Characteristics of Chinese Poetic-Musical Creations Yan GENG1 Abstract: The present study intoduces a series of characteristics related to Chinese poetry. It shows that, together with rhythmical structure and intonation (which has a crucial role in conveying meaning), an additional, fundamental aspect of Chinese poetry lies in the latent, pictorial effect of the writing. Various genres and forms of Chinese poetry are touched upon, as well as a series of figures of speech, themes (nature, love, sadness, mythology etc.) and symbols (particularly of vegetal and animal origin), which are frequently encountered in the poems. Introduction In his Advanced Music Theory course, &RQVWDQWLQ 5kSă VKRZV WKDW ³we can differentiate between two levels of the phenomenon of rhythm: the first, a general philosophical one, meaning, within the context of music, the ensemble of movements perceived, thus the macrostructural level; the second, the micro-VWUXFWXUH ZKHUH UK\WKP PHDQV GXUDWLRQV « LQWHQVLWLHVDQGWHPSR « 0RUHRYHUZHFDQVD\WKDWUK\WKPGRHVQRWH[LVWEXWUDWKHUMXVW the succession of sounds in time [does].´2 Studies on rhythm, carried out by ethno- musicology researchers, can guide us to its genesis. A first fact that these studies point towards is the indissoluble unity of the birth process of artistic creation: poetry, music (rhythm-melody) and dance, which manifested syncretically for a very lengthy period of time. These aspects are not singular or characteristic for just one culture, as it appears that they have manifested everywhere from the very beginning of mankind. There is proof both in Chinese culture, as well as in ancient Romanian culture, that certifies the existence of a syncretic development of the arts and language. -

Schlag INTRODUCTION Every student of law has at some point encountered the “bright line rule” and the “flexible standard.” In one torts casebook, for instance, Oliver Wendell Holmes and Benjamin Cardozo find themselves on opposite sides of a railroad crossing dispute.1 They disagree about what standard of conduct should define the obligations of a driver who comes to an unguarded railroad crossing. Holmes offers a rule: The driver must stop and look.2 Cardozo rejects the rule and instead offers a standard: The driver must act with reasonable caution.3 Which is the preferable approach? Holmes suggests that the requirements of due care at railroad crossings are clear and, therefore, it is appropriate to crystallize these obligations into a simple rule of law.4 Cardozo counters with scenarios in which it would be neither wise nor prudent for a driver to stop and look.5 Holmes might well have answered that Cardozo’s scenarios are exceptions and that exceptions prove the rule. Indeed, Holmes might have parried by suggesting that the definition of a standard of conduct by means of a legal rule is predictable and certain, whereas standards and juries are not. This dispute could go on for quite some time. But let’s leave the substance of this dispute behind and consider some observations about its form. First, disputes that pit a rule against a standard are extremely common in legal discourse. -

NCUE Journal of Humanities Vol. 6, pp. 47-64 September, 2012 The Reception and Translation of Classical Chinese Poetry in English Chia-hui Liao∗ Abstract Translation and reception are inseparable. Translation helps disseminate foreign literature in the target system. An evident example is Ezra Pound’s translation based on the 8th-century Chinese poet Li Bo’s “The River-Merchant’s Wife,” which has been anthologised in Anglophone literature. Through a diachronic survey of the translation of classical Chinese poetry in English, the current paper places emphasis on the interaction between the translation and the target socio-cultural context. It attempts to stress that translation occurs in a context—a translated work is not autonomous and isolated from the literary, cultural, social, and political activities of the receiving end. SHAUGHNESSY East Asian Languages and Civilizations, The University of Chicago The publication of a major English-language book on the Shang shu 尚書 (Elevated documents) or Shu jing 書經 (Classic of documents), the second of the Chinese classics, should surely count as a major milestone in the Western study of early China. As the editors note in their Introduction, the Shang shu has inspired all aspects of Chinese political philosophy for over two thousand years now. Yet, as they also say, “In some kind of reverse—and bizarre— Book Reviews correlation, the Shangshu is as important to the Chinese political tradition as it is neglected in Western scholarship” (p. 2). Their claim just above this that “major Western works on the Shangshu can be counted on two hands, with fingers to spare” is only a bit exaggerated.1 In this volume we now have fourteen studies in just over 500 pages, that directly address at least fourteen different chapters of the Shang shu, not to mention two chapters of the 1 True, I count only eight or nine such studies listed in the various bibliographies attached at the end of each chapter, but they do not even include mention of such classic studies as Paul Pelliot, “Le Chou King en caractères anciens et le Chang Chou che wen,” Mémoires concernant l’Asie Orientale 2 (1916): 123–77, or Benjamin Elman, “Philosophy (I-Li) versus Philology (K’ao-cheng): The Jen-hsin tao-hsin Debate,” T’oung Pao 2nd ser. -

I know that music made a tremendous difference in the anti- war movement of the 60s as well as the civil rights movement. Music is a powerful force that is often unrecognized. A song has a way of inspiring folks that nothing else comes even close to. We are in need of inspiring songs. One of the roles of a songwriter is not only to reflect on what is happening in the present but also to provide a vision of the future. What is your vision of the future? For some it is nihilistic bleakness – a very cynical response to our world. For others, it is filled with hope – we are somehow going to be able to figure out how we can live together and with all of creation. If you are a performer, I want to challenge you to get out of yourself and add songs that reflect your vision of the future to your repertoire. -

BRAVE NEW WORLD: TECHNOLOGY AND TORT PRACTICE Richard Marcus* I am a civil procedure person, not an official torts person, but fairly often torts and civil procedure seem to be joined at the hip. And that seems particularly true with regard to the effects of technological change on tort litigation practice. I've been working on the Federal Rules of Civil Procedure for more than twenty years and find that it's usually the torts cases that are the focus of the most intense disputes regarding procedure issues. For this Symposium, I intend to focus on five topics, but the last one is mainly an advertisement for the second panel at the Symposium: (1) E-Discovery (2) The more general impact of technology on torts practice (3) The growing importance of technology on manner of proof (4) The MDL "boom" (5) TPLF -- third party litigation funding I. -

Based on Jeffrey Wainwright, George Lansing Raymond, and Liu Xie’s theories, this study was conducted from four perspectives: theme, content, prosody structure and aesthetic features. The purposes of my thesis are to trace the originality of 160 folk songs in Shijing and 47 folk songs in Han yuefu , to illuminate the origin of Chinese folk songs and to demonstrate the secularism reflected in Chinese folk songs. My research makes contribution to the following four areas: it explores the relation between folk songs in Shijing and Han yuefu and compares the similarities and differences between them ; it reveals the poetic kinship between Shijing and Han yuefu; it evaluates the significance of the common people’s compositions; and it displays the unique artistic value and cultural influence of Chinese early folk songs. ii Acknowledgments I would like to express my sincere gratitude to my supervisor Professor Graham Sanders for his supervision, inspirations, and encouragements during my two years M.A study in the Department of East Asian Studies at University of Toronto. -
