STATEMENT REFERRED TO IN REPLY TO PARTS (a) TO (d) OF STARRED QUESTION NO. 590 ANSWERED IN THE LOK SABHA ON 07.05.2015 REGARDING POWER TARIFF. **********

(a) : Yes, Madam. Due to variability of demand during the day / night, there is generally a gap in consumption (demand met) of electricity during peak and non-peak hours. On a typical day, say 30th April, 2015, the demand met during peak and non- peak hours was 1,29,395 MW and 1,17,020 MW respectively. Thus, there was a difference of 12,375 MW in the peak demand and non-peak demand in a day on 30th

April, 2015. This figure may vary for any given day depending on demand and generation.

(b) to (d) : The Electricity Act, 2003 has entrusted the responsibility of distribution tariff fixation on the State Electricity Regulatory Commissions (SERCs) / Joint

Electricity Regulatory Commissions (JERCs) for various categories of consumers. In this regard, SERCs / JERCs notify the terms and conditions of tariff fixation from time to time for both public and private distribution licensees. Section 61 of the Act provides for guiding principles which the Appropriate Commission is required to consider for specifying the terms and conditions of tariff. As per Section 61 (i) of the

Act, the Regulatory Commissions are also guided by the Tariff Policy notified by the

Central Government.

Time of Day (TOD) tariff is an important Demand Side Management

(DSM) measure which can be used for incentivizing consumers to shift a portion of their loads from peak times to off-peak times, thereby improving the system load factor by reducing the demand on the system during peak period. 20 States have already implemented the TOD tariff for various categories of consumers.

Ministry of Power has proposed for amendment in the existing provisions of the Tariff Policy so as to mandate the Appropriate Commissions to introduce time differentiated tariff within a specified time.

It has a full fledged vigilance set up headed by a Chief Vigilance Officer (CVO) and is also subjected to scrutiny by the independent agencies like Statutory Auditors, Comptroller and Auditor General (CAG), CVC/CBI etc. Further, it may be mentioned that CBI has registered a case on 25.01.2011 on the issue of contract awarded to the State Trading

Corporation of India Ltd. regarding alleged supply of low quality imported coal at NTPC

Unchahar Thermal Power Station.

(c) : The Ministry of Power, Government of India is not aware of any State joining the Earth Hour Programme.

(d) : Ministry of Power and Bureau of Energy Efficiency (BEE), have undertaken following initiatives for the conservation of electricity:

i. Energy efficiency labeling for 19 appliances.

ii. Fuel efficiency standard prescribed for passenger cars.

iii. Energy Conservation Building Codes (ECBC) formulated for energy efficiency improvement in commercial buildings.

iv. Demonstration projects on Demand Side Management (DSM) in Municipal, Household, Agriculture and Small & Medium Enterprises (SME) sectors.

v. Specific energy consumption norms prescribed for energy intensive industries notified as designated consumers.

vi. Capacity building of State Designated Agencies and Distribution Companies for effective implementation of energy efficiency programmes.

vii. Enabling investments in energy efficiency projects through a special purpose joint venture company, Energy Efficiency Service Ltd. (EESL), on a performance linked repayment business model.

(a) : After enactment of Electricity Act, 2003 generation of electricity has been de-licensed. As such Techno-Economic Clearance of Central Electricity Authority (CEA) is not required for thermal power projects. However, details of power plants under execution in Chhattisgarh are furnished in Annex.

(b) & (c) : Prior Environmental Clearance (EC) from Ministry of Environment & Forests (MOEF) and from State Level Environment Impact Assessment Authority (SLEIAAs) are mandatory for the Power Plants as listed under the Schedule of Environmental Impact Assessment (EIA) Notification, 2006 and its amendments. ECs are accorded by following the due process laid down in the EIA Notification, 2006 which includes detailed appraisal of the EIA by the Expert Appraisal Committee. The conditions imposed while granting EC are meant to mitigate pollution as per the standards approved. The monitoring mechanism provides for regular reporting and supervision by the Regional Offices of the Ministry and State Pollution Control Boards (SPCBs).

(a) & (b) : Yes, Madam. In order to bring further competition and efficiency in distribution sector, Government of India has, inter-alia, proposed separation of power supply and the distribution network business through the Electricity (Amendment) Bill, 2014 which has already been introduced in the Lok Sabha on 19.12.2014. These amendments envisage competition in retail (i.e. choice to consumers to select retail suppliers).

(c) & (d) : The Working Group on Power constituted to formulate the programme for development of the power sector during the 12th Plan, under the Chairmanship of Secretary, Ministry of Power, after detailed consultation with various stakeholders, recommended separation of “Carriage and Content”. Further, Forum of Regulators (FOR) also commissioned a study in this context. The study analyzed, inter-alia, the national and international experiences.

(e) : Since the Electricity (Amendment) Bill, 2014 has already been introduced in the Lok Sabha, its implementation would commence after the Bill is passed by the Parliament.

(a) : The state wise details of operational private power projects

{conventional sources (25 MW and above)} is Annexed.

(b) & (c): Central Electricity Authority(CEA) periodically monitors all power projects (including Private Projects) in terms of generation, plant load factor

(Coal/Lignite/Gas/Nuclear), outages, reservoir level, coal stock position, coal and gas allocation, gas supply position and renovation, modernization and life extension works and information is uploaded on the website regularly.

(d) & (e) : To facilitate the increase in generation from all available sources,

following measures are being taken by Government on regular basis:

I. Government has been allocating coal blocks which were cancelled by Hon’ble Supreme court through auction/ allocation. This will lead to improvement in thermal power generation in the country.

II. For power projects which are affected due to short supply of gas, Government of India has sanctioned a scheme which envisaged supply of imported spot RLNG to the stranded gas based power plants as well as plants receiving domestic gas up to the target PLF selected through a reverse e-bidding process. The scheme envisages financial support from PSDF (Power System Development Fund).

III. Renovation, Modernization and Life Extension of old thermal power generating units and retirement of old and inefficient thermal generation units, in phased manner, has been undertaken. A total capacity of 3,115 MW has already been retired till date and 2667 MW capacity is to be retired by the end of the 12th Plan.

IV. Strengthening of inter/intra-state and inter-regional transmission capacity for optimum utilization of available power.

Company Ltd. Vs Anuj Joshi & others is pending with Hon’ble Supreme Court. The

Hon’ble Supreme Court vide its judgment dated 13.08.2013 in the said Civil Appeal has directed Ministry of Environment, Forests & Climate Change (MoEF&CC) as well as State of Uttarakhand not to grant any further environmental clearance or forest clearance for any hydroelectric power project in the State of Uttarakhand, until further orders.

The matter is sub-judice in the Hon’ble Supreme Court.

(a) & (b) : Yes, Madam, Government has approved the National Smart Grid Mission-an institutional mechanism for planning, monitoring and implementation of policies and programs related to Smart Grid activities. The total outlay for NSGM activities for 12th Plan is Rs 980 crore with a budgetary support of Rs 338 crore.

NSGM has three tier structure:

• At the apex level, NSGM has a Governing Council headed by the Minister of Power. Members of the Governing Council are Secretary level officers of concerned Ministries and departments. Role of Governing Council is to approve all policies and programme for smart grid implementation.

• At the second level, the NSGM has an Empowered Committee headed by Secretary (Power). Members of the Empowered Committee are Joint Secretary level officers of concerned Ministries and departments. Role of Empowered Committee is to provide policy input to Governing Council and approve, monitor, review specific smart grid projects, guidelines / procedures etc.

• In a supportive role, NSGM has a Technical Committee headed by Chairperson (CEA). Members of the Technical Committee are Director level officers of concerned Ministries & departments, representatives from industries and academia. Role of Technical Committee is to support the Empowered Committee on technical aspect, standards development, technology selection guidelines etc.

• For day-to-day operations, NSGM has a NSGM Project Management Unit (NPMU) headed by the Director NPMU. Director NPMU is a Member of the Governing Council and Empowered Committee, and Member Secretary of Technical Committee. NPMU is the implementing agency for operationalizing the Smart Grid activities in the country under the guidance of Governing Council and Empowered Committee.

• Grant up-to 30% of the project cost is available from NSGM budget. For selected components such as training & capacity building, consumer engagement etc, 100% grant is available.

Corresponding to the NSGM, State Level Mission chaired by the Power Secretary of the State has also been proposed. Support for training & capacity building to State Level Project Monitoring Units (SLPMUs) for smart grid activities is provided by NSGM.

The major activities envisaged under NSGM are development of smart grid, development of micro grids, consumer engagements and training & capacity building etc. NSGM entails implementation of a smart electrical grid based on state- of-the art technology in the fields of automation, communication and IT systems that can monitor and control power flows from points of generation to points of consumption.

(a) & (b) : Domestic coal has high ash content which leads to generation of large quantities of ash. Efforts have been made by the Government to promote alternate uses of ash in construction industries. The unutilized ash is required to be disposed of in the ash ponds using water slurry mixture. This requires use of water. However, much of this water is recycled back to the thermal power station and reused in ash handling system.

Following measures are being adopted to reduce water requirement for ash disposal and reduce resultant pollution:

• Utilisation of fly ash is being promoted under National Fly Ash Mission so as to reduce quantum of ash to be disposed of.

• Low grade/ waste water, available in the plant, is used for ash disposal and generally, no fresh water is drawn from source water body for ash disposal. Recirculation and reuse of water in ash disposal is adopted so as to reduce net requirement of water for ash disposal. Typically, 70% of water is recycled from ash pond.

• Higher concentration slurry systems are adopted on case to case basis for ash disposal to reduce quantity of water for ash disposal.

• Use of washed coal with lower ash content is promoted in thermal power plant which also results in reduced ash generation requiring less quantity of water for ash disposal.

• Supercritical power plants with high thermal efficiency are encouraged resulting in reduced coal consumption and consequently reduced requirement of water for ash disposal.

(a) & (b) : As per the provisions given in section 61 to 64 Electricity Act, 2003, the Electricity Regulatory Commissions has been entrusted with the functions of determination of Tariff for generation, transmission and distribution. The tariff of generation and Transmission companies owned by Central Government is regulated by the Central Electricity Regulatory Commission, whereas the tariff for generation, transmission and distribution within the state are determined by the State Electricity Regulatory Commission. Under Section 62 of the Act, the Appropriate Commission shall determine the tariff if it is supplied from a generating company to a distribution licensee, while under section 63 the Appropriate Commission shall adopt the tariff if such tariff has been determined through transparent process of bidding in accordance with the guidelines issued by Central Government. Since the tariff determination has been entrusted with Appropriate Commission, the Central Government has no role in this regard.

(c) & (d) : Government has not constituted any committee to conduct a comparative study between competitive tariff and regulatory tariff.

(a) to (d) : An Integrated Energy Policy Report (IEPR) was approved by the Government in 2008. The implementation of the above policy was reviewed from time to time and many recommendations have already been implemented.

In pursuance of President’s address to the Parliament on 9th June, 2014, referring, inter-alia, to Government’s intent to issue a National Energy Policy (NEP), NITI Aayog has proposed to frame a National Energy Policy to meet the demand for energy including solar, wind, gas and coal, in consultation with the stake holders.

Memorandum of Understanding (MoU) on 27.11.2014 in order to cooperate with each other for development of projects in Andhra Pradesh. The officials of Andhra Pradesh

Power Generation Company(APGENCO) and M/s Sumitomo Corporation, Japan along with their manufacturers and consultants visited prospective sites from 02.03.2015 to 06.03.2015 to establish 4000 MW (4x1000 MW) Ultra Super Critical Thermal

Project in Srikakumal District, Andhra Pradesh. Among the sites, Andhra Pradesh

Power Generation Company (APGENCO) provisionally selected a site at POLAKI

Village in Srikakulam.

(a) to (c) : Government of India has sanctioned a scheme for importing spot RLNG in 2015-16 and 2016-17 for the stranded gas based power plants as well as for plants receiving domestic gas upto the target PLF selected through a reverse e-bidding process. The scheme provides for financial support from PSDF (Power System Development Fund). The outlay for the support from PSDF has been fixed at Rs 7500 crores (Rs. 3500 crores and Rs 4000 crores for the year 2015-16 and 2016-17 respectively). The list of such plants is given at Annex-I and Annex-II.

(d) : After the cancellation of 204 Coal Block by the Hon'ble Supreme Court vide its judgment dated 25.08.2014 and order dated 24.09.2014, Government of India had promulgated an Ordinance (now replaced by an Act) for re-allocation of the cancelled Coal Blocks through auction/allotment. So far, 46 coal blocks have been allocated through auction/allotment to the power sector.
