IV-SEM MUSLIM LAW BY Dr. JAVED AHMED QURESHI DATE- 04-04-2020 MALIKI SCHOOL Maliki school is one of the four schools of fiqh or religious law within Sunni Islam. It is the second largest of the four schools, followed by about 25% Muslims, mostly in North Africa and West Africa. This school is not a sect, but a school of jurisprudence. Technically, there is no rivalry or competition between members of different madrasas, and indeed it would not be unusual for followers of all four to be found in randomly chosen American or European mosques. This school derives its name from its founder Imam Malik-bin-Anas. It originates almost to the same period as the Hanafi school but it flourished first in the city of Madina. Additionally, Malik was known to have used ray (personal opinion) and qiyas (analogy). This school is derives from the work of Imam Malik. It differs in different sources from the three other schools of rule which use it for derivation of regimes. All four schools use the Quran as the primary source, followed by Prophet Muhammad's transmitted as hadith (sayings), ijma (consensus of the scholars or Muslims) and Qiyas (analogy).In addition, the School of Maliki uses the practice of the people of Madina (Amal Ahl al-Madina) as a source. While the Hanafi school relies on Ijma (interpretations of jurists), the Maliki school originates from Sunna and Hadis. -

Anti-Semitism and Anti-Zionism in Iran: the Role of Identity Processes
View metadata, citation and similar papers at core.ac.uk brought to you by CORE provided by Nottingham Trent Institutional Repository (IRep) 1 Anti-Semitism and anti-Zionism in Iran: the role of identity processes Rusi Jaspal De Montfort University, Leicester, UK Anti-Semitism and anti-Zionism constitute two important ideological building blocks of the Islamic Republic of Iran. Yet, there is no existing research into the psychosocial motives underlying the manifestation of anti-Semitism and anti-Zionism at the institutional level in Iran. Here it is argued that there is much heuristic and predictive value in applying tenets of identity process theory (IPT), a socio-psychological model of identity threat and action, to the primarily socio-historical literature on anti-Semitism and anti-Zionism in Iran. The paper provides a summary of anti-Semitism, anti-Zionism and ‘new anti-Semitism’ and IPT. The substantive section of the paper explores (i) how anti-Semitism and anti-Zionism may restore feelings of belonging in the Muslim world and beyond; (ii) the inter-relations between ingroup and outgroup self-efficacy; (iii) the psychosocial motivation to maintain Shiite ideology and Khomeini’s legacy; and (iv) the construction of Jews and Israel in terms of a threat to group continuity. It is suggested that insights into the motivational principles underlying anti-Semitism and anti- Zionism at the institutional level may inform empirical research into social representations of Jews and Israel in Iran. More broadly, this paper highlights the potential contribution of social psychology to existing work on anti-Semitism and anti-Zionism in the humanities. -

IRAN 2019 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution defines the country as an Islamic republic and specifies Twelver Ja’afari Shia Islam as the official state religion. It states all laws and regulations must be based on “Islamic criteria” and an official interpretation of sharia. The constitution states citizens shall enjoy human, political, economic, and other rights, “in conformity with Islamic criteria.” The penal code specifies the death sentence for proselytizing and attempts by non-Muslims to convert Muslims, as well as for moharebeh (“enmity against God”) and sabb al-nabi (“insulting the Prophet”). According to the penal code, the application of the death penalty varies depending on the religion of both the perpetrator and the victim. The law prohibits Muslim citizens from changing or renouncing their religious beliefs. The constitution also stipulates five non-Ja’afari Islamic schools shall be “accorded full respect” and official status in matters of religious education and certain personal affairs. The constitution states Zoroastrians, Jews, and Christians, excluding converts from Islam, are the only recognized religious minorities permitted to worship and form religious societies “within the limits of the law.” The government continued to execute individuals on charges of “enmity against God,” including two Sunni Ahwazi Arab minority prisoners at Fajr Prison on August 4. Human rights nongovernmental organizations (NGOs) continued to report the disproportionately large number of executions of Sunni prisoners, particularly Kurds, Baluchis, and Arabs. Human rights groups raised concerns regarding the use of torture, beatings in custody, forced confessions, poor prison conditions, and denials of access to legal counsel. -

132 rudolph peters MURDER IN KHAYBAR: SOME THOUGHTS ON THE ORIGINS OF THE QAS¤MA PROCEDURE IN ISLAMIC LAW * RUDOLPH PETERS (University of Amsterdam) Abstract The institution of qas¨ma has intrigued both Muslim jurists and western scholars. The first were puzzled by its violation of essential legal principles, the latter by its apparent pre-Islamic origins. Because of its archaic and irrational character, western scholars assume that the institution was not applied in practice: Ò[I]t does not appear that this institution functioned much, even in the past, when the penal law of Islam had a certain practical application.Ó1 However, the evidence of fatwa collections shows that the qas¨ma was indeed enforced by courts as late as the nineteenth century, 2 and the rules connected with it have now found their way into some modern Islamic criminal codes. 3 The qas¨ma, it appears, was a living institution in Islamic law and not just theory. In this essay I will try to shed some light on the origins of this institution and its reception into Islamic law. I will attempt to chart the earliest developments of Islamic jurisprudence by analyzing the available hadith material and the statements of the first generation of jurists. In the conclusion I will suggest that my analysis of the material on qas¨ma corroborates MotzkiÕs 4 and I thank Harald Motzki and Gautier Juynboll for introducing me to the unfamiliar field of isn¨d analysis and for their critical remarks on earlier versions of this essay, from which I have greatly benefited. -

Religion is important in Muslim countries and understanding Sunni and Shia beliefs is important in understanding the modern Muslim world. The beginnings The division between the Sunnis and the Shia is the largest and oldest in the history of Islam. To under- stand it, it is good to know a little bit about the political legacy of the Prophet Muhammad. When the Prophet died in the early 7th Century he not only left the religion of Islam but also an Islamic State in the Arabian Peninsula with around one hundred thousand Muslim inhabitants. It was the ques- tion of who should succeed the Prophet and lead the new Islamic state that created the divide. One group of Muslims (the larger group) elected Abu Bakr, a close companion of the Prophet as the next caliph (leader) of the Muslims and he was then appointed. However, a smaller group believed that the Prophet's son-in-law, Ali, should become the caliph. Muslims who believe that Abu Bakr should be the next leader have come to be known as Sunni. Muslims who believe Ali should have been the next leader are now known as Shia. The use of the word successor should not be confused to mean that that those that followed the Prophet Muhammad were also prophets - both Shia and Sunni agree that Muhammad was the final prophet. How do Sunni and Shia differ on beliefs? Initially, the difference between Sunni and Shia was merely a difference concerning who should lead the Muslim community. -

In the heated debate on Islamic dogmatics, Maturidi school unswervingly protected the authority of the Book and the reason and became the one of the founders of the Sunni theology. Maturidi school successfully applied dialectical principles to ensure the supremacy of the Scriptures and at the same time upheld the role of the reason. They maintained a more rational and tolerant attitude toward many issues, and it is called "Moderatism"by the Sunni scholars. The thought of Maturidi school spread all over Central Asian countries, Afghanistan, India, Bangladesh, Pakistan, Rome, Persian, Turkey, Egypt and China ,etc.. In today's globalized and diversified international situation, it is of great significance to enhance the study of Maturidi school's theological thought, especially it's theory of God's Science in order to promote ideological and cultural exchanges between our country and Muslim world and to enhance the mutual understanding. 1. Introduction Muslims began to argue about the fundamental principles of Islamic belief after the Prophet passed away. Diff erent perceptions held by Muslims are examined, problem areas regarding interaction with the ICRC are analysed and aspects are mentioned which, in the opinion of the author, can help the ICRC improve its activities in Muslim countries. Th e conclusions of the examination could be relevant in any relationship with conservative movements within other religions. : : : : : : : Any Muslim person or organization working in the West, and any western individual or organization working in the Muslim world, will be confronted with myths. Deep-seated traumas stemming from historical contact with the “other” are being revived and updated, be those “others” the Crusaders, the colonialists and their alleged modern variants, or the Muslim troops ranged before the gates of Vienna or Poitiers and the global Jihadi1 who, it is claimed, are intent on destroying western civilization. A Migration Story From Muslim Immigrants to European "Citizens of the Heart?"' BASSAM TIBI Although a newcomer with regard to migration of a global scope, Europe has become a popular destination for Muslim immigrants, taking in more Muslims than the U.S. in recent years. It is currently home to more than 20 million Muslims. However, despite their large numbers, these im- migrants are not integrated into European society. They are therefore sus- ceptible to the political Islam that is making Europe its battlefront. As the prominent New York Times journalist Richard Bernstein, who led the Berlin office of that paper for four years, wrote in his farewell col- umn, Europeans believe they live in a Tuscan paradise and hate to see the problems in the "world beyond." 2 Bernstein noted that this European senti- ment can be described as "wealthy, soignde, [and] ecologically correct" and that European opinion leaders believe they are "distant from vexing prob- lems like Muslim immigration."3 Stuck in this mindset, Europeans do not view themselves as confronted with what is perceived to be "Islam" or with its jihadist dimension. The perception that jihadist assaults by al-Qaeda on September 11, 2001 were the result of an unsettled score between the Arabs and the United States was belied by a consistent series of events in Europe ranging from attacks in Madrid on March 11, 2004 to the foiled plot in London in August 2006.
