Thank you for requesting the comments of the Division for Historic Preservation of the Office of Parks, Recreation and Historic Preservation (OPRHP). We are currently reviewing the submitted materials in accordance with the New York State Historic Preservation Act of 1980 (section 14.09 of the New York Parks, Recreation and Historic Preservation Law). These comments are those of the Division for Historic Preservation and relate only to Historic/Cultural resources. They do not include potential environmental impacts to New York State Parkland that may be involved in or near your project. Such impacts must be considered as part of the environmental review of the project pursuant to the State Environmental Quality Review Act (New York Environmental Conservation Law Article 8) and its implementing regulations (6NYCRR Part 617).

We have reviewed the provided Draft Scope of work for the Preparation of an Environmental Impact Statement dated July 2020. Based upon review of that document we offer the following comments: 1. At this point, it is unclear if there will be an involved federal agency and if Section 106 of the National Historic Preservation Act will need to be completed. Please keep us informed on the involvement of any federal agencies in this project so we can continue our review in the appropriate manner. 2. The Project Location as illustrated in Figure 1 of the Draft Scope of Work includes a number of known historic resources. 3. We concur with the proposed Architectural Resources Analysis as described. Please use the building survey wizard in our CRIS system to complete this analysis of Architectural Resources within the project area. Please see comments from Linda Mackey for further details. Linda can be reached at [email protected] if there are additional questions. 4. We concur with the proposed archeological resources analysis as described. Please use the CRIS system to provide the background information pertaining to the past land use and ground disturbance within the project area. We note that LPC has identified the possible presence of an historic cemetery in this vicinity. Please see the comments from Philip Perazio for further details. 5. We note that proposed project includes demolition of historic resources that are already known. As such, we would recommend that as the Lead Agency, ESD take a “hard look” at these negative impacts to historic resources and seek ways to avoid or minimize these effects.

Based on the information provided, we have no further archaeological concerns regarding the proposed project. A single impact recommendation will be provided once all outstanding cultural resource concerns have been addressed.

Specifically, we have reviewed the draft Table 1: Architectural Resources and Table 2: Summary of Adverse Impacts on Architectural Resources. Based upon this review, we offer the following comments: 1. We concur that the previously identified historic resources listed in Table 1 have the correct historic designations. We further note that the project scope of work included an Architectural Resources Analysis that would, presumably, survey the remaining buildings within the direct project area. We look forward to reviewing this survey when it is available. 2. Currently, we have a limited understanding of the proposed project’s impacts but note that demolition of historic resources is proposed. Demolition of an historic resource is considered an Adverse Impact; however, we cannot anticipate other direct or indirect impacts at this time. Further understanding of the proposed projects direct and indirect impacts should become evident as the project details are made clearer.

CPP’s for LPC designated and eligible properties potentially affected by construction impacts shall be submitted to LPC for review and comment.

LPC requests a copy of the Mitigation Chapter covering demolition, shadow impacts, and visual/contextual impacts for review and comment.

The Historic Resource chapter appears acceptable for archaeology. Based upon the findings of the below referenced documentary study, we concur that there are no further archaeological concerns.

The LPC is in receipt of the, “Archaeological Documentary Study of the Former B’nai Jeshurun Cemetery, Empire Station Site 7, Block 808 Lot 7501 and Adjacent Streetbed of West 32nd St, New York, New York,” prepared by AKRF, Inc and dated November 2020. We have reviewed the submitted materials in accordance with the New York State Historic Preservation Act of 1980 (Section 14.09 of the New York Parks, Recreation and Historic Preservation Law). These comments are those of the Division and relate only to Historic/Cultural resources.

We have completed our review of the Preliminary Draft Environmental Impact Statement (DEIS), Chapter 8: Historic and Cultural Resources (December 1, 2020). This chapter identifies seven properties that have been determined to be eligible for inclusion in the New York State and National Registers of Historic Places would be demolished as part of this undertaking. We concur that under the provisions of Section 14.09 the loss of the identified historic resources constitutes an Adverse Impact finding for the project.

The next step in the process is for your agency to review options that would avoid or minimize impacts to historic properties.

Additionally, we note that Chapter 8 of the Preliminary DEIS also discusses the potential for indirect adverse impacts. Such impacts could be caused by new construction at the project site. Issues such as contextual changes, visual intrusions and shadow impacts on nearby historic resources would be anticipated. However, we do not yet have enough information on the scope of such potential impacts to comment at this time. Once the additional planning aspects of the project are developed the assessment of such issues can be more fully addressed by our office.

We have reviewed Chapter 8, Historic and Cultural Resources of the Preliminary DEIS dated December 1, 2020. Based upon review of that document we offer the following comments related to architectural resources within the Project Area/Direct APE:

1. The Penn Terminal Building at 370 7th Avenue was reevaluated for National Register eligibility. Our office has determined the building is eligible under Criterion C in the area of architecture. A copy of the resource evaluation is attached.

2. Loft buildings at 247 and 259-261 West 30th Street were also reevaluated for National Register eligibility. Based on archival research and historic photos, our office has determined that both 247 and 259-261 West 30th Street are not individually eligible for the National Register.

3. The building addressed as 151 West 30th Street and located within Development Site No. 3 retains excellent integrity. However, our office has no information about the building. In order to evaluate the building for National Register eligibility, please provide a brief history and architect information.

Please be aware that additional historic resource survey data may be required to evaluate potential additional impacts associated with the site development aspect of the undertaking.
