M I N U T E S of the ORDINARY MEETING of The PARISH COUNCIL held at The COASTAL ZONE, DOWNDERRY, (formerly The Methodist Church) at 7.30pm on Thursday, 10 th January 2013.

1. DECLARATION OF INTEREST IN ITEMS ON THE AGENDA: Cllr. D.L.G. Elliott declared a disclosable pecuniary interest in relation to item 8.2. on the agenda being the applicant of the planning application in question Cllr. S. J. Parry declared a disclosable pecuniary interest in relation to item 8.2. being an agent contracted to market land at the application site.

2. 10 MINUTE PUBLIC PARTICIPATION PERIOD for public comment on the items below: A member of the public addressed the Meeting regarding recent flooding at Keveral Gardens and Keveral Lane, Downderry. C. Cllr. R. Pugh was thanked for his help in securing help from a local land owner to clear up after the flooding. It was suggested that work would be required to avert future flooding including increasing drainage to cope with rainwater from a gulley that ran down from Struddicks Farm, Hill to Keveral Gardens and to provide larger pipes to contain water flowing through the culverts at the bottom of Keveral Gardens. The Parish Council was asked to consider producing a contingency plan for future events of flooding. The Parish Council was asked to investigate responsibility for the maintenance of Keveral Lane. A second member of the public spoke in favour of planning application PA12/11578 Sunnyside, Brenton Road, Downderry (Item 8.2.2.), citing reasons including the poor state of repair of the exiting dwelling, the need to accommodate a sick relative, the fact that the new build would incorporate environmentally sustainable features and the support the project would provide for local employment. A third member of the public spoke objecting to planning application PA12/11392, Plot 1, Land Adjacent 40 Buttlegate, Downderry( Item 8.2.1.), stating that while he had no objection to development of the site he was concerned by the proposed creation of an additional entrance to the Highway near to a dangerous bend on Buttlegate. Concern was also expressed that the additional drive would increase rain water run-off onto Buttlegate thereby adding to the risk of flooding of properties on the Main Road. There being no further requests to address the meeting, the Chair closed the public participation period.

4. STANDING ORDERS OF THE COUNCIL: To adopt revised Standing Orders of the Council (January 2013) The Clerk informed members that the revised Standing Orders were produced in line with the new Code of Conduct that had been adopted at the November 2012 meeting. It was understand that NALC was in the process of producing a completely new set of Standing Orders that the Council could adopt later in 2013. After discussion Cllr. Mrs. M. Y. Byles proposed that the Council defer adoption of the revised Standing Orders until the next full Council meeting, in order to provide time for councillors to familiarise themselves with them; this was seconded by Cllr. Mrs. A. Robinson and agreed unanimously by the Meeting.

5. MINUTES: 5.1. Minutes of the Ordinary Meeting of 8 th November 2012 It was proposed by Cllr. Mrs. G. E. Hartland, seconded by Cllr. D. L. G. Elliott and AGREED unanimously by the Meeting to accept the minutes as a correct record.

6. REPORTS ON MATTERS ARISING FROM THE MINUTES: There were none.

7. POLICE MATTERS: 7.1. POLICE MATTERS FOR THE COUNCIL P.C.S.O. John Riggall had emailed the monthly police report, stating that since the last meeting (8 th November 2012) the Parish had suffered seven recorded crimes, being 1) an assault in Buttlegate, Downderry 2) theft of water tanks from Front Road 3) damage to motor vehicle on Looe Hill 4) assault on the B3247 near Triffle 5) sheep worrying at Deviock Barton Farm 6 & 7) two reports of out of control dogs in Narkurs. During 2012 the parish had suffered 41 recordable crimes.

7.2. COUNCIL MATTERS FOR THE POLICE: Cllr. Ms. H. M. Brockbank requested that a badly parked van at Brenton Road, Downderry be reported to the police as it was causing an obstruction. Cllr. R. J. Daniel stated that the crime figures supplied by the Police did not provide any explanation and that more detail was required. It was requested that a representative from the Police be asked to attend the next meeting.

8. PLANNING:

8.1. PLANNING COMMITTEE: 8.1.1. Minutes of the meeting of 22nd November 2012 It was proposed by Cllr. D. L. G. Elliott to accept the minutes as a correct record, subject to minor amendment; this was seconded by Cllr. Ms. H. M. Brockbank and agreed unanimously by the Meeting.

8.1.2. Matters arising from the minutes Cllr. D. L. G. Elliott asked if trees received from the Woodland Trust had been planted. The Clerk stated that he had spoken to Mr. Roger Prowse who would be carrying out this work in the near future. Cllr. Mrs. A. Ratsey requested that as item 10 of the minutes (a request for discussion of Broad Yards car park to be put on the agenda), had not appeared on the agenda, that his be put on FROMthe agenda for the nextTHE full council PARISHmeeting. 8.2. PLANNING APPLICATIONS: 8.2.1. PA12/11392 Mr. & Mrs. D. L. G. Elliott – PLOT 1, LAND ADJACENT 40 BUTTLEGATE, DOWNDERRY Construction of 1 no 3 bedroom house with access to highway (Case Officer – Davina Pritchard)

Cllr. D. L. G. Elliott stated that the application was to provide separate access for a proposed dwelling at plot 1, and then left the Meeting. Cllr. S. J. Parry also left the Meeting.

After discussion Cllr. Ms. H. M. Brockbank proposed objection to the application for reasons of highway safety because of the proposed poor access, and also because of possible increase in rain water run-off from the proposed new driveway onto Buttlegate that might exacerbate the risk of future flooding onto the Main Road; this was seconded by Cllr. Mrs. M. Y. Byles and agreed unanimously by the Meeting.

Cllr’s Elliott and Parry rejoined the Meeting.

8.2.2. PA12/11578 Mr. N. Wiseman – SUNNYSIDE, BRENTON ROAD, DOWNDERRY Demolition of existing dwelling and construction of new dwelling with slightly enlarged parking area with retained garaging (Case Officer – Steve Jefferson) Cllr. S. J. Parry proposed support of the application; this was seconded by Cllr. Mrs. G. E. Hartland and agreed unanimously by the Meeting.

8.3. PLANNING APPLICATIONS RECEIVED AFTER PUBLICATION OF THE AGENDA None had been received.

8.4. PLANNING APPEALS: 8.4.1. PA12/00108 Wentworthy, Main Road, Downderry (DCLG Ref: APP/D0840/A/12/2186485/NWF) The Clerk reminded members that the Parish Council had objected to this application and asked if the Council required any additional submission to be made regarding the appeal; the deadline for submissions being 22 nd January 2013. Cllr. Mrs. M. Y. Byles proposed that the Clerk be instructed to write, reiterating the objections previously made by the Parish Council; this was seconded by Cllr. D. L. G. Elliott and agreed unanimously by the Meeting.

10.2. NEIGHBOURHOOD PLAN - UPDATE Cllr. Mrs. A. Ratsey informed the members that a meeting of the Neighbourhood Plan Planning Group had taken place. As a first step it would be necessary to submit a request to Council for the agreed area of the plan (namely Deviock Parish) to form the basis of the Neighbourhood Plan area, as previously agreed by the Parish Council. The Clerk was instructed to write formerly requesting this permission. Cllr. Ratsey continued that once this submission had been made a six week consultation period would take place. Officer support from to help with formulating the plan should be available. A series of public engagement sessions would be held to gain ideas and feedback. A minimum of 50% of local voters was required to enable the plan to be adopted. The planning group felt that it would be best to keep the plan as short as possible in order to increase the likelihood of successful adoption.

10.3. AFFORDABLE HOUSING - UPDATE The Clerk informed members that a response from Nick Marsden / Westcountry Homes, regarding a proposal by Mr. Alan Fox of Cornwall CLT Ltd. relating to the possibility of a community led scheme at the Treliddon Lane site with Westcountry Homes as the provider, had not met with a positive response. The land owner was currently exploring all options. Cllr. Ms. H. M. Brockbank requested that there should be a meeting of the Affordable Housing Working Party. Members of this working party agreed to organise a meeting and inform the Chair when this would be occurring.

11.6. FINANCIAL CORRESPONDENCE: None had been received. 11.6.1. Cornwall Council – Precept calculation and assessment (Email received 7 th December 2012 from Mr. Peter Hocking, Acting Business Analyst, Finance Service. Cornwall Council) The Clerk explained that If the Cornwall Scheme was agreed then Deviock Parish Council would receive a grant of approximately £2,000.00 and could therefore reduce the 2013/14 Precept request by that amount. As this scheme would not be finalised with Government until 15th January 2013 it would be best to wait and see what happened at that time and perhaps grant delegated authority to the Clerk so that an amendment to the 2013/14 Precept request could be made if this scheme did come into affect. Cllr. D. L. G. Elliott proposed that the Clerk be granted delegated authority to amend the 2013/14 Precept request in line with any Cornwall Council agreed grant to the Parish Council; this was seconded by Cllr. R. J. Daniel and agreed unanimously by the Meeting. Cllr. Mrs. A. Ratsey requested that clarification of the Cornwall Council scheme be sought.

11.7. TO CONSIDER A DRAFT PROTOCOL FOR COUNCIL GRANT ALLOCATION Cllr. Mrs. A. Ratsey presented a form for use by groups wishing to apply for Council grants. After discussion it was agreed that the Clerk should liaise with Cllr. Ratsey in order to finalise this form.

11.8. FINANCIAL BUSINESS RECEIVED AFTER THE PUBLICATION OF THE AGENDA: None had been received.

12. HIGHWAY MATTERS: 12.1. TRAFFIC & PARKING ISSUES: Downderry, Seaton & Hessenford The issue of recent flooding was considered under item 13.1.1.

12.1.1. Parish T.R.O. - Update No report was made.

12.2. PUBLIC TRANSPORT ISSUES C. Cllr. R. Pugh informed members that a revised bus timetable for A Line Buses would come into effect on 14 th January 2013. 13. CURRENT / ONGOING BUSINESS: - 13.1. FLOODING 13.1.1. To consider the recent flooding issues affecting the Parish Councillors discussed the recent problems of flooding that had affected various locations within the Parish including: Narkurs, Treliddon Lane, Downderry and Keveral Gardens and Lane, Seaton. Cllr. D. L. G. Elliott informed members that he had arranged for a site meeting at Narkurs with Cornwall Council Highways officers for Tuesday 15 th January 2012, 10 am, in order to discuss the flooding at Narkurs. Cllr. S. J. Parry stated that maintenance of drains and culverts by the local authorities was not taking place as regularly as in the past and that this failure had increased the effects of the floods. C. Cllr. R. Pugh stated that he would be having site meetings with Steve Blatchford, Cornwall Council Engineer, in order to assess the causes and damage created by the flooding. With regard to problems at Treliddon Lane, Downderry, he would approach Downderry Construction to request that they take action to clear the stream. It had been suggested that a trash screen should be installed in the stream adjacent to Keveral Gardens, Seaton, in order to catch moving debris.

FROM13.1.2. Cornwall CommunityTHE Flood PARISH Forum – To consider participation WEBSITE in this forum Cllr. Ms. H. M. Brockbank offered to represent the Parish Council on this forum and this was agreed by the Meeting.

13.2. PARISH PROJECTS 13.2.1. Rocknose Footpath: The Clerk reported that a letter had been received from Mr. Jonathan Luker (Development Officer, Planning & Regeneration Service), acknowledging receipt of a valid application request for discharge of condition 3 in respect of decision notice PA11/09711 and that an official response would be made within 8 weeks from 10th December 2012.

13.3. SEATON COUNTRYSIDE PARK 13.3.1. Distance Markers for Seaton Countryside Park Cllr. S. J. Parry informed members that he had a meeting with Park Ranger and the position of the distance marker posts had now been agreed. Funding for the posts was in place, although there could be a shortfall of approximately £150.00 which he hoped could be found. Cllr. Parry also stated that because of recent flooding the north end of the park was currently closed to the public as the board walk was in need of repair. Cllr. Mrs. A. Ratsey informed members that Footpath 6 was now in a poor state of repair because of the recent floods. The Clerk stated that the Boules Piste had also been affected by the floods and that he would contact the Twinning Association regarding this.

13.3.2. New Public Toilets for Seaton – Update The Clerk reported that there had been problems with blocked drains at these toilets and that the Ladies toilets had had to be closed on a number of occasions because of this. The toilet block had also been flooded.

13.4. ST ANNES HESSENFORD, GRAVEYARD EXTENSION STRIP: Cllr. D. L. G. Elliott asked if solicitors had been contacted regarding the sale of this land. The Clerk agreed contact Mark Grassam Solicitors in order to instruct them on the land sale.

13.5. TO CONSIDER A REQUEST FOR ADDITIONAL DOG WASTE BINS IN THE PARISH: Cllr. Ms. H. M. Brockbank requested that a dog waste bin be installed in Treliddon Lane, Downderry. It was suggested that the fact that dog waste could now be deposited in ordinary public litter bins be made more widely known to the public. It was agreed that this fact should be published in the Nut tree Newsletter. Because of the temporary closure of Footpath 1 (St. Nicolas School, Downderry), the dog waste bin located at the beach was not now being cleared. It was suggested that this bin be moved to Treliddon Lane.

13.6. PARISH NOTICEBOARDS The Clerk reported that it had been suggested that the W.M.C. notice board be moved to the back wall of the Broads Yard bus shelter and that a new noticeboard be erected on the pavement at the bottom of Broads Yard car park. This was agreed by members. The Clerk continued that a new board was likely to cost in excess of £1,000.00 Cllr. D. L. G. Elliott suggested that the Clerk contact St. Germans Parish Council in order to obtain details of the contractor who had recently supplied new galvanised metal notice boards for that council. The Clerk also state that the notice board adjacent to the Seaton play area was waiting for repair as was the board at Narkurs.

14. REPORT BY CORNWALL COUNCILLOR :- FROMC. Cllr. R. Pugh made THE the following PARISH points:- WEBSITE a) The old public toilets adjacent to the Seaton Beach Café were being advertised for sale by Cornwall Council. b) That the Coastal Footpath between Seaton and Looe had been closed because of a land slip.

14. REPORT BY CORNWALL COUNCILLOR (continued) :- c) That there had been an issue over recycling collections at Trewall Hill, Downderry, but that this had now been resolved. d) That the planning application by Tesco for a new store at Looe had been deferred. e) That the Chief Executive of Cornwall Council had resigned in order to take up a new position in Wellington, New Zealand. f) That Cornwall Council was still in the process of finalising budgets for the forthcoming year. g) That he had been thrilled by his visit to a performance by Deviock Community Music.

15. NEW BUSINESS :- 15.1. CORNWALL COUNCIL / NALC / CALC, ETC DOCUMENTS 15.1.1. Code of Conduct training sessions – Thursday 17 th January 2013 6pm – Town Council Offices Cllr. Ms. H. M. Brockbank indicated her intention to attend this training session.
