern two separate questions: adapting the text of the canons that define the ministerial function of deacons to the relative text in the Catechism of the Catholic Church (1581), and suppressing a subordinate clause in three canons concerning marriage, which experience has shown to be inappropriate." Deacons The variation to the text of Canon 1008 will now limit itself to affirming that "those who receive the sacrament of orders are destined to serve the People of God with a new and specific title," he explained. Canon 1009 "will be given an additional third paragraph in which it is specified that the minister constituted into the order of the episcopate or the priesthood receives the mission and power to act in the person of Christ the Head, while deacons receive the faculty to serve the People of God in the diaconates of the liturgy, of the Word and of charity," the archbishop's note added. -

Breve glosario de terminologia eclesiástica Archidiócesis Es la diócesis principal de una provincia eclesiástica, gobernada por un arzobispo. Es un título que permite reconocer la importancia de algunas sedes episcopales destacadas, sobre todo por motivos de orden histórico o social. En las Iglesias orientales se llama archieparquía. Arzobispo Es el título que recibe el obispo que gobierna una archidiócesis. La condición de arzobispo es una dignidad que se adquiere por nombramiento del Papa. No se refiere al sacramento del orden sagrado. También son arzobispos quienes ocupan cargos de mayor grado en la jerarquía curial, como los nuncios, o los responsables de oficios que ejercen funciones interdiocesanas. A los arzobispos metropolitanos se les impone el palio, una franja de lana blanca decorada con cruces negras, que simboliza la oveja sobre los hombros del Buen Pastor, y significa la comunión con Roma. En enero de 2015, en una carta del maestro de ceremonias pontificias a las nunciaturas, se comunica la decisión del Papa de que la imposición del palio a los nuevos arzobispos se realice en las iglesias locales, y no en Roma, como hasta ese momento. En la Urbe sólo recibirán el palio de manos del Papa. Decker Washington, D.C. 2016 An Examination of the Foundation and Activation of the Cooperation of Laity and Pastors in the Munus Docendi in Catechesis according to Canon 776 Zabrina R. Decker, J.C.D. Director: Rev. Robert J. Kaslyn, S.J., J.C.D. Canon 776 of the 1983 Code of Canon Law establishes the obligation of the pastor to provide catechetical formation and responsibility of laity to cooperate in such formation.1 This study uniquely focuses on the foundation and activation of the cooperation of the lay Christian faithful with pastors in catechesis. Such cooperation derives from baptism (both the right to witness to the gospel message [c. 211] and the correlative obligation of suitable preparation to exercise that right [c. 229]). Chapter one establishes baptism as the canonical foundation for incorporation, personhood and catechetical responsibility in the Church. From this constitutive basis, chapter two presents the ecclesiology of the sanctifying, governing and teaching (catechetical) mission of the Church for both laity and pastors. Conciliar, ecclesial and canonical definitions of catechesis are the focus of chapter three. Chapter four explores the definition of the lay Christian faithful as derived from their ontological status in baptism. -

IUSTITIA Vol. 1, Nos. 1&2, December 2010 Pages: 84-117 MAJOR CONTRIBUTIONS OF CCEO DURING THE PAST 20 YEARS Pablo Gefaell* This year we celebrate the 20th anniversary of the promulgation of the CCEO. In this article I try to explain the path followed by Eastern canonical science throughout these years. In order to make the explanation more pleasant I would like to talk about personal experience, but without any interest of self-satisfaction. I will try to be as clear and thorough as I can, bearing in mind that I have the unmerited fortune to belong to a generation that has received its formation directly from the lips of the protagonists of the new Eastern codification. 1. The Interest of the Study of Eastern Law As I was finishing my doctorate in Latin Canon Law, back in the year 1990, and beginning my educational experience, the much awaited Codex Canonum Ecclesiarum Orientalium1 was passed. On October 25th of that same year, the Servant of God Pope John Paul II presented it to the Assembly of the Synod of Bishops that was taking place in Vatican. Presenting the Code that regulates the common ecclesiastical discipline of all the Eastern Catholic Churches to the *Pablo Gefaell, born in Vigo (Spain) in 1960, was ordained priest in 1989, Prelature of Opus Dei. He optained Licenciate in Medicine (Santiago de Compostela University, Spain, 1983), Doctorate in Latin (“Santa Croce" Pontifical University, 1990) and Oriental Canon Law (PIO, Rome, 2005) and Diploma in "Studio Rotale" (Roman Rota, 1992). From 1996 he has been Professor of Eastern Canon Law at "Santa Croce" and from 1997 External Judge at the Tribunal, Vicariate of Rome. -

A DISCUSSION OF MATRIMONIAL IMPEDIMENTS Prior Marital Bond - Canon 1085 — §1. A person bound by the bond of a prior marriage, even if it was not consummated, invalidly attempts marriage. §2. Even if the prior marriage is invalid or dissolved for any reason, it is not on that account permitted to contract another before the nullity or dissolution of the prior marriage is established legitimately and certainly. Who can dispense: only the Roman Pontiff by way of the Favor of the Faith or a dispensation from a ratified but non-consummated marriage. However, many times freedom to marry is determined by a nullity of marriage case. Age - Canon 1083 — §1. A man before he has completed his sixteenth year of age and a woman before she has completed her fourteenth year of age cannot enter into a valid marriage. Who can dispense: Canon 1078 — §1. The local ordinary can dispense his own subjects residing anywhere and all actually present in his own territory from all impediments of ecclesiastical law except those whose dispensation is reserved to the Apostolic See. However, prudence dictates that such dispensations should rarely be granted because “the necessary discretion of mind, even if it is had before this age is weak.” (Gasparri, De Matrimonio, n. 493). Further, state laws also are involved in setting minimum ages. Impotence - Canon 1084 — §1. Antecedent and perpetual impotence to have intercourse, whether on the part of the man or the woman, whether absolute or relative, nullifies marriage by its very nature. §2. If the impediment of impotence is doubtful, whether by a doubt about the law or a doubt about a fact, a marriage must not be impeded nor, while the doubt remains, declared null. -

Motu Proprio “Omnium in Mentem” CIUDAD DEL VATICANO, martes 15 de diciembre de 2009 (ZENIT.org).- Ofrecemos a continuación una traducción de la versión no oficial en italiano del Motu Proprio “Omnium in Mente” del Papa Benedicto XVI, que ha sido hecho público hoy por la Santa Sede, y por el que se modifican varios cánones del Código de Derecho Canónico sobre los sacramentos del Orden Sacerdotal y del Matrimonio. ****** La Constitución Apostólica Sacrae disciplinae leges, promulgada el 25 de enero de 1983, llamaba a la atención de todos que la Iglesia, en cuanto comunidad al mismo tiempo espiritual y visible, y ordenada jerárquicamente, necesita normas jurídicas “para que el ejercicio de las funciones a ella confiadas por Dios, especialmente la de la sagrada potestad y de la administración de los sacramentos, pueda ser adecuadamente organizado”. En tales normas es necesario que resplandezca siempre, por una parte, la unidad de la doctrina teológica y de la legislación canónica, y por otra, la utilidad pastoral de las prescripciones, mediante las cuales las disposiciones eclesiásticas están ordenadas al bien de las almas. Con el fin de garantizar más eficazmente tanto esta necesaria unidad doctrinal como la finalidad pastoral , algunas veces la suprema autoridad de la Iglesia, tras haber ponderado las razones, decide los oportunos cambios de las normas canónicas, o bien introduce en ellas alguna integración. Esta es la razón que Nos induce a redactar la presente Carta, que afecta a dos cuestiones. Ante todo, en los cánones 1008 y 1009 del Código de Derecho Canónico sobre el sacramento del Orden, se confirma la distinción esencial entre el sacerdocio común de los fieles y el sacerdocio ministerial y, al mismo tiempo, se evidencia la diferencia entre episcopado, presbiterado y diaconado.
