February 2017 the Pre Trial 11 Chamber granted the Co Lawyers ten days to file the Application before the Chamber On 21 February 2017 the Defence filed the Application and on 6 March 2017 the ICP Trial Chamber is satisfied that the conditions of Internal Rule 76 4 are met The contested investigative actions the impugned Forwarding Order and Supplementary Submission and the charges20 do not concern any order that is open to appeal Nothing in the application suggests that it is evidently unfounded in fact or in law such as to deprive it of view that the set forth in the any prospect of success The Chamber is of the further reasoning application is sufficient since it contains logically consistent submissions underpinned by legal reasoning whose grounds are set forth or by factual material pinpointed in the case file The Pre Trial Chamber therefore finds the application admissible IV APPLICABLE LAW 7 Annulment is foreseen under Internal Rule 48 which provides that “[investigative or the judicial action may be annulled for procedural defect only where the defect infringes rights of the party making the application” 8 Accordingly examination of an application for annulment requires 1 consideration in the first place of procedural defect and 2 subsequently where such defect is established 21 the existence of prejudice to the applicant A procedural irregularity which is not prejudicial 22 to an applicant does not result in annulment V CONSIDERATION OF THE MERITS 9 Upon deliberation the Judges of the Pre Trial Chamber could not reach a majority of votes for a decision on the merits of this Application 10 Therefore while the decision of the Pre Trial Chamber in respect of the admissibility of the Application is expressed in the preceding paragraphs the separate opinions of the the ICCPR would qualify as a procedural defect [ ] In such cases the investigative or judicial action may be ” annulled 42 “[Wjhere a procedural defect would not be prescribed void in the text of the relevant provision and where there has been no violation of a right recognized in the ICCPR the party making

The main objective of this policy is 1). to improve governance reform at sub national administration to promote local democratic, 1). to promote local social and economic development, and 3). to alleviate poverty across country. Based on the Law on Administrative Management of the Capital, Provinces, Municipalities, Districts and Khans which was enforced in 2008 have provided a basic principle for democratic reform at sub national level and have put in place new councils who are democratic governance body at Capital, Provinces, Municipalities, Districts and Khans through indirect election in 2009. Councils are representative of public legal entity who has to establish, promote and ensure sustainability of democratic development at sub national level. Meaning that the councils must be accountable mainly and directly to citizens in order to ensure transparency and encourage civic engagement both male and female by focusing on their needs and voices in making decision, resources allocation, public services delivery and local development. Organizing dissemination and consultative forum is an important tool to promote accountability, transparency and civic engagement both male and female in good governance process of sub national councils. Therefore the National Committee for Sub-National Democratic Development (NCDD) has developed this Technical Document on Dissemination and Consultative Forums for the Capital council, provincial councils, municipal councils, district councils and khan councils in order to support dissemination and consultative forums smoothly, effectively, transparently, and actively participate from female and male citizens.

LAWS & REGULATIONS UPDATE AGRICULTURE f Prakas Nº 402 (MAFF) of September 1, 2008 on The Registration Sample, Certificate, and Permit for Use of Cambodian Specified Rubber Certification Trade Mark and Official Letter (Ogs, Year 08, N0 71, September 27, 2008): This Prakas regulates relevant registration samples, certificates and permits for certifying Cambodian rubber quality to ensure the unity of Cambodian specified rubber quality standard to provide confidence in doing business with rubber derived from the Kingdom of Cambodia for national and international markets. The Cambodian Rubber Research Institution (CRRI) shall be entitled to use the following six items, including a relevant registration sample, certificate and permit for certification of Cambodian rubber quality: 1. Cambodian specified rubber certificate issued by the CRRI; 2. Cambodian specified rubber certificate issued by the National Specification Laboratory; 3. Rubber recycle factory registration; 4. National Specification Laboratory registration; 5. Permit for use of Cambodian specified rubber certification trade mark; and 6. Official letter of the National Specification Laboratory. The above registration sample, certificate and permit may be modified or created for new model in accordance with the necessity of the national rubber development.

The main objective of this study is to measure 13 technical efficiency (TE) of Cambodian rice production and also trying to identify core influencing 14 factors of rice TE at both national and household level, for explaining the possibilities of increasing 15 productivity and profitability of rice, by using translog production function through Stochastic 16 Frontier Analysis (SFA) model. Four-years dataset (2012-2015) generated from the government 17 documents was utilized for the national analysis, while at household-level, the primary three-years 18 data (2013-2015) collected from 301 rice farmers in three selected districts of Battambang province 19 by structured questionnaires was applied. The results indicate that level of rice output varied 20 according to the different level of capital investment in agricultural machineries, total actual 21 harvested area, and technically fertilizers application within provinces, while level of household 22 rice output varied according to the differences in efficiency of production processes, techniques, 23 total annual harvested land, and technically application of fertilizers and pesticides of farmers.
