Effective Tuesday, March 17, 2020 at 8:30 a.m., all Township of Oro-Medonte facilities including the Administration Centre were closed to the public. We will continue to offer services online and over the telephone.

The Township of Oro-Medonte has amended its Procedural By-law to allow for electronic participation at Council meetings during a declared emergency. Hello CAO Dunn, Mayor Hughes, members of Council, Ms Aubichon

I listened with interest when Councillor Keane introduced the proposed and passed Public Code of Conduct with reference to the Canadian Human Rights Act.

It was apparent that no legal opinion had been obtained on such a contentious piece of legislation, given the “expected” criticism and resistance from members of this community.

FYI - The Law

The Ontario Human Rights Code defines discrimination as the unequal treatment of a person because of their race, sex, ethic origin, religion, etc., including handicap.

Mental illness is defined as a handicap under the Code.

Mayor Hughes, you stated during the Council meeting that you believed that the increase in “disrespectful” e- mails and letters to members of Council and staff is as a result of Covid, and what you perceived to be the “pressure” adversely affecting the “mental health” of those members of this community who are writing disrespectful e-mails and letters to members of Council and OM staff.

Page 6 of 147 2.a) Motion to Adopt the Agenda. It was you, Mayor Hughes, who introduced the “mental health” consideration with your comments during the Council meeting, and thereby opening the door to the possibility of human rights complaints based on your comments.

If it is the continuing practice or proposed policy of members of Council and Oro-Medonte staff to simply ignore those e-mails and letters from members of this community who have a mental illness, or are perceived by you and members of Council or OM staff to have a mental disorder, that, is called discrimination, if other members of the community who are perceived not to have a mental disorder routinely receive responses from members of Council or OM staff.

In this case, unequal or different treatment is discrimination, on the grounds of handicap.

That’s the law.

A community member could arguably file a human rights complaint of discrimination with the Ontario Human Rights Commission on that basis.

The respondent(s), possibly being the Township, Council member(s) and/or staff member, would be required to provide an explanation as to why the complainant did not receive a response given the foregoing comments of Mayor Hughes regarding the “mental health” of those communicating with members of Council or OM staff, if the complaint were to be investigated by the Commission.

I have drafted enough complaints of discrimination by members of the public to know that this would be viewed as unequal treatment, or discrimination, comparatively speaking, without a legally acceptable explanation.

It would be the decision of an investigator subsequent to an investigation to recommend to the Commission the dismissal of the complaint on the basis it was frivolous, vexatious or made in bad faith, or recommend a board of inquiry, or no board of inquiry to the Commission.

I have made all three recommendations many times in my ten years with the Ontario Human Rights Commission, in addition to having seconded to the Province’s Independent Investigation Unit mandated to investigate complaints under the Provinces Workplace and Harassment Policy in the Provinces’s correctional facilities.

I strongly suggest, as I have in a previous e-mail, that all communications from members of the public should, at the very least, be acknowledged as a preliminary matter by the person to whom it is directed upon receipt of a communication from a member of this community.

It’s not complicated. It would be a standardized, form e-mail or form letter to be pulled up on a computer initially acknowledging the communication, possibly followed up by a second standard letter with a response.

Or, if the e-mail or letter is “disrespectful” and “crosses the line”, a standardized form e-mail or letter with a caution.

In my view, it is less than professional not to respond, and can result in frustration and more “disrespectful” communications from the member of our community.

Acknowledging a communication from a person(s) or company or group is standard business practice in the private sector, of which I have worked, and in the Provincial government, where I have worked, as well.

You are in the business of the governance of this Township, and in providing that service.

Page 7 of 147 2.a) Motion to Adopt the Agenda. It is my understanding that allegedly not all e-mails or letters to members of Council are being received by Council members and therefore not acknowledged or responded to by members of Council.

I suggest that Council members should explore this information further. That is, that mail is being censored without Council members’ knowledge.

Personally, I would want to receive all communications from members of the public, good and bad, in order to maintain the “pulse” of what is happening in the community and feedback.

As has been said by another community member, if you can’t stand the heat, get out of the kitchen!

In my view, this By-Law is unnecessary.

A public discussion on “disrespectful” communications from members of the public would have sufficed with a clear indication to the public of how Council intends to address the problem of “disrespectful” communications. - see above.

I agree with the motion by Councillor Greenlaw and Councillor Veitch that this By-Law should be re-visited and eliminated.

The goal of 'mutual respect for all' is definitely valid.

The method, tone and intent by some Council members who initiated the motion is certainly questionable and as evident from the public commentary - quite offensive.

Words written or otherwise are always subject to interpretation, the principle and intent behind them is most significant.

Comments – January 13 2021 Council Agenda Item 13 (b) Request for Reconsideration of Council Code of Conduct for the Public.

I support the noted request for reconsideration and for staff to prepare a report at a future meeting of Council, to prepare a full contextual policy framework “Respect and Dignity for All” and to better simplify and clarify the intent of Motion No. C201209-9.

Recent reports in the press brought the Council Code of Conduct for the Public to my attention, and the structure of it did not 'feel' right to me after reading it. I appreciate the spirit of respect and dignity for all in which it was conceived. In my view the structure of Code with its sanctions, appears to over- reach giving the 'perception' of Council compelling behaviour of the public, and it requires reconsideration.

Please permit my quick reflections from my personal experience.

A career in the corporate sector taught me that it is ok as a service provider to expect respect and dignity from recipients of my service. As humans each of us in our daily lives expects as much of each other. If I felt the service interaction turned disrespectful, I reviewed the scope of my role and ability to help, together with authentic listening, understanding and responding and if necessary a verbal warning of offending behaviour. This was all it took in the moment to return the engagement to a productive interaction for the service recipient and myself. Of course, serious issues may require other supports for all parties affected by inappropriate behaviours, including mandatory reporting and official complaint escalation options.

Engaging with anyone on municipal issues and service delivery to me requires behaviours like respect and dignity and equity. Certainly the Municipal Act and legislated Codes of Conduct, municipal employment policies and other existing operational policies of the municipal corporation, place a high degree of accountability on Council and Staff for good stewardship of municipal operations and acceptable, appropriate behaviours when engaging with each other and the public.

With comments and input from the public, staff and Council, I imagine the municipal corporation of Oro-Medonte Township could choose to develop a ' corporate' respect and dignity for all policy for the legislative operations, workplace and service delivery of the 'corporation', that achieves the spirit of the recent Code. The idea is to give advance notice of its expectations for all, including the public, to engage together with dignity and respect. Posters with a summary of the policy as it

Precedents for such municipal corporation policies exist, helping to create a culture of understanding and mutual respect. Refer to existing policies of Municipal Corporation of the City of Toronto and the TTC. The City of 's recent review as noted in the local press of workplace policies may also provide input for a new detailed comprehensive policy of respect and dignity for all.

Engaging with respect and dignity is not an unreasonable expectation for each one of us, and to which each one of us can hold ourselves accountable.

Mayor Hughes and Council Please include my email as part of the public record for item 13b dealing with the Public Code of Conduct. I do believe that civility should be shown when communicating, however this should be practiced by all parties. I do take umbrage with the title “Public Code of Conduct “. In my view it implies that the public alone should be censured for how they correspond with council. This is arrogant, dismissive and hypocritical. I also believe that if council insists on this motion that I see as another attempt at censorship, than perhaps the residents and staff should put forth a motion regarding a Code of Conduct for the mayor and councillors. I have been appalled at how certain members of council are publicly ridiculed and demeaned. This was never how council conducted themselves under Mayor Beard and Mayor Craig, two well respected mayors held in high regard by the residents and staff of Oro-Medonte. Perhaps our CEO Mr. Dunn should play a role in keeping interactions more professional and Civil. I am writing to respectfully agree with Councillors’ Veitch and Greenlaw that the Motion regarding a Public Code of Conduct be re-examined.

I am sorry that Councillors feel they are not being treated with the respect of their office – the public isn’t always pretty – as we have seen this past week south of the border. In fact many of them might be under educated vis a vis civil communication.

That said the process for your Public Code of Conduct Motion was not fully explained to the public as far as I can tell and we the constituents weren’t afforded an opportunity to hear why it was necessary to have such a Code or who would make the judgment about what constituted poor communication and offense.

May I suggest we are all constrained by the pandemic and stuck in our homes – so if patience is ragged and our psyches are worn our elected representatives ought to take this into consideration and understand this situation will not be upon us forever.

As I am not happy about harassment or rudeness in an email I have often used the delete button or emailed a request for a more civil tone. No Councillor or private citizen need suffer abuse or rudeness - May I suggest replying to rudeness with a note to say the tone of the email, phone call is inappropriate and won’t be addressed until the communication is civil.

Politics is a rough game at all levels as you are learning – a thick skin and some psychology go a long way.

Why was it felt that such a Code of Conduct for the public was introduced? We haven’t as a community had a discussion about the pressure Councillors feel they are facing. I would like to have the issue aired in a public forum as in a Council meeting agenda piece.

Thank you for serving us – your job is never an easy one and I know as public servants you are always having to be open to our views whether expressed badly or well.

I fully support the motion to reconsider this issue.

To Mayor and Council I am sending this note in support of Councillors Greenlaw and Veitch’s Request for Reconsideration related to Motion No. C201209-9.

Without doubt there are many examples of exchanges between constituents and Township Council and staff which are:  Vitriolic  Disrespectful  Unreasonable  Out of context

Council has determined that this warrants attention via ‘official’ action. This came forward as the motion on December 9th. Regrettably there was little advance of notice that it would be addressed during this meeting and very little opportunity to gain an understanding of all the implications. Among those the determination of what is outside the boundaries of the code. The meeting format imposes limitations with which Council is managing very well. But interaction between and among councillors is limited as is input from staff. The implications of this motion, while well intentioned are profound and should receive more attention before the motion becomes reality.

In my view, this issue reflects the very limited opportunities for constituents to interact with Council as a whole. As I have stated on several occasions, the Council agenda format is so constrained with rules, other than public meetings or deputations, dialogue does not happen. This leaves the public frustrated which may provoke troubling communications and equally troubling responses.

I have suggested restoration on the Public Advisory Committee. The structure, population and processes impaired value and seemingly resulted in dismantlement. I suggest once again that this matter be readdressed. Strike a small group to study the matter and come forward with a proposal. A small group to be comprised of two councillors, the CAO, two staff members and two members of the public. Chair to be a member of the public.

Whereas the Township of Oro-Medonte is committed to providing a work environment in which all persons employed by the Township are treated with respect and dignity;

Now therefore Be it Resolved that 1. The Township of Oro-Medonte adopts a “Code of Conduct for Members of the Public” when communicating with Township Council and staff regarding matters related to the Township. 2. It is at the discretion of the Clerk, in consultation with the CAO, to determine what constitutes a breach in the “Code of Conduct for a Member of the Public” as defined herein: a) Harassment, including disrespectful, intimidating, vexatious and/or defamatory actions, comments or conduct that is reasonably expected to cause offence to an employee or Member of Council of the Township of Oro-Medonte shall not be tolerated. b) Harassment includes actions, comments or conduct from customers, clients, members of the general public, residents of Oro-Medonte and members of groups and Associations representing a subject or an issue. c) Harassment includes actions, comments or conduct from an individual outlined in item 2) of this Motion by way of any form of electronic, written and verbal communication; including email, text, messaging and telephone correspondence; during any Township Committee or meetings of Council; and, in-person interactions (on or off Township property).

Should an offense occur, a clear statement will be provided to the member of public stating that such forms of harassment shall not be tolerated and may reference the “Code of Conduct for Members of the Public” as adopted. In addition, a copy of the “Code of Conduct for Members of the Public” may be provided to the individual or group. Employee(s) and/or Council member(s) for the Township of Oro-Medonte continue to exercise the right to refuse to respond, or meet with individual(s) in the future resulting from breaching of the “Code of Conduct for Members of the Public”. Background:

The current Parking By-law No. 2012-168, as amended was enacted in 2012, since this time the By-law has had several amendments. The purpose of this by-law update is to consolidate the previous amendments, and include permit parking and enhance other areas that have been identified by the public and staff.

Analysis:

The draft By-law will consolidate the previous by-law amendments and the Permit Parking By-law. The following provisions are enhancements to the existing by-law that have been identified by staff and the public.

Parking Prohibited For Winter Road Maintenance From the 1st of December in any year until the 1st day of April in the following year between the hours of 2:00 a.m. and 12:00 p.m., no person shall park a vehicle on a highway or in a municipal lot within the Township.

For the implementation of this winter road maintenance provision, it is staff’s intention to initially provide an educational approach so that residents and visitors are aware of the by-law update prior to active enforcement through ticketing/towing. To raise awareness, staff will exercise discretion initially in ticketing/towing and will be utilizing the Township website and social media channels to make individuals aware of the by-law amendments during this winter season and prior to the next winter season.

Permit Parking

Between May 1st and October 30th, no person shall park a vehicle on a highway or in any location identified within Schedules “D” and “E of this By-law unless a valid Township permit is displayed so as to be visible from outside the vehicle any time of year.

All permits issued by the Township are valid from May 1st through till October 30th as identified on the permit face, no person shall park and display an expired permit within locations identified within Schedules “D” and “E” of this By-law.

Permits shall be issued to residents, at no charge, through the Township Administration Office. Such permits will allow the holder to park in the locations specified in Schedules "D" and "E" of this By-law, provided that all other provisions of this By-law are complied with.

Permits may be purchased by non-residents for a fee as specified in the Township Fees and Charges By-law. Permits displayed so to be visible from the outside by non-residents will allow the vehicle to park in the locations specified in Schedules “D” and "E" of this By-law, provided that all other provisions of this By-law are complied with.

Should a violation under section 14.1 of this By-law continue in excess of three (3) hours, the Municipal Law Enforcement Officer may issue the vehicle/operator a second infraction, and subsequently issue further infractions every three (3) hours thereafter until such violation ceases.

General Traffic Rules

No person shall drive a vehicle on a sidewalk except for the purpose of directly crossing the sidewalk. No person shall drive a vehicle on the Rail Trail without the written consent from the Township prior to doing so.

No person shall drive a vehicle on municipal property unless in a designated parking area or on municipal roads controlled under the Highway Traffic Act. Notwithstanding sections 17.1, 17.2 and 17.3 vehicles operated by or on behalf of the Township for the purpose of their duties shall be permitted.

Municipal Law staff continue to receive concerns associated with snowmobiles utilizing the sidewalks in certain areas of the Township. The sidewalk provision will provide staff with the ability to enforce such concerns. To further assist staff we have included a traffic provision for vehicles on the Rail Trail. Although Municipal Law Staff do not have stopping powers this can assist if an address or individual is identified.

Within Schedule “A” staff have added in the following locations to restrict parking as a result of the publics concerns.

 Both sides of John Moon Road- No parking  East side of Warbler Way- No parking  Entire lake side of Moon Point Road

Financial / Legal Implications / Risk Management:

Signage would be required to be updated for the new Winter Road Maintenance restrictions. Currently, there is signage throughout the Township informing of the winter parking restrictions, these signs will need to be amended to reflect the new provision.

Cost would be approximately $60.00 per sign with 30 locations ($1800.00).

Background:

The subject lands are located within the Lake Simcoe Regional Airport Economic Employment District in accordance with the Provincial Growth Plan and are located across Line 7 from the Lake Simcoe Regional Airport. The lands have approximately 1120 metres (3674 feet) of frontage on Line 7 North and are approximately 86.1 hectares (212.75 acres) in area. The lands were the subject of a previous draft plan of subdivision approval for 23 industrial lots; however that draft plan approval has since lapsed.

Most recently, the lands were the subject of a Minister’s Zoning Order (O. Reg. 362/19) issued on November 1, 2019 to permit a range of automotive related industrial uses in addition to the already permitted airport related and other industrial uses.

On March 30, 2020 the applicant submitted a Draft Plan of Subdivision application to the Township to facilitate the development of a four (4) block industrial development on the subject lands. Supporting documents submitted with the application included:

 Planning Justification Report;  Environmental Impact Study (Natural Heritage Assessment);  Archaeological Assessment;  Functional Servicing and Preliminary Stormwater Management Report; and  Traffic Impact Study

The application was deemed complete and was subsequently circulated to relevant Township departments and external agencies for review and comments. A statutory Public Meeting was held on September 2, 2020 to receive comments from members of the Committee and the public with regards to the proposed draft plan of subdivision. A number of comments were received both from the public and Township staff/external agencies pertained to matters of servicing (water, sewage, and stormwater), potential noise impacts, use and land use compatibility, and natural heritage. In addition, a series of technical agency comments were received and provided to the applicant’s consultants following the Public Meeting. At the end of October 2020, the applicant’s consultant provided a summary (see Schedule 7) to the Township on how all of the comments (agency and public) received had been addressed either through the current draft plan of subdivision process or the required Site Plan Approval process in the future.

The purpose of this report is to consider the application made by Innovative Planning Solutions of behalf of 2639025 Ontario Inc. for a Draft Plan of Subdivision. A Location Map and Aerial Photo of the subject lands are included as Schedules 1 and 2. The proposed Draft Plan is included as Schedule 4.

This report reviews the comments made by agencies and the public with respect to the application during the public consultation process and provides recommendations to the Committee with respect to the Draft Plan of Subdivision. Staff Report DS2020-160 was originally scheduled for discussion and a decision on the draft plan conditions at the December 2, 2020 Development Services Committee meeting; but at the applicant’s request this was deferred at the applicant’s request for further review of the draft plan conditions.

Property Description

The lands subject to this application have a land area of 86.1 hectares (212.75 acres). The draft plan of subdivision application proposes 4 industrial blocks that will provide for the phased development of the entirety of the lands; these blocks range in lot area from 0.8 hectares to 37.3 hectares. The surrounded land uses include the Lake Simcoe Regional Airport to the west, agricultural uses to the north, rural industrial, a campground, and residential uses to the south, and agricultural/rural and a dog kennel use to the east.

The lands are designated “Industrial, Environmental Protection One and Environmental Protection Two Overlay” by the Township’s Official Plan. Permitted uses in the Industrial designation include “manufacturing, assembly, processing fabrication, storage and/or warehousing uses, research establishments, wholesaling establishments, portable asphalt plants, and similar uses.” The Environmental Protection designations relate to a portion of the property in the south east corner related to a significant woodland/wetland feature. The applicants are proposing a range of industrial uses in accordance with the permitted uses and Minister’s Zoning Order; although the plan of subdivision application is intended only to create the 4 industrial blocks that will be further designed/developed through the Site Plan Approval process. The Site Plan Approval is required in accordance with the Townsihp’s requirements for all commercial and industrial developments.

Analysis:

Planning Staff has reviewed the proposed Draft Plan of Subdivision in the context to relevant planning policies and legislation contained in the Township of Oro-Medonte Official Plan, County of Simcoe Official Plan, A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020), the Provincial Policy Statement (2020) and the Lake Simcoe Protection Plan, as detailed below.

Provincial Policy Statement (PPS) 2020

The Provincial Policy Statement (PPS) provides policy direction on matters of Provincial interest related to land use planning and development. The intent of the Provincial Policy Statement (PPS) is to build strong and healthy communities while at the same time promoting efficient land use and development patterns. Specifically, Section 1.1.4 – Rural Areas, Section 1.1.5 Rural Lands, and Section 2.1 – Natural Heritage are applicable to this application. This application is associated with the development of an industrial park that promotes economic development in the Township on lands that are designated for Industrial growth that would be considered to be consistent with the PPS by providing for a range of employment uses that are compatible with the rural landscape and rural service levels and the appropriate infrastructure.

The application is also consistent with the Natural Heritage policies of the PPS, as the proposed industrial development will not be located within those lands designated environmental protection, and will require approval from the Lake Simcoe Region Conservation Authority as identified in the Draft Plan Conditions and as part of the Site Plan Approval process.

A Place to Grow: Growth Plan for the Greater Golden Horseshoe (2020)

The Growth Plan for the Greater Golden Horseshoe provides a long-term plan to manage growth and protect the natural environment. Section 2.2.5 Employment is applicable to this application. This section promotes economic development through making more efficient use of existing employment areas and vacant employment lands, such as the subject lands, and providing for a variety of employment uses, such as being proposed. The application would also align with the Township Official Plan policies that designate the lands for industrial uses with the Township Strategic Plan’s Balanced Growth goal that “supports business and job creation while protecting the natural environment.”

As noted above, this section has been reviewed and Planning Staff is of the opinion that the proposed industrial plan of subdivision that would support industrial uses permitted through the existing industrial land use designation and zoning is consistent with the Employment policies in the Growth Plan.

Lake Simcoe Protection Plan

Portions of the subject lands are regulated by the Lake Simcoe Region Conservation Authority (LSRCA), are located within the Lake Simcoe watershed and are therefore subject to the policies of the Lake Simcoe Protection Plan (LSPP). The LSPP is a comprehensive plan that was issued by the Province of Ontario in 2009 in order to protect and restore the ecological health of Lake Simcoe and its watershed. As a result, the LSRCA has been consulted on this application and has provided technical comments as outlined in their September 20, 2020 submission to the Township and the applicant’s consultant. The applicant’s consultant provided responses to these technical review comments on October 30, 2020. No further response to date has been received from the LSRCA but is expected prior to the meeting. As a result, while some draft plan conditions have been incorporated (see Schedule 6), in order to ensure the application’s conformity with the LSPP and other Provincial Policies regard should be given to the inclusion of any additional comments/conditions received from the LSRCA.

As the lands will be subject to Site Plan Approval applications, the LSRCA will be required to provide additional technical review of these more detailed design submissions and Planning Act applications. The development or site alteration on the lands is also subject to obtaining the required permits under O. Reg. 179/06 and the Conservation Authorities Act from the LSRCA.

County of Simcoe Official Plan

The lands are designated Lake Simcoe Regional Airport Economic Employment District (LSRAEED) as per Schedule 5.1 of the County of Simcoe Official Plan.

Section 3.9.1 of the Plan, which includes the subject lands states “Within the Lake Simcoe Regional Airport Economic Employment District, development will be in accordance with the directive issued by the Minister of Infrastructure on September 24,

2012.” The draft plan of subdivision will facilitate the future development of these lands through Site Plan Approval and Plan of Condominium applications for each of the 4 blocks. As noted above, the subject lands have also been the subject of a Minister’s Zoning Order in 2019 that provides for additional uses beyond the Minister’s Directive.

Section 3.3.2 provides the policy framework for the Subdivision of land by plan of subdivision or consent, or plans of condominium provided it is for land uses that are permitted in the designation. The proposed plan of subdivision will create 4 industrial blocks in accordance with the employment designation and uses. Further Section 3.3.9 provides the policy framework for the required subdivision agreement that is noted in the draft plan conditions.

Based on the above, the application is considered to confirm to the County of Simcoe Official Plan.

Township of Oro-Medonte Official Plan

The subject lands are designated “Industrial, Environmental Protection One, and Environmental Protection Two” in accordance with Schedule “A – Land Use” of the Township’s Official Plan. The “Industrial” designation as outlined in Section C8 permits manufacturing, assembly, processing, fabrication, storage and/or warehousing uses and research establishments, wholesaling establishments, portable asphalt plants and similar uses by way of Plan of Subdivision on private individual wells and septic services where municipal services are not available, as proposed by this application.

The Environmental protection designations as discussed above, apply to the South East corner of Block 3 on the proposed draft plan and are not proposed to be developed.

The plan of subdivision application proposes the creation of 4 blocks for industrial development in conformity with the Township’s Official Plan.

Development on the subject lands is also subject to the policies in Section C8.5.2 Special Development Policy for West Half of Lots 18 and 19, Concession VIII (Oro) as outlined below.

C8.5.2 Special development policy for the West Half of Lots 18 and 19, Concession 8 (Oro)

Prior to the consideration of any Plan of Subdivision on the lands located in the West Half of Lots 18 and 19, Concession 8, it shall be a policy of this plan to require the landowners to prepare a Comprehensive Development Plan. The Comprehensive Development Plan shall deal with such issues as: a) the means by which sewer and water will be provided in the area with all forms of sewage disposal being considered including higher forms of servicing such as

municipal sewage treatment systems or communal systems;

b) the nature, extent and timing of improvements on the 7th Line and the impacts of development on the Highway 11, 7th Line interchange and the County roads in the area.

c) the proposed form, scale and density of industrial development

d) the means by which the area is to be accessed by roads taking into account the existing locations of entrances to the Lake Simcoe Regional Airport; and,

e) the means by which stormwater quality and quantity is to be managed on site.

The Township will consult the appropriate agencies prior to the approval of a Comprehensive Development Plan.

Section C8.5.2 requires the landowner to prepare a Comprehensive Development Plan to deal with such issues as: “the means by which sewer and water will be provided in the area with all forms of sewage disposal being considered including higher forms of servicing such as municipal sewage treatment systems or communal systems”. The reports submitted with this application noted above address this policy. Section C8.3 (Industrial – Servicing) states “Permitted uses in the Industrial designation shall generally be serviced by private water and sewage systems, as being proposed through the applicant’s Functional Service Report. The Functional Servicing Report prepared by Tatham Engineering, demonstrates that the site can be appropriately serviced through private wells and water pumping stations as needed, on site private sewage treatment and disposal (including pump stations as needed) and on site stormwater management controls to provide quality and quantity controls, to be further addressed through the site plan application process. The proposed form, scale, and density of development would be addressed more appropriately through the future site plan approval application; however wording will be contained in the draft plan conditions and subdivision agreement to ensure this is addressed at that time. From a transportation perspective, necessary road improvements and widening requirements were reviewed through the Traffic Impact Study prepared by Tatham Engineering. The Ministry of Transportation (MTO) has confirmed based on the study that no further review or permit is required from the MTO. The Townsihp’s Operations Department has confirmed the requirement for a road widening along the Line 7 frontage of the subject lands that has been included as a draft plan condition.

Township of Oro-Medonte Zoning By-law 97-95, as amended

The lands are subject to a Minister’s Zoning Order issued in November 2019 that identifies the following uses:

Public, Department and External Agency Comments

The Draft Plan of Subdivision application and the associated background studies and reports have been reviewed by various Township departments and external agencies. In response to comments received, the applicant’s consultant has provided comments (see Schedule 7). Public comments raised at the Public Meeting consisted of questions regarding the nature of the uses, noise associated with the proposed automotive track, lack of details on the proposed plan of subdivision, proposed access and servicing. As a result of the circulation comments, Township Staff prepared Conditions of Draft Plan Approval as contained in Schedule 6 to address all of the necessary requirements.

In Planning Staff’s opinion, all department, agency and public comments have been adequately addressed in order to permit this proposed development to proceed to Draft Plan Approval, with the exception of the LSRCA who have indicated comments are expected prior to the meeting.

The following is a summary of the department and agency comments that were received.

Development Engineering Division

The Manager, Development Engineering reviewed and commented on the draft plan, the functional servicing and preliminary stormwater management report, and traffic

impact study. As a result, have advised that Detailed Engineering Design will be required / forthcoming as part of the Development Approvals process (Site Plan Approval) and that individual / site specific servicing design will occur within the development to accommodate the various internal development components (Specifically the track, buildings, garages, swm, sanitary, roads, water supply and other servicing infrastructure).

Operations and Community Services Department

The Manager, Infrastructure and Capital Projects has confirmed that as a condition of draft plan approval the applicant will be require to:

1. Provide a 3.0m road widening across the entire frontage of the property; and 2. Provide Cash in lieu of parkland in accordance with the Planning Act

Additionally he has noted the Departments preference for the proposed entrances for the development to align with the existing entrances on the west side of Line 7 South on the Lake Simcoe Regional Airport lands.

Lake Simcoe Region Conservation Authority (LSRCA)

LSRCA Staff has reviewed the application and provided their comments in a letter in addition to 1st Functional Review Submissions for Planning, Hydrogeology, and Engineering dated September 20, 2020. At this time, there continue to be outstanding comments from the LSRCA in response to the follow up by the Applicant’s consultant. Conditions of Draft Plan Approval have been included, and may be required to be amended based on LSRCA further comments to ensure the LSRCA approvals are obtained through the Site Plan Approval, Plan of Condominium applications and/or a more detailed design process.

Ministry of Tourism, Culture and Sport

As part of the application process the applicant was required to complete an archaeological assessment on the subject lands and the report concluded that no archaeological remains are found on the site. Standard Draft Plan Conditions have been included with respect to Ministry of Tourism, Culture and Sport requirements and needed clearance.

Other Agencies

Standard draft plan conditions for Bell Canada, Canada Post, Powerstream, Hydro One, and Enbridge Gas haven been included in the proposed conditions. As an industrial plan of subdivision proposal, no conditions are required to address either the Simcoe Muskoka Catholic District School Board or the Simcoe County District School Board.

Conclusion:

The applicant is seeking Council’s approval of the Draft Plan of Subdivision application in support of its proposal to construct a 4 block industrial development that will be the subject of individual Site Plan Approval applications for each block. The applicant has addressed the relevant issues raised during the circulation of the applications with the exception of the LSRCA. As noted, the property will be the subject of Site Plan Approval that will include the detailed engineering design and technical review by both Township departments and external agencies prior to consideration of permits. This would be similar to a plan of condominium type process where the blocks are created for legal purposes and then subject to the Site Plan Approval process for the details development.

The submitted Draft Plan of Subdivision application is consistent with the Provincial Policy Statement, and conforms to the Growth Plan, the Lake Simcoe Protection Plan (pending LSRCA comments), the County of Simcoe Official Plan and the Township’s Official Plan. It is also Planning Staff’s opinion that the application satisfies the requirements of Section 51(24) – (Subdivision of Land) of the Planning Act. In light of the preceding, Planning Staff is of the opinion that the proposed development is appropriate and represents good planning, and it is recommended that Development Services Committee approve the Draft Plan of Subdivision application and associated draft plan conditions as outlined and described in this report.

When and How to File an Appeal

Notice to appeal the decision to the Local Planning Appeal Tribunal (LPAT) must be filed with the Township of Oro-Medonte no later than 20 days from the date of this notice as shown above as the last date of appeal.

1. 2. Prior to final approval of the Plan, the Owner shall provide the Township with evidence in the form of an Ontario Land Surveyor Certificate that:

a) Any existing buildings or structures on the lands as of the date of final approval, are situated so as to comply with applicable zoning by-laws after registration of the plan; and,

b) All lot frontages and lot areas within the plan conform to the Township of Oro-Medonte Zoning By-law.

3. That the Owner shall agree in the Subdivision Agreement that a municipal numbering system be assigned to the satisfaction of the Township of Oro- Medonte.

4. That the Owner shall enter into a subdivision agreement with the Township of Oro-Medonte, agreeing to satisfy all conditions, financial and otherwise, of the Township of Oro-Medonte.

5. That the subdivision agreement between the Owner and the Township of Oro- Medonte be registered by the Municipality against the lands to which it applies, pursuant to the provisions of the Planning Act.

6. The Owner shall agree in the Subdivision Agreement that all applicable Development Charges will be paid when the Building Permit is received in accordance with the Township’s Development Charges By-law, the County of Simcoe Development Charges By-law and Education Charges By-law subject to any applicable development charge credits and any other agreements with the Township and/or the County.

7. The Owner shall agree in the Subdivision Agreement to pay cash-in-lieu of parkland in accordance with the requirements of the Planning and/or Municipal Act to the satisfaction of Council.

8. That prior to final Plan approval, the road allowances, including daylighting triangles, included within this draft plan of subdivision shall be dedicated as public highways to the Township of Oro-Medonte without monetary consideration and free of all encumbrances.

9. The Owner shall agree in the Subdivision Agreement that if 0.3 metre reserves are required on the final Plan, they shall be conveyed to the Township of Oro- Medonte without monetary consideration and free of all encumbrances.

10. The Owner shall agree in the Subdivision Agreement that a 3.0 metre road widening along the Line 7 frontage is required to be shown on the final Plan, and shall be conveyed to the Township of Oro-Medonte without monetary consideration and free of all encumbrances.

Development Engineering

11. That the final alignment and radii of all roads be designed and constructed to the satisfaction of the Township of Oro-Medonte in accordance with the Township of Oro-Medonte’s Development Engineering Policies, Process and Design Standards. The costs of all construction will be at the expense of the Owner.

12. The Owner shall agree in the Subdivision Agreement that construction access shall be provided only in a location approved by the Township.

13. The Owner shall agree in the Subdivision Agreement that all portions of public highways (rights-of-ways) which are not to be paved and all drainage swales on public or private property shall be graded and sodded in accordance with the standards of the Township.

14. The Owner shall agree in the Subdivision Agreement to grade and seed all undeveloped lands within the plan, other than conservation lands, and to maintain, to the satisfaction of the Township, all undeveloped lands within the plan.

15. Prior to final Plan approval, the Owner shall provide adequate storm drainage outlets including any necessary drainage easements to the satisfaction of the Township of Oro-Medonte.

16. That such easements as may be required for utility or drainage purposes shall be granted to the appropriate authority.

17. That the Owner to the satisfaction of the Township of Oro-Medonte provide adequate storm drainage outlets including any necessary easements.

18. That the Owner shall agree in the Subdivision Agreement, that such easements and land dedications as may be required for access, drainage, servicing, utilities and construction purposes shall be designed to the satisfaction of, and granted to the Township of Oro-Medonte and the appropriate agencies or authorities, free and clear of all encumbrances, to the satisfaction of the Township of Oro- Medonte and all appropriate agencies or authorities. Such easements shall be dedicated to the appropriate approval authority at the Owner’s expense.

19. That prior to final Plan approval, an Environmental Compliance Approval from the Ministry of the Environment, Conservation and Parks be obtained with respect to ownership and operation of the stormwater management facilities.

20. That prior to final Plan approval, a plan or plans shall be prepared to the satisfaction of the Township Manager, Development Engineering showing: a) drainage control measures; b) general lot grading including existing and proposed elevations; c) building envelopes; d) erosion control measures; e) location and type of drinking water supply; f) location and type of sewage disposal system; f) locations of streetscape features, utilities, driveways and landscaping; g) design details for the emergency access; and g) location of all existing wells on abutting properties.

These above-noted approved plan(s) will form part of the Subdivision Agreement with the Township of Oro-Medonte.

The Owner’s Consulting Engineer may be required to check the elevations of the building footings and top of foundation, prior to further construction, to ensure conformity with the approved plans noted above.

21. The Owner shall agree in the Subdivision Agreement that the Owner’s engineer shall be required, prior to the issuance of a Final Inspection Report, to certify in writing that the installed works have been carried out in accordance with the approved plans.

22. That prior to final Plan approval, the Owner’s Consulting Engineer shall to the satisfaction of the Township Engineering Consultant, provide an Operation and Maintenance Manual for the stormwater management facility.

23. The Owner shall provide to the Township, engineering drawings for, and shall agree in the Subdivision Agreement to install in accordance with the standards and specifications of the Township of Oro-Medonte Development Engineering Policies, Process and Design Standards, storm sewer works, adequate pavement width for roadways, street lighting, regulatory signs, street name signs, municipal address signs and any other services or facilities as required.

All lands to be conveyed to the Township and all easements shall be shown on the engineering drawings.

The Owner shall obtain the approval of the Ministry of the Environment, Conservation and Parks, by way of certificate of approval, for the installation of storm sewer works.

24. That prior to final Plan approval, an Environmental Compliance Approval from the Ministry of the Environment, Conservation and Parks be obtained with respect to ownership and operation of the water facilities, if required.

25. That prior to final Plan approval, an Environmental Compliance Approval from the Ministry of the Environment, Conservation and Parks be obtained with respect to ownership and operation of the waste water facilities, if required.

26. That the Owner shall agree in the Subdivision Agreement to install, to the satisfaction of the Township of Oro-Medonte, fencing in accordance with the standards of the Township of Oro-Medonte along the limit of any Storm Water Management Facilities, if required.

27. The Owner shall agree in the Subdivision Agreement:

a) To be responsible for the proper drainage within this draft Plan of Subdivision and the effect of such drainage on all lands abutting this draft plan; b) That all lot and block grading plans shall be prepared by the Owner’s Consulting Engineer in accordance with the Township’s Development Engineering Policies, Process and Design Standards and to provide individual lot grading plans for each lot on the plan prior to the issuance of building permits;

c) That for the purpose of preparation of the overall lot and/or block grading plans and the individual lot grading plans, the Owner shall comply with the Township Zoning By-law with respect to usable yard criteria; and d) To develop the lands within the plan in accordance with the approved grading plans and individual lot grading plans.

28. Prior to any grading, stripping or servicing of the lands included within the draft plan, the Owner shall provide a detailed Stormwater Management Report. This report shall be completed to the satisfaction of the Manager, Development Engineering and shall address:

a) Stormwater management retention and conveyance methods, low impact development and end-of pipe practices to be implemented within and external to the draft plan to address water quantity, water quality and erosion control; b) The protection of groundwater quality and quantity; c) The stormwater management design, inspection, operation and maintenance procedures and associated costs; and, d) Erosion and sediment control measures to be implemented before stripping and grading of the subject lands to protect downstream watercourses and environmental features.

Lake Simcoe Region Conservation Authority (LSRCA)

29. Prior to final Plan approval, the following shall be prepared to the satisfaction of the Lake Simcoe Region Conservation Authority (LSRCA) and the Township of Oro-Medonte: a) A detailed Stormwater Management Report in accordance with Lake Simcoe Region Conservation Authority Technical Guidelines for Stormwater Management Submissions and in conformity with the Stormwater Management Master Plan approved under Strategic Action 4.5-SA of the Lake Simcoe Protection Plan; b) A detailed erosion and sediment control plan; c) A detailed grading and drainage plan; d) A Natural Heritage Evaluation; e) A Detailed Lot Impact Development (LID) Evaluation demonstrating the means to maximize the use of LID measures consistent with Policy 1.6.6.7 of the Provincial Policy Statement (2020).

30. Prior to final Plan approval, the following shall be undertaken to the satisfaction of the LSRCA in accordance with Designated Policy 6.40 of the Lake Simcoe Protection Plan and the Lake Simcoe Protection Plan Water Budget Policy for LSPP 4.8-DP and 6.40-DP: a) Detailed Hydrogeological Report / Water Balance; b) Compensatory measures if required.

31. Prior to final Plan approval, the following shall be undertaken to the satisfaction of the LSRCA in accordance with the LSRCA Phosphorus Offsetting Policy: a) Phosphorus budget; b) Compensatory measures if required.

32. Prior to final Plan approval, it shall be demonstrated to the satisfaction of the LSRCA and the Township of Oro-Medonte that all LID/SWM facilities be located within a Municipal Easement or ROW.

33. The Owner shall agree in the Subdivision Agreement to carry out, or cause to be carried out, the recommendations and requirements contained within the plans and reports as approved by the LSRCA and the Township of Oro-Medonte.

34. The Owner shall agree in the Subdivision Agreement to retain a qualified professional to certify in writing that the works were constructed in accordance with the plans and reports as approved by the LSRCA and the Township of Oro- Medonte.

35. The Owner shall agree in the Subdivision Agreement to ensure that proper erosion and sediment control measures will be in place in accordance with the approved Grading and Drainage Plan, and Erosion and Sediment Control Plan prior to any site alteration or grading.

36. The Owner shall agree in the Subdivision Agreement to grant any easements required for storm water management purposes to the Township of Oro- Medonte.

37. Prior to final Plan approval, the Owner shall pay all development fees to the LSRCA in accordance with the approved fees policy, under the Conservation Authorities Act.

38. The Owner shall agree in the Subdivision Agreement to maintain all existing vegetation up until a minimum of 30 days prior to any grading or construction on- site in accordance with 4.20b.-DP of the Lake Simcoe Protection Plan.

39. The Owner shall agree in the Subdivision Agreement to indemnify and save harmless the Township of Oro-Medonte and the LSRCA from all costs, losses, damages, judgements, claims, demands, suits, actions, or complaints resulting from any increased flooding or erosion to property and people as a result of the approved storm water management scheme. The Owner shall obtain and maintain in full force and effect general liability insurance with respect to the storm water management works and system during the period that the Owner is responsible for operating and maintaining the stormwater management works and system.

40. That the Owner agree in the Subdivision Agreement to make satisfactory arrangements for the construction of utilities including but not limited to electrical, telephone, natural gas and cable television (if available in the area).

41. That such easements as may be required for utility purposes shall be granted to the appropriate authority.

42. The Owner shall indicate in the Subdivision Agreement, in words satisfactory to Bell Canada, that it will grant to Bell Canada any easements that may be required, which may include a blanket easement, for communication/telecommunication infrastructure. In the event of any conflict with existing Bell Canada facilities or easements, the Owner shall be responsible for the relocation of such facilities or easements.

Ministry of Tourism, Culture and Sport

43. That prior to final Plan approval the Owner shall submit to the Township of Oro- Medonte an archaeological assessment to be conducted of the development site by a licensed archaeologist and adverse impacts to any significant archaeological resources found on the site be mitigated through preservation or resource removal and documentation. No demolition, grading or other soil disturbances shall take place on the subject property prior to the Ministry of Tourism, Culture and Sport confirming that all archaeological resource concerns have met licensing and resource conservation requirements. NOTE: A copy of the archaeological assessment report is to be submitted to the County of Simcoe Planning Department for information.

Clearance of Conditions

Prior to granting approval to the final Plan, the Township’s Development Services Department will require written notification from the following agencies that their respective conditions have been met satisfactorily:

 The Township of Oro-Medonte shall advise that Conditions 1-43 inclusive have been satisfied.

 The Lake Simcoe Region Conservation Authority shall advise that Conditions 29- 39 inclusive have been satisfied.

 Bell Canada shall advise how Condition 42 has been satisfied.

 The Ministry of the Environment, Conservation and Parks shall advise how Conditions 23-25 has been satisfied.

 The Ministry of Tourism, Culture and Sport shall advise how Condition 43 has been satisfied.

Notes to Draft Plan Approval

1. It is the applicant's responsibility to fulfill the conditions of Council's approval and to ensure that the required clearance letters are forwarded by the appropriate agencies to the Township of Oro-Medonte, Development Services Department, 148 Line 7 South, Oro-Medonte, ON L0L 2E0, quoting Township file number 2020-SUB-01.

2. Land Required to be Registered Under the Land Titles Act: (a) Section 160(1) of The Land Titles Act, which requires all new plans be registered in land titles systems; (b) Section 160(2) – allows certain exceptions.

3. Stormwater System: Inauguration or extensions of a storm drainage system or a stormwater management system is subject to approval of the Ministry of the Environment, Conservation and Parks (Approvals Branch) pursuant to The Environmental Protection Act, R.S.O. 1990.

4. The Township of Oro-Medonte uses a 0.3 metre reserve to notify the public that access to the Municipal highway will not be granted across the reserve. It should be shown as a block on the final Plan outside the road allowance. Deeds in triplicate conveying this reserve to the Corporation of the Township of Oro- Medonte together with the proposed final Plan should be sent to the municipal Clerk.

5. Hydro One wishes to advise the developer of the following: a) The costs of any relocations or revisions to Hydro One facilities which are necessary to accommodate this subdivision will be borne by the developer b) Any easement rights of Hydro One are to be respected. c) The developer should contact the local Hydro One Area Office to verify if any low voltage distribution lines may be affected by the proposal.

6. Bell Canada wishes to advise the developer of the following: a) The developer shall contact Bell Canada during detailed design to confirm the provision of communication/telecommunication infrastructure needed to service the development. b) Prior to commencing any work, the developer must confirm that sufficient wire-line communication/telecommunication infrastructure is available. In the event that such infrastructure is unavailable, the developer shall be required to pay for the connection to and/or extension of the existing communication/telecommunication infrastructure. c) If the developer elects not to pay for the above noted connection, then the developer will be required to demonstrate to the satisfaction of the Municipality that sufficient alternative communication/telecommunication will be provided to enable, at a minimum, the effective delivery of

communication/telecommunication services for emergency management services (i.e., 911 Emergency Services).

7. Enbridge Gas Distribution wishes to advise the developer of the following: a) The developer shall contact Enbridge Gas Distribution’s Customer Connections department by emailing [email protected] for service and meter installation details and to ensure all gas piping is installed prior to the commencement of site landscaping (including, but not limited to: tree planting, silva cells, and/or soil trenches) and/or asphalt paving. b) If the gas main needs to be relocated as a result of changes in the alignment or grade of the future road allowances or for temporary gas pipe installations pertaining to phase construction, all costs are the responsibility of the developer. c) In the event that easement(s) are required to service this development, the developer will provide the easement(s) to Enbridge Gas Distribution at no cost. d) The developer will grade all road allowances to as final elevation as possible, provide necessary field survey information and all approved municipal road cross sections, identifying all utility locations prior to the installation of the gas piping.

8. Lake Simcoe Region Conservation Authority (LSRCA) wishes to advise the developer of the following: a) The owner shall agree, prior to final plan approval, to pay all development fees to the LSRC as required in accordance with the LSRCA’s fees policy, under the Conservation Authorities Act.

9. To obtain verification that the agency conditions are fulfilled, the Township of Oro- Medonte shall provide the following agencies with a copy of the Subdivision Agreement to be executed, a copy of the draft M-Plan:

a) Lake Simcoe Region Conservation Authority b) Ministry of the Environment Conservation, and Parks c) Canada Post

10. To obtain verification that the agency conditions are fulfilled, the Owner shall provide each agency a letter detailing how the agency’s conditions of draft plan approval have been fulfilled.

11. The final Plan approved by the Township of Oro-Medonte must be registered within 30 days or the Township may withdraw the approval under Section 51(59) of the Planning Act, R.S.O. 1990

12. All measurements in the subdivision final Plan must be presented in metric units.

This approval may be extended pursuant to subsection 51(33) of the Planning Act, but no extension can be granted once the approval has lapsed. 16. Draft approval shall automatically and irrevocably lapse if final Plan approval is not given to this plan within three (3) years of the approval date and no extensions have been granted. If the Owner wishes to request an extension to the draft approval period, a written explanation shall be submitted to the Township of Oro-Medonte at least ninety (90) days prior to the lapsing with reasons why the extension is required. A resolution from Township Council must also be obtained prior to the lapsing date.

Subject to the conditions set forth above, this Draft Plan is approved under Section 51 of the Planning Act R.S.O. 1990, Chapter 13, as amended.

V. Presentations a) Stormwater Optimization Study Update General Manager, Integrated Watershed Management, Ben Longstaff, along with a Tracy Patterson, a consultant with Freeman Associates, provided an update on the Stormwater Optimization Study, also known as the Equitable Responsibility for Transformational Design: Optimization of stormwater management within the East Holland River watershed. This study was formed in response to growing challenges in stormwater management. The East Holland River was selected as the pilot watershed to test the hypothesis that improved environmental outcomes can be realized at lower capital and operating costs via a systemic, watershed-based approach to stormwater management planning that includes siting centralized and distributed infrastructure on both publicly-owned and privately-owned properties. Funded by Federal grants, watershed municipalities, Lake Simcoe Conservation Foundation, and Sustainable Technology Evaluation Program partners, the study began in 2018. Project stages included: (1) formation of advisory committee and model selection; (2) watershed characterization and data compilation; (3) current state model development and calibration; (4) future state model development and screening; (5) future state simulations to test study principles; (5) reporting and communications.

The study was able to demonstrate that (i) optimization modeling will lead to more cost effective SWM strategies; (ii) most cost effective SWM strategies are achieved when private and public lands are considered; and (iii) most cost-effective strategies are achieved when stormwater is planned and managed at a watershed rather than jurisdictional scale. In addition, immediate opportunities to improve stormwater planning and management within the East Holland River were identified. Technical and non-technical study reports are currently being finalized and will be available in early December. These reports will outline the study methodology, study findings and will make a series of recommendations. Carried b) Response to Bill 229 Chief Administrative Officer, Mike Walters, provided an overview of the changes to the Conservation Authorities Act and the Planning Act as outlined in the Provincial Bill 229, Protect, Support and Recover from COVID-19 (Budget Measures), 2020. In 2018, the Province began a review of Conservation Authority operations, following which Bill 108, More Homes, More Choice Act was introduced, and Schedule 2 specifically amending the Conservation Authorities Act with the following three key goals in mind: to improve consistency and transparency of the programs and services that conservation authorities deliver; to provide additional oversight for

Board of Directors’ Meeting BOD-13-20 November 27, 2020 Page 4 municipalities and the province; and to streamline conservation permitting and land use planning reviews to increase accountability, consistency, and transparency. Conservation authorities have demonstrated willingness to work with the Province and have since been working to meet these expectations by: adopting consistent By-Laws by December 2018; implementing best management practices regarding governance and administration; voluntarily reducing timelines for issuance of permits based on the previous Conservation Authority Liaison Committee requirements; initiating client centric service training and monitoring protocols to document improvements in service delivery, and attending a series of consultation sessions with the Minster and provincial staff. Additionally, Conservation Ontario, on behalf of all 36 conservation authorities, has been consistently trying to engage the Province to clarify their concerns and discuss a path forward for conservation authorities to work collectively to achieve the Province’s desired outcomes. Unfortunately, the amendments introduced in Schedule 6 of Bill 229 show no regard for these efforts, do not reflect the discussions during consultations, and would seem ill conceived containing several unintended consequences which either conflict with other existing pieces of legislation and/or are counterproductive to their stated objectives. In fact, none of the recommendations put forth by conservation authorities have been considered in the amendments, including long awaited tools to assist with permitting and enforcement. Simply put, the changes will not achieve the objectives of the Province, objectives that all 36 Conservation Authorities share. Rather, many are potentially contrary leading to increased red tape, additional costs to taxpayers, and placing Ontario’s residents and environment at risk. The proposed changes significantly diminish our ability to protect Ontario’s environment and ensure people and property are safe from natural hazards by not being able to apply watershed-based decisions on new development. Additionally, the unintended consequences associated with amendments to permitting will ultimately create more red tape, delays, disruption, and costs which would need to be borne by the taxpayer. The outcomes are contrary to the Province’s goals and plans for economic recovery as is the decision to repeal enforcement tools previously considered. Without these tools our Authority cannot meet the intent of the Conservation Authorities Act and effectively enforce Section 28 of Ontario Regulation 179/06. Inadvertently the result is that violators will benefit from our limited ability resulting in further environmental degradation and risk to people and property. Finally, the significant changes to governance involving the ‘Duty to Members’ section of the Conservation Authorities Act that would have municipal representatives on conservation authority Boards act in the interests of their own municipality rather than the conservation authority’s interests is fundamentally flawed.

Other Business a) Pefferlaw Dam Mayor Quirk advised of a motion passed earlier in the week by the Township of Georgina requesting the Province to provide clarity around the ownership of the Pefferlaw Dam. Chair Emmerson noted that he would like to see a staff report before year-end with a decision on this matter as he is not sure the Province will assist. General Manager, Conservation Lands, Brian Kemp, advised that staff continue to stay on top of this file and remain hopeful that we will find something more definitive. He referenced a package recently received from Ms. Karen Wolfe, which is consistent with information the Authority already has. He has had some dialog with the Ministry of Natural Resources and Forestry and will continue to follow up with them. He also noted he was hosting a site visit to Scanlon Creek Conservation Area with some Town of Georgina staff and Council to share some restoration results that can be achieved when dealing with structures such as the Pefferlaw Dam. a) Upper York Sewage System Chair Emmerson advised that after many years of planning and dealing with several different Ministers of the Environment, York Region has spent over $100M on a state-of-the-art facility and has recently been advised by the Minister that there will be no further discussion regarding the Upper York Sewage System going to Lake Simcoe but rather it will be redirected to Lake Ontario. Andrea Matrosovs WHEREAS: the Province has introduced Bill 229, Protect, Support and Recover from COVID 19 Act - Schedule 6 – Conservation Authorities Act; and WHEREAS: the Legislation introduces several changes and new sections that could remove and/or significantly hinder conservation authorities’ role in regulating development, permit appeal process and engaging in review and appeal of planning applications; and WHEREAS: we rely on the watershed expertise provided by local conservation authorities to protect residents, property, and local natural resources on a watershed basis by regulating development and engaging in reviews of applications submitted under the Planning Act; and WHEREAS: the changes allow the Minister to make decisions without conservation authority watershed data and expertise; and WHEREAS: the Legislation suggests that the Minister will have the ability to establish standards and requirements for non-mandatory programs which are negotiated between the conservation authorities and municipalities to meet local watershed needs; WHEREAS: municipalities require a longer transition time to put in place agreements with conservation authorities for non-mandatory programs; and WHEREAS: municipalities believe that the appointment of municipal representatives on conservation authority boards should be a municipal decision; and the Chair and Vice Chair of the conservation authority boards should be duly elected; and WHEREAS: the changes to the ‘Duty of Members’ contradicts the fiduciary duty of a conservation authority board member to represent the best interests of the conservation authority and its responsibility to the watershed; WHEREAS: conservation authorities have already been working with the Province, development sector and municipalities to streamline and speed up permitting and planning approvals through Conservation Ontario’s Client Service and Streamlining Initiative;

WHEREAS: changes to the legislation will create more red tape and costs for the conservation authorities, their municipal partners, and potentially result in delays in the development approval process; AND WHEREAS: municipalities value and rely on the natural habitats and water resources within conservation authority jurisdictions for the health and well-being of residents; municipalities value conservation authorities’ work to prevent and manage the impacts of flooding and other natural hazards; and municipalities value conservation authorities’ work to ensure safe drinking water;

NOW THEREFORE, BE IT RESOLVED:

Ontario is committed to protecting and restoring Ontario’s water resources, including Lake Simcoe and its watershed.

Since 2009, the province’s actions to protect and restore Lake Simcoe have been guided by the Lake Simcoe Protection Plan, which focuses on the lake’s water quality, reducing pollutants such as phosphorus, caring for natural heritage, and addressing the impacts of invasive species and other emerging threats.

In July, the Minister released the 10-year report on Lake Simcoe, which highlighted some of the progress made to protect and restore the lake. This includes overall improvements in lake health, such as improved dissolved oxygen in the deep waters of the lake, which is key for a healthy cold- water fish population.

As part of our commitment to improve and protect the health of Lake Simcoe and its watershed, we recently announced $581,000 in new funding to support four new projects to help find better ways to reduce the amount of pollutants, such as phosphorus, from entering Lake Simcoe. Local projects on water quality monitoring and research, such as those led by the Lake Simcoe Region Conservation Authority, will enhance our knowledge and understanding of new science and information. These types of projects help us adapt our policies and programs to continue to restore and protect Lake Simcoe and its watershed.

As a legislated stakeholder, you also play a key role in implementing the plan. As we launch our 10- year review of the Lake Simcoe Protection Plan, we will be inviting you to share your thoughts about the plan policies. There are several opportunities to participate in the review, including:  Requesting a ministry presentation at one of your upcoming meetings  Requesting a meeting with ministry staff  Sending a written submission to [email protected]

There will also be several ways for municipalities to take part in the plan’s review over the next few months. The details are still being finalized, and we will share them with you shortly. 10. Request for an Interim Cap on Gas Plant and Greenhouse Gas Pollution and the Development and Implementation of a Plan to Phase-Out Gas-Fired Electricity Generation (Item 10.2)

WHEREAS, the Government of Ontario is planning to increase reliance on gas- fired electricity generation from Ontario’s gas-fired power plants, which is anticipated to increase greenhouse gas (GHG) pollution by more than 300% by 2025 and by more than 400% by 2040;

WHEREAS, Canada’s temperature is rising more than double the rate of the rest of the world (which is in alignment with climate models and projections impacting northern climates most significantly);

WHEREAS, the Province of Ontario will adversely impact more than a third of the greenhouse gas reductions it achieved by phasing-out its dirty coal-fired power plants, due to a power plan built around ramping up gas-fired generation to replace the output of the Pickering Nuclear Station (scheduled to close in 2024);

WHEREAS, alternative options are available to reversing short sighted cuts to energy efficiency programs and stop under-investing in this quick to deploy and low-cost resource, which include maximizing our energy efficiency efforts by paying up to the same price per kilowatt-hour (kWh) for energy efficiency measures as we are currently paying for power from nuclear plants (e.g., up to 9.5 cents per kWh);

WHEREAS, the Province of Ontario should continue to support renewable energy projects that have costs that are below what we are paying for nuclear power and work with communities to make the most of these economic opportunities;

WHEREAS, the Province of Ontario has alternative options to increasing gas- fired electricity generation, such as the Province of Quebec’s offer to receive low- cost 24/7 power from its water powered reservoir system as a possible alternative; Page 114 of 147 14.e) Correspondence dated December 5, 2020 from City of Hamilton re: Re... WHEREAS, our staff have noted this problem in their report on Updated Timelines and SMART Corporate Goals and Areas of Focus for Climate Mitigation and Adaptation where they warn that “Unless the Province of Ontario changes direction on Ontario’s fuel supply mix, it is expected natural gas, and therefore GHG emissions, may continue to increase as the nuclear facilities are refurbished and the Province of Ontario further supplements the electricity grid with natural gas inputs”;

THEREFORE, BE IT RESOLVED:

(a) That the City of Hamilton request the Government of Ontario to place an interim cap of 2.5 mega tonnes per year on our gas plant and greenhouse gas pollution and develop and implement a plan to phase-out all gas-fired electricity generation by 2030 to ensure that Ontario meets its climate targets; and,

(b) That a copy of this resolution be sent to the Premier of Ontario, to the local MPP’s, to the Region of Waterloo and local area municipalities.

Therefore, there City of Hamilton respectfully requests your consideration of this matter and looks forward to your response.

Dear Municipal Stakeholder,

I am pleased to announce that effective January 1, 2021, the province has expanded the on-road opportunities for off-road vehicle riders in some parts of Ontario. Off-road vehicle riders are expected to experience enhanced trail access resulting from the increased on-road connections to Ontario’s off-road vehicle trail network. The changes apply only to municipalities listed in Ontario Regulation 8/03 and amend the way permitted off-road vehicles are allowed on-road access to municipal highways.

In municipalities listed in Ontario Regulation 8/03, permitted off-road vehicles will be allowed by default on municipal highways unless the municipality has an existing by-law that restricts their use or creates a new by-law to prohibit or restrict the use of some or all off-road vehicles. These new provisions replace the previous requirement that municipalities had to enact a by-law to permit off-road vehicles to operate on municipal highways. The updated regulations can be found at Ontario Regulation 316/03, and Ontario Regulation 863.

It is important to note that the on-road access rules for off-road vehicles in municipalities that are not listed in Ontario Regulation 8/03 will continue to be subject to the existing regulatory framework under Ontario Regulation 316/03 and these municipalities are not affected by this change.

The equipment configuration and performance requirements for off-road vehicles as set out in Section 10 of Ontario Regulation 316/03 also remain unchanged. The Highway Traffic Act prohibition of drivers of any motor vehicles causing the vehicle to make unnecessary noise, for example through modification, also applies and violations are subject to fines.

In order to support municipalities with these changes, the ministry has provided a Municipal Guidance Document (attached) to help municipalities decide whether they need to take action to revoke, update or pass new by-laws related to on-road access by off-road vehicles on the highways under their jurisdiction.

I ask you to kindly forward this notice and the attached Municipal Guidance Document to municipal staff responsible for traffic safety and those responsible for enforcing off- road vehicle laws in your area. Although changes have been previously announced on the Ontario Newsroom site and there will be a communication in the backgrounder issued by the Premier’s Office, municipalities should ensure that the public and off-road vehicle riders are made aware of the rules in their area.

Municipal Guidance Document Operation of Off-road Vehicles on Municipal Roadways January 1, 2021

Effective January 1, 2021, the Ministry of Transportation (MTO) is changing the way the province manages how off- road vehicles (ORVs) are allowed on-road in some municipalities.

The use of ORVs on highways is controlled under Section 191.8 of the Highway Traffic Act (HTA), Ontario Regulation 316/03 made under the HTA, and municipal by-laws passed in accordance with the legislation and regulations. Currently, ORVs that meet the requirements in Ontario Regulation 316/03 are allowed on some provincial highways and municipal highways where a municipality has passed a by-law allowing the use of such ORVs on highways under their jurisdiction.

WHAT’S NEW?

Effective January 1, 2021, all ORVs that meet the requirements in Ontario Regulation 316/03 for ORVs permitted on- road, will be allowed by default on municipal highways under the jurisdiction of municipalities listed in Ontario Regulation 8/03 unless the municipality has a by-law prohibiting or restricting the use of some or all such ORVs.

Municipalities that are not listed in Ontario Regulation 8/03 will continue to be subject to the existing regulatory framework and are not affected by this change. In these municipalities, ORVs will continue to be allowed only if the municipality has passed a by-law to allow permitted ORVs on municipal highways under their jurisdiction.

Where a local municipality affected by the change has an existing by-law providing a blanket permission for ORVs on all municipal highways, the by-law would not be in conflict with the new regulations. If an existing by-law only permits some ORVs or restricts ORVs to only some highways, the municipality may have to revoke the by-law and pass a new by-law as outlined above if the municipality wishes to continue such restrictions.

There is no change to the enforcement of laws related to the use of ORVs. Any issues with the day-to-day operations of police services and the actions of police officers related to ORVs should be raised with the local chief of police or their designated representatives. Off-road Vehicles Allowed On-road

Effective July 1, 2020, MTO made changes to add off-road motorcycles (ORM) and extreme terrain vehicles (XTV) to the existing list of ORVs permitted on-road. These two new ORV types are in addition to the currently permitted 4- wheeled ORV types.

ORV is a general term used to capture several different vehicles designed for off-road use, however, only certain off-road vehicles that meet the requirements in Ontario Regulation 316/03 are permitted on-road:

All-Terrain “A “single-rider” all-terrain vehicle (ATV) is designed to travel on four tires, having a seat designed to be straddled by the operator, handlebars Vehicles for steering control and it must be designed by the manufacturer to carry a driver only and no passengers.

A two-up ATV is designed and intended for use by an operator or an operator and a passenger. It is equipped with straddle-style seating and designed to carry only one passenger.

Side-by-Sides A recreational off-highway vehicle (ROV) has two abreast seats, typically built with a hood, and uses a steering wheel instead of a motorcycle steering handlebar.

A utility terrain vehicle (UTV) has similar characteristics to an ROV but typically also features a box bed. UTVs are generally designed for utility rather than for recreational purposes.

New Off-Road Extreme Terrain Vehicles (XTVs), commonly referred to as Argos are 6+ wheeled off-road vehicles capable of riding in multiple terrains, including Vehicle Types through water. These vehicles sometimes come with tracks, however, tracked versions are not being permitted on road and are restricted to off-road use only.

Off-Road Motorcycles (ORMs) are 2 wheeled off-road vehicles that come in varying configurations such as, but not limited to: Recreational

Good Day Donna,

First and most important, Stew Garner and myself Thank the Township of Oro-Medonte staff for having patience and guiding us through this process.

We have both fallen in love with this neighbourhood! I maintained, prepared and sold a client's home on Basswood Circle, for a duration that totalled a year. Stew had also lived in the neighbourhood for a short period of time. We both share passion for the outdoors; we biked the Oro Rail trails and walked down to the lake, close access to Horseshoe Valley and close proximity to Eastview Secondary school for our 3 children.

Stew's grandparents lived at 1 Bay St. for over 50 years; They rented the home which was owned by St. Thomas Church (The Church Society of the Diocese of Toronto). His childhood memories of Shanty Bay are his biggest emotional draws to be back to the community.

I personally have majority of my clients in the Oro-Medonte area, as a Realtor I am also drawn to the beauty and charm! We are merging our families, my two children aged 11 and 12, and Stew's 12 year old; We have both been restructuring coming from separations and are main and sole focus to assure the children have a happy home in a warm community in the school district of choice and the freedom of outdoor activities.

We have been searching for a home to suit us and we are really struggling. So our sincere requests to you, the Councillors of Oro-Medonte and the Township, is the lot known as 46 Red Oak Crescent in Shanty Bay, be converted to a zoning that permits a residential home to be built on the property. We, of course, would like the opportunity to purchase the land, but understand there is a process involved.

We have our fingers crossed!

A By-law to Name, Establish and Assume Highways Within the Township of Oro-Medonte

(1 Foot Reserve, Merrington Avenue, being Block 35, Plan 51M-947, PIN 58530-0384 (LT))

Whereas the Municipal Act, 2001, Section 31, permits the council of every municipality to pass by-laws for establishing and laying out highways;

And Whereas the Corporation of the Township of Oro-Medonte is the owner of a one-foot reserve which is described as Block 25, Plan 51M-947, Township of Oro- Medonte;

And Whereas said one-foot reserve separates portions of Merrington Avenue, which has been assumed as a public highway, from abutting private lands;

And Whereas it is now deemed expedient to establish designate Block 35 Plan 51M-947, Township of Oro-Medonte for use as a public highway;

Now Therefore, the Council of the Township of Oro-Medonte hereby enacts as follows:

1. That Block 35, Plan 51M-947 is hereby names, established and assumed for use as a public highway for the Corporation of the Township of Oro-Medonte.

2. That this by-law shall come into force and take effect on the final passing thereof.

A By-law to Amend By-law 2017-165 being to a By-law to Govern the Proceedings of Council and Committees/Technical Support Groups of Council in the Township of Oro-Medonte (Procedural By-law)

Whereas Section 238(2) of the Municipal Act, 2001, S.O. 2001, c.25, as amended states that every municipality and local board shall pass a procedure by-law for governing the calling, place and proceedings of meetings.

And Whereas Section 238(2.1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended states that the procedure by-law shall provide for public notice of meetings.

And Whereas the Township of Oro-Medonte By-law No. 2017-165, being a by-law to govern the proceedings of Council and Committees/Technical Support Groups of Council in the Township of Oro-Medonte was passed under the authority of the Municipal Act, 2001, S.O. 2001, c.25, Section 238(2).

And Whereas the Council of the Corporation of the Township of Oro-Medonte deems it expedient to amend By-law No. 2017-165, as amended, so that Council may reflect the current practices, procedures and statutory requirements of Council and Committees/ Technical Support Groups of Council as per Motion No. C201216-18.

Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows:

1. That Schedule “A” to By-law 2017-165 be amended as follows:

(i) Section 2, Notice of Meeting That Section 2 a) be replaced with the following:

a) The Clerk or designate shall ensure that the Agenda, for each regular meeting of Council and/or Committee, shall be distributed to Council up to one day prior to, but no later than noon on the last business day prior to its release to the public via the Township website by end of the last business day of the week prior to the meeting. The posting of the Agenda on the Township website shall constitute public notice of the meeting.

(ii) Section 4.3 Attendance That Section 4.3.2 be amended to replace “In accordance with this by-law”, with “In accordance with the criteria set out in 4.3.1 above”.

(iii) Section 13.1 Council Agenda That Section 13.1a) be deleted in its entirety and applicable items be renumbered accordingly.

(iv) Section 13.1 Council Agenda That Section 13.1h) be amended to add “Announcements” and applicable items be renumbered accordingly.

(v) Identification from the Public of an Agenda Item of Interest That Section 13.1h) #9 and Section 14.9 be deleted in their entirety to be reinstated in the order of the agenda once Council resumes in person meetings.

Land Acknowledgement

The Township of Oro-Medonte acknowledges that we are situated on the traditional land of the Anishnaabek (A- nish- in- aa- beh) people, and ancestral territory of the Huron-Wendat. The Anishnaabek include the Odawa [Oh-DAH-wah], Ojibwe [O-jib-we] and Pottawatomi [boh-tah-WAH- toh-mee] nations, collectively known as the Three Fires Confederacy. It continues today as the home for diverse Indigenous Peoples including the historic Métis Community in .

The Anishnaabek people continue to have an enduring relationship with this land, specifically the Chippewas of Rama First Nation, the Chippewa Tri- Council and the Williams Treaties . The Huron-Wendat Nation also continues to pay respect and protect their ancestors and heritage on this land. We honour the Indigenous history and culture that has thrived for millennia in this territory and the Treaties that bind us together as partners in the spirit of a shared sustainable and prosperous future. We are all Treaty People. Our commitment begins with acknowledging the Truth so that we can move forward together towards Reconciliation.

(vii) Section 14.13 Announcements That an additional Section 14.13 be added as follows and applicable items be renumbered accordingly:

The Chair may call on members to state items related to events that are taking place within their ward/municipality, i.e., community events and/or Mayor events i.e. golf tournament, etc. The member of Council may state the event noting date/time. A By-law to a By-law to provide for the restricting and regulating of traffic and parking on highways or parts of highways under the jurisdiction of The Corporation of The Township of Oro-Medonte, and to repeal By-law Nos. 2012- 168, 2012-181, 2013-193, 2014-008, 2014-136, 2015-074, 2015-121, 2015-170, 2015- 208, 2016-002, 2017-007, 2020-068, 2020-076, 2020-077, 2020-090 and 2020-091 or any other applicable by-law enacted to regulate Parking and Traffic.

(Parking and Traffic By-law)

Whereas Section 11 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, states a lower-tier municipality and an upper-tier municipality may pass by-laws respecting matters within the following spheres of jurisdiction: highways including parking and traffic on highways.

And Whereas the whole sphere of highways, including parking and traffic on highways is assigned to all upper tier municipalities non- exclusively; And Whereas Section 27(1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality may pass By-laws in respect to highways over which it has jurisdiction; And Whereas the part of the parking sphere of jurisdiction relates to municipal parking lots and structures; And Whereas Section 100 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows for the regulating or prohibiting the parking or leaving of motor vehicles on private property without the consent of the owner; And Whereas Section 102 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows for the establishment of a system of disabled parking;

And Whereas Sections 63(1), 101(1) and 102(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows for the removal and impounding or retraining and immobilization of objects or vehicles placed, stopped, standing or parking on a highway in contravention of a municipal By-law. And Whereas Section 425 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows for a municipality to pass By-laws providing that a person who contravenes a Bylaw of the municipality passed under the Municipal Act is guilty of an offence; And Whereas Section 35 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows that, a municipality may restrict the common law right of passage by the public over a highway; And Whereas Section 432 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, allows that, a municipality may establish a procedure for the voluntary payment of penalties for By-laws related to the parking, standing or stopping of vehicles.

Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows:

1. That Appendix “A” and Schedules “A”, “B”, “C”, “D” and “E” attached hereto form part of this By-law

2. This by-law shall be cited as “The Township of Oro-Medonte Parking and Traffic By-law.”

to By-law No. 2021-005 for The Corporation of the Township of Oro-Medonte

1. Definitions

For the purpose of this By-law; "Accessible Person Parking Space" means a designated parking space or parking area under this By-law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of the Highway Traffic Act, 1990, and the regulations there under and this By-law;

"Accessible Person Parking Permit" means an accessible person parking permit issued under the Highway Traffic Act, 1990, and is currently valid, or a permit, number plate or other marker or device issued by another jurisdiction and is currently valid and recognized under the Highway Traffic Act, 1990, and the regulations there under;

"Authorized Sign" means a sign or other device placed or erected on a highway or elsewhere pursuant to the provisions of this By-law or approved by the Ministry of Transportation of Ontario for the purpose of regulating, warning or guiding traffic;

"Boulevard" means all parts of the highway save and except any roadway, shoulder or sidewalk;

"Outer Boulevard" means that part of the highway lying between any sidewalk and the edge of the shoulder furthest from the roadway, or where a shoulder does not exist from the edge of the roadway; "Inner Boulevard" means that part of the highway lying between the property line and the edge of the sidewalk nearest to the property line and where there is no sidewalk, it means that part of the highway lying between the property line and the edge of the shoulder furthest from the roadway or where a shoulder does not exist from the edge of the roadway, shoulder, where such exists, furthest from the travelled portion of the road; "Commercial Motor Vehicle" means any motor vehicle having permanently attached thereto a truck or delivery body licensed as such by the Ministry of Transportation and without limiting the generality of the foregoing, includes ambulance, hearses, casket wagons, fire apparatus, police patrols, motor buses and tractors used for hauling purposes on the highways; "Corner" means the point of intersection of curbs or edges of the portion of the highway used for vehicular traffic;

"Corporation" means The Corporation of The Township of Oro- Medonte; "Curb" shall include the edge of the roadway and gutters;

"Council" means the Council of The Corporation of The Township of Oro- Medonte; "Driver" means a person who drives or is in actual physical control of a vehicle;

"Driveway" means improved land on a highway which provides vehicular access from the roadway to a laneway or a parking area on adjacent land; "Fire Route" means any roadway, driveway, lane, ramp or other means of vehicular access to or egress from, around or from a building, or property when the fire access route is: (a) located on private property; and, (b) not less than 4.5 m. wide; and,

(c) posted with required signs, and shall include any part of a parking area set aside by visible markings or markers for the purpose of vehicular movement and that has been designated by the Fire Department for the Municipality to be a fire access route;

"Highway" includes a common and public highway, street, avenue, parkway, square, place, bridge, viaduct or trestle, designed and intended for, or used by the general public for the passage of vehicles, including unopened and unassumed highways;

"Intersection" means the area embraced within the prolongation or connection of the lateral curblines, or, if none, then the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other;

"Leave or Left When Prohibited" means the parking of a motor vehicle: 1.17.1 in excess of any time limit so posted; or

1.17.2 where a time limit is not posted in excess of two hours; or,

1.17.3 for any use other than the normal use intended for the property.

"Local Board" means a local board within the meaning of the Ontario Municipal Board Act, R.S.O. 1990, c. 0.28;

"Motorized Snow Vehicle" means a self-propelled vehicle designed to be driven primarily on snow; "Municipal Property" means all property owned or occupied by The Township of Oro-Medonte or any local board thereof except municipal roads controlled under the Highway Traffic Act or a municipal traffic control By-law;

"Municipality" means The Corporation of The Township of Oro-Medonte;

"Municipal Law Enforcement Officer" means a person duly appointed by the Corporation for enforcing the provisions of this By-law;

“Occupant” when used in relation to property means:

(a) The tenant of the property or part thereof whose consent shall extend only to the control of the land of which he/she is tenant and any parking spaces allotted to him under his lease or tenancy agreement;

(b) the spouse of a tenant;

(c) a person or The Corporation of the Township of Oro-Medonte, or a local board thereof, having an interest in the property under an assessment or right of way granted to or expropriated by the person, the Corporation or local board whose consent shall extend only to part of the property that is subject to the easement or right of way; or

(d) a person authorized by an occupant as defined above in paragraph (a) or (b), to act on the owner’s behalf for requesting the enforcement of this by-law.

"Owner" when used in relation to property means:

(a) the registered owner of the property;

(b) the spouse of a person described in (a);

(c) a person authorized by the property owner as defined above in paragraph (a) or (b), to act on the owner’s behalf for requesting the enforcement of this By-law;

"Park" or "Parking", when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; "Parking Space" means that part of the surface of a roadway designated for the purpose of parking a vehicle; "Person" means any human being, firm, association, partnership, private club, incorporated company, corporation, tenants in common, joint tenants, agent or trustee and the heirs, executors or other legal representatives of a person to

Page 131 of 147 17.c) 2021-005: A By-law to a By-law to provide for the restricting and ... whom the context can apply according to law and for the purpose of this By- law includes the owner or driver of a vehicle; "Police Officer" means a member of the Police Force or a person authorized to regulate, direct or enforce the provisions of this By-law and the Highway Traffic Act. "Private Roadway" means a roadway or laneway on private property; "Roadway" that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively;

"Service Vehicle" means any municipal vehicle, including emergency vehicles;

"Shoulder" means that part of the highway immediately adjacent to the roadway;

"Sidewalk/Footpaths" means that portion of a highway as is set aside by The Corporation of The Township of Oro-Medonte for the use of pedestrians; "Special Event" means those events approved by Council; "Stand" or "Standing" when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers; "Stop" or "Stopping", when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or of a traffic control sign or signal; "Township" means The Corporation of The Township of Oro-Medonte;

"Trailer" means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn;

"Traffic Control Device" means any sign, or roadway, curb or sidewalk marking, or other device erected or placed under the authority of The Corporation of The Township of Oro-Medonte for the purpose of guiding or directing traffic;

"Vehicle" includes a motor vehicle, trailer, commercial motor vehicle, an automobile, motorcycle, motor assisted bicycle, a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry road building machine and any other vehicle propelled or driven otherwise than by muscular power.

2. General Regulations 2.1 Where any expression of time occurs or where any hour or other period of time is stated, the time referred to shall be eastern standard time, provided however, if what is known as "" has been generally adopted in the Regional Area for any period of the year, under any statute, order-in-council, By-law, resolution or proclamation, whether the same is effective in law or not, such time shall be the time referred to during such period in any reference to time in this Bylaw. 2.2 The Director of Operation and Community Services, or his/her designate, for The Township, shall have the authority to place or erect and to maintain such authorized signs as are required to give effect to the provisions of this By- law;

2.3 The Director of Operation and Community Services or his/her designate, of The Township is hereby authorized to place or erect and to maintain temporary "No Parking" signs and "No Stopping" signs on any highway; 2.4 Schedules to this By-law shall form part of this By-law and each entry in a column of such a Schedule shall be read in conjunction with the entry or entries across there from and not otherwise;

2.7 "Shall" shall be construed as imperative.

4.0 Distances 3.1 Where a distance is used in this By-law as part of a prohibition of parking or stopping within a specified distance of an object, structure, land or part of a highway, such distance shall be measured: 3.1.1 from the projection of the nearest curb line or edge of the roadway in the direction stated unless it is specifically stated otherwise; or

3.1.2 along the curb or edge of the roadway from a point in such curb or edge of roadway opposite such object, structure, land or part of a highway, unless the context otherwise requires, or; 3.1.3 from such object, structure, land, or part of a highway in all directions.

3.2 All distances/dimensions are measured in the metric measurement unless otherwise stated.

4.0 Exemptions Impractical 4.1 This By-law applies only to highways forming part of the road system under the jurisdiction of the municipality. 4.2 If compliance therewith be impractical, the provisions of this By-law shall not apply to:

4.2.1 ambulances, police, fire department, or public utility emergency vehicles; 4.2.2 vehicles of the Corporation or vehicles contracted by the Corporation where such vehicles are actually engaged in the performance of cleaning, maintenance, repair, construction, snow removal or other work on any highway within The Township of Oro-Medonte; or 4.2.3 tradesman bona fide temporarily stopping or parking for the purpose of loading or unloading equipment to complete minor repairs. For the purpose of this exemption "temporarily" shall mean a time limit of not more than two hours.

5.0 General Stopping or Parking Regulations 5.1 No person shall park or stop any vehicle on any highway or portion thereof unless on the right side of the highway having regard to the direction in which the vehicle had been proceeding, with the right front and right rear wheels and runners not more than 0.15 metres from the curb or boundary of the roadway, as near as the condition of the highway permits.

6.0 Parking Prohibited With Signs 6.1 When authorized signs have been erected, no person shall park a vehicle, or permit a vehicle to remain parked on any highway; 6.1.1 at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule "A". 6.1.2 within the intersection of the Rail Trail and the highway, 6.1.3 within the signed portion of the entrance to the Rail Trail.

7.0 Parking Prohibited Without Signs 7.1 When authorized signs have not been erected, no person shall park a vehicle or permit a vehicle to remain parked on any highway; 7.1.1 within fifteen metres (15m) of an intersection;

7.1.2 within three metres (3m) of a fire hydrant;

7.1.4 in front of or within one and one half metres (1.5m) of a laneway or driveway; 7.1.5 so as to interfere with the formation of a funeral procession.

7.1.6 in such a position that will prevent the convenient removal of any other vehicle previously parked; 7.1.7 for the purpose of displaying the vehicle for sale; 7.1.8 for the purpose of greasing, repairing, servicing or painting of vehicles except for such repairs as have been necessitated by an emergency; 7.1.9 on the roadway where the width of the roadway is six metres (6m) or less; 7.1.10 on a driveway within one metre (1m) of a sidewalk or footpath, or if there is no sidewalk or footpath within three metres (3m) of the roadway;

7.1.11 so as to impede or obstruct the flow of other traffic during their lawful use of the highway; 7.1.12 on a boulevard.

8.0 Temporary No Parking Signs

8.1 The Director of Operations and Community Services, or his/her designate is authorized and directed to erect or place at the Director's discretion temporary "No Parking" signs on any highway used by the general public for the passage of vehicles. Temporary changes indicated by the erection of such signs shall not be effective after the next Council meeting, unless confirmed by resolution of Council at such meeting, which resolution shall

8.2 Without limiting the generality of the foregoing, such signs shall be erected in the event of fire, or parades, or while large assemblies are in an auditorium or otherwise, for a reasonable period of time immediately preceding and following such assemblies, provided however, that such "No Parking" signs shall be erected one hour or more before such parades or assemblies;

8.3 No person shall at any time park a vehicle on any of the highway, parts of highways, or sides of highways where temporary "No Parking" signs have been erected. 9.0 Stopping Prohibited - Specified Places Without Signs

9.1 No person shall stop a vehicle or permit a vehicle to remain stopped on any highway: 9.1.1 on, or partly on, or over a sidewalk or footpath;

9.1.2 within fifteen metres (15m) of an intersection or crosswalk;

9.1.3 on the roadway side of any stopped or parked vehicle; 9.1.4 upon any bridge or elevated structure except where parking is otherwise permitted in this By-law; 9.1.5 within thirty metres (30m) of either end of a bridge or elevated structure;

9.1.6 within fifteen metres (15m) of the nearest rail of any level crossing of a railway;

9.1.7 within the turning basin of a cul-de-sac;

9.1.8 on a highway.

10.0 Stopping Prohibited – Specified Places With Signs

10.1 Where authorized signs have been erected, no person shall stop a vehicle on any

11.0 Parking Prohibited For Winter Road Maintenance 11.1 From the 1st of December in any year until the 1st day of April in the following year between the hours of 2:00 a.m. and 12:00 p.m., no person shall park a vehicle on highway or in a municipal lot within the Township. 11.2 No person shall park, or leave standing, a vehicle on a highway, whether attended or unattended, between October 15th and April 30th inclusive, in such a manner as to interfere with winter road maintenance. For clarity, and without limitation, if a winter road maintenance vehicle must alter its course to avoid a parked vehicle, or is prevented from entering an area it would otherwise have entered to perform winter road maintenance because of a parked vehicle, that vehicle is deemed to be interfering with winter road maintenance. 11.3 Notwithstanding Sections 11.1 and 11.2 of this By-law, legal parking is permitted with a valid permit, for recreational purposes between October 15th and April 30th inclusive, along the roadways of the locations set out in Schedule "B" attached hereto and forming part of this By-law. For clarity, and without limitation, any vehicle parked within the locations identified in Schedule "B" shall not be deemed to be interfering with winter road maintenance. 12.0 Parking Prohibited - Private Property and Property of the Municipality

12.1 No person shall park or leave a vehicle on: 12.1.1 private property without first having obtained permission from the owner or occupant of the property; 12.1.2 property owned or occupied by The Township of Oro-Medonte or any local board thereof without first having obtained written consent from The Township of Oro-Medonte or the local board unless authorized signs have been posted indicating parking is permitted;

12.2 No person shall park a vehicle or permit a vehicle to remain parked on property owned by The Township of Oro-Medonte or any local board thereof where: 12.2.1 an area that is designated by sign as reserved, unless the area is reserved for such person; 12.2.2 an area designated by sign as an area where parking is prohibited;

12.2.3 for any period in excess of 24 hours.

13.0 Fire Routes 13.1 Where signs are displayed, no person shall stop, stand or park a vehicle in:

13.1.1 designated fire route zone;

13.1.2 Within the signed portion of the highway on the side of the highway which the fire hall is located and the opposite side of the highway of such fire hall.

14.0 Permit Parking

14.1 Between May 1st and October 30th, no person shall park a vehicle on a highway Or in any location identified within Schedules “D” and “E of this By-law unless a valid Township permit is displayed so as to be visible from outside the vehicle.

14.2 All permits issued by the Township are valid from May 1st through till October 30th as identified on the permit face, no person shall park and display an expired permit within locations identified within Schedules “D” and “E” of this By-law.

14.3 Permits shall be issued to residents, at no charge, through the Township Administration Office. Such permits will allow the holder to park in the locations specified in Schedules "D" and "E" of this By-law, provided that all other provisions of this By-law are complied with.

14.4 Permits may be purchased by non-residents for a fee as specified in the Township Fees and Charges By-law. Permits displayed so to be visible from the outside by non-residents will allow the vehicle to park in the locations specified in Schedules “D” and "E" of this By-law, provided that all other provisions of this By-law are complied with.

14.5 Should a violation under section 14.1 of this By-law continue in excess of three (3) hours, the Municipal Law Enforcement Officer may issue the vehicle/operator a second infraction, and subsequently issue further infractions every three (3) hours thereafter until such violation ceases.

15.0 Accessible Permit Parking

15.1 When authorized signs have been erected, designating a space as an accessible permit space, no person shall park or stop a vehicle or allow a vehicle to remain parked or stopped in a public parking area in a parking space reserved for persons with an accessible permit unless a valid accessible parking permit is openly displayed on the dashboard of the vehicle. 15.2 Enforcement of this Section on property other than property owned by the municipality will only be carried out upon written request by the owner. 16.0 Signs - Traffic Signals 16.1 No person shall move, remove, deface or in any manner interfere with any sign, traffic control signal, marking, or other traffic control device placed, erected or maintained under this By-law.

16.2 No person shall erect a traffic control signal, marking, or other traffic control device without authority. 16.3 No person shall place, maintain or display on any highway, any sign, marking or device which purports to be, or is an imitation of, or resembles an authorized sign or which conceals from view or interferes with the effectiveness of an authorized sign. 17.0 General Traffic Rules 17.1 No person shall drive a vehicle on a sidewalk except for the purpose of directly crossing the sidewalk. 17.2 No person shall drive a vehicle on the Rail Trail without the written consent from the Township prior to doing so. 17.3 No person shall drive a vehicle on municipal property unless in a designated parking area or on municipal roads controlled under the Highway Traffic Act. 17.4 Notwithstanding sections 17.1, 17.2 and 17.3 vehicles operated by or on behalf of the Township for the purpose of their duties shall be permitted. 17.5 No person shall drive any vehicle over any marking on the roadway where markers are in place to indicate that the marking material has been freshly applied.

18.0 Enforcement And Administration

18.1 This By-law shall be enforced and administered by The Township of Oro- Medonte Municipal Law Enforcement Officers.

19.0 Parking Infraction Notice

19.1 Where a vehicle is found parked in contravention of the provisions of this By-law, Municipal Law Enforcement Officers may complete and place upon or attach to the vehicle or give to the person driving the vehicle a parking infraction notice in the form of a serially numbered notice stating:

19.1.2 a description of the offence;

19.1.3 the date, time and location of the alleged offence;

19.1.4 the signature of the signing officer;

19.1.5 the set fine for the alleged offence; 19.1.6 that the owner or driver thereof may make a voluntary early- payment in the amount and manner set forth and pay the fine as indicated on the parking infraction notice prior to the 15th day as set out in the Provincial Offences Act, 1990 Part II.

19.1.7 that the owner or driver thereof may enter a not guilty plea within 15 days of the offence and request a trial date be set as set out in the Provincial Offences Act 1990 Part II.

19.2 The Municipal Law Enforcement Officer shall prepare the parking ticket in duplicate and shall attach one copy of the parking infraction notice to the vehicle or give the copy of the parking infraction notice to the driver of the vehicle and deliver one copy to the Corporation.

20.0 Voluntary Payment 20.1 Notwithstanding the provisions of Section 19 of this By-law, any person served with a Parking Infraction Notice for an offence as set out in this By- law, may make an early payment in the manner shown on the reverse side of such notice within seven (7) calendar days from the date of the notice was issued.

21.0 Owner Liable 21.1 The owner of a vehicle may be charged with and convicted of an offence under this By-law for which the driver or the vehicle is subject to be charged and on conviction the owner is liable to the penalty prescribed or provided for the offence, unless, at the time of the offence, the vehicle was in possession of some person other than the owner without the owner's consent.

22.0 Exemptions

22.1 This By-law shall not apply to the Corporation, or to its employees when engaged in the maintenance of a designated parking space or the enforcement of this Bylaw.

23.0 Offences

23.1 Any person who contravenes any provision of this By-law is guilty of an offence and on conviction is liable to the maximum fine as provided for in the Provincial Offences Act, R.S.O., 1990, c.P.33, as amended and/or Part XIV of the Municipal Act, 2001, as amended.

24.0 Tow/Impound Vehicle

24.1 Notwithstanding any other penalty imposed by this By-law, the Municipal Law Enforcement Officer issuing the parking infraction notice may have the vehicle towed away and impounded at the owner's expense pursuant to section 170(15) of the Highway Traffic Act, 1990, as amended;

24.2 All towing and impounding charges incurred under this section shall become a lien against the vehicle and enforced in accordance with the Repair and Storage Liens Act, R.S.O. 1990, c.R.25, as amended.

25.0 Severability

25.1 If a court of competent jurisdiction should declare any section of this By- law, or part thereof, including any part of the schedules, to be invalid, such section or part thereof is deemed severable from this By-law and shall not be construed as having influenced Council to pass the remainder of this By-law and it is the intention of Council that the remainder of the By-law shall survive and remain in force.

A By-law to provide for an interim tax levy and to provide for the payment of taxes and to provide for penalty and interest

Whereas Section 317(1) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that the Council of a local municipality may before the adoption of the estimates for the year pass a by-law levying amounts on the assessment of property in the local municipality rateable for local municipality purposes;

And Whereas Section 317(3) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that the amount levied on a property shall not exceed 50% (percent) of the total amount of taxes for municipal and school purposes levied on the property for the previous year;

And Whereas the Council of the Corporation of the Township of Oro-Medonte deems it expedient to enact such a by-law;

Now Therefore the Council of the Corporation of the Township of Oro-Medonte enacts as follows:

1. There shall be levied and collected upon all properties having rateable assessment in the Corporation of the Township of Oro-Medonte an amount of 50% of the total amount of taxes for municipal and school purposes levied on the property for the previous year.

2. The said interim tax levy shall be due and payable in two equal installments on or before Friday February 26th, 2021 and Friday April 30th, 2021.

3. The Treasurer is hereby authorized to mail or cause to be mailed the notice of taxes due to the address of the residence or place of business of the person to whom such notice is required to be given as shown on the latest revised Assessment Roll.

4. A penalty for non-payment of taxes shall be imposed not exceeding 1 ¼% on the first day of default, and on the first day of each calendar month thereafter during the year 2021, until taxes are paid.

5. That there be added an interest charge of 1 ¼% on the first day of each month on any outstanding tax arrears from the 31st day of December in the year in which the taxes were levied until the taxes are paid.

6. Taxes are payable at the Township of Oro-Medonte Administration Office or at most financial institutions which accept and process payments on behalf of customers, with the onus on the financial institution to remit payments on time.

7. That the Treasurer be authorized to accept part payment from time to time on account of any taxes due and to give a receipt for such part payment, provided that acceptance of any such payment shall not affect the collection of any penalty or interest or any other levies, rates, charges or collections imposed, collectable and due in respect to any non-payment.

8. That By-law No. 2019-129 and By-law No. 2020-041 are hereby repealed.

By-Law No. 2021-007

Being a By-Law to Confirm the Proceedings of the Council Meeting held on Wednesday, January 13, 2021

Whereas Section 5 of the Municipal Act, 2001, S.O. 2001, C. 25, as amended provides that the powers of the Municipal Council shall be exercised by By-Law, unless the municipality is specifically authorized to do otherwise;

And Whereas The Council of The Corporation of the Township of Oro-Medonte deems it expedient that the proceedings at this Council Meeting be confirmed and adopted by By-Law;

Now Therefore the Council of The Corporation of the Township of Oro-Medonte hereby enacts as follows:

1. That the actions of the Council at its Council Meeting held on Wednesday, January 13, 2021, and in respect to each Motion, Resolution and other actions passed and taken by the Council at its said Meeting is, except where prior approval of the Ontario Municipal Board is required, hereby adopted, ratified and confirmed.

2. That the Mayor and the proper Officials of the Township are hereby authorized and directed to do all things necessary to give effect to the said action or to obtain approvals where required and to execute all documents as may be necessary on behalf of the Council of the Corporation of the Township of Oro- Medonte.

3. That the Mayor/Chair and Clerk/Designate are hereby authorized and directed to execute and affix the corporate seal to all necessary documents.

4. And That this by-law shall come into force and take effect on the final passing thereof.
