WASHINGTON, D.C. 20554 News media information 202/418-0500 Fax-On-Demand 202/418-2830 Internet: http://www.fcc.gov ftp.fcc.gov Released: June 2, 2000 DA 00-1224 CERTIFICATES OF ELIGIBILITY FOR CLASS A TELEVISION STATION STATUS On November 29, 1999, the Community Broadcasters Protection Act of 1999 was signed into law. That legislation provides that a low power television station licensee may convert the secondary status of its station to the new Class A status, provided it can satisfy certain statutorily- established criteria. To become eligible for a Class A certificate of eligibility, the licensee’s station must, during the 90-day period ending November 28, 1999, have: (1) broadcast a minimum of 18 hours per day; (2) broadcast an average of at least three hours per week of programming produced within the market area served by the station or by a group of commonly-controlled low power television stations; and (3) been in compliance with the Commission’s regulations applicable to the low power television service. The legislation also provided that licensees intending to seek Class A designation file a certification of eligibility with the Commission no later than January 28, 2000. The low power television station licensees listed in the attached Appendix have timely filed statements of eligibility, certifying full compliance with the above statutory programming and operational standards. Accordingly, the listed LPTV licensees are deemed eligible to file an application for Class A station status (FCC Form 302-CA) in accordance with the procedures set forth in the Commission’s Report and Order in MM Docket No. 00-10, entitled “Establishment of a Class A Television Service,” 15 FCC Rcd 6355 (2000). By separate Public Notice issued today, the Mass Media Bureau has announced that FCC Form 302-CA has been approved by the Office of Management and Budget and is now effective. That Public Notice also sets forth the various ways by which copies of FCC Form 302-CA may be obtained from, and filed with, the Commission. Commencing Friday, June 9, 2000 and continuing for a six-month period, eligible LPTV licensees may file FCC Form 302-CA to convert the secondary status of their stations to the new Class A status. Any comments directed to those applications, including the LPTV licensees’ certifications of eligibility, should be filed with the Commission prior to action on those applications. By subsequent Public Notices and separate letters, the Mass Media Bureau will announce those entities that do not meet the statutory eligibility criteria, as well as address the alternative eligibility showings submitted on or before January 28, 2000. As such, we have great interest in the Notice of Proposed Rulemaking to permit all AM stations to broadcast an all-digital signal using the HD Radio in-band on-channel (IBOC) mode known as MA3 on a voluntary basis (“Notice”), and we offer the following comments in support of this petition. I. Benefits of All-Digital AM Transmissions It has been well established for more than a decade of operation by many of our stations in the MA1 hybrid digital mode that AM stations stand to gain a great deal from digital operation. Greatly improved audio quality is at the forefront, with audio bandwidth comparable to FM broadcasts, stereo audio and receiver display of title/artist or program title information. When a receiver locks in the digital mode to one of our stations, particularly one playing music, as the receiver blends from analog to digital, the contrast is dramatic. The highs and lows of the audio open up, the stereo image widens out, and the noise that seems to be ever present on almost any AM frequency disappears. Listeners experiencing this effect for the first time are quite often amazed at how good an AM broadcast can sound in this mode.
