Scan the code to install Naga News Designed & Printed by app from Google Playstore artworks Nagaland-Kohima 4 THE WARRIOR VOL-48 NO.03 JUNE 2019 A DIPR MONTHLY MAGAZINE OFFICIAL ORDERS and NOTIFICATIONS EXEMPTION FOR INSPECTION OF LABOUR LAWS/ACTS The Labour & Employment, Skill Development & Entrepreneurship Department has notified that in regard to startup India action plan promoting the startup ecosystem in the country to incentivize the entrepreneurs in setting up new startup venture for creation of employment opportunity through them, the Government of Nagaland will exempt the inspection of the following Labour Laws/Acts for 5years whose annual turnover is not exceeding Rs.25 (Rupees twenty five crores) only in any preceding financial year and working towards innovation development, deployment or commercialization of the product, processes or services driven by the technology or intellectual property. However, inspections maybe taken up only when very creditable and verifiable complaints of violation is filed in writing and the approval has been obtained from at least one level senior to the inspecting officer or from the Central Analysis and Intelligent Unit (CAIU) as the case may be. In this regard, it is clarified that to make compliance of Labour Laws and to regulate the Labour Laws Inspection System in case of Start-Ups self-certify compliance for five years is hereby made applicable. The exempted Labour Laws are given below: 1. The Building and Other Construction Workers Welfare Board (RE&CS) Act, 1996 2. The Payment of Gratuity Act, 1972 3. The Contract Labour (Regulation and Abolition) Act, 1970 4. The Employees’ Provident Fund and Miscellaneous Provision Act, 1952 5. The Employees’ State Insurance Act, 1948 6. The Inter-State Migrant Workmen (RE&CS) Act, 1979. This will come into force with immediate effect. FINANCE DEPARTMENT NOTIFIES The department of Finance (Revenue branch) has in a notification informed that in exercise of the powers conferred by sub-sections (1), (3) and (4) of section 9, sub¬section (1) of section 11, sub-section (5) of section 15, sub-section (1) of section 16 and section 148 of the Nagaland Goods and Services Tax Act, 2017 (4 of 2017), the State Government, on the recommendations of the Council, and on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of Nagaland, Finance Department (Revenue Branch) F.NO.FIN/REV-3/GST/1/08 (Pt-1) “N”, dated the 30th June, 2017, namely: In the said notification: 1. In the Table, against serial number 3, in items (ie) and (if), in the entries in column (5), for the figures and letters “10th” wherever they occur, the figures and letters “20th” shall be substituted; 2. In Annexure IV, for the figures and letters “10th”, at both the places where they occur, the figures and letters “20th” shall be substituted. VOL-48 NO.03 JUNE 2019 THE WARRIOR 5 A DIPR MONTHLY MAGAZINE OFFICIAL ORDERS and NOTIFICATIONS EQUAL PROTECTION AND SAFETY IN SITUATIONS OF RISK, ARMED CONFLICT, HUMANITARIAN EMERGENCIES AND NATURAL DISASTERS FOR PERSONS WITH DISABILITIES In compliance with Section 8 of the Rights of Persons with Disabilities (RPwD) Act 2016 which states that ‘The persons with disabilities shall have equal protection and safety in situations of risk, armed conflict, humanitarian emergencies and natural disasters’. According to a release by the State Commissioner for persons with disabilities, the State Disaster Management Authority shall take appropriate measures to ensure inclusion of persons with disabilities in its disaster management activities as defined under clause (e) of section 2 of the Disaster Management Act, 2005 for the safety and protection of persons with disabilities. The District Disaster Management Authority constituted under section 25 of the Disaster Management Act, 2005 shall maintain record of details of persons with disabilities in the district and take suitable measures to inform such persons of any situations of risk so as to enhance disaster preparedness. The authorities engaged in reconstruction activities subsequent to any situation of risk, armed conflict or natural disasters shall undertake such activities, in consultation with the concerned State Commissioner, in accordance with the accessibility requirements of persons with disabilities. INFORMATION OF STATE GOVERNMENT EMPLOYEES IN THE PIMS DATA-BASE The P&AR department (PIMS Cell) has in a memorandum informed that, Government of Nagaland has envisioned implementing e-governance in the State with a view to enhance transparency and efficiency, minimize errors and provide quality and speedy services to its employees. The Personal Information Management System (PIMS) is helping the State Government in getting instant access and accurate information of State Government employees. It is a comprehensive web-enabled personnel management system for the State Government to address the administrative requirement for managing its employees, right from the date of their joining into service till they retire. In order to promote e-governance initiative and to provide transparency of the employee’s profile, the State Government has decided to make basic PIMS data public. Further, State Government employees will be able to access their own personal data from the website of PIMS, P&AR Department by logging in at www. pimsnaqaland.in. Individual Login Id and Password can be obtained from their concerned controlling Administrative Heads of Departments and the Heads of the Departments. Further, if any discrepancy arises, the same can be brought to the notice of the authority concerned for further necessary action. 6 THE WARRIOR VOL-48 NO.03 JUNE 2019 A DIPR MONTHLY MAGAZINE OFFICIAL ORDERS and NOTIFICATIONS HEAT WAVES - DOs AND DONTs Dos Must for all • Listen to radio, watch TV, read newspapers for local weather news • Drink sufficient water • Use ORS (Oral Rehydration Solution), homemade drinks like lassi, torani (rice water), lemon water, buttermilk, etc. to keep yourself hydrated. • Wear lightweight, light-coloured loose cotton clothes. • Cover your head: Use a cloth, hat or umbrella. Employers and Workers • Caution workers to avoid direct sunlight. • Schedule strenuous jobs to cooler times of the day. • Increasing the frequency and length of rest breaks for outdoor activities. • Pregnant workers and workers with a medical condition should be given additional attention. Other Precautions • Stay indoors as much as possible. • Keep your home cool, use curtains, shutters or sunshade and open windows at night. • Use fans, damp clothing and take bath in cold water frequently. • If you feel faint or ill, see a doctor immediately. • Keep animals in shade and give them plenty of waters to drink.
