There is simply NO NEED to change current law and force new standards on every school in the Commonwealth. Here’s how SB 2128 would work: 1. This is a MANDATE: According to SB 2128, every public or charter school “that offers a comprehensive sexual health education curriculum [which is the overwhelming majority of schools in MA] shall provide medically accurate, age-appropriate… education.” SB 2128 Section 1 (pg. 3, lines 37-39) (emphasis added) “Age appropriate” is vaguely defined to include the “developing cognitive, emotional and behavior capacity typical for the age or age group.” SB 2128 Section 1 (pg. 2, lines 29-31). “Medically accurate,” teachings need only be “supported by peer-reviewed research” and “if relevant, published in peer-reviewed journals.” SB 2128 Section 1 (pp. 2-3, lines 33-36) 2. The clitoris is the homologue of the male’s glans and corpora cavernosa, and erection is reached in three phases: latent, turgid, and rigid. The vestibular bulbs cause ‘‘vaginal’’ orgasmic contractions, through the rhythmic contraction of the bulbocavernosus muscles. Because of the engorgement with blood during sexual arousal, the labia minora become turgid, doubling or tripling in thickness. The corpus spongiosum of thefemaleurethrabecomescongestedduring sexual arousal; therefore, male erection equals erection of the female erectile organs. The correct anatomical term to describe the erectile tissues responsible for female orgasm is the female penis. Vaginal orgasm and the G-spot do not exist. These claims are found in numerous articles that have been written by Addiego F, Whipple B, Jannini E, Buisson O, O’Connell H, Brody S, Ostrzenski A, and others, have no scientific basis. Marshall McCachran, assistant public defender for the defendant Devan Thomas Stedman, 10 South Third Street, Batavia, Ohio 45103. This cause came before the court for trial on November 7, 2012. At the conclusion of the trial, the court took the issues raised at trial under advisement. The defendant is charged in a one-count indictment with gross sexual imposition in violation of R.C. 2907.05(A)(4), a felony of the third degree, with a specification that evidence other than the testimony of the victim was admitted in the case corroborating the violation. 1 Upon consideration of the record of the proceeding, the oral arguments of counsel, the evidence presented for the court’s consideration, and the applicable law, the court now renders this written decision. FINDINGS OF FACT On June 20, 2012, the defendant Devan Stedman was at his sister Amber Stedman’s apartment located at 6 Montgomery Way, Apartment 5, Amelia, Clermont County, Ohio. Present in the apartment at the time were Devan Stedman, Amber Stedman, Amber’s newborn twin sons, Amber’s 2-year old son, and I.A., who is the daughter of a cousin to Devan and Amber and who was approximately 18 months old at the time. The defendant was on the couch watching television when he began to think about pornography he had viewed previously and started to become sexually aroused.
