By Placing Its Thumb on the Scale of Competition, the Commission by This
....@-- by placing its thumb on the scale of competition, the Commission by this Rule has distorted and restricted competition in other ways affecting pro gram producers, syndicators, independent stations, new networks, and network affiliates. The Rule has come to be seen largely as a measure to promote the fortunes of independent and UHF stations. The evidence shows that today many independent stations are more profitable than affiliates. Further, UHF affil iates of ABC, CBS and NBC are victims of the Rule, yet on average are fi nancially weaker than UHF independents, intended beneficiaries of the Rule. Furthermore, any "handicapII affecting independent UHF stations in the past has been reduced or eliminated, due to forces other than PTAR. The economic costs, penalties, restrictions and consumer harms caused by PTAR cannot be justified by an increase in diversity, because PTAR has not increased diversity. The number of outlets for local broadcast programming is unchanged by the Rule. The number of sources of programming avail able to those outlets is reduced by the terms of the Rule. There is no basis to believe that the Rule enhances the diversity of prime-time broadcast program content (or the variety of viewpoints), and there are some reasons to believe that diversity has been reduced. In any event, the flowering of new media alternatives makes irrelevant whatever marginal change in broadcast network affiliate content diversity, if any, can be attributed to the Rule. INTRODUCTION 1. Paxson Chicago License, Inc. (“Paxson”), is the licensee of television station WCPX, Chicago, Illinois. WCPX broadcasts an NTSC analog television service on channel 38 and a digital television service on channel 46. The digital transmission on channel 46 includes six separate multiplexed Federal Communications Commission DA 01-149 programming streams: (1) the primary Central Time feed of PAXTV; (2) PAXTV east coast feed; (3) PAXTV west coast feed; (4) The Worship Network; (5) The Praise Network; and (6) The TLN Network. Paxson has filed 13 must carry complaints against cable operators (“operators”) in and around Chicago, Illinois. The cable systems involved in this proceeding generally already carry the WCPX, channel 38, analog service. Paxson requests that the Commission order each of the cable operators involved to replace the existing WCPX analog service with a downconverted analog version of the digital primary Central Time feed of PAXTV received from channel 46 and place the remaining five channel 46 programming streams on the digital portion of the cable systems for access by subscribers that have digital set top boxes. -

In December 1987, the station relocated from its longtime studios on Virginia Street East to their current location on Piedmont Road in Charleston. The company sold off WCHS-AM in 1991. Heritage sold all of its remaining broadcasting properties (four television stations, LMAs for two other television stations, and 24 radio stations) to Sinclair Broadcast Group in 1997 just as Heritage itself was being swallowed up by News Corporation (that sale being for Heritage's supermarket marketing operations, rather than for its television stations). None of Heritage's stations thus switched network affiliations. This simulcast continued while technical issues were worked out as WBME transitioned to Weigel's West Allis studios, and Weigel eventually received carriage on both DirecTV and Dish Network on the basic tier of all of those services, as it is allowed to assert must-carry status with those providers.
