INTRODbCTION The legal development of Taiwan' in the twentieth century reflects the complex legacy of "one land with two national flags." A government imposed by Japan ruled Taiwan for the first half of the twentieth century (1895-1945), followed by a government originating in China (the Chinese mainland) in the second half of the century (1945-2000). The people who came from Japan or Republican China became the leading class in Taiwan. Accordingly, these two regimes were regarded by the native inhabitants as foreign rulers.2 Taiwan's legal institutions underwent a radical change on the eve of the twentieth century. Prior to 1895, the laws in Taiwan were dominated by the Chinese legal traditions of the late nineteenth century. The state law introduced by pre-war Japan and Republican China was largely modeled on the individualist, liberal law of the modem West that was still novel to the rulers of Japan and China. Taiwan has thus been exposed to the so-called "reception of Western law." 3 The term . When I wrote that piece, no one could imagine that the Council of Grand Justices would find the newly-amended constitutional provisions unconstitutional, that the National Assembly would be virtually abolished, and that the opposition party would win the presidential election for the first time in Taiwan's history. I I No. 3 "Western law" includes continental European law and Anglo-American law. However, as discussed below, continental European law was the more prevalent of the two because pre-war Japan and Republican China had adopted continental European law before acquiring Taiwan. This Article examines the process of legal modernization in Taiwan during the past century. It focuses on the positive law of the state, including various legislation, executive measures, and judicial decisions, which have been the primary means of introducing the individualist, liberal legal system of the modem West into an Asian country like Taiwan. Part II presents a general picture on development of the Taiwan's legal systems to provide a context for the laws promulgated throughout the twentieth century. Parts I1, IV, and V discuss the changes in constitutional law, criminal justice and civil justice from late 1895, when Japan established its colonial government on the island, to May 20, 2000, when the Chinese Nationalist administration ended its rule in Taiwan.4 These parts also examine the extent to which the people of Taiwan5 have had, in general, access to these imported institutions and ideas. II. ETHNICITY, STATES, AND LAWS Every state has laws that facilitate the governance and administration of the state, and that can evolve into an independent rule system. Even though the basic substance of the laws enacted by two different states may be the same, these laws are subject to separate legal sovereignty and are therefore different in the formative sense. Additionally, values and attitudes exert significant influence over the interpretation and application of official law and upon the daily law], in GAIKOKUHOTONIHONHO [FOREIGN LAW AND JAPANESE LAW] 115-58 (It6 Masami ed., 1966). Pre-war Japan and Republican China adopted Westem-style law primarily for the purpose of ending the extraterritoriality of Western powers. The political leaders of Japan and China, who were influenced by legal thoughts of ancient China, did not sincerely receive the individualism and liberalism from which modem Western law was derived. ' The essence of colonial rule, exploiting others for the interests of the ruler(s), is immoral in and of itself; therefore, it is not necessary to ask whether the Japanese colonial rule in Taiwan was good or bad. Nevertheless, some of the results of the colonial rule were probably beneficial in some aspects. For example, the Japanese colonialists established a complete official registration system for real estate and households. Similarly, the authoritarian rule of the Chinese Nationalist Party should be blamed for its anti-democratic essence, but some of the results were beneficial for today's Taiwan, such as, its establishment of a sovereign government with armed forces on the island. JUNE2002 TAIWAN'S LEGAL DEVELOPMENT behavioral patterns of private individuals. 6 Different ethnic groups possess varying legal values and attitudes because of their unique culture or historical experiences. In Taiwan's case, various states and ethnic groups have all helped to shape its legal history in the twentieth century. A. The Period of JapaneseRule (1895-1945) Japan acquired Taiwan in 1895 as a result of Japan's overwhelming victory in the Sino-Japanese War over the interests in Korea. Prior to the arrival of the Japanese, the Han Chinese (hanren [C]) had been the dominant ethnic group in Taiwan. According to a Japanese survey conducted in 1896, the population of "islanders" (Hontjin [J]) was 2.5 million.7 "Islanders" as a legal term usually included three groups: Hokkien (Holo, Fulaoren [C]; or Southern Fukienese, Minnanren [C]) and Hakka (Kejiaren [C]), both of whom were Han Chinese, and the plains aborigines (Pingpuzu [C]) who had been assimilated by the former two groups.8 The term "Taiwanese" was later used by those "Islanders" to identify themselves during the period of Japanese colonial rule. 9 In addition, mountain aborigines (Gaoshanzu [C]) who preserved their original culture comprised about three percent of the total population of Taiwan. The number of incoming metropolitan Japanese (Naichijin [J], literally the "people in homeland") was very small relative to the population of Taiwan (reaching only six percent of the total population by 1942), but they were the elite ethnic group in Taiwan's society.' 0 They brought with them Japanese legal codes and Japanese legal experience. Japan had largely completed its modem codes modeled on continental European law of the late nineteenth century when it occupied Taiwan in 1895.11 Promulgation of Western-style codes played an important role in nation-building during the Meiji era (1868-1912). The codes acted as a tool to unify the nation and to eliminate Western 6 See LAWRENCE M.     10 Senior civil service training in Taiwan: Current concerns and future challenges Su Tsai-Tsu and Liu Kun-I Although Taiwanese Civil Service positions are still attractive to young people1 due to their high job security and lucrative retirement pensions, the current civil service system does not enjoy as much power or receive as much respect from citizens as it did in the past. To restore public confidence in the civil service system, the Taiwanese Government is determined to improve the calibre of the civil service, focusing particularly on top-level officials. The Examination Yuan (Branch), the highest authority responsible for the recruitment, selection and management of all civil service personnel, approved the Civil Service Reform Plan in June 2009. One major objective of the plan is to enhance the training of high-ranking officials to improve decision-making and leadership skills. 1 According to statistics released by the Ministry of Examination, the number of people who registered to take the Junior and Senior Civil Service Examinations reached a record high in 2010 and 2011. Accessed 3 July 2012.) 213 SHARPENING THE SWORD OF StatE The capacities of top-level civil service members are naturally held in higher regard than those of their subordinates in the bureaucratic hierarchy. People expect those serving at the top—the cadre of the civil service—to be equipped with strategic foresight and up- to-date knowledge to steer the nation through tough challenges. Hence in 2010, with the support of President, Ma Ying-jeou, and the Legislature, the Examination Yuan established the National Academy of Civil Service (NACS) under the Civil Service Protection and Training Commission (CSPTC).2 With the training of high-level officials as one of its most important tasks, NACS has since designed and vigorously implemented a series of training programs.

Feng-fan Hsieh National Tsing Hua University Many Sinitic languages respect low vowel raising (LVR) whereby the low vowel /a/ is raised to /e/ only when flanked by a palatal glide and a coronal coda. In this article, I show that LVR in Sinitic languages is a genuine process of grammar because low-level phonetic coarticulatory effects alone cannot account for cross- linguistic/dialectal variation. Specifically, my survey reveals that vowel duration, onset consonants and/or the presence of retroflexes may have a direct bearing on LVR, thus calling for a phonological analysis. I argue that the phenomenon in question is better treated as additive effects of (i) target undershoot in the wake of impoverished vowel duration (i.e. vowel reduction) and (ii) contextual influences (i.e. backness assimilation). Phonological vowel quality change (LVR here) is motivated only when the benefit of contextual neutralization exceeds that of the sum of the “cost” of implementing the above coarticulatory patterns. Analytically, Flemming’s (2003) feature co-occurrence constraints, together with phonetically driven constraints, provide a straightforward account of the relationship between coronal place and vowel backness attested in LVR. A moment in Vogue history when the rules of the Caucasian-centric world of high fashion were discarded in favor of something more representative. Published between September 1994 and January 1997, Vogue Singapore began as an offshoot of Australian Vogue and produced 29 issues. Its first cover featured Chinese born Twin Peaks star Joan Chen, lensed by leading Singaporean photographer Russel Wong. Wong vividly remembers that auspicious moment. 'I was the first photographer they approached. The editor knew that I was close to Joan and did most of her photography so they asked me if I could ask her to do a cover for them. She was Asian of course, a big movie star and this was a perfect choice for everyone. I will always remember that cover as it was the first one for Singapore and also for me. What better than to share it with a close friend and make history together.' Sadly, no comprehensive archive of the magazine exists and some issues are considered lost.

The background to the MAS Consultation Paper is the policy framework agreed by the Basel Committee on Banking Supervision (“BCBS”) and the International Organisation of Securities Commissions (“IOSCO”), as set out in their final report on “Margin requirements for non-centrally cleared derivatives” (the “BCBS-IOSCO Final Report”) of September 2013. Most jurisdictions are in the early phases of implementing the BCBS-IOSCO Final Report but a number are working on finalising their rules on margining. For example, the European Supervisory Authorities have published a Second Consultation Paper dated 10 June 2015 on the Draft Regulatory Technical Standards on risk-mitigation techniques for OTC-derivative contracts not cleared by a CCP under Article 11(5) of Regulation (EU) No 648/2012. The draft regulatory technical standards are anticipated to be adopted by the European Commission by the end of 2015. In line with the global efforts to implement the BCBS-IOSCO Final Report, MAS is seeking public feedback on policy proposals to implement margin requirements for uncleared derivatives.

Mullen Adviser Graduate Program of Political Science Copyright by Selina Sher Ling Lim 2007 ABSTRACT This research explores the concept of national loyalty within today’s context of international migration and globalization. It seeks to provide a systematic understanding of national loyalty that, thus far, has been widely accepted by most citizens as a social fact and assumed to be an inherent trait. Probing deeper, however, we realize that our understanding of national loyalty is superficial, made ever more shaky by today’s ease of international travel, increasingly porous territorial borders, and images of the global citizen who is at home anywhere in the world. Academically, our understanding of national loyalty has also been mired in intellectual, philosophical, and rhetorical debates over the concept of the nation and national identity. Still, the realization that national loyalty is particularly vital during times when the nation-state is at some major cross road, or faced with the greatest challenge ever yet, is not lost on political leaders throughout the world, especially since the terrorist attacks of September 11, 2001, on the World Trade Center in New York.
