Essays ISLL Papers The Online Collection DIRITTO E LETTERATURA David Cerri Avvocato [email protected] Abstract Law and Literature The author retraces the events of the L&L movement singling out in the “stimulus to read” the most important suggestion that literature can provide to law. Literature expands the repertoire of arguments and lexical forms tied to the complexity of emotions, illustrating how we can broaden our understanding of the emotions, an understanding that should form an integral part of law-school training. What emerges from the essay is the importance of professional ethics and the need to construct not only a simple set of rules for the legal profession but also a broader legal culture for the contemporary lawyer as an actor embedded in the social context. Se fossi in Te, dimenticherei qualsiasi preparazione tecnica per quanto concerne il diritto. Il miglior modo per studiare il diritto è quello di giungere a tale studio come una persona già ben istruita. Solo così si può acquisire la capacità di usare la lingua inglese, scritta ed orale, ed avere un metodo di pensiero chiaro, che solo una educazione genuinamente liberale possono conferire. Per un giurista non è meno importante coltivare le facoltà immaginative leggendo poesia, ammirando grandi quadri, nell’originale o in riproduzioni facilmente accessibili, ascol- tando grande musica. Rifornisci la tua mente di tante buone letture, e amplia e approfondisci i Tuoi sentimenti sperimentando indiret- tamente ed il più possibile i magnifici misteri dell’universo, e dimenticati della tua futura carriera. ISAIDAT , 2010, fasc.1, 3). 1 Abstract Ripercorrendo le vicende del movimento Diritto e Letteratura, l’Autore individua come valori aggiunti dalla letteratura al diritto in primo luogo lo stimolo alla lettura, con le conseguenze in ordine all’ampliamento del repertorio degli argomenti e delle forme lessicali, e alla comprensione della complessità delle emozioni, aspetto quest’ultimo particolarmente rilevante nella formazione forense. Sottolinea quindi l’importanza della deontologia, intesa non solo e non tanto come insieme di regole, quanto come costruzione a tutto tondo della figura dell’avvocato contemporaneo, che opera immerso in una rete di rapporti sociali. Le opere e gli uomini Da sempre diritto e letteratura intrecciano un rapporto strettissimo. Oltre alle opere, lo dimostrano le biografie di molti celebri giuristi, e di altrettanti scrittori e filosofi. Cicerone e Seneca erano avvocati; filosofi, letterati ed uomini di stato come Tommaso Moro, Bacone e Montesquieu avevano una preparazione giuridica; Dickens fece il garzone di studio (e poi il cronista giudiziario); nel novecento Jorge Amado, un poeta come Wallace Stevens, John Luther Long (l’autore di Madama Butterfly) o Bernardo Guimaraes, il creatore della Schiava Isaura, erano tutti giuristi; in Italia, bastino i nomi di Salvatore Satta e di Francesco Galgano, oggi di Michele Salazar 2. Scrittori, quindi, sia di generi “alti” che di più popolari, per non parlare dei protagonisti di alcuni filoni letterari oggi molto frequentati (dai gialli ai veri e propri legal thriller ). Perché allora dedicare un’ora di questo Congresso a diritto e letteratura ? Poco tempo, o troppo, (o, meglio, inutile) ? una sorta di pausa-caffè per alleggerire l’impegno di altri interventi più tecnici, ed almeno per quanto mi riguarda, sicuramente più autorevoli ? Forse un motivo c’è, od addirittura più di uno. E il primo è tratteggiare una risposta anche sotto questo punto di vista a quell’invito pressante, e spesso strumentale, cui siamo quotidianamente sottoposti come categoria: guardate all’Europa, agli Stati Uniti, al mercato globale ! certamente; nessuna remora, perchè si avranno anzi piacevoli sorprese. Il movimento detto Diritto e Letteratura ( Law and Literature ) nasce negli Stati Uniti quasi quarant’anni fa, annoverando tra i primi apostoli James Boyd 2 Ricordiamo soltanto, nell’ordine di citazione: S. SATTA, Il mistero del processo , Milano, Adelphi, 1994; F. GALGANO, Tutto il rovescio del diritto , Milano, Giuffrè, 2007; M. e M. SALAZAR, Scritti sfaccendati su diritto e letteratura , Milano, Giuffrè, 2011. 2 White, con l’opera The Legal Immagination 3; per dare una dimensione del suo successo, mi limito a riferire che le discussioni odierne sui programmi delle Law Schools (che, mi si consenta di notare, arrivano non raramente sulle prime pagine dei quotidiani più importanti, come il New York Times: a testimonianza di un differente consapevolezza della rilevanza sociale di questa professione da parte di un’opinione pubblica che certamente anche oltre oceano non è tenera con gli avvocati) vedono tra gli argomenti più trattati quello dell’ eccessivo spazio dato a questo genere di studi, il cui inserimento nei percorsi della formazione per l’accesso è dato per indispensabile e scontato. Anche in Italia non mancano significative esperienze e corsi, come quello della facoltà di Giurisprudenza di Torino, diretto da Pier Giuseppe Monateri, e quello di Roma Tre, che ha visto tra gli altri gli interventi – oltre che di Emanuele Conte che lo dirige – di Eligio Resta, di Vincenzo Zeno Zencovich, di Mario Aschieri), né associazioni (come l’ AIDEL – Associazione Italiana Diritto e Letteratura, e la SIDL - Società Italiana di Diritto e Letteratura 4) alle cui attività partecipano giuristi come Francesco Galgano, Luigi Lombardi Vallauri, Eugenio Ripepe, Umberto Breccia, e che si caratterizzano per una forte interazione con analoghe esperienze europee 5. Un filosofo italiano, Mauro Barberis, ha messo in guardia da un eccessivo entusiasmo, ricordando come il successo americano delle humanities non sia indenne dal rischio che talvolta corrono le doppie traduzioni: si tratterebbe infatti di re-importare sul continente europeo approcci in realtà lì nati e cresciuti (il post-modernismo, lo strutturalismo 6), sì che tornerebbe attuale la battuta di Tarello 7. 3 Ma è proprio J. This disease cause always important health challenges for the human communities. It is common in many parts of the globe. This research was designed to determine the epidemiology of CL in East of Ahvaz County during 2003- 2013. Methods: This was a descriptive cross-sectional study. The disease was diagnosed based on clinical examination and microscopic observation of the parasite in the ulcer site. The patient's Information such as age, gender, number and sites of ulcer (s) on the body, month and residence area were recorded. Data analysis was performed using SPSS software. Results: Totally, 2287 cases were detected during 2003 – 2013. About 53.4% patients were male and 46.4% female. The highest frequency infected age groups were observed in 10-19 years old (n=550 ,24%). Nearly 37 % of the patients had one and 38.1% had three ulcers.

The many subtleties of Iranian Cinema has also stemmed from the filmmakers’ need to circumvent the harsh censorship rules of the state and the financial limitations imposed on independent filmmakers. Despite these limitations, post‐revolutionary Iranian Cinema has been a reGular feature at major film festivals around the Globe. The minimalist Art Cinema of Iran often blurs the borders between documentary and fiction films. Directors employ non‐professional actors. Male and female directors and actors darinGly explore the themes of Gender inequality and sexual exploitation of women in their work, even thouGh censorship laws forbid female and male actors from touchinG one another. In the process, filmmakers have created aesthetically sublime metaphors that bypass the censors and directly communicate with a universal audience. This course is an introduction to contemporary Iranian cinema and its interaction with Political Islam. Special attention will be paid to how Iranian Realism has 1 developed a more tolerant discourse on Islam, culture, Gender, and ethnicity for Iran and the Iranian plateau, with films about Iran, AfGhanistan, and Central Asia.

About 90% of cases of cutaneous leishmaniasis (CL) are reported from seven countries including Iran. Evidence suggests the increased annual incidence of this disease in Iran. Intracellular protozoan parasite, Leishmania, is an obligatory parasite. Sandflies transfer infectious forms of the parasite or its metacyclic promastigotes to its vertebrate hosts such as humans by biting. In order to review the epidemiology of CL in Isfahan, Iran, factors such as incidence, disease causes, geographic features, age, and sex distribution, nationality, and occupation of patients, and the clinical spectrum of disease were evaluated. Methods: During the study, 1315 patients with CL, who referred to the Dermatology and Leishmaniasis Research Center at Isfahan, were evaluated. Results: The highest prevalence of CL was observed in fall (54%) and in northern areas of Isfahan (60.9%). Although CL was prevalent in both men and women, it had higher incidence in men (61.8%). The majority of patients (31.2%) aged 21–30 yr old. Most lesions were nodule-shaped (36.5%) and in upper extremities (48.3%) particularly in men (32.4%). While 81.2% of the subjects were Iranian, others were Afghani or with other nationalities.

Ghasemi3 1 Agroclimatologist/ Research Project Manager, International Center for Agricultural Research in the Dry Areas (ICARDA), Aleppo Syria 2 Director-General, Drylands Agricultural Research Institute (DARI), Maragheh, Iran 3 Head of GIS/RS Department, Soil and Water Research Institute (SWRI), Tehran, Iran INTRODUCTION The agroclimatic zones map of Iran has been produced to as one of the outputs of the joint DARI-ICARDA project “Agroecological Zoning of Iran”. The objective of this project is to develop an agroecological zones framework for targeting germplasm to specific environments, formulating land use and land management recommendations, and assisting development planning. In view of the very diverse climates in this part of Iran, an agroclimatic zones map is of vital importance to achieve this objective. METHODOLOGY Spatial interpolation A database was established of point climatic data covering monthly averages of precipitation and temperature for the main stations in Iran, covering the period 1973-1998 (Appendix 1, Tables 2-3). These quality-controlled data were obtained from the Organization of Meteorology, based in Tehran. From Iran 126 stations were accepted with a precipitation record length of at least 20 years, and 590 stations with a temperature record length of at least 5 years. The database also included some precipitation and temperature data from neighboring countries, leading to a total database of 244 precipitation stations and 627 temperature stations. The ‘thin-plate smoothing spline’ method of Hutchinson (1995), as implemented in the ANUSPLIN software (Hutchinson, 2000), was used to convert this point database into ‘climate surfaces’.

Therefore, the purpose of this study is to investigate unmet costs (those which are not covered either by the insurance companies nor the recent reform coverage mentioned in Sections 1.2.2 and 1.2.1, Article 6 of the Health Minister Reform Guideline) in the inpatient billings within the first 5 months from the reform implementation.
