Marie Tribe of Chippewa Indians WHEREAS, the Pueblo of Jemez has continuously used and occupied its NORTHEAST Lance Gumbs aboriginal lands in the Jemez Mountains, including the area now encompassed by the Shinnecock Indian Nation Valles Caldera National Preserve, for traditional and non-traditional purposes pursuant NORTHWEST Fawn Sharp to the Pueblo’s aboriginal Indian title from time immemorial to the present; and Quinault Indian Nation PACIFIC Rosemary Morillo Soboba Band of Mission Indians WHEREAS, in 1860 the United States Congress authorized the heirs of Luis ROCKY MOUNTAIN Maria Cabeza de Baca to select lands within New Mexico Territory in settlement of Ivan Posey Eastern Shoshone Tribe the heirs’ Spanish land grant claim in the vicinity of Las Vegas, New Mexico; and SOUTHEAST Ron Richardson Haliwa-Saponi Indian Tribe WHEREAS, the Baca heirs received an American grant title subject to SOUTHERN PLAINS continuing Pueblo of Jemez aboriginal Indian title; and Stephen Smith Kiowa Tribe of Oklahoma SOUTHWEST Manuel Heart WHEREAS, the United States and the Pueblo of Santa Clara purchased the Ute Mountain Ute Tribe 1860 American land grant title to the Baca Location No. 1 from private parties on July WESTERN Arlan Melendez 25, 2000 to create the Valles Caldera National Preserve; and Reno Sparks Indian Colony EXECUTIVE DIRECTOR Jacqueline Johnson Pata WHEREAS, at all times the lands encompassed by the Valles Caldera Tlingit National Preserve have remained subject to the valid aboriginal Indian title of the NCAI HEADQUARTERS Pueblo of Jemez, which title has never been abandoned or terminated, and the Pueblo 1516 P Street, N.W. Washington, DC 20005 of Jemez wants these lands returned to its ownership and control; and 202.466.7767 202.466.7797 fax www.ncai.org WHEREAS, in July 2012 the Pueblo of Jemez filed a quiet title lawsuit, Pueblo of Jemez v. United States, to quiet its aboriginal Indian title to the Valles Caldera National Preserve, which lawsuit was dismissed on the grounds that it is precluded by the 1946 Indian Claims Commission Act and is now on appeal to the 10th Circuit Court of Appeals; and NCAI 2014 Annual Session Resolution ATL-14-009 WHEREAS, the Pueblo of Jemez agrees that other Pueblos may continue any traditional cultural activities and spiritual uses they have traditionally conducted within the Valles Caldera and will also preserve the Conservation and Access Easement held by Santa Clara Pueblo within the Valles Caldera National Preserve; and WHEREAS, the United States recently announced its support of the United Nations Declaration on the Rights of Indigenous Peoples and Article 26, paragraph 1 of the Declaration states that “[i]ndigenous peoples have the right to the lands, territories and resources which they have traditionally owned, occupied or otherwise used or acquired.” NOW THEREFORE BE IT RESOLVED, that the NCAI calls upon the United States as Indian trustee to recognize the Pueblo of Jemez’ continuing aboriginal Indian title to the lands within the Valles Caldera National Preserve and to return ownership and control of these lands to the Pueblo of Jemez but also to ensure that other Pueblos will continue to have access to areas within the Valles Caldera that they have used for traditional cultural purposes, and to maintain the existing Conservation Easement held by Santa Clara Pueblo; and BE IT FURTHER RESOLVED, that the President and Executive Director of the National Congress of American Indians are hereby authorized to provide to governmental agencies and governmental officials as appropriate upon request by the Governor of the Pueblo of Jemez letters of support for recovery by the Pueblo of Jemez of the lands encompassed by the Valles Caldera National Preserve; and BE IT FINALLY RESOLVED, that this resolution shall be the policy of NCAI until it is withdrawn or modified by subsequent resolution. CERTIFICATION The foregoing resolution was adopted by the General Assembly at the 2014 Annual Session of the National Congress of American Indians, held at the Hyatt Regency Atlanta, October 26-31, 2014 in Atlanta, Georgia, with a quorum present.     Passive Monitoring of Ambient Reactive Gaseous Mercury ihFin the Four Corners Area, Eastern OklhOklahoma, an d Central/East Texas: Important Method Evaluation and Baseline Work Presented at the National Air Toxics Monitoring and Data Analysis Workshop, Dallas, Texas, April 7, 2011. • Mark Sather, U.S. EPA Region 6, Air Quality Analysis Section • (214) 665-8353, [email protected] 1 Introduction • This presentation will summarize the first year of a two year monitoring project estimating reactive gaseous mercury (RGM, a.k.a. gaseous oxidized mercury, GOM) dry deposition in the Four Corners area and eastern Oklahoma, and preview a similar study to be done in Texas. • RGM of interest because of its chemical reactivity/water solubility; RGM readily deposits to water , soils and vegetation by both dry and wet processes; atmospheric lifetime = 0.5-2 days versus 0.5-2 years for elemental mercury which is mildly reactive and sparingly soluble in water. • Four Corners/Eastern Oklahoma project is a two year effort funded by U.S. EPA ORD Regional Applied Research Effort (RARE) program; the upcoming Texas study will also be funded by RARE . • Project Collaborators: U.S. EPA Region 6, U.S. EPA ORD, Frontier Geosci/lbliiences/Global Sciences, Ali on, NMED, NPS, USFS/ BLM, Jemez Pueblo/Valles Caldera Trust, Cherokee Nation. • Ambient monitoring began in August, 2009, and will run through the first part of August, 2011. 2 Project Objectives • To gather first-time RGM dry deposition estimates for 24 consecutive months at six sites in the Four Corners area to set a valuable ambient RGM dry deposition estimate baseline with proper assessment of: (a) the effectiveness of the Frontier Atmospheric Dry Deposition (FADD) surrogate surface devices in providing reliable RGM dry deposition estimates and (b) the inter-annual RGM dry deposition estimate variability.

    ______________________________________________________________________________ A Vegetation Map of the Valles Caldera National Preserve, New Mexico ______________________________________________________________________________ A Vegetation Map of Valles Caldera National Preserve, New Mexico 1 Esteban Muldavin, Paul Neville, Charlie Jackson, and Teri Neville2 2006 ______________________________________________________________________________ SUMMARY To support the management and sustainability of the ecosystems of the Valles Caldera National Preserve (VCNP), a map of current vegetation was developed. The map was based on aerial photography from 2000 and Landsat satellite imagery from 1999 and 2001, and was designed to serve natural resources management planning activities at an operational scale of 1:24,000. There are 20 map units distributed among forest, shrubland, grassland, and wetland ecosystems. Each map unit is defined in terms of a vegetation classification that was developed for the preserve based on 348 ground plots. An annotated legend is provided with details of vegetation composition, environment, and distribution of each unit in the preserve. Map sheets at 1:32,000 scale were produced, and a stand-alone geographic information system was constructed to house the digital version of the map. Abstract This study focuses on the cultural-historical environment of the 88,900-acre (35,560-ha) Valles Caldera National Preserve (VCNP) over the past four centuries of Spanish, Mexican, and U.S. governance. It includes a review and synthesis of available published and unpublished historical, ethnohistorical, and ethnographic literature about the human occupation of the area now contained within the VCNP. Documents include historical maps, texts, letters, diaries, business records, photographs, land and mineral patents, and court testimony. This study presents a cultural-historical framework of VCNP land use that will be useful to land managers and researchers in assessing the historical ecology of the property. It provides VCNP administrators and agents the cultural-historical background needed to develop management plans that acknowledge traditional associations with the Preserve, and offers managers additional background for structuring and acting on consultations with affiliated communities. The Authors Kurt F. Anschuetz, an archaeologist and anthropologist, is the Program Director of the RÍo Grande Foundation for Communities and Cultural Landscapes in Santa Fe, New Mexico. Box 359 Jemez Springs, NM 87025 (505) 661-3333 [email protected] SWJML VALLES CALDERA NATIONAL PRESERVE Page 2 Existing Condition - Hydrology VALLES CALDERA NATIONAL PRESERVE Existing Condition - Hydrology Introduction Water quality is strongly influenced by surficial geology and deeper, structural elements. The temperature of some caldera stream water may be naturally warmed. Faulting controls valley and channel development, and has led to particular erosion sensitivity of certain slopes. Remnant ashflow along the footslopes of the resurgent domes and older caldera rim has secondary alluvial and landslide deposits which are particularly susceptible to erosion. The upland slopes of the caldera are connected by surface flow with the valley bottoms only through gullied swales or degraded 1st order draws that are entirely within the slope deposits mentioned. The 1935 aerial photographs show all of the present gully forms and that many were then actively scouring. These photos predate the industrial logging and road building and 1960’s stock tank construction. Historic sheep grazing may have been the single most important management activity that contributed to gully starts. The possibility is raised that the extent of perennial wet valley bottoms (fens do still exist) was much greater in pre-settlement times, and surface flow on the valley bottoms was more dispersed. In general the present stream channels are in an upward trend with regards to bank stability although the process is slowed by a paucity of transported material. Cooling units of the tuff were mapped in detail and correlated using new geo- chemical data, allowing us to confi dently sample isochronous units for paleomagnetic remanence directions. In total, 410 specimens were α ≤ subjected to step-wise thermal and alternating fi eld demagnetization. Of the 40 accepted site means, 30 have 95 values 5°. Analysis of the geographic distribution of the site-mean declinations of the data set reveals no statistically signifi cant tectonic rotation either across (northwest/southeast) the northeast-striking Jemez fault or across (east/west) the north-striking Pajarito fault zone. Similarly, our data do not record any measurable relative change in declination difference (−1.1° ± 1.6°) that could be interpreted as a rotation over the ~0.36 m.y. time duration between deposition of the two principal stratigraphic members of the Bandelier Tuff. The step-over discussed in this paper is an area of exceptional structural complexity and, as such, meets the defi nition of “accommodation zone.” We propose the name “Jemez- Embudo accommodation zone” for this composite of structural and volcanic features in recognition of its regional importance in the evolu- tion of the Rio Grande rift.

(a) FINDINGS.—Congress finds that— (1) the Baca ranch comprises most of the Valles Caldera in central New Mexico, and constitutes a unique land mass, with significant scientific, cultural, historic, recreational, ecological, wildlife, fisheries, and productive values; (2) the Valles Caldera is a large resurgent lava dome with potential geothermal activity; (3) the land comprising the Baca ranch was originally granted to the heirs of Don Luis Maria Cabeza de Vaca in 1860; (4) historical evidence, in the form of old logging camps and other artifacts, and the history of territorial New Mexico indicate the importance of this land over many generations for domesticated livestock production and timber supply; (5) the careful husbandry of the Baca ranch by the current owners, including selective timbering, limited grazing and hunting, and the use of prescribed fire, have preserved a mix of healthy range and timber land with significant species diver­ sity, thereby serving as a model for sustainable land develop­ ment and use; (6) the Baca ranch's natural beauty and abundant resources, and its proximity to large municipal populations, could provide numerous recreational opportunities for hiking, fishing, camping, cross-country skiing, and hunting; (7) the Forest Service documented the scenic and natural values of the Baca ranch in its 1993 study entitled "Report on the Study of the Baca Location No.
