Base Standing Order 37.00 CANNABIS POLICY IDENTIFICATION Date of Issue October 2018 Date of Application 17 October 2018 Aim The aim of this directive is to provide direction with regards to the possession, cultivation and consumption of cannabis within the confines of Canadian Forces Base (CFB) Kingston. This is an order that applies to members of the Canadian Armed Forces (CAF) and a directive that applies to employees of the Department of National Defence (DND) employed within CFB Kingston owned or leased property to include the Brockville and PWOR Armouries. This order also applies to all visitors to CFB Kingston IAW ref P. Approval Authority This order is issued under the authority of the Base Commander (BComd) CFB Kingston. Office of Primary BComd, CFB Kingston. Interest (OPI) Office of Collateral Nil. Interest (OCI) INTRODUCTION On 17 October 2018, the Government of Canada will legalize the recreational possession, consumption and cultivation of cannabis (ref A). This represents a Context significant change in both Canadian society and CAF military culture. References B and C provide the legal framework for which Canadian adults over the age of 19 in the Province of Ontario can possess, consume and cultivate recreational cannabis. References G through I provide the policy guidelines for the use of recreational cannabis by CAF members and DND employees, and speaks to cannabis prohibitions and misuse. This Base Standing Order (BSO) provides guidelines for the responsible possession, consumption and cultivation of recreational cannabis within the confines of any property that is owned or leased by CFB Kingston. Note: as with DAOD 9004-1 and DAOD 2007-2, this BSO does not affect the rights of a person who has been authorized to access cannabis for medical purposes. Definitions “Cannabis” means a cannabis plant and anything referred to in subsection (2), but does not include anything referred to in subsection (3) of ref A. “Cannabis consumption” means in respect of cannabis, smoking, vaping, ingesting, or absorption by any other means into the body (Defence Terminology Bank). 1/3 Base Standing Order 37.00 “Smoke” or “smoking” means to carry or hold a lighted cigar, cigarette, pipe, or any other lighted smoking equipment (ref F). “Electronic cigarette” or “vaping” means a vaporizer or inhalant-type device, whether called an electronic cigarette or any other name, that contains a power source and heating element designed to heat a substance and produce a vapour intended to be inhaled by the user of the device directly through the mouth, whether or not the vapour contains nicotine (ref C). “Leased property” means property that is rented by, and therefore under the authority of, CFB Kingston. Examples of leased property include, but are not limited to the Empire Building, Midland Ave, etc. “Enclosed Workplace” means: a. the inside of any place, building or structure or vehicle or conveyance or a part of any of them, (1) that is covered by a roof, (2) that employees work in or frequent during the course of their employment whether or not they are acting in the course of their employment at the time, and (3) that is not primarily a private dwelling, or b. a prescribed place (ref D). “Work space” means any indoor or other enclosed space in which employees perform the duties of their employment, and includes any adjacent corridor, lobby, stairwell, elevator, cafeteria, washroom or other common area frequented by such employees during the course of their employment (ref E). “Workplace” means any land, premises, location or thing at, upon, in or near which a worker works (ref B) “Employee” means a person employed by DND on a full-time, part-time, seasonal, term, contract, temporary or casual basis (ref I) “Public place” means any place to which the public is ordinarily invited or permitted access, either expressly or by implication, whether or not a fee is charged for entry (ref C). PROCEDURE In order to promote responsible recreational cannabis use across CFB Kingston, the Policy following guidelines will apply: a. recreational cannabis consumption is not permitted in any workplace, enclosed or not, or work space; b. recreational cannabis possession or consumption is not permitted in the Training Area, on any range or in or on any vessel, boat, vehicle or aircraft, 2/3 Base Standing Order 37.00 military or civilian, operated by or in support of the DND or the CAF; c. recreational cannabis consumption is not permitted in any public place such as Arrowhead Beach, playgrounds/parks/splash pads, parking lots, sports fields, golf course, CANEX, KMFRC, Base sports facility, place of worship, Mess, dining facility or concession (McDonald’s, Tim Horton’s, etc.); d. smoking or vaping of recreational cannabis is not permitted inside transient or single living-in quarters; e. consumption of recreational cannabis is not permitted at designated smoking points as these constitute public places; f. recreational cannabis will not be sold at CANEX or at any Mess at CFB Kingston; and g. possession, consumption and cultivation (up to four plants per residence and not per person) is authorized inside transient and single living-in quarters as well as CFHA Residential Housing Units, understanding that CAF members and DND employees remain subject to the policies outlined in refs G and I.
