CLONES, BONES AND TWILIGHT ZONES: PROTECTING THE DIGITAL PERSONA OF THE QUICK, THE DEAD AND THE IMAGINARY By JosephJ. Beard' ABSTRACT This article explores a developing technology-the creation of digi- tal replicas of individuals, both living and dead, as well as the creation of totally imaginary humans. The article examines the various laws, includ- ing copyright, sui generis, right of publicity and trademark, that may be employed to prevent the creation, duplication and exploitation of digital replicas of individuals as well as to prevent unauthorized alteration of ex- isting images of a person. With respect to totally imaginary digital hu- mans, the article addresses the issue of whether such virtual humans should be treated like real humans or simply as highly sophisticated forms of animated cartoon characters. SCOTT (Executive Producer, Director) – As a director and producer, Michael Scott has been a creative force behind 16 television films for cable and network since 1990. Previously, he had a successful 10-year career producing, writing and directing documentaries and reality programs. In 2008, Scott served as co-executive producer for the Lifetime Original movie titled “The Two Mr. Kissels,” starring John Stamos. As a director, he recently delivered “Special Delivery,” starring Lisa Edelstein and Brenda Song. Scott directed several other films for the Lifetime Network, including “Murder on Pleasant Drive,” “Tell Me No Lies,” “Her Sister’s Keeper” and “Best Friends.” For Hallmark Channel, Scott directed the 2009 holiday movie, “Debbie Macomber’s Mrs. Miracle,” followed in 2010 by “Debbie Macomber’s Call Me Mrs. Miracle” and the Hallmark Channel Original Movies “Edge of the Garden” and “Window Wonderland.” Other directing credits include “Dangerous Heart” (USA Network), “Murder at 75 Birch” (CBS), “Like Father, Like Santa” (Fox Family), “Desperate Justice” (Lifetime) and “Escape From Terror” (NBC). Scott’s producing credits include “Murder 101” (USA), directed by Academy Award®- winning writer Bill Condon, “Sweet Poison” (USA) and “Dead in the Water” (USA) starring Bryan Brown and Teri Hatcher. In November 2005, Robert Iger, the newly appointed CEO of the Walt Disney Company, eagerly awaited the box office results of Chicken Little, the company’s second computer-generated (CG) feature film. He knew that, for Disney as a whole to be successful, he had to get the animation business right, particularly the new CG technology that was rapidly supplanting hand-drawn animation.1 Yet the company had been reliant on a contract with animation studio Pixar, which had produced hits such as Toy Story and Finding Nemo, for most of its recent animated film revenue. And the co-production agreement, brokered during the tenure of his predecessor, Michael Eisner, was set to expire in 2006 after the release of Cars, the fifth movie in the five-picture deal. Unfortunately, contract renewal negotiations between Steve Jobs, CEO of Pixar, and Eisner had broken down in 2004 amid reports of personal conflict. When he assumed his new role, Iger reopened the lines of communication between the companies. In fact, he had just struck a deal with Jobs to sell Disney- owned, ABC-produced television shows—such as “Desperate Housewives”—through Apple’s iTunes Music Store.2 Iger knew that a deal with Pixar was possible; it was just a question of what that deal would look like. Cedars-Sinai’s outstanding fiscal year 2019 extended throughout the institution, including extraordinary growth and achievements in our academic programs (major research findings and a record number of advanced degrees awarded in the Graduate School of Biomedical Sciences) . And strong donor support helped our development team raise a record $120 million in philanthropy. Many of these gifts, small and large, came from grateful patients, reflecting their appreciation for the compassionate expertise of our physicians, nurses, pharmacists, other health professionals and support staff . Meanwhile, we cared for more outpatients and inpatients than ever before throughout Southern California . This was due to several factors, including the continued growth and geographic expansion of our network in Santa Monica and the Valley and clinical enhancements at Cedars-Sinai Marina del Rey Hospital.
