REGULATION OF ACCESS TO OIL PIPELINES 777 THE NATIONAL ENERGY BOARD: REGULATION OF ACCESS TO OIL PIPELINES JENNIFER HOCKING* In the past few years, a number of long-distance oil pipelines have been proposed in Canada — Northern Gateway, the Trans Mountain Expansion, Keystone, and the Energy East Project. This article describes the criteria used by the National Energy Board in approving the allocation of capacity in oil pipelines to firm service contracts while requiring that a reasonable percentage of capacity is allocated for uncommitted volumes (common carriage). It explains the economic theory related to regulation of access to major oil pipelines. It reviews and analyzes relevant NEB decisions, which show that the NEB supports well- functioning competitive markets, but will exercise its discretion to resolve complaints where markets are not functioning properly. The article also explains the economic significance of the proposed long-distance oil pipelines to Canada and Alberta despite the current low price of crude oil. The article concludes with recommendations for a written NEB policy regarding access to capacity in oil pipelines. TABLE OF CONTENTS I. REPORT FEDERAL POLITICS st DATE FebruaryNUMÉRO1 DE, 2020 PROJET METHODOLOGY METHODOLOGY Web survey using computer-assisted Web interviewing (CAWI) technology. From January 29th to January 30th, 2020 1,501 Canadians, 18 years of age or older, randomly recruited from LEO’s online panel. Using data from the 2016 Census, results were weighted according to age, gender, mother tongue and region in order to ensure a representative sample of the population. No margin of error can be associated with a non-probability sample (Web panel in this case). However for comparative purposes, a probability sample of 1,501 respondents would have a margin of error of ±2.53%, 19 times out of 20. The research results presented here are in full compliance with the CRIC Public Opinion Research Standards and Disclosure Requirements. 2 METHODOLOGY Notes on Reading this Report The numbers presented have been rounded up. However, the numbers before rounding were used to calculate the sums presented and might therefore not correspond to the manual addition of these numbers. In this report, data in bold red characters indicate a significantly lower proportion than that of other respondents. Conversely, data in bold green characters indicate a significantly higher proportion that that of other respondents. A more detailed methodology is presented in the appendix. April 28, 2020 Honourable Catherine McKenna Minister of Infrastructure and Communities [email protected] Dear Minister McKenna, We write as twenty (20) business organizations representing a broad cross-section of Manitoba’s economy collectively employing tens of thousands of women and men. Those industries include engineering & consulting, heavy civil and 2 vertical construction, commercial and residential development, manufacturing & exporting, retail, agriculture, commercial trucking and skilled trades. Our appeal to the federal government is that it assist in our provincial economic recovery by accelerating the approvals of and flexibility in the allocation from federal programs. Such measures would enable funding of key Manitoba projects that would immediately procure jobs, build legacy assets and be key instruments in help kick-staring Manitoba’s economy. The above is necessary to help correct the lack of confidence in the economy by all its sectors, the alarm, anxiety and fear of what lies ahead around the corner, and indeed where that corner is. That has led to private-sector projects being deferred or outright canceled. Those decision have resulted in lost jobs, supply and equipment sales, all of which reduces the collective ROI to GDP. Addressing consumer and investor confidence is critical to our recovery. In that regard, we understand the Province of Manitoba has communicated its commitment to flow its capital programs, harnessing investment in infrastructure to help Manitoba’s economy recover. We are told Manitoba has more than $6B in project submissions for the Investing in Canada Infrastructure Program (ICIP) with many being shovel ready. We urge the federal government to make the most of the current market conditions - competitive bid prices and extraordinarily low interest rates - to meet the formidable economic challenge in front of us. -

Box 30473 Lansing, MI 48909 Re: Enbridge Lakehead System Line 5 Pipelines at the Straits of Mackinac Dear Attorney General Schuette and Director Wyant: Thank you very much for the opportunity to discuss Enbridge Energy, Limited Partnership’s Line 5 pipeline crossing of the Straits of Mackinac. We appreciate the dialog that has already occurred to provide some clarity and understanding in relation to the information requests that accompanied your letter of April 29, 2014. In order to fully understand the current situation and our responses to the information requests, I would like to provide some background information to you about the history of Line 5’s Straits crossing, about Enbridge’s operations, and about the significant economic benefits Enbridge’s Line 5 has brought Michigan and its citizens since it entered service in 1953. Historical Facts about Line 5 In 1953, one of the greatest pipeline engineering achievements of its time was completed with the construction of a new 30-inch pipeline from Superior, Wisconsin to Sarnia, Ontario, and also serving Michigan. One of the most notable achievements during construction of this 645-mile line was the 4.6-mile crossing of the Straits of Mackinac in up to 220 feet of water. While such a long crossing had not been attempted before, engineering specialists from Bechtel, the Department of Naval Studies of the University of Michigan, as well as specialists from Columbia University came together to address the challenge. -

The COVID-19 pandemic dramatically reshaped the experience of the 2020-21 internship cohort relative to previous years. Such changes began with a mostly-virtual orientation in September, and continued with remote work in their MP placements, virtual study tours, and Brown-Bag lunches over Zoom. Yet while limiting some aspects of the PIP experience, the pandemic provided opportunities as well. The interns took full advantage of the virtual format to meet with academics, politicians, and other public figures who were inaccessible to previous cohorts relying on in-person meetings. They also learned new skills for online engagement that will serve them well in the hybrid work environment that is emerging as COVID-19 recedes. One thing the pandemic could not change was the steadfast support of the PIP’s various partners. We are greatly indebted to our sponsors who chose to prioritize their contributions to PIPs despite the many pressures they faced. In addition to their usual responsibilities for the Programme, both the PIP’s House of Commons Liasion, Scott Lemoine, and the Programme Assistant, Melissa Carrier, also worked tirelessly to ensure that the interns were kept up to date on the changing COVID guidance within the parliamentary preccinct, and to ensure that they had access to the resources they needed for remote work.
