AN ACT to amend the law relating to the endowments and property of the See of Sodor and Man, and for other purposes.

GENERAL NOTE: By virtue of section 2(4) of the Church Act 1992 all references to “the Commissioners” (i.e. the Church Commissioners of the established by the Church Act 1880 (except so far as they relate to the excepted functions) shall, unless the context otherwise requires, be construed as references to the Sodor and Man Diocesan Board of Finance.

1 Short title This Act may be cited as “The Church Act, 1948”, and this Act and the Church Acts, 1880 to 1938, may be together cited as “The Church Acts, 1880 to 1948”, and shall be construed as one.

2 and 3 [Repealed]1

4 Rights, powers and privileges of the Bishop preserved Nothing in this Act shall prejudice or affect or detract from or in any way interfere with the rights, powers and privileges of the Bishop.

5 and 6 [Repealed]2

7 Power of incumbents and churchwardens relating to property, etc (1) In addition to the purposes for which the Incumbent and Churchwardens of any parish or parochial district are by law permitted to hold land, the Church Commissioners may, from time to time, by Order, permit the Incumbent and Churchwardens of any particular parish or parochial district to purchase or otherwise acquire and to hold any land or lands for any purpose or purposes which may be specified in the Order; c AT 3 of 1948 Page 5

(2) In addition to the purposes for which the Incumbent of any parish or parochial district is by law permitted to hold land, the Church Commissioners may, from time to time, by Order, permit the Incumbent of any particular parish or parochial district to purchase or otherwise acquire and to hold any land or lands for any purpose or purposes which may be specified in the Order. (3) to (5) [Repealed]3

8 Maintenance, etc, of Chancels of Patrick, German, Jurby, Braddan, Andreas, Ballaugh and Bride The Chancels of Patrick, German, Jurby, Braddan, Andreas, Ballaugh and Bride Parish Churches shall be maintained, repaired and insured by the persons responsible for the maintenance, repair and insurance of such Parish Church.4
