Mr. Justice Sayyed Mazahar Ali Akbar Naqvi, Honorable Justice – Supreme Court of Pakistan, Supreme Court of Pakistan, Constitution Avenue, G-5/2 Islamabad, Pakistan SUBJECT: REQUEST FOR SUO MOTU NOTICE OF EXTRA JUDICIAL KILLING OF BALOCH YOUTH Honorable Judges, We are a young group of lawyers and professionals, and in some instances students, who call themselves the Constitutional Front by name. We are writing this letter to you with the utmost respect and to request you to take suo motu notice under Article 184(3) of the recent extra judicial killing of Baloch youth Hayat Baloch in front of his parents. As per media reports, On Thursday, 13th August 2020, a 25-year-old resident of Turbat, Hayat Baloch, was shot dead by the paramilitary Frontier Corps in broad daylight. He was a final-year student of BSC (Physiology) at the Karachi University. On the fateful morning of August 13, Baloch was harvesting dates on a farm with his father Ma’azar Mohammed. Reportedly, a convoy of security forces was passing by the Aapsar area, just before noon, when it was attacked with an IED explosion. Since the farm was located adjacent to the road where the blast took place, troops of paramilitary Frontier Corps entered the farm. As per reports, they began harassing Hayat Baloch and accused him of engineering the IED explosion. Frontier Corps tied him up and carried him to the other side of the farm, despite his father pleading to the security forces that Hayat had not left the farm since morning. Mohammed’s plea fell on deaf ears as the FC Corps personnel dumped him on the ground while one of the officers fired 8-10 shots at him. Reportedly, the security personnel then abandoned his dead body while the parents of Baloch wept by the side of his dead body. Hayat Baloch was dead even before they could manage to take him to a hospital. Protests were held in Quetta at Quetta Press Club and demonstrations in Karachi were held at Karachi Press Club. #JusticeForHayatBaloch kept trending on Twitter as netizens mourned his death. It has been the magnificent history of this court to come to the help of those who have been extra judicially targeted in this country in breach of due process and specially in cases where the family and friends of the victim are unable to face the very powerful law enforcement agencies, for example in the case of Sarfaraz Shah in Karachi this honorable court took suo motu notice and had ordered to remove DG Rangers Major General Ejaz Chaudhry and IGP Sindh Police Fayyaz Laghari, while six Rangers and seven others involved in the extra-judicial killing were remanded into police custody for 15 days. In the same manner this magnificent court had taken suo motu notice of killing of 20 people whose bodies were found abandoned in Balochistan’s Turbat area in 2017 and suo motu notice of the Chechens’ killings in Kharotabad in 2011. It is the need of the hour to protect the lives of young Baloch students, who will be the shining stars of this country in the near future. It is respectfully requested to take suo motu notice of the extra judicial killing on the basis of a rolling review/continuing mandamus so that justice may be ensured to the victim who belongs to the lowest rung of the socio-economic ladder. Countless intellectuals have opined that the legitimacy of a state comes from the rule of law and the rule of law is dependent on the judiciary’s reactions to its breach.     The Journal of Humanities and Social Sciences, 2019, Vol. XXVII, No.2 Minority Ethnic, Race and Sect Relations in Pakistan:Hazara Residing in Quetta Sarfraz Khan Professor, Area Study Center, University of Peshawar Noor Ul Amin1 Islamia College Univeristy, Peshawar Abstract This paper charts systematic persecution, ethnic profiling, target killing, kidnapping, harassment, racial discrimination and ghettoization, ethnic Hazara face in Quetta.The Hazara, a marginalized ethnicity severely discriminated, began migrating initially into British India, from Afghanistan, in 1890s. During 1962- 63, the government of Pakistan granted ethnic Hazara citizenship rights. Constitutionally, they were to enjoy equal rights, might form political parties, to represent them in elected bodies of Balochistan and Pakistan. Previously, ethnic Hazara individuals rose to the positions of:Generals; rather, Chief of the Army Staff; and to Federal/ProvincialMinisters/Governors, in Pakistan. However, the Hazara began facing discrimination and ethnic, cultural as well as confessional (a majority of Hazara profess Shia sect of Islam) persecution, in Pakitan, in the last two deacades of the previous mellenium, at unofficial, and continue to face, both, at official and unofficial levels. Since 2012, computerised National Identity Cards of ethnic Hazara in Quetta have been suspended/blocked, a step tentamount to denial of citizenship rights of Pakistan. A Sunni militant terrorist outfit, Lashkar-Jhangive, warned ethnic Hazara of turning Pakistan into their graveyard, in case, they did not leave this country. Following Iranian revolution enusuing Iran/Saudi (Shia- Sunni) conflict resulted into proxy war. Hazara leaders suspect, systematic persecution of Hazara, aims at, evicting them of expensive land they occupy in and around Quetta.
