The A9-A96 Inshes to Smithton CPO Schedule
THE A9 and A96 TRUNK ROADS (INSHES TO SMITHTON) COMPULSORY PURCHASE ORDER 201[ ] Made 201[ ] The Roads (Scotland) Act 1984 and the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947. The Scottish Ministers (hereinafter referred to as “the acquiring authority”) in exercise of the powers conferred by sections 103 to 108 inclusive as read with section 110(2) of the Roads (Scotland) Act 1984 hereby make the following compulsory purchase order- 1. This Order may be cited as the A9 and A96 Trunk Roads (Inshes to Smithton) Compulsory Purchase Order 201[ ]. 2. Subject to the provisions of this Order, the acquiring authority are hereby authorised to purchase compulsorily for the purpose of improving the A96 Aberdeen – Inverness Trunk Road and the M9/A9 Edinburgh – Stirling – Thurso Trunk Road by constructing the new Inshes to Smithton Road between Inshes in the vicinity of Culloden, Inverness-shire and Smithton Roundabout, Inverness, the land and servitude rights which are described in the Schedule hereto and are numbered and shown delineated in red and coloured pink and blue respectively, on the map signed with reference to this Order and marked “Map referred to in the A9 and A96 Trunk Roads (Inshes to Smithton) Compulsory Purchase Order 201[ ]”. 3. In relation to the foregoing purchase section 70 of the Railways Clauses Consolidation (Scotland) Act 1845 and sections 71 to 78 of that Act as originally enacted and not as amended for certain purposes by section 15 of the Mines (Working Facilities and Support) Act 1923 are hereby incorporated with the enactment under which the said purchase is authorised, subject to the modifications that references in the said sections to the company shall be construed as references to the acquiring authority and references to the railway or works shall be construed as references to the land authorised to be purchased and any building or works constructed or to be constructed thereon. -

Appendix 1 Highland Council Specification Appendix 2 Photographic Register The author was commissioned in December 2009 by Colin Armstrong Associates on behalf of Slioch Ltd to undertake a project of a photographic Survey to be undertaken prior to the demolition of Wester Drakies Steading, Culcabock, Inverness as a condition of planning by Highland Council. The Steading dates from the late 18th or very early 19th century and has seen some alterations throughout its use, but with some of the original features being intact. Only partial access to building was possible due to it being in a dangerous state. PURPOSE/EXECUTIVE SUMMARY 1.1 This report seeks approval for the Main Issues Report for the second Inner Moray Firth Local Development Plan to be published for public consultation. The Main Issues Report enclosed at Appendix 1 has been shaped by a series of appraisals, engagements and discussions outlined in Section 4 of this report. Approval of this consultation document by Committee will allow the Council to seek views on the options for addressing the main issues affecting the future of the area, and also where to direct future development, in the Inner Moray Firth area. 2. RECOMMENDATIONS 2.1 Members are asked to: i. approve the Main Issues Report (as applicable to this committee area) to be published for public consultation, accepting that a number of minor presentational and typographical changes will be made prior to publication; ii. agree the approach to consultation outlined in paragraph 6.1 of this report; and iii. note the important role that the plan will play in addressing the Climate & Ecological Emergency, economic recovery, and in taking forward the Council’s agreed Indicative Regional Spatial Strategy recently submitted to Scottish Government. 3. IMPLICATIONS 3.1 Resource: Resources to complete the statutory processes are allowed for within the Service budget. 3.2 Legal and Risk: the Plan can be challenged in the courts but only on matters of process not planning judgement emphasising the need for the Council to continue to adhere to all statutory procedures throughout the Plan’s progress so that the Council will have a defensible position in the event of any challenge. -

Wester Drakies Steading dates from the very late 18 th or very early 19 th century and has seen some alterations throughout its use, but with some of the original features being intact. The Building was demolished in 2010 after a photographic survey was conducted by S. Farrell. The evaluation revealed the remains of thirteen pits of unknown use, a stone-lined drain associated with the former steading and structural remains associated with 20 th century farm buildings, a household midden and sheep burial. -

item: 6 report: CYP12/11 FHC3 ACTION PLAN – FOOD AND NUTRITION by Sally Amor Summary Maintaining a healthy weight is a problem and a challenge across western societies. Since 2008 a focused programme of work by the Joint Committee for Children and Young People partners has sought to address some of these challenges and enabled the achievement of the HEAT 3 and HEAT 7 targets across Highland communities. 1. Background In 2008 Scottish Government allocated funding to NHS Highland to support child healthy weight interventions (HEAT 3) and to support the nutrition of women of child bearing age and infant feeding (CEL 38 (2008)). Within Highland the funding was aligned to support nutrition, infant feeding and healthy weight activity that is orientated around communities and family lives. This approach has enabled a range of activity: the implementation plan, capturing key activity and outcomes for this work programme is detailed in Appendix 1. 2. Progress to date 2.1 Healthy child weight Data from Highland children collected in 08/09 and 09/10 suggests that P1 children in Highland are more overweight and obese (24%) than the Scottish average (20%). These figures indicate that 1 in 4 P1 children in Highland are overweight or obese, and these rates increase with age, and this has serious implications for the physical, emotional and economic wellbeing of our population. The HEAT 3 target and SOA for family based child healthy weight interventions has been in place since 2008. The target details the number of healthy weight interventions to be undertaken with 5-15 year olds by April 2010.
