Wasserman*** For which team should basketball superstar LeBron James play? Where should celebrity statistician Nate Silver ply his craft of predictive wizardry? On which network should Jon Stewart flash his mordant wit? For some reason, the answers to these disparate questions are only indirectly related to the desires of third-party fans. Indeed, it is a puzzle that fans do not already have more influence on the recruitment or retention of their sports or en- tertainment heroes ("talent"). This paper proposes that fans can adopt forms of crowdfunding to mo- bilize and empower fans to play a larger role in the decision-making associ- ated with which "teams" the talent will work. By creating Fan Action Committees ("FACs"), fans could directly compensate talent or donate to * 1972-2014. We discuss both obstacles and objections from a variety of policy and legal perspectives ranging from competitive balance to distributive justice. Finally, we consider possible extensions of the FAC model as well as offer some ruminations on why FACs have not already developed. Importantly, FACs create the potential for more efficient valuations of talent by registering not only the number of fans but also the intensity of their preferences. This insight, which stresses the upside of price discrimina- tion, has relevance for a wide range of human endeavors where bilateral con- tracts have effects on third parties that are neither calibrated nor valued adequately. Clevelanders were stung that basketball hero LeBron James took his talents to South Beach, when he signed with the Miami Heat in 2010,2 while Miami fans were equally disap- pointed when James returned to Cleveland in 2014. 3 Many fans of TV's "Downton Abbey" were crushed when actor Dan Stevens (the actor who played male romantic lead Matthew Crawley) left the show in 2013.' Stu- dents, faculty, and alumni at the University of Chicago are undoubtedly still upset about losing one of the most prolific scholars, Cass Sunstein,5 to Harvard Law School a few years ago. The choices of where high-profile talent "perform" in an organiza- tional context-athletes, academics, chefs, network newscasters, actors, op- era singers, faculty members-present a puzzle. On the one hand, "teams"-the organizations that employ talent-try to anticipate the pref- erences of fans to capture their dollars. On the other hand, fans are largely 1 See Daniel L. But for purposes of the larger idea, the team represents the second party in the bilateral negotiation that controls where talent performs and under what conditions. So the team might be a television network, a law school, a restaurant, a couture house, a symphony, etc. HarvardJournal of Sports & Entertainment Law / Vol. 6 shut out of the conversations between talent and team. We wonder why fans are not more proximately involved in talent's choices. Even if disappoint- ment for fans is inevitable, utter powerlessness is not-or so we argue here. Instead, fans can overcome that powerlessness through crowdfunding. Crowdfunding empowers fans to collect and use money to influence the choices talent makes regarding where to perform or for what team. As we see it, groups of fans, what we call Fan Action Committees ("FACs"), would engage in coordinated influence mongering, raising and offering money in an effort to collectively affect the key choices made by stars or teams regard- ing recruitment and retention. FACs, in short, allow fans to put their money where their hearts are. A fancier way of saying this is that FACs can respond to and reflect the intensity of third-party

    Denise Egéa 385 The (Im)possible Gift of Education Denise Egéa Nazarbayev University Cecilia Diego writes, “Gifting in education is impossible.” I would like, if I may, begin by looking at this word “gifting.” According to the Oxford English Dictionary, “gift” as a verb has been used since the seventeenth century. Like the noun “gift,” it comes from the Old English asgift, which meant “payment for a wife,” or in the plural form, “wedding,” with its implication of dowries. In Middle Dutch and Old High German, the word had the same meaning associated with monetary value. In the History of France, we find the following sentence: “Parents were prohibited from selling, gifting, or pledging their children”1 (rather shocking, as it implies that they did, but it is still happening in some countries). Then, “gift” as a verb fell into disuse until 1924, when the United States Congress introduced a “gift tax.” Repealed in 1926, it was revised, updated, and, in 1932, was reinstated. This tax was levied by the Internal Revenue Service “on the transfer of property by one individual to another while receiving nothing, or less than full value, in return.”2 Note that this “gift tax” was “receiving nothing … in return.” When the tax code changed, from the “gift tax” came the expression “gifting money.” Mostly confined to the context of taxes, a 1995 episode of Seinfeld brought it again to attention, when the words “re-gift,” “de-gift”, and “re-gifter” were repeatedly used, following the passing off of an unwanted gift (a label-maker).3 By 2009, the word had gained enough traction for Ellen DeGeneres to center one of her monologues on “gifting,” and “re-gifting gifts.”4 So far, what characterizes “gifting” from the origin of the word “gift” and its association with “payment” and “dowry” through “gift tax” and from the notion of “re-gifting” is its reference to money in one form or another.

    The Twenty-First Century American Voter: The Dominance of Partisanship Matthew Farrell Government Department GOV490A Date of Graduation: May 17, 2008 Submitted May 2008 2 CHAPTER ONE: INTRODUCTION Nearly everyone who studies American politics or has any familiarity with the subject agrees that political parties are incredibly important institutions. However, the scope and nature of the role of political parties is frequently debated. Some argue that the role and configuration of American political parties has changed substantially in the past fifty years, while others argue that political parties have been stable. The debate now also focuses on when and how people choose which party they wish to support. One theory, which is often referred to as “revisionist,” believes that since the late 1960s people have decided where they stand on various issues and choose the party that they feel is closer to them ideologically. The revisionist approach believes that “citizens adjust their partisan self-images as warranted by experience and evidence.”1 The older position, which was established during the 1950s, argues that support for a party comes first, with specific positions on issues and support for certain ideas and individuals coming later. This “partisan influence” theory argues that “party identification influences value positions” as a result of the ability of party identification to influence perception.2 In this paper, I attempt to articulate the current debate about the role of partisanship in America, discuss how the current debate arises from the political history of the United States since 1950, and reach the conclusion that political parties are more important than ideology and generally precede issue positions and the much noted ideology.

Diles* Abstract The resurgence in franchise free agency in the National Football League (NFL) potentially implicates the loss of a significant source of local identity and tradition for multiple cities. In January 2016, NFL owners approved the relocation of the Rams franchise from St. Louis, Missouri, to Los Angeles, California, by a vote of thirty-to-two. The owners’ vote also potentially implicates the relocation of the San Diego Chargers and the Oakland Raiders. Though applauded by numerous sports commentators, athletes, and fans, the vote reflects the failure of negotiations between the City of St.
