Dissertation Presented to the Faculty of the Graduate School of The University of Texas at Austin in Partial Fulfillment of the Requirements for the Degree of Doctor of Philosophy The University of Texas at Austin December, 2004 To my Mom and Reed, and in memory of my Father Acknowledgements This dissertation is the product of considerable personal sacrifice not only on my part but, more importantly, on the part of the people I love most. I, therefore, humbly dedicate it to my mother and my husband, for their abiding love and support, and to my father, who sadly did not live to see the project’s completion. I also thank Marcella Evans, who made it easier for me to be so far away from home during such trying times. In addition, I benefited from the support of a tremendous circle of friends who were always there when I needed them: Tracy McFarland, Brenna Troncoso, Rosie and Scott Truelove, Anna O. Law, Holly Hutyera, Pam Wilkins Connelly, John Hudson, Jason Pierce, Emily Werlein, Greg Brown, and Lori Dometrovich. While in Australia and New Zealand, I benefited from the kindnesses of far too many people to list here, but I extend a special thanks to Imogen, Baghurst, Kerri Weeks, Sonia Palmieri, Robyn Lui, Ling Lee, and Peter Barger.

Greater than the sum of its parts, the varied collection of local heritage in an area enriches its character and gives identity to a neighbourhood, region or town in a way that cannot be reproduced. Clarifying the acquisition date of land – an officials’ issues paper. ISBN 0-478-39209-5 CONTENTS CHAPTER 1 Introduction 1 Suggested options 3 Application date 3 Submissions 3 CHAPTER 2 Background 5 The issue: applying different dates of acquisition 6 Possible interpretations of section CB 6 6 Preferred interpretation from a tax policy perspective 10 Other factors to consider under the “first interest” interpretation 11 CHAPTER 3 Possible dates of acquisition 12 Indicative characteristics of each option 12 The advantages and disadvantages of each option 13 CHAPTER 4 Evidence of intention or purpose 15 APPENDIX History of section CB 6 16 CHAPTER 1 Introduction 1.1 A key element of an efficient tax system is certainty. That means a person’s liability for tax should be as clear and as certain as possible, especially in New Zealand where the tax system is based on self-assessment. This issues paper focuses on the taxation of land disposal provisions in the Income Tax Act 2007, in particular section CB 6, which is causing some considerable uncertainty for taxpayers, their agents and Inland Revenue. 1.2 Section CB 6 deals with land acquired for the purpose of, or with the intention of disposal, and the taxation of income derived from disposing of the land. If a taxpayer acquires the land with the intention or purpose of disposal and subsequently disposes of the land, any profit made from the disposal is taxable.
