Press Conference 0n Bank Negara’s Alert List July 19,2017

Ethics Council Malaysia (ECM), DSAM, MCA Public Services & Complaints Department (MCAPSCD), and the Malaysian Crime Prevention Foundation held a joint press conference on July 19. The press conference was to highlight Bank Negara’s updated Alert List of known companies and websites which are allegedly not authorised or approved under the relevant laws and regulations administered by the central bank. Members of the public were urged not to fall prey on the illegal schemes offered by unauthorised / approved companies. Since the beginning of this year, ECM and MCAPSCD have received reports (Seated 3rd from left) Datuk Sen Michael Chong (MCAPSCD) from 10 victims of these illegal schemes. Briefing on Price Control & Anti-Profiteering Regulations 2016 May 18, 2017

DSAM organised a half-day session on the new regulations governing unreasonable high profits for DSAM Members which was conducted by Guna Selan AS Marian, Section Head of the Price Control & Anti-Profiteering Unit, Enforcement Division from the Ministry of Domestic Trade, Co-operatives and Consumerism, assisted by Senior Assistant Directors Faizah Othman and Nor Hafizah Haron. This session was aimed at providing the members with an overview of the new regulations, a run-through of the formulations used, and the implications of the new regulations for the Direct Selling industry.

This regulation was gazetted on December 22, 2016 and enforced January 1, 2017. There was a six months grace period for compliance while the guidelines were being finalised. Briefing on Company Act 2016 September 19, 2017

DSAM, together with Wong & Partners held a briefing on the new Companies Act 2016. It was attended by more than 70 participants. Among the topics that were presented were Summary and Overview of the new Act, Compliance for Direct Selling companies especially in Directors’ Duties and Obligations. The half-day session ended with a Q&A Session.

Companies Act 2016 has been implemented in stages from January 31, 2017. This new

Act repeals the Companies Act 1965. Companies Commission of Malaysia (SSM) has advised owners and head of companies to take into account of the changes in the Act when reviewing, formulating or implementing policies and procedures which may affect companies when dealing with ministries and government agencies.

5 EVENT SPOTLIGHT CEOs Luncheon February 2017 The first CEOs Luncheon for 2017 was held on February 16. This event was also to celebrate Chinese New Year. Over 70 CEOs, company owners and top management were present plus invited guests from the Ministry of Domestic Trade, Co-operatives and Consumerism, Zulkifli Yaacob (Head of Direct Selling Unit), and Ridzuan Khamis (Senior Assistant Director, Operations Unit, Enforcement).

The format for this luncheon differs from previous. Instead of having a main speaker, a forum on prevailing topic, “Direct Selling and the Online e-Commerce Marketplace” was held instead. The panels for this forum consists of Khairuddin Yahya (DSAM Board Member, presenting a Direct Selling perspective), Andre Gan (Managing Partner Bernard Lee (right) from 11Street speaking of Wong & Partners, presenting a legal perspective) and Bernard Lee during the forum. (Senior Manager, 11Street presenting an e-commerce perspective). The content of the forum focused on unauthorised sale of our Members’ products and the consequences. On this matter, 11Street has agreed to work with DSAM Members to find a mutually beneficial solution.

Proceeding after the forum, was a short presentation by Gold Coast Business Events, Australia, offering their city and attractions as an option for our Members’ next incentive trips.

During the luncheon, Tung Saik Leng, an award winning Financial Planner, author, lecturer and Consultant in the area of Financial Services presented “Lessons from best practices in Financial Services”. In this thought provoking session, Tung described the Financial Services’ successes and failures over the years.

Ethics Council Malaysia Launched March 21, 2017 Ethics Council Malaysia (ECM), an initiative of DSAM was launched on March 21 by the Minister of Domestic Trade, Cooperatives and Consumerism Dato’ Seri Hamzah Zainudin. The role of ECM is to form a united front against pyramid schemes, illegal investment schemes and all other illegal schemes. ECM functions by collaborating information on suspected illegal schemes, deliberating if these schemes are legitimate, and disseminating the information to law enforcers for their immediate actions plus warning the public of such illegal activities. ECM is chaired by DSAM Vice President Datuk Tan Chong Guan and consists of representatives from the following;

• Direct Selling Association of Malaysia (DSAM) • Domestic Trade Division and Enforcement Division of MDTCC • Intelligence and Operations Unit, Royal Malaysia Police • MCA Public Services and Complaints Department • Federation of Chinese Associations Malaysia (Huazong) • Wong & Partners, a member firm of Baker & McKenzie International

DSAM’s annual general meeting (AGM) 2017 was held on May 31. The meeting begun with the Treasurer’s Report presented by Khor Lee Fan. This was followed by the presentation of the Board Report by the Honorary Secretary David Cheong.

The Korea Tourism Organization (KTO) invited the DSAM Board and Sub-Committee Members on a familiarisation trip to Korea from December 17 to 23, 2017. Platinum Ranking for DSAM WFDSA UPDATES DSAM is pleased to announce that the World Federation of Direct Selling Association (WFDSA) has ranked our Association as Platinum for 2017! This is the highest performance standard to be accorded by WFDSA and we share this accolade with only five other Direct Selling Associations (DSAs) - New Zealand, Australia, France, United States and Colombia. The performance standards in the form of Bronze, Silver, Gold and Platinum was developed by WFDSA for the Member DSAs of 62 countries and the European Direct Selling Association (SELDIA). The purpose is to benchmark the current operating and organisational characteristics among all DSAs globally and an effort to strengthen and achieve excellence in association management. The World Federation of Direct Selling Associations (WFDSA) World Congress 2017 was held in Paris on October 2-3. This triennial event with the theme “Own the Future” was attended more than 500 participants from 52 countries. WFDSA Chairman Doug DeVos of officially launched the 15th World Congress.

Among the highlights of the congress were the;

• Keynote address by Bertrand Piccard, the first man to fly around the world in a solar-powered plane. Piccard gave his insights on positively achieving our goals and journeys through life; • Presentation on the global state of Direct Selling by WFDSA Executive Director, Tamuna Gabilaia; The congress came to a finale at the Gala and Awards • Roundtable discussion with the title “Own the Future” Dinner at Chateau de Versailles. During the awards moderated by DeVos with panel members made up of several industry leaders; ceremony, DSAM attained the 2nd placing in the DSA • The positive outlook of Direct Selling by in-coming Innovation Programme Awards for the formation of Ethics WFDSA Chairman, Magnus Brannstrom of Oriflame; Council Malaysia. • Eight workshops providing more insight on the Direct Selling industry.
