As agreed by States in Vienna in 1993, civil and political rights and ESC rights must be treated equally, as “all human rights are universal, indivisible and interdependent and interrelated” .2 As the UN Office of the High Commissioner on Human Rights has explained, there is no fundamental difference in nature between civil and political and ESC rights 3. Treaties such as the International Covenant on Economic, Social and Cultural Rights (ICESCR) are binding on the States that are party to them and States thereby un- dertake to implement them in good faith 4. All States parties, including the Republic of Uzbekistan, have internationally binding obligations to protect and secure these rights, including the rights to: healthcare; housing; food; water and sanitation; education; work; and social security 5. Thus, these are not benefits that depend on the good will of States, but rights that must be guaranteed by States which have undertaken to imple- ment these international obligations . The ICESCR is one of the principal universal treaties in this field — other treaties to which Uzbekistan is a party 6 provide particular guarantees for the ESC rights of persons from particular groups, including women, children and persons with disabilities 7. Under this and other human rights treaties, States implement their international legal obligations through their national legal systems: laws, policies and practices, on matters including healthcare, housing, food and nutrition, education or labour 8. This report considers some aspects of Uzbekistan’s implementation of these obligations through laws and policies as well as through access to justice and remedies for those who allege that their ESC rights have been violated . Analysing the general legal framework for protection of these rights, it considers in more detail particular challenges in Uzbekistan, in respect of the right to adequate housing, the right to health, and rights in the workplace . For rights to be effective in practice, they must not only be provided for in legislation and policy, but also be accessible to all, on an equal basis 9. Accessibility of rights re- quires access to information, and the dismantling of physical, administrative, economic or cultural barriers to accessing rights, as well as access to justice and effective rem- edies (including judicial remedies) to enforce these rights 10. Her basic and fundamental rights are being violated since centuries and in all the societies and Uzbekistan is not an exception. Uzbekistan is a patriarchal society in which a cultural bias against women has been an acceptable fact. After the disintegration of the Soviet Union, Uzbekistan opened a new chapter to bring socio-cultural changes in the status of women. Uzbekistan inscribed gender equality in the constitution. Women have been guaranteed equality of rights by the law but are unable to get equality by male dominated society and family. The objective of this paper is to highlight the status of Uzbek women in different periods with special reference to status of women in independent Uzbekistan.     POLICY REPORT Forced Sterilization of Women in Uzbekistan Natalia Antelava December 2013 EXECUTIVE SUMMARY This investigation into an alleged government sterilization program in Uzbekistan has uncovered a pattern of ongoing, systematic forced sterilizations that have affected tens of thousands of women across the country and appears to have intensified in recent years. According to overwhelming testimonial evidence, for the past 13 years the Uzbek government has carried out a program to sterilize women of reproductive age. The program is not based on ad hoc decisions of individual hospitals, but rather is a centrally-regulated policy with the apparent aim of controlling population growth. Spanning a period of two years, this investigation draws on interviews with dozens of victims of forced sterilization, 14 medical professionals, including doctors and 2 officials at the Ministry of Health, and a survey of 53 doctors th 224 West 57 Street, New York, New York, 10019 | TEL +212-548-0600 | FAX +212-548-4600 POLICY REPORT-FORCED STERILIZATION OF WOMEN IN UZBEKISTAN 2 across the country. While the extent of implementation has varied, the government has never abandoned the program entirely. The backbone of this research is a survey of 54 doctors that provides the most extensive testimonial evidence to date of the existence and prevalence of a nation-wide government sterilization program. It shows that the program is not limited to particular geographical areas or institutions and that it takes place across the country’s medical establishment. In Uzbekistan, all women of reproductive age who have delivered two or more children are potential targets of the program.
