Le paragraphe 46.01(1) prévoit que sont désormais exclus du processus de détermination du statut de réfugié au Canada tous ceux qui sont passés par un tiers pays «sûr» pour arriver au Canada, à la seule exception de ceux qui ne s’y trouvaient qu’en vue d’un vol de correspondance. En vertu de l’art. 19(1)(c.1)(i), toute revendication du statut de réfugié au Canada est irrecevable si l’intéressé a commis une infraction criminelle dans son pays d'origine. L’auteur soutient que ces dispositions violent les garanties procédurales de justice fondamentale prévues à l'article 7 de la Charte canadienne des droits et libertés. De plus, il soulève la possibilité que les droits conférés aux articles 11(d), 11(g), 12, 14 et 15(1) sont également enfreints par la Loi sur l’immigration. Ensuite, il aborde la question de savoir si ces violations constituent des limites raisonnables au sens de l’article premier de la Charte. Etant donné que les questions relatives à la politique d’immigration se trouvent actuellement au centre de nos débats de société, il devient de plus en plus difficile de maintenir l'équilibre entre les buts de la Loi et les obligations imposées sur le Canada par la Charte et par la Convention des nations unies relative aux réfugiés.

Notice biographique : Monsieur André Plourde naquit à Rivière-du-Loup le 12 janvier 1937. Après des études au cours Sciences et Commerce à l’École Mgr Taché, il débuta, en 1954, un emploi à la Banque Canadienne Nationale. L’année suivante, il fut engagé par l’entreprise Vitrerie Générale Inc. à titre de commis-vendeur. En décembre 1959, André Plourde épousa madame Marielle Gamache, qui lui donna trois enfants : Élaine, Alain et Éric. En mai 1965, il devint président-directeur général de la Vitrerie Générale Inc. Son implication au sein de cette entreprise s’étendra sur une période de 29 années. En 1972, M. Plourde fonda, en partenariat avec d’autres actionnaires, la compagnie Prelco Inc. Cette entreprise, située à Rivière-du-Loup, est spécialisée dans la fabrication du verre trempé. Durant la même période, il fut directeur de Glassec Inc., autre industrie de verre trempé, située à Cornwall en Ontario. De 1965 à 1983, en plus de son travail dans l’industrie manufacturière, André Plourde fit preuve d’une implication sociale marquée dans différentes sphères touchant au mieux être des gens de la région de Rivière-du-Loup. En 1965, il fut membre-fondateur du Club Lions de Rivière-du-Loup en plus de faire partie de l’organisation des Chevaliers de Colomb. D’ailleurs, l’année suivante, il occupa les fonctions de secrétaire-archiviste de ces mêmes Chevaliers de Colomb en plus d’être le secrétaire de L’Army & Navy de Rivière-du-Loup.
