The Political Origins of Religious Liberty

Whereas politicians have long championed the idea of religious freedom and tolerance, the actual achievement of these goals has been an arduous battle for religious minorities. What motivates polit- ical leaders to create laws providing for greater religious liberty? In contrast to scholars who argue that religious liberty results from the spread of secu- larization and modern ideas, Anthony Gill argues that religious liberty results from interest-based calculations of secular rulers. Using insights from political economists dating back to Adam Smith, Gill develops a theory of the origins of religious liberty based on the political and economic interests of governing officials. Political leaders are most likely to permit religious freedom when it enhances their own political survival, tax revenue, and the economic welfare of their country. He explores his theory using cases from British America, Latin America, Russia, and the Baltic states. Anthony Gill is Associate Professor of Political Science at the University of Washington, where he specializes in the study of religion, economics, and poli- tics. He is the author of Rendering Unto Caesar: The Catholic Church and the State in Latin America and numerous articles on religion and politics. Investigative Case Summary Pertains to the Bombing of the Harry T
PRELIMINARY STATEMENT The following investigative Case Summary pertains to the bombing of the Harry T. Moore1 residence in Mims, Brevard County, Florida, by person or persons unknown who caused the deaths of Harry Tyson Moore and Harriette Vyda Moore2 on December 25, 1951, at approximately 10:20 P. M.. This case has been previously investigated by the Brevard County Sheriff’s Office (BCSO), the Federal Bureau of Investigation (FBI) (Case #44-4036), the Brevard County State Attorney’s Office, and the Florida Department of Law Enforcement (FDLE) under FDLE Case Number EI-91-26-016. Florida Attorney General Charlie Crist reopened this case in December 2004, and assigned the case to the Division of Civil Rights at Fort Lauderdale. The Division of Civil Rights initiated an official investigation of this case on December 21, 2004, under case number LO - 4 -1358. Attorney General Charlie Crist requested assistance from the Florida Department of Law Enforcement. Allison K. Bethel, Esq., Director of Civil Rights for the Attorney General’s (AG) Office, was assigned to direct the general course of the investigation. Frank M. Beisler, Senior Investigator at the Attorney General’s Office (AG) of Civil Rights and Special Agent (SA) C. Dennis Norred, of the Florida Department of Law Enforcement (FDLE) were assigned as primary Investigators. AG staff in Tallahassee was assigned to review information, conduct research, and to make recommendations regarding this investigation. SA Norred opened a criminal investigation under FDLE case number PE-01-0048. To clearly understand the current FDLE and Florida Attorney General’s Office Investigation and its results, it is important to fully understand the depth of the investigations conducted by the previously mentioned agencies. -

The Legal Philosophies of Religious Zionism 1937-1967 Alexander Kaye Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in the Graduate School of Arts and Sciences COLUMBIA UNIVERSITY 2013 © 2012 Alexander Kaye All rights reserved ABSTRACT The Legal Philosophies of Religious Zionism 1937-1967 Alexander Kaye This dissertation is an attempt to recover abandoned pathways in religious Zionist thought. It identifies a fundamental shift in the legal philosophy of religious Zionists, demonstrating that around the time of the establishment of the State of Israel, religious Zionists developed a new way of thinking about the relationship between law and the state. Before this shift took place, religious Zionist thinkers affiliated with a variety of legal and constitutional philosophies. As shown in chapter 1, the leaders of the religious kibbutz movement advocated a revolutionary, almost anarchic, approach to law. They (in theory, at least,) only accepted rules that emerged spontaneously from the spirit of their religious and national life, even if that meant departing from traditional halakha. Others had a more positive attitude towards law but, as chapter 2 shows, differed widely regarding the role of halakha in the constitution of the Jewish state. They covered a spectrum from, at one extreme, the call for a complete separation between religion and state to, on the other, the call a rabbinic oversight of all legislation. They all, however, were legal pluralists; they agreed that a single polity may have within it a plurality of legitimate sources of legal authority and that, even in a Jewish state, other kinds of legislation may hold authority alongside halakha. -

Instead, this study redirects focus toward the neo-religious nature of modern spirituality; that is, the fulfillment of Thomas Luckmann’s prediction that a significant aspect of modern spirituality would concern the need to construct a “self”the constantly shifting work of forming personal identity and enhancing self understanding. As such, internal commitments and intense devotion may perform as a de facto “invisible religion” in the lives of people. As popular culture provides useful texts toward satisfying this ongoing work, professional sports can act as a conduit of both personal and collective self understanding for “highly identified fans,” subsequently operating as an invisible religion within their lives.
