To date, most of what is known about sugar babies’ experiences is through anecdotal accounts filtered through the media. By drawing on the content of one popular sugar baby forum, as well as data gathered from two in-depth qualitative interviews with two active sugar babies, this thesis explores the lived experiences and perceptions of the participants. In particular, this study seeks to determine whether sugar babies articulate shared motivations; how they navigate sugar dating’s blurring of traditional romance and sex work; and how they exercise power and agency within their relationships. Key findings are that sugar dating’s blend of conventional dating and sex work creates a new conceptual space that both enhances the degree of power and agency exercised by sugar babies, and constrains it in ways both traditional and novel. iii ACKNOWLEDGEMENTS This thesis has been made possible thanks to the encouragement and guidance of my supervisor and friend, Prof. Ummni Khan. Sugar relationships are rapidly increasing in popularity among college students as a way to earn money yet there is a dearth of scholarly research on this trend. Despite parallels with the sex industry, sugar dating is not necessarily sex work. This thesis describes how sugar dating websites appeal to students, and it explores student sugar baby experiences and reflections on their decisions to start sugar dating, and then to continue or desist upon finishing school. The study has two parts. Firstly, content analysis of the leading sugar dating websites in the United States and Germany, seeking.com and mysugardaddy.de respectively, offers contextual information on the appeal of sugar dating to students in countries with very different cultural and legal norms around sex and sexuality. Secondly, eight semi-structured interviews with sugar babies, examined using interpretive phenomenological analysis, explore student sugar dating experiences. The websites revealed three main appeals to potential sugar babies: money and luxury, mentorship, and sex appeal. All of these topics were mentioned in the interviews; however, the participants focused especially on their worldview and potential conflicts of sugar dating, the dangers and drawbacks they experienced, and their personal agency.

The Article concludes that Twitter may be viewed as a micro-courtroom in which victims’ veracity and perpetrators’ responses are evaluated, interrogated, and assessed. A key, feminist critique of rape law is that the determination of the perpetrator’s guilt or innocence too often hinges on an assessment of the victim’s character. This is borne out on social networking sites, where terms such as “gold digger,” “slut,” and “ho” are engaged with regularity to describe those who come forward alleging an assault by a public figure. These de- rogatory terms serve not only to discipline the accuser but also to critique parties’ behavior as they forge relationships with legal systems and processes.

In addition to offering a review of the legal economics behind gift-giving, this article is the first to survey the five legal theories of revocability for romantic gifts, as well as an unprecedented new theory recently employed in federal court. Although the general presumption is that gifts are irrevocable, courts have used five main theories to return romantic gifts to their donors—conditional gift, pledge, consideration, unjust enrichment, and fraud—as well as a new approach which has been used recently in federal court: criminal fraud. Criminal fraud is a surprising and unprecedented development because it not only requires the disgorge- ment of the gifts as the other theories do but also punishes the donee beyond the cost of the gift. Thus, it is the only theory of revocability that will change the ex ante incentives of the donee. In the course of discussion, this article will note three economic paradoxes that arise in the context of romantic gifts: (1) non-cash gifts appear on first glance to be extremely inefficient because they involve guessing the desires of donees but are nonetheless ubiqui- tous; (2) extremely inefficient gifts tend to be better signaling mecha- nisms than efficient gifts in romantic relationships; and (3) although one who pursues a relationship blatantly for financial benefits faces more social condemnation than one who tastefully hides his or her motivations, he or she is actually facilitating a more efficient relation- ship.

Through the lens of case files, I examine the dissolution of marriages (or quasimarital relationships) formed by marriage payment agreements and analyze the anticommodification views expressed by feminists and legal scholars. In these cases, judges wrestle with two competing considerations: their own antimarriage payment and pro-groom views on one hand and the litigants’ eco- nomic conception of marriage on the other. The former urges judges to rule for the grooms, and the latter for the brides. In bal- ancing these two considerations, judges generally order a partial or full repayment of the payment when the relationship dissolves. I also examine feminist concerns of voluntariness and fairness in the commodification of sexuality. The current theoretical and judicial frameworks do not account for the divergent power dynamics in individual cases; as a result, the case rulings do not respond appro- priately to brides and grooms with differing degrees of agency. These blind spots may have unintended consequences, including inflating prices and reinforcing gender-based asymmetries. In this Article, I argue that judges should rely on economic analysis rather than moral judgment to better account for the actual dynamics of marriage payment arrangements.

So, maybe Jessica’s experience as a sugar baby isn’t all that unique after all.
