  • Midnight Special Songlist
west coast music Midnight Special Please find attached the Midnight Special song list for your review. SPECIAL DANCES for Weddings: Please note that we will need your special dance requests, (I.E. First Dance, Father/Daughter Dance, Mother/Son Dance etc) FOUR WEEKS in advance prior to your event so that we can confirm that the band will be able to perform the song(s) and that we are able to locate sheet music. In some cases where sheet music is not available or an arrangement for the full band is need- ed, this gives us the time needed to properly prepare the music and learn the material. Clients are not obligated to send in a list of general song requests. Many of our clients ask that the band just react to whatever their guests are responding to on the dance floor. Our clients that do provide us with song requests do so in varying degrees. Most clients give us a handful of songs they want played and avoided. Recently, we’ve noticed in increase in cli- ents customizing what the band plays and doesn’t play with very specific detail. If you de- sire the highest degree of control (allowing the band to only play within the margin of songs requested), we ask for a minimum of 100 requests. We want you to keep in mind that the band is quite good at reading the room and choosing songs that best connect with your guests. The more specific/selective you are, know that there is greater chance of losing certain song medleys, mashups, or newly released material the band has.

  • Deana Carter Danny Myrick
Deana Carter DEANA CARTER, the daughter of famed studio guitarist and producer Fred Carter, Jr., grew up surrounded by musical greats, including Willie Nelson, Bob Dylan, Waylon Jennings, and Simon & Garfunkel. She developed her songwriting skills at writer’s nights throughout Nashville, but her real break came when one of her demo tapes fell into the hands of Willie Nelson, who remembered Deana as a child. Impressed with how she’d grown as a songwriter, Nelson asked Deana to perform along with John Mellencamp, Kris Kristofferson, and Neil Young, as the only female solo artist to appear at Farm Aid VII in 1994. Her 1996 debut album Did I Shave My Legs for This? quickly climbed to the top of both the country and pop charts, quickly achieving multi-platinum status. "Strawberry Wine,” the first single from the album, was awarded CMA's 1997 Single of the Year. Seven albums and a decade later, Deana is still writing and producing for both the pop/rock and country markets when not on the road touring. Her superstar success continues to be evident. Her chart topper “You & Tequila,” co-written with Matraca Berg and recorded by Kenny Chesney, was nominated in 2011 as CMA’s “Song of the Year” and received two Grammy nods. Carter also recently co-wrote and produced a new album for recording artist Audra Mae while putting the finishing touches on her own Southern Way of Life that hit the shelves last December. Danny Myrick DANNY MYRICK is an award winning songwriter and musician based here in Nashville.

  • 265 Edward M. Christian*
COPYRIGHT INFRINGEMENT ANALYSIS IN MUSIC: KATY PERRY A “DARK HORSE” CANDIDATE TO SPARK CHANGE? Edward M. Christian* ABSTRACT The music industry is at a crossroad. Initial copyright infringement judgments against artists like Katy Perry and Robin Thicke threaten millions of dollars in damages, with the songs at issue sharing only very basic musical similarities or sometimes no similarities at all other than the “feel” of the song. The Second Circuit’s “Lay Listener” test and the Ninth Circuit’s “Total Concept and Feel” test have emerged as the dominating analyses used to determine the similarity between songs, but each have their flaws. I present a new test—a test I call the “Holistic Sliding Scale” test—to better provide for commonsense solutions to these cases so that artists will more confidently be able to write songs stemming from their influences without fear of erroneous lawsuits, while simultaneously being able to ensure that their original works will be adequately protected from instances of true copying. * J.D. Candidate, Rutgers Law School, January 2021. I would like to thank my advisor, Professor John Kettle, for sparking my interest in intellectual property law and for his feedback and guidance while I wrote this Note, and my Senior Notes & Comments Editor, Ernesto Claeyssen, for his suggestions during the drafting process. I would also like to thank my parents and sister for their unending support in all of my endeavors, and my fiancée for her constant love, understanding, and encouragement while I juggled writing this Note, working full time, and attending night classes. 265 266 RUTGERS UNIVERSITY LAW REVIEW [Vol.

  • Their Greatest Hits (1971-1975)”—The Eagles (1976) Added to the Registry: 2016 Essay by Marc Eliot (Guest Post)*
“Their Greatest Hits (1971-1975)”—The Eagles (1976) Added to the Registry: 2016 Essay by Marc Eliot (guest post)* The Eagles In 1971, the arrival of The Eagles signaled a major shift in popular musical tastes in America. If Woodstock was the funeral for both the music and the culture of a decade of drugged out, hippie, free love and cultish idealism, the Seventies was the decade of blatant decadence, political cynicism, sexual distrust, and rampant narcissism. No band represented both the rejection of the Sixties and the celebration of the Seventies more than its crown princes, the Eagles. Songs like “Lyin’ Eyes,” “Witchy Woman,” “One of These Nights,” and “Already Gone,” filled with spirited playing, close harmonies and an overlay of the Eagles’ war between the sexes, comprise four of the ten selections included in the initial compilation of Eagles’ hit songs from their first four albums, “Their Greatest Hits (1971-1975).” Ironically, although the Eagles’ laid-back sound was bright and natural as Southern California sunshine, none of the original four members were Golden State natives (Don Henley, vocalist, lyricist, drummer, was from Texas, bred on bluegrass and country music; Glenn Frey, vocalist, lyricist, rhythm guitar, pianist, came from the streets of Detroit, influenced by the music of Motown and mentored by Bob Seger; Randy Meisner, on bass, was a veteran bar band night sider out of Nebraska; Bernie Leadon, guitar, mandolin, banjo, was a Minnesotan who loved and loved to play classic country). Each migrated separately to Los Angeles, like lemmings, to The Troubadour, the musical and cultural ground zero club on Santa Monica Boulevard, owned and operated by Doug Weston, who favored putting on his stage country-rock bands and female vocalists.

  • Multimillion-Selling Singer Crystal Gayle Has Performed Songs from a Wide Variety of Genres During Her Award-Studded Career, B
MultiMillion-selling singer Crystal Gayle has performed songs from a wide variety of genres during her award-studded career, but she has never devoted an album to classic country music. Until now. You Don’t Know Me is a collection that finds the acclaimed stylist exploring the songs of such country legends as George Jones, Patsy Cline, Buck Owens and Eddy Arnold. The album might come as a surprise to those who associate Crystal with an uptown sound that made her a star on both country and adult-contemporary pop charts. But she has known this repertoire of hardcore country standards all her life. “This wasn’t a stretch at all,” says Crystal. “These are songs I grew up singing. I’ve been wanting to do this for a long time. “The songs on this album aren’t songs I sing in my concerts until recently. But they are very much a part of my history.” Each of the selections was chosen because it played a role in her musical development. Two of them point to the importance that her family had in bringing her to fame. You Don’t Know Me contains the first recorded trio vocal performance by Crystal with her singing sisters Loretta Lynn and Peggy Sue. It is their version of Dolly Parton’s “Put It Off Until Tomorrow.” “You Never Were Mine” comes from the pen of her older brother, Jay Lee Webb (1937-1996). The two were always close. Jay Lee was the oldest brother still living with the family when their father passed away.
