You will see that the letter requests a review of the premises licence in respect of the above premises in terms of Section 38 of the Licensing (Scotland) Act 2005. I do this on the basis that the premises licence holder has been issued and failed to comply with a Section 14 Compliance Notice issued by a Licensing Standards Officer. The licence holder was issued with a Section 14 Compliance Notice for breaching their Premises Licence Mandatory Conditions in that they failed to pay their annual fees which were due on 1st October 2010, contrary to Schedule 3, paragraph 10(1) and (2). The notice was served on 21/10/10, at 0900 hrs, with the condition attached that payment must be made within fourteen days from the date of service. This notice has, to date, not been complied with as the premises licence holder has failed to make any such payment. A copy of the said Compliance Notice is attached herewith. Under Section 14(2)(a)(ii) of the Licensing (Scotland) Act 2005 a Licensing Standards Officer may apply for a premises review hearing if a notice has been served and, in the case of a premises licence, such a notice is not complied with to the satisfaction of the Officer, to make a premises licence review application in respect of the licence. Therefore it is respectfully requested that the Board uphold this application and review the premises licence in light of this information.
