Journal of Tax Administration Vol 6:2 2021 Dark Store Theory DARK STORE THEORY: EXAMINING THE TAX LOOPHOLE’S RELEVANCE IN WISCONSIN FROM MULTIPLE PERSPECTIVES Daniel H. Boylan1, Jeffrey W. Cline1 Abstract Originally encouraged through legislative reformation during the 1950s, big-box retailers play a major role in the United States’ economy. Built to thrive in the suburbs, they were welcomed by municipalities and property owners who believed that the increased sales taxes that the stores would generate would, in turn, lead to increased tax revenues and lower property taxes. Municipalities and residential property owners are now pushing for legislative action to close a tax loophole that was ostensibly allowed through recent tax reform. However, there is a substantial amount of confusion over the legitimacy of the loophole, as analysts have opposing viewpoints. This research examines the relationship between the presence of big-box retailers and the property tax levies of local municipalities in Wisconsin. It then investigates the phenomenon known as the dark store loophole and analyzes the opposing perspectives held by specialists within the industry. It also considers the overall impact of the loophole on residential property owners. This research finds that imposing legislation to close the dark store loophole would enable local governments to lower residential property taxes. There is simply no room left for new investments in long-lived carbon intensive infrastructure. Still, public agencies continue to provide tens of billions of dollars to finance and support such investments each year. This has to stop. -

Lavine Assemblymember & Chair of the Assembly Judiciary Committee Legislative Office Building 831 Albany, NY 12248 Chairman Charles Lavine: Throughout the course of the COVID-19 pandemic, our state has been tested in countless ways. Our work is not over, and the scandals coming from the Cuomo Administration have only added to the challenges we all face. The importance of the Judiciary Committee’s responsibility to investigate Governor Cuomo and the administration cannot be overstated. While it is important your committee is provided the time and resources it needs to conduct a thorough investigation, it is critical that there be no delays in your work. It would be wrong to afford Governor Cuomo and his administration the opportunity to further misuse his office by utilizing the budget process to impede or influence your investigation. In our state’s rich long history, only one Governor, William Sulzer, has ever been impeached. Like the Assembly Speaker did in 1913, Speaker Heastie has opted to begin the impeachment process with an investigative committee. The allegations against Governor Cuomo are far more serious and more numerous than those levied against Governor Sulzer, or more recently against Governor Elliot Spitzer. Many of these impeachable offenses were conducted in the middle of a pandemic when millions of New Yorkers were putting their faith in the Legislature and Governor Cuomo to be honest with them. The only thing that will restore the public’s trust in our state government is to provide New Yorkers the unvarnished truth in a timely manner. -

January 2021 Dear Friends, On Wednesday, January 13th, the House voted to impeach President Trump for the second time, charging him with “incitement of insurrection” after the violence and rioting last week at the Capitol, where five people tragically died. With that vote, he is the only President in history to be impeached twice. The final vote tally was 232 to 197, with 10 Republicans in support. The timing and next steps of a possible Senate trial are unclear, though Leader McConnell indicated that there will be no trial before Mr. Biden is inaugurated next week.
