In August 2005, in an unprecedented move, the NCAA acquired its long-time rival postseason men’s basketball tournament, the National Invitation Tournament (“NIT”), in a settlement of an antitrust case brought by the Metropolitan Intercollegiate Basketball Association (“MIBA”), the owner-operator of the NIT.1 The NCAA has called the moment a “historic day for men’s college basketball.”2 Whether this “historic” event will remain undisturbed by antitrust law is unclear. Although legal issues abound, the DOJ has yet to challenge the settlement’s legitimacy. Dieter* Introduction The death penalty has been a firmly established institution in the United States since its inception. Dating back to the colonial period of the early 1600s, through the establishment of the United States under its present constitution in 1787, right through to the present day, the death penalty has been part of U.S. law and practice. During that time, there have been over 15,000 executions in the U.S. The period from 1900 to 1950 represented the most prolific use of the death penalty in our history for any comparable period of time.1 Executions were halted briefly between 1967 and 1977 as the U.S. Supreme Court considered and then ruled on the constitutionality of the death penalty. The Court held in 1972 that the existing practice of capital punishment was so arbitrary and unpredictable that it violated our constitutional prohibition against cruel and unusual punishments.2 But states quickly revised their statutes, and some of these new laws met the Court's approval in 1976.3 Executions resumed and slowly rose to a level of almost 100 in one year. However, since the start of the new millennium in 2000, the death penalty has taken a very different course, and that change is the principal subject of this paper. This newfound power to suspend athletic programs—albeit limited in duration to two years—has become colloquially known as the “death penalty” because “everyone, including [NCAA member] presidents, believes it could effectively kill a program for decades.” This Article examines why the NCAA “death penalty,” although arguably benevolent in its intent, undermines the core principles of federal antitrust law. Coverage highlighted that 2018 marked the fourth consecutive year with fewer than 30 executions and 50 death sentences and that fewer death-row prisoners now faced active death sentences than at any time in more than a quarter century. Many media outlets reported that, for the first time since Furman v. Georgia, no county imposed more than two death sentences. The report also emphasized that even as the number of death sentences and executions had dramatically fallen since the 1990s, that decline had not reduced the death penalty’s discriminatory and arbitrary nature when it was applied. The report noted that rather than reserving executions and death sentences for the worst of the worst crimes and offenders, capital punishment was instead disproportionately meted out in 2018 in cases involving the most vulnerable defendants and prisoners and the least reliable judicial process. SMU was caught committing two or more major violations of NCAA rules in less than five years. Therefore, under the repeat offender clause, their football program was terminated for the 1987-1988 school year, and they chose to take the next season off as well. Before this unprecedented and highly publicized scandal, SMU was a nationally ranked and competitive team. In the years following the death penalty, the team struggled to find success. Using the synthetic control method, this article measures the cost of the death penalty in terms of athletic success and the university's finances.
