    Canadian Sanctions and Canadian charities operating in Zimbabwe: Be Very Careful! By Mark Blumberg (January 7, 2009) Canadian charities operating in Zimbabwe need to be extremely careful. It is not the place for a new and inexperienced charity to begin foreign operations. In fact, only Canadian charities with substantial experience in difficult international operations should even consider operating in Zimbabwe. It is one of the most difficult countries to carry out charitable operations by virtue of the very difficult political, security, human rights and economic situation and the resultant Canadian and international sanctions. This article will set out some information on the Zimbabwe Sanctions including the full text of the Act and Regulations governing the sanctions. It is not a bad idea when dealing with difficult legal issues to consult knowledgeable legal advisors. Summary On September 4, 2008, the Special Economic Measures (Zimbabwe) Regulations (SOR/2008-248) (the “Regulations”) came into force pursuant to subsections 4(1) to (3) of the Special Economic Measures Act. The Canadian sanctions against Zimbabwe are targeted sanctions dealing with weapons, technical support for weapons, assets of designated persons, and Zimbabwean aircraft landing in Canada. There is no humanitarian exception to these targeted sanctions. There are tremendous practical difficulties working in Zimbabwe and if a Canadian charity decides to continue operating in Zimbabwe it is important that the Canadian charity and its intermediaries (eg. Agents, contractor, partners) avoid providing any benefits, “directly or indirectly”, to a “designated person”. Canadian charities need to undertake rigorous due diligence and risk management to ensure that a “designated person” does not financially benefit from the program.

In the past two weeks the private media have recorded the harassment and arrest of at least nine journalists across the country, mainly stemming from stories exposing government brutality in elections with the complicity of the police force. The cases involved three freelancers from Manicaland, five journalists from Alpha Media Holdings, publishers of the private daily, NewsDay, and the weeklies the Zimbabwe Independent and The Standard, and the Editor of the UK-based weekly, The Zimbabwean. As we went to Press, NewsDay (18/11) reported the arrest of The Standard’s Bulawayo-based journalist Nqobani Ndlovu for contravening Section 96 of the Criminal Law (Codification and Reform) Act, which criminalizes the publication of falsehoods. The charges emanated from the story, Police exams cancelled, published in the private weekly (14/11), which alleged plans by the Zimbabwe Republic Police to recall retired police officers and war veterans to occupy vacant top posts to direct operations in next year’s elections. The paper claimed the recall “follows the scrapping of this year’s promotional examinations for the police force…which are used as the basis for promoting junior officers to the ranks of sergeant and inspector”.     ZIMBABWE INCLUSIVE GOVERNMENT WATCH: THE MOST BREACHED CLAUSES OF THE GLOBAL POLITICAL AGREEMENT SOKWANELE ‐ 16 DECEMBER 2012 Zimbabwe’s controversial power‐sharing Agreement, termed the “Global Political Agreement” (GPA), was signed by President Mugabe’s ZANU PF party and the two Movement for Democratic Change formations – led by Morgan Tsvangirai (MDC‐T) and Arthur Mutambara (MDC‐M) respectively ‐ on September 15, 2008 in Harare. The objective of the South African‐mediated Agreement was to "create a genuine, viable, permanent, sustainable and nationally acceptable solution to the Zimbabwe situation." Integral to this was the restoration of democracy and the garnering of international support to revive the country’s collapsed economy. Commenting on the negotiations, Tsvangirai stressed at the inception: “This is not about power sharing.
