Recommendations for Council action: 1. FIND that the City Council has imposed all the mitigation measures that are within the control of the City, as described in the Final Mitigated Negative Declaration that is associated with the impacts of vacating Vermont Avenue and 83rd Street Vacation District (VAC No. E1400958) and that other mitigation measures that are not withing the authority of the City, have been or should be imposed as set forth in the findings of the Community Redevelopment Agency (CRA) as adopted by the CRA as Resolution No. 6862 on April 7, 2005 and attached to the Council file. 2. FIND that no new information exists to show that the project or circumstances of the project have been changed to require additional environmental review, as described in California Environmental Quality Act (CEQA) Guidelines 15162, and therefore the existing environmental documents as described above in Recommendation No. 1 adequately describe the potential impacts for the vacation of Vermont Avenue and 83rd Street Vacation District. 3. ADOPT the FINDINGS of the City Engineer dated January 17, 2006, as the Findings of the Council. 4. ADOPT the accompanying City Engineer report dated January 17, 2006 to approve the vacation. 5. INSTRUCT the City Clerk to set a public hearing date for March 1, 2006. Fiscal Impact Statement: The City Engineer reports that the petitioner has paid a fee of $6,540.00 for the investigation of this request pursuant to Section 7.42 of the Los Angeles Administrative Code (LAAC). Any deficit fee to recover the cost pursuant to Section 7.44 of the LAAC may be required of the petitioner. Maintenance of the public easement by City forces will be eliminated. SUMMARY The City Engineer reports that the area sought to be vacated is vacating Vermont Avenue and 83rd Street Vacation District (a map of the area is included as Exhibit B in the May 26, 2005 City Engineer report and is attached to the Council file). Specifically, this vacation consists of the following: 1) The easterly 30.5 feet of Vermont· Avenue lying between 83rd Street and 84th Street. 2) The north/south alley easterly of Vermont Avenue between 83rd Street and 84th Street. 3) The east/west alley southerly of 83rd Street from the north/south alley easterly of Vermont Avenue to approximately 124 feet easterly thereof. The purpose of this vacation request is to consolidate the vacation area with the adjoining properties to construct a new office building and associated parking structure. Additionally, this vacation action is part of the Manchester Vermont Village Project, a project pertaining to the development of a four story, government office building with 200,000 rentable square feet for office use and 4,000 rentable square feet of retail and/or fast-food restaurant use. Additionally, a six-story parking garage housing approximately 900 parking spaces, and a 6,000 square foot child care center would be constructed. This project site is to be located along the east side of South Vermont Avenue between 83rd and 84th Streets and the project developer is ICO Development, LLC who is also the petitioner for this street vacation. The CRA is the lead agency under the CEQA and this project was previously approved by Council on May 11, 2005 (Council file No. 05-0806). Finally, this vacation procedure is being processed under procedures established by Council on March 5, 2002 as detailed in Council file No. 01-1459. Finally, according to the City Engineer, the vacation of the public street as shown on the map designated as Exhibit B of the May 26, 2005 City Engineer report could be conditionally approved based upon the following: 1) it is unnecessary for present or prospective public use; 2) it is not needed for vehicular circulation or access; 3) it is not needed for nonmotorized transportation purposes; and 4) a 26 and 20-foot variable width replacement alley is proposed to be dedicated and constructed over Lot 9, as depicted on Exhibit B of the January 17, 2006 City Engineer report, to provide for ingress/egress to the existing east/west alley southerly of 83rd Street. At its regular meeting held on January 27, 2006, the Public Works Committee considered the recommendations of the City Engineer as contained in its January 17, 2006 report. After having provided an opportunity for public comment, the Committee moved to recommend approval of the recommendations as contained in said City Engineer report. This matter is now submitted to Council for its consideration.
