Omasombo Introduction L’an 2014 s’ouvre dans la confusion et la remise en question des succès qui avaient été présentés jusqu’à la fin de l’année précédente comme définitivement engrangés. Le président Kabila n’a pas profité de l’état de grâce dont il bénéficiait au terme de son voyage dans l’Est du Congo, d’autant plus que la pacification de cette région est encore loin d’être réalisée. Il paraît vain, en effet, de chercher à camou- fler les retombées corrosives des troubles qui ont affecté les villes de Kinshasa, Lubumbashi, Kindu, fin 2013, et Beni, en octobre 2014, de faire l’impasse sur la dégradation de la situation sécuritaire au Katanga, de minimiser les combats et les violences dus aux groupes armés qui continuent ou recommencent à endeuiller plu- sieurs endroits, d’ignorer au plan politique les atermoiements du chef de l’État à mettre sur pied un gouvernement de « cohésion nationale » tant attendu, de taire les dissensions au sein du réseau d’alliances gravitant autour du chef de l’État, de sous- estimer les frustrations suscitées par les promesses non tenues, de tirer un trait sur l’intensification des mesures répressives adoptées à l’encontre de l’opposition ou de ce qui est perçu comme telle, de tenter de dédramatiser les effets de l’assassinat du colonel Mamadou Moustapha Ndala, considéré comme un héros par la popu- lation du Nord-Kivu au vu de ses succès militaires contre le M23. Democratic Re public of the Congo 1 Introduction The Democratic Republic of the Congo (DRC) is the second-largest country in Africa, with a population of approximately 84 million people.1 The DRC gained independence from Belgium in 1960. Its post-independence history is bloody: the first post-independence leader, Patrice Lumumba, was assassinated in 1961. In 1965, military officer Mobutu Sese Seko assumed power after a period of civil war. Mobutu ruled his one-party state (which he renamed Zaire) until 1996, when he was ousted by an armed coalition led by Laurent Kabila. However, the coun- try remained dangerously unstable and effectively in a state of civil war. In 2001, Laurent Kabila was assassinated by his bodyguard and was succeeded by his son, Joseph Kabila. Although Joseph Kabila is credited with introducing a number of important reforms, most notably a new constitution, his democratic credentials remained extremely poor. The last election which he won (in 2011) is disputed and lacked credibility due to widespread irregularities. President Kabila’s sec- ond five-year term of office ended in December 2016, but the DRC failed to hold elections and he ruled without an electoral mandate, albeit with the backing of the Constitutional Court. In May 2016, the Constitutional Court, in a heavily crit- icised judgment, interpreted section 70 of the constitution, which provides that the president continues in office until the assumption of office of his successor, as entitling President Kabila to remain in office without an election having taken place. Critics argue that the Constitutional Court should have found section 75 of the constitution applicable — this provides for the Head of the Senate to assume office temporarily in the case of a presidential vacancy.2 In August 2018, President Kabila announced he would not be running for a third term and the ruling party chose Emmanuel Shadari, seen as a Kabila loyalist,3 as its candidate for the presidential elections. -

epr atlas 417 Congo, DRC epr atlas congo, drc 418 Ethnicity in Congo, DRC Group selection The coding of the DR Congo /Zaire is particularly difficult, because central authority has generally remained rather weak. Congo has faced many challenges to its territorial integrity, either by secession or by external intervention. This means that during signficant peri- ods since independence the country was not under (complete) control of the central government or the government itself was mainly con- trolled by outsiders. Though ethnicity constantly played a role in Congolese politics, this was mainly true for the local and provincial level. Things are further complicated by the fact that some relevant groups do not hold Congolese cititzenship, e.g. parts of the Ban- yarwanda/Banyamulenge living in eastern Congo. Their citizenship rights have been changed several times, but the group has been in- cluded during all time periods. Now signs of political mobilization and relevance of the Azande-Mangbetu cluster have been found, nei- ther with regard to some organization or ethnic voting patterns. The Group has therefore been coded as being irrelevant for the entire period from 1960 to 2013. Power relations 1960-1965: The Belgian Congo achieved independence on 30.6.1960. Hence, the coding period begins in 1960. The newly independent state lost most of its functions during its first days. Triggered by a mutiny of Congolese soldiers in the army, the plan of the Belgian administration to design a post-independence transition with an army and national bureaucracy firmly in the hands of Belgians fell apart. Almost all Belgian soldiers and bureau- crats (all of them occupying the highest echelons of the organiza- tions) were removed – except for those in the state of Katanga that quickly announced its secession from the Republic of the Congo, re- taining its Belgian base (1126). -

Introduction 1. Soumis en application du paragraphe 46 de la résolution 2463 (2019) du Conseil de sécurité, le présent rapport retrace les principaux faits nouveaux intervenus en République démocratique du Congo du 29 juin au 25 septembre 2019. Il revient sur les progrès accomplis dans l’exécution du mandat de la Mission de l’Organisation des Nations Unies pour la stabilisation en République démocratique du Congo (MONUSCO) depuis mon rapport du 17 juillet 2019 (S/2019/575), donne un aperçu de l’évolution de la situation politique, décrit les progrès réalisés dans l’ajustement des priorités, du dispositif et de la présence de la Mission, ainsi que son action globale de protection des civils et propose une analyse de la performance des agents en tenue de la Mission. II. Évolution de la situation politique 2. Au cours de la période considérée, la situation politique a été essentiellement marquée par l’investiture, en septembre, d’un gouvernement de coalition dirigé par le Premier Ministre Sylvestre Ilunga Ilunkamba. Le Président Félix Tshisekedi a également continué de jouer un rôle actif dans les initiatives régionales visant à renforcer les relations bilatérales et à resserrer la coopération dans les domaines de l’économie et de la sécurité. 3. Le 26 août, le Premier Ministre Ilunga a annoncé la composition de son équipe gouvernementale après avoir reçu l’aval du Président Tshisekedi. -

Anticipating this, Mr. Fayulu's lawyers filed the challenge yesterday. The regime has attacked protestors in cities through the DRC, but until now has not threatened Mr. Fayulu. As the regime's options shrink, it may make Mr. Fayulu the target. Mr. Fayulu will continue to follow the official appeals process, although he will not get a fair hearing. The next stop is the Constitutional Court, which Kabila tightly controls (see attached Jason Stearns report). Our ask: the international community must continue to join the Congolese in·pressing for a public recount of polling station data (certified and signed) in front on the Chiefs of Mission of the electoral observation groups (SADC, AU, SYMOCEL, CENCO) to resolve the discrepancies. It cannot be run by CENI. We cannot stress this enough: as long as international scrutiny, especially that of the United States, remains focused and cohesive, Kabila faces long odds to stay in power. The Congolese need your support all the way until they have established a clear, credible democratic transition. -
