The 229th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 11th - 12th January, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 229th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

The decision of the Appeal Committee noted by the ERC and decided that the name of the institution viz. Kalimuddin Smriti B.Ed. College, Plot No- 289, 431, Street No.- NH- 34, Vill- Halalpur, PS- Runia, Tehsil/Taluka- Tajpur, Town/City- Raiganj, Dist- Uttar Dinajpur, West Bengal- 733156 (B.Ed.) (ERCAPP2510) be changed as “Uttar Dinajpur Primary Teachers Training Institute, Plot No- 289, 431, Street No.- NH-34, Vill- Halalpur, PS- Runia, Tehsil/Taluka- Tajpur, Town/City- Raiganj, Dist- Uttar Dinajpur, West Bengal- 733156”.

VT be constituted of Uttar Dinajpur Primary Teachers Training Institute for B.Ed. course. ATTENTION!

1. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built- up area, additional staff, additional funds etc) for the SECOND UNIT as prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

ER-229.4 [Appeal Case] 1. B B M Mahavidyalaya, Okari, Jehanabad, Plot no - 1178/1179, Street/Road - Okari, Vill - Okari, PO - Jaytipur Kurua, Tehsil/Taluka - Modanganj, Town / City - Jehanabad, 229.4.1 Dist - Jehanabad, Bihar - 884432 (D.El.Ed.-New proposal) (Private) (Bihar School Examination Board) (ERCAPP3869) The Appellate Authority vides Order No. 89-369/2016-Appeal/12th Meeting – 2016/43508 dated 26.09.2016 remand back the case for revisiting the matter. The impugned order dated 29.06.2016 is set aside.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

(i) The institution is directed to submit (notarized) certified translated English version of the three sale deeds in the name of B.B.M. Mahavidyalaya.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. 2. B B M Mahavidyalaya, Okari, Jehanabad, Plot no - 1178/1179, Street/Road - Okari, Vill - Okari, PO - Jaytipur Kurua, Tehsil/Taluka - Modanganj, Town/City - Jehanabad, 229.4.2 Dist-Jehanabad, Bihar - 884432 (B.Ed.-New proposal) (Private) (Magadh University) (ERCAPP3864) The Appellate Authority vides Order No. 89-376/2016-Appeal/12th Meeting – 2016/43536 dated 26.09.2016 remand back the case for revisiting the matter. The impugned order dated 29.06.2016 is set aside.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

Bihar- 804402 (B.Ed.-New proposal) (Private) (Magadh University) (ERCAPP4045) The Appellate Authority vides Order No. 89-434/2016-Appeal/12th Meeting – 2016/43712 dated 26.09.2016 remand back the case to ERC with a direction to process the application further as per the NCTE Regulations, 2014.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

(i) The institution is directed to submit its documentary evidence for running B.A./B.Sc. courses on that institute. (ii) In the NOC issued by Magadh University dated 26.06.2015, there is no mentioned about the proposed course. (iii) Land possession/Mutation certificate issued from Land Revenue/concerned Govt. Department is not submitted. (iv) The institution is required to submit blue print of building plan mentioning the details of plot number, total land area, total built up area etc. and duly approved by Govt. Engineer.

Mahatma Gandhi Prarambhik Shiksha Prashikshan Mahavidyalaya, Mukti Niketan, Plot No. 424/234, Street/Road-01, Vill/Town/City-Katoria, PO- Katoria, Tehsil/Taluka- 229.4.4 Katoria, Dist.- Banka, Bihar-813106 (D.El.Ed. - Addl. Course) (Private) (Bihar School Examination Board) (ERCAPP2629) The Appellate Authority vides Order No. 89-454/2016-Appeal/13th Meeting – 2016/46935 dated 02.12.2016 remanded back the case to ERC for further processing of the application. If necessary, the appellant may also be allowed to get the word „Prarambhik‟ deleted from the name of programme applied for.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

(i) The institution is directed to delet the word „Prarambhik‟ in the website as well as other corresponding matters to make it a composite institution.

In view the above, the committee decided as under: Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution. The institution which is already recognized for B.Ed./D.El.Ed course(s) and sought recognition/permission for additional course/additional intake are to furnish the previous faculty list along with compliance of the Letter of Intent.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD ERC NCTE and institution with the reply of letter of intent. ER-229.6 Reply to LOI / SCN after LOI 5. Indira Gandhi Teachers Training College, Plot No.- 1112, Vill/PO- Talandu, 229.6.1 Tehsil/Taluka- Chinsurah-Mogra, Dist- Hooghly, West Bengal- 712148 (B.Ed.-Addl. Course) (Private) (University of Burdwan) (ERCAPP2564) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to LOI, the Committee discussed the matter in detail and observed as under:

(i) List of practice teaching schools duly approved by the Inspector of Schools is not submitted. (ii) M.Ed. mark-shete of Biswajit Pal and Anjan Bhandari are not accepted as downloaded copy without any seal & signature of the issuing authority. (iii) M.Ed. mark-sheet of Sahely Banerjee is not accepted as there is no seal of issuing authority. (iv) Original FDRs of Rs. 5.00 lakhs and Rs. 7.00 lakhs into joint name of institution/society/trust and RD ERC NCTE and not submitted

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. 6. Dr. Shashi Bhushan Institute of Education, Plot No.76, St reet No. NH 154, Vill- Lakshirbond, P.O.- Boalipar Bazar, Tehsil/Taluka – Hailakandi, Town/City - Hailakandi, 229.6.2 Dist - Hailakandi, Assam - 788155. Course) (Private) (SCERT) (ERCAPP3166) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and decided as under:

Formal permission order under clause 7(16) of the NCTE Regulation 2014 for applied D.El.Ed. programme with an intake 50 (one basic unit) from the academic session 2017-18 be issued to the institution.

Intake) (Private) (North Bengal University) (ERCAPP2930) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to LOI, the Committee discussed the matter in detail and decided as under:

Formal permission order under clause 7(16) of the NCTE Regulation 2014 for applied B.Ed. programme with an additional intake 50 (one basic unit) from the academic session 2017-18 be issued to the institution.

8. Kolkata Teachers Training College, Plot No- 1701, 1705, 1706, 1715, Vill - Panpur,PO- Narayanpur, Tehsil/Taluka- Naihati, Town/City- Kankinara, Dist- North 24 Parganas, 229.6.4 West Bengal - 743126 (M.Ed.-Addl. Course) (Private) (The West Bengal University of Teachers Training, Education Planning and Administrative) (ERCAPP3141) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to LOI, the Committee discussed the matter in detail and observed as under:

(i) The appointed Professor Dr. M. Amareswara Raju is not qualified as he does not possess 10 years of teaching experience as per Regulation, 2014.

9. The ICFAI University Tripura, Plot No- 6458, Street/Road- Simna Road, Vill/PO- 229.6.5 Kamalghat, Tehsil/Taluka- Kamalghat, Town/City- Agartala, Dist-West Tripura, Tripura- 799210 (B.P.Ed.) (Private) (The ICFAI University Tripura) (ERCAPP3654) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to LOI, the Committee discussed the matter in detail and observed as under:

(i) The institution has not submitted the faculty list duly countersigned by the concerned affiliating body. (ii) Copies of educational/professional qualification certificate and experience certificate of the appointed Principal and faculty members are not submitted. (iii) Website of the institution with required documents /information as per provisions under clause 7(14)(i) of the NCTE Regulations, 2014 have not been hyperlinked.

(i) NAAC Accreditation/LOI from NAAC is not submitted, only track ID submitted. (ii) Website of the institution with required documents /information as per provisions under clause 7(14)(i) of the NCTE Regulations, 2014 have not been hyperlinked.

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after VT, the Committee discussed the matter in detail and decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution.

14. Amity Institute of Education, Plot No- IIA-36, 37,38, Vill- Rajarhat, New Town, PO- Rajarhat, Tehsil/Taluka- North 24 Parganas, Town/City- Kolkata, Dist- North 24 229.7.3 Parganas, West Bengal - 700156 (B.Ed.-Part Time) (Private) (Amity University) (ERCAPP2247)

After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after VT, the Committee discussed the matter in detail and observed as under:

a. Show Cause Notice was issued on 30.09.2016 on the following grounds:-

(i) 37 courses are running by the Amity University in one building where the VT members physically visited for three composite teachers education courses which is impracticable. (ii) There is no separate demarcation for new three teaching education courses in the same building. (iii) The instructional facilities of B.Sc., M.Sc., BCA, MCA, Engineering courses have been shown to VT members as Science lab, computer lab and other three composite training education courses which are impracticable. (iv) Incorrect data has been filled up in the essential data sheet: Ex-classroom size is 7600 Sq. ft. (v) Building completion certificate has not been countersigned by competent authority. (vi) Books for teacher educational courses are not adequate. (vii) Permission for practice teaching has been obtained from two schools only.

b. In response to SCN, the institution submitted reply vide letter dated 19.10.2016 along with some documents. The ERC considered the reply of the institution and observed that the institution is still deficient on the following grounds:-

(i) The submitted building plan is not approved by Govt. Engineer. (ii) The submitted building completion certificate is not issued by Govt. Engineer. As per building completion certificate., the total built up for B.Ed.(Part-time) course is mentioned as 2751.95 Sq. Mts. which has not been reflected in anywhere in the building plan. (iii) In the building plan, there is no demarcation /allotment for teacher education programme. (iv) As per Norms & Standards for B.Ed.(part-time), Appendix-14 of Clause 2(i) & (ii) under NCTE Regulations 2014, the institution should have been recognised for B.Ed. and M.Ed. programmes and in existence for at least five years and having NAAC Accreditation with minimum B grade. (v) Departments/Schools of Education in UGC recognised Central/State Universities for conducting the programme before submitting the application to NCTE.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP2247 of the institution regarding recognition for B.Ed.(Part-time) Programme is refused under section 14(3)(b) of NCTE Act 1993.

a. Show Cause Notice was issued on 27.09.2016 on the following grounds:-

b. In response to SCN, the institution submitted reply vide letter dated 17.10.2016 along with some documents. The ERC considered the reply of the institution and observed that the institution is still deficient on the following grounds:-

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP2244 of the institution regarding recognition for B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.

16. Amity Institute of Education, Plot No- IIA-36, 37,38, Vill- Rajarhat, New Town, PO- 229.7.5 Rajarhat, Tehsil/Taluka- North 24 Parganas, Town/City- Kolkata, Dist- North 24 Parganas, West Bengal - 700156 (B.El.Ed.) (Private) (Amity University) (ERCAPP2245)

a. Show Cause Notice was issued on 29.09.2016 on the following grounds:-

b. In response to SCN, the institution submitted reply vide letter dated 18.10.2016 along with some documents. The ERC considered the reply of the institution and observed that the institution is still deficient on the following grounds:-

(iv) The submitted building plan is not approved by Govt. Engineer. (v) The submitted building completion certificate is not issued by Govt. Engineer. As per building completion certificate., the total built up for B.El.Ed. course is mentioned as 2751.95 Sq. Mts. which has not been reflected in anywhere in the building plan. (vi) In the building plan, there is no demarcation /allotment for teacher education programme.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP2245 of the institution regarding recognition for B.El.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.

17. Pragati Educational Institute, Plot No- 214, 218, 222, Street No -1, Vill/PO- Banharishpur, Tehsil/Taluka- Panchla, Dist- Howrah, West Bengal- 711222 (B.Ed.-New proposal) 229.7.6 (Private) (The West Bengal University of Teachers Training, Education Planning and Administration) (ERCAPP3214)

(i) The institution has possessed 3585 Sq. Mts. of built up area.

In view of the above, the committee decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution for two basic units.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD ERC NCTE and institution with the reply of letter of intent.

18. Pragati Educational Institute, Plot No. 214, 218, 222, Vill./PO- Banharishpur, Tehsil/Taluka- Panchla, Town/City- Howrah, Dist- Howrah, West Bengal - 711322 229.7.7 (D.El.Ed.-New proposal) (Private) (West Bengal Board of Primary Education) (ERCAPP3221)

(i) The institution has possessed 3585 Sq. Mts. of built up area.

In view of the above, the committee decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution for one basic unit.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD ERC NCTE and institution with the reply of letter of intent.

(i) The total built up area of the institution is 1962.96 Sq. Mts. which is less than the required 3500 Sq. Mts. stipulated for existing B.Ed.(two units) + proposed D.El.Ed.(one unt) as per NCTE Regulations, 2014.

In view the above, the committee decided as under: The committee is of the opinion that application bearing Code No. ERCAPP3457 of the institution regarding permission for D.El.Ed. Programme is refused under section 15(3)(b) of NCTE Act 1993.

a. Show Cause Notice was decided in 207th ERC meeting held on 1st -3rd March, 2016 to the institution giving 21 days time to submit the reply on the following ground:

(i) The instructional and infrastructural facilities like multipurpose hall, Library, ICT lab, Class rooms, furniture etc. are found identical at par with institution Mother Teresa Institute of Education and Research (ERCAPP2635). Both the institutions are required to re-visit by another visiting team at the cost of both institutions by submitting fee of Rs.1,50,000/-. Letter of Intent issued u/c 7(13) to Mother Teresa Institute of Education and Research (ERCAPP2635) decided in 206th ERC Meeting be kept in abeyance.

b. In response, the institution submitted reply vide letter dated 09.11.2016 along with Demand Draft of Rs. 1,50,000/- bearing No. 923957 dated 08.11.2016 requesting for revisit the institution, which is received by the ERC office on 10.11.2016.

c. The committee considered the application and observed that the reply of the institution has been received by the office after 8 months i.e. 10.11.2016 which is not accepted. Also both the institutions namely “DR Shahidullah Institute of Education”, Aminpur, North 24 Parganas, West Bengal and “Mother Teresa Institute of Education and Research”, Nadibhag, North 24 Parganas, West Bengal applied without having separate building and other infrastructures which misleads the ERC, NCTE for taking appropriate decision.

d. Further, the Demand Drafts of both the institutions are to be refunded and not to conduct the VT.

The institution preferred an appeal to the NCTE Hqrs. against the ERC‟s withdrawal order dated 19.08.2014. The Appellate Authority vide Order No. 89-350/2014-Appeal/13th Meeting-2014/A99969 dated 10.12.2014 decided that another inspection under section 13 of the NCTE Act, 1993 be caused at the cost of appellant institute within a period of one month from the date of issue of appeal order with an objective to ascertain whether the appellant institution possesses exclusive and adequate facilities for conducting B.Ed. course.

The ERC in its 188th meeting considered the matter in accordance with appeal order and forwarded to the NCTE Hqrs. vide letter dated 04.02.2015 for conducting the re-inspection of the institution u/s 13 of the NCTE Act, 1993 and subsequent Reminder I & II on 07.08.2015 & 27.10.2016. No communication received from NCTE Hqrs. till date.

Now, the Principal of the institution vide its letter dated 17.01.2016 requested not to conduct inspection and desired not to continue the B.Ed. programme and return the original FDRs towards Endowment & Reserve fund.

In view the above, the committee decided as under: Request of the institution is accepted. The original FDRs be returned to the institution and file be closed. The decision taken by ERC for withdrawal of recognition for B.Ed. course from the academic session 2015-2016 vide Order No. 26998 dated 19.08.2014 remains unchanged. The decision of the ERC may be endorsed to the Appellate Authority of NCTE Hqrs. for information.
