Re: NOVA Gas Transmission Ltd. (NGTL) 2021 NGTL System Expansion Project (Project) Certificate GC-129 (Certificate) Detailed Route Process – Confirmation of Service to Aboriginal Groups File No.: OF-Fac-Gas-N081-2018-03 03

In accordance with the guidance contained within the Form of Plan, Profile and Book of Reference (PPBoR) and sample notice letter issued by the Energy Regulator (CER) on November 16, 2020,1 and the CER’s further and revised direction issued on December 4, 2020,2 (Letters) NGTL submits the confirmation of service of detailed route notices (Notices) on Aboriginal groups engaged on the Project.

NGTL served the Notices via e-mail to each potentially affected Aboriginal group engaged on the Project. Throughout its ongoing engagement on this Project, including the GH-003-2018 hearing and subsequent condition compliance process, NGTL has used e-mail as a method to serve potentially affected Aboriginal groups engaged on the Project. In addition, due to the ongoing pandemic, Canada Post is not confirming signatures for Registered Mail, many staff at Aboriginal groups’ offices are working from home and some reserves have implemented community closures.

Accordingly, NGTL sent the Notices electronically with hard copy to follow via Canada Post Xpresspost in accordance with Sections 8(1) and (9) of the National Energy Board Rules of Practice and Procedure, 1995 (Rules). As per the guidance in the Letters, NGTL provides the details of service in Table 1: Detailed Route Notification Delivery Details.
