The decision to merge the functions of the National Council for Education and Training for Wales (ELWa) into the Education and Lifelong Learning Department of the National Assembly for Wales is part of a wider agenda of the Welsh Assembly Government to deliver quality public services which are more joined-up, more responsive to people and businesses, and more efficient. Purpose and intended effect of the measure 2. This Order will transfer the functions (together with any property, rights and liabilities) of the National Council for Training and Education for Wales (ELWa) to the National Assembly for Wales; provides for the transfer of staff from ELWa to the National Assembly for Wales; makes appropriate consequential, incidental, transitional and supplementary provisions; and abolishes ELWa. 3. ELWa is responsible for planning, funding, promoting and quality assuring post-16 education and training in Wales, with the exception of higher education. This includes further education, private and voluntary sector training provision, adult and community learning and school sixth forms. Risk Assessment 4. The purpose of the legislation is not about addressing risks or hazards. The probability of any significant risk or harm arising as a result of this legislation proceeding or not is likely to be minimal. It is intended that existing functions should continue and, where possible, improvements to the services made. Options Option 1: Do Nothing 5. Without the transfer of functions of ELWa to the National Assembly for Wales the merger of ELWa into the National Assembly for Wales cannot be implemented.
