Copies of this Transcript and the accompanying Tithe Map can be obtained from:- G Dutton 7 Ashe Park Cottages Steventon Basingstoke Hants RG25 3AY email: [email protected] © G Dutton 12th July 2003 Contents Page Legal Agreement of Apportionment 2 Schedule of Rent Charge Apportionments (Listed Alphabetically by Land Owner) 6 Summary of Holdings and Rent Charges 29 Numeric Listing of Holdings by Map Reference 34 Page 1 Wootton St Lawrence - Tithe Apportionment Legal Agreement of Apportionment Page 2 Agreement APPORTIONMENT of the RENT-CHARGE in lieu of TITHES in the Parish of Wotton St Lawrence in the County of Southampton Whereas AN AWARD of RENT-CHARGE in lieu of TITHES in the Parish of Wotton Ssint Lawrence in the County of Southampton, was on the Thirteenth day of February in the Year one thousand eight hundred and forty six, confirmed by the Tithe Commissioners for England and Wales, of which Award with the Schedule therein comprised, the following is a Copy:- Know all Men by these presents That I William Wakeford Attree of the Middle Temple Barrister at Law having been duly appointed and sworn an Assistant Tithe Commissioner according to the provisions of the Acts for the commutation of Tithes in England and Wales and having been also duly appointed to ascertain and award the total sums to be paid by way of Rentcharge instead of the tithes of the Parish of Wotton Saint Lawrence in the County of Southampton Do hereby award as follows that is to say:- Whereas I have held divers Meetings in the said Parish touching the matter aforesaid of which Meetings due Notice was given for the information of the Landowners and Titheowners of the said Parish. And whereas I have duly considered all the allegations and proofs tendered to me by all parties interested and have made all enquiries touching the premised subject which appeared to me to be necessary. And whereas I find that the estimated quantity in statute measure of all the lands of the said Parish which are subject to the payment of tithes amounts to Two thousand six hundred and eighty five acres three roods and seventeen perches which are cultivated and used as follows that is to say. Two thousand two hundred and fifty five acres one rood and thirty nine perches as Arable land. One hundred and fourteen acres one rood and ten perches as Meadow or Pasture Two hundred and sixty acres as Woodland And Fifty six acres and fourteen perches are Gardens, Homesteads and the sites of houses. And whereas I find that the Glebe land belonging to the Vicar of the said Parish for the time being amounting by estimation to Thirty six acres and thirty nine perches statute measure are by prescription absolutely exempt from the render of all tithes both great and And whereas I find that the undermentioned lands of the said Parish that is to say, All those lands called or known as the Demense lands belonging to the Dean and Chapter of the Cathedral Church of Winchester and now in the occupation of the Reverend Lovelace Bigg Wither or his undertenants and containing by estimation One thousand one hundred and twenty two acres one rood and thirty seven perches are by prescription or otherwise absolutely exempt from the render of all tithes both great and small. And all that farm called or known as Tangier Farm belonging to the Dean and Chapter of the Cathedral Church of Winchester and now in the occupation of the Reverend Lovelace Bigg Wither or his undertenants and containing by estimation Eighty acres is by prescription or otherwise alos absolutely exempt from the render of all Rectorial tithes and covered from the render of all Vicarial tithe in kind except the tithe of Wood by a Modus or prescriptive annual payment of One pound payable in lieu thereof to the Vicar of the said Parish for the time being. Page 3 Agreement And all that farm called or known as Bolboshes or Bulls Bushes Farm belonging to William Beach containing by estimation One hundred and ninety seven acres, whereof One Hundred and seventy acres are now in the occupation of John Taplin and twenty acres being the remaining part thereof are now in the occupation of the said William Beach himself by prescription or otherwise absolutely exempt from the render of all Vicarial tithes in kind by a Modus or prescriptive annual payment of One Pound payable in lieu thereof to the Vicar of the said Parish for the time being. And whereas I find that all the lands of the said Parish except as aforesaid mentioned are liable to the payment of all manner of tithes And whereas in estimating the clear annual value of the said tithes I have taken into account the rates and assessments paid in respect of such tithes during the seven years of average prescribed by the said Act. And whereas due Notice was given me in the manner prescribed by the said Act that the clear average value of the great and small tithes of the said Parish during the said seven years of average would not fairly represent the sums which ought to be the basis of a And whereas I have taken into consideration all the allegations and proofs tendered to me touching the matter of the said Notice before awarding the Rentcharges hereinafter mentioned. And whereas I find that the Dean and Chapter of the Cathedral Church of Winchester are the Appropriators of the all tithe of Corn and Velches arising from all the titheable lands of the said Parish and that the Reverend Lovelace Bigg Wither holds a Lease of the said tithes under the said Dean and Chapter. And that the Vicar of the said Parish for the time being is entitled to all the tithes thereof other than the tithes of Corn and Velches. Now Know Ye that I the said William Wakeford Attree do hereby award that the annual sum of Five hundred seventy pounds eighteen shillings and six pence by way of Rentcharge subject to the provisions of the said Act shall from the First day of October next preceding the confirmation of the Apportionment of the said Rentcharge be paid to the said Lovelace Bigg Wither, his executors administrators or assigns during the continuance of the said lease and after expiration or other determination tereof then to the said Dean and Chapter instead of all the tithes of Corn and Velches arising or accruing due from all the titheable lands of the said parish And I do hereby direct and award that no part of the said Rentcharges shall be apportioned upon any holding of less than thirty six In Testimony whereof I have hereunto set my hand this fifth day of February in the Year one thousand eight hundred and forty six.
