The content of this study is the exclusive responsibility of its author and it in no way reects the views of the EFB. 3 Abstract In its Enlargement Strategy for 2018, the European Union assessed that elements of state capture are present throughout the Western Balkans. Our research shows, howe- ver, that when it comes to Serbia this is a very restrained assessment as whole state institutions and sectors – the security services and institutions tasked with their con- trol and oversight – have been captured by the ruling Serbian Progressive Party (SNS). Key positions in the security and intelligence sector are staffed by close associates of party officials or directly by party officials and its founding members. The Director of the BIA, Bratislav Gašić, and the head of the Security Services Coordination Bureau, Nebojša Stefanović, are founding members and high-ranking officials in the SNS. Key posts in the judiciary that are significant for the activities of the security services have been taken up by close associates of party officials or of the leader of the SNS and the President of Serbia, Aleksandar Vučić. -

Yugoslavia, Federal Republic of Page 1 of 44 Yugoslavia, Federal Republic of Country Reports on Human Rights Practices - 2001 Released by the Bureau of Democracy, Human Rights, and Labor March 4, 2002 (The report on the Federal Republic of Yugoslavia is discussed in three separate sections on Serbia, Kosovo, and Montenegro and addresses human rights situations in each of these entities. Since federal authority was exercised effectively only over the Republic of Serbia throughout the year, the human rights situations in Kosovo and Montenegro are dealt with in separate sections following this report.) The Federal Republic of Yugoslavia (Yugoslavia), a constitutional republic consisting of the Republic of Serbia and the Republic of Montenegro, has a president and a parliamentary system of government based on multiparty elections. Vojislav Kostunica was elected President of the Federation in elections held on September 24, 2000 that were closely contested; President Slobodan Milosevic ultimately was unable to manipulate the elections. Massive public protests forced Milosevic to recognize his defeat and cede power on October 6, 2000. Under the constitutional framework, the Federation encompasses the Republics of Serbia and Montenegro; however, the Montenegrin Government has refused to participate in many of the functions of the Federal Government and has acted unilaterally in several areas. The Federal Government presides over a weakened structure, with responsibilities essentially limited to the Foreign Ministry, the Yugoslav Army (VJ), the Customs Administration, civil aviation control, and foreign economic and commercial relations. Although President Kostunica enjoyed wide popular support, significant power was concentrated at the republic level where, in Serbia, Prime Minister Djindjic exercises significant executive authority. -
Forging Transnational Belonging Through Informal Trade; Thriving Markets in Times of Crisis
Forging Transnational Belonging through Informal Trade Analyzing informal trading practices and smuggling through the case study of Novi Pazar, this book explores how societies cope when governments no longer assume the responsibility for providing welfare to their citizens. How do economic transnational practices shape one’s sense of belonging in times of crisis/precarity? Specifically, how does the collapse of the Ottoman Empire – and the subsequent migration of the Muslim Slav population to Turkey – relate to the Yugoslav Succession Wars during the 1990s? Using the case study of Novi Pazar, a town in Serbia that straddles the borders of Montenegro, Serbia and Kosovo that became a smuggling hub during the Yugoslav conflict, the book focuses on that informal market economy as a prism through which to analyze the strengthening of existing relations between the émigré community in Turkey and the local Bosniak population in the Sandžak region. Demonstrating the interactive nature of relations between the state and local and émigré communities, this book will be of interest to scholars and students interested in Southeastern Europe or the Yugoslav Succession Wars of the 1990s, as well as social anthropologists who are working on social relations and deviant behavior. Sandra King-Savic is a postdoctoral fellow at the Center for Governance and Culture in Europe (GCE) at the University of St. Gallen (HSG). She served as a human rights educator for Amnesty International and conducted research for the Foreign Military Studies Office at the University of Kansas (KU) before receiving a Swiss National Foundation scholarship for her dissertation on the transversal relationship between migration and informal markets. -

Serbia and Montenegro Serbia1 IHF FOCUS: freedom of the media; judicial system and independence of the judiciary; fair trial, torture and ill-treatment; conditions in prisons; national and ethnic minorities; intolerance, xenophobia, racial discrimination and hate speech; international humanitarian law (accountability for war crimes). The outcome of the early parliamentary election in late December 2003 and, before it, of the third, failed run for the Serbian presidency, opened eyes to the misconception about Serbia’s democratic potential and elucidated the political scene that had been rather blurred up until then. The Serbian elite’s endeavor over the past twenty years to create a new cultural model—marked by totalitarian thought—still figured as the biggest obstacle to democratization. Nationalism did not disappear in “post-October 5”2 Serbia but just appeared in a new form. It was easily detectable, however, whenever the issues of facing the recent past or a reformist breakthrough were on the table. The past has been rationalized—ranging from negation of crimes and the “Greater Serbia project” to blaming the communists for everything. Military defeat and past developments that never resulted in a bottom line, persistence in the “Greater Serbia project,” identity crisis and overall frustration all revived traditional conservativeness. Serbian conservativeness was characterized as follows: an absolute lack of economic thought, reluctance to make economic progress, absence of political pluralism, democracy being perceived as anarchy, and xenophobia. This is why today’s Serbia moves about without a definite destination, without a vision, unwilling to face its recent past, wars and war crimes, and without the idea about how to build its social system. -
