National Park Service, U.S. Department of the Interior Gateway National Recreation Area Jamaica Bay and Staten Island Units Commercial Use Authorization Solicitation Short Term or Various Events 2019 and 2020 Mobile Food and Beverage Service at Various Areas within the New York Units Shorebird Festival At Jamaica Bay IMPORTANT DATES Solicitation Date May 21, 2019 Questions about this Opportunity are due May 28, 2019 Application Due Date June 7, 2019 by 1:00 pm 1 Gateway National Recreation Area is seeking mobile food and beverage vendors to provide service in the Jamaica Bay and Staten Island Units of Gateway National Recreation Area. The Superintendent of Gateway National Recreation Area announces the intent to issue in-park Commercial Use Authorizations (CUAs) in accordance with Public Law 105-391 Section 418. The CUAs will authorize mobile food and beverage operations at the Jamaica Bay and Staten Island Units of Gateway National Recreation Area (Park) at selected NPS events and/or seasonal or shorter duration as determined by NPS, including, but not limited to: Event Time of Year Location Horseshoe Crab Festival May Jamaica Bay Unit Shorebird Festival August Jamaica Bay Unit Pollinator Festival September Jamaica Bay Unit Raptorama! October Jamaica Bay Unit Fleet Week Parade of Ships May Staten Island Unit July 4th Concert and Fireworks July Staten Island Unit Founders Day Concert August Staten Island Unit Staten Island Shakespearean Summer and Shoulder Staten Island Unit Theatre performances in the park Seasons Athletic Events at Miller Field Year Round Staten Island Unit Beach Center at Great Kills Park Summer and Shoulder Staten Island Unit Seasons Selected Applicants will be notified by NPS as needed NPS will provide Selected Applicants with email notification of the need for service and the time and place of the event and will select from the pool of CUA Holders on a first come-first served basis. NPS reserves the right to revise or limit opportunities for mobile food and beverage service and to determine whether mobile food and beverage service is appropriate at any location, date, or time. Other events at which mobile food and beverage service may be sought remain at the park’s discretion but may include other events taking place throughout the park: https://www.nps.gov/gate/planyourvisit/things2do.htm 2 Location of Service Area: The Park seeks a variety of mobile food and beverage vendors to operate, by request from the Park, on a per event basis, and/or seasonal or shorter duration as determined by NPS, at the Jamaica Bay and Staten Island Units of the Park Jamaica Bay The Jamaica Bay Unit is one of the largest expanses of open-space in the region, consisting of over 19,000 acres within two boroughs of New York; Brooklyn and Queens. The unit offers various events throughout the summer season. The park is interested in offering mobile food and beverage services during those events. Area for mobile food and beverage services may include, but is not limited to the below areas: - Plumb Beach - Floyd Bennett Field - Canarsie - The Jamaica Bay Wildlife Refuge - Frank Charles Park and Hamilton Beach - Fort Tilden 3 Staten Island Unit The Staten Island Unit encompasses almost 3,000 acres of shoreline and four areas including Fort Wadsworth, Great Kills Park, Miller Field, and Swinburne Island and Hoffman Island in Staten Island, New York. The unit offers various events throughout the summer season. The park is interested in offering mobile food and beverage services during those events. Area for mobile food and beverage services may include, but are not limited to the below areas: - Fort Wadsworth - Great Kills Park - Miller Field The Park will issue CUAs to operate during the summer and shoulder seasons of 2019 and 2020 for NPS events. The selected vendors will be authorized to operate mobile food and beverage services at events and locations identified by NPS. CUAs will not be subject to renewal. The Superintendent retains the right to issue determinations as to compatibility with and impact to natural and other Park resources, and to limit or decrease the number of CUAs issued based on preservation and proper management of Park resources and values. Vendors must submit the required Commercial Use Authorization Application Form (OMB Control No: 1024-0268) and Supplemental Application Form for each mobile operation. Vendors should identify their preferred location at Jamaica Bay, Staten Island or both location from which they would be willing to operate. There is no guarantee that selected Vendors will be assigned their preferred location. The Park will select applicants and assign locations based on an Applicant’s ability to meet the below identified criteria and the Park’s desire to provide visitors with a wide variety of offerings. All CUAs will be subject to the General Conditions listed in Appendix A and to other conditions, if any, NPS determines are appropriate. 4 Description of Services Solicited: Authorized vendors are to offer food, beverages, and convenience items to event participants. Food items may include a variety of hot and cold foods such as hot dogs, pizza, sandwiches, barbeque, ice cream, potato chips, and candy. Beverages may include only non-alcoholic beverages (no alcoholic beverages may be sold). Convenience items may include sunscreen lotion, insect repellent, umbrellas, and other sundries typically used for beach clean ups. The Park Superintendent reserves the right to approve all food, beverage, and convenience items before operations commence. Selected Applicants must comply with FDA Food Code, which can be found at: http://www.fda.gov/downloads/Food/GuidanceRegulation/RetailFoodProtection/FoodCode/UC M374510. pdf Vendor Operation Stipulations: The Park will provide no water, electrical, or utility services to support vendor operations; nor are any on-site utility services available through other providers. No on-site vendor construction of any kind is authorized to support vendor operations. Please note, the Park may have dumpsters at certain locations, at which Selected Applicants will have to keep the areas in which those dumpsters are located litter free. There are other areas of the park at which dumpsters are not available and at which selected Applicants will be solely responsible for trash management and removal and recycling. Mobile food and beverage vendors must dispose of trash in a manner directed by the park staff or his/her designee. Vendors are prohibited from using or distributing styrofoam products or plastic straws. Additional terms and conditions can be found in Appendix A. Commercial Use Authorization Requirements: Applicants interested in this opportunity must complete and submit the attached Commercial Use Authorization (CUA) Application (Attachment A) and a non-refundable $150.00 Application Fee. Selected Applicants will also be required to: 1. Remit payment for the Application Fee of $150.00. Fees are non-refundable. 2. Remit payment in the amount of three percent (3%) of gross receipts within thirty (30) days of each event at which the CUA Holder provides Mobile Food and Beverage Services, or if authorized to operate for a longer duration, (3%) of gross receipts for the preceding month within thirty (30) days of same. 3. Submit NPS Revenue Reporting Form 10-660 within the timeframe identified above. 4. Follow all the terms and Conditions of the attached CUA, which include, but are not limited to the following obligations: a. Submit proof of insurance (General Liability $1 Million per occurrence $3 Million aggregate). b. Provide a statement of gross receipts from activities conducted under this authorization immediately upon expiration of the CUA. Selected applicants are required to maintain accounting systems and make all financial records related to the activities conducted under the CUA available to the United States of America and the General Accounting Office. Selected applicants may also be 5 required to provide information related to visitor use statistics and resource impact assessments at the request of the Superintendent. c. Comply with inspections and approvals by the Park and by United States Public Health Service (USPHS) personnel. Inspections will take place prior to commencement of vendor operations. Inspections may also take place anytime thereafter to ensure compliance with federal, state, and local safety, sanitation and health codes, including FDA Food Code. d. Submit proof of Food Handler’s Certificate e. Comply with Park Signage Requirements Minimum CUA Holder Standards Standard 1 – Experience and Operations CUA holders must have the following experience: 1. The experience necessary to successfully develop and manage a high-quality mobile food and beverage service operation with a concept that will attract customers. Please include customer satisfaction or industry standard awards demonstrating exceptional service, products, and quality (i.e. Best Chili - State of NJ, most delicious blintz, Fan Favorite). 2. A proven track record providing food and beverage services through a mobile operation/s in a National Park/s or venue of the same scale, i.e. festivals, concerts, etc. as demand dictates. 3. Appearance and design of mobile food and beverage unit (for example pushcart, truck, or trailer on wheels) must be visibly appealing, in good condition, clean on the inside and outside, complementary to the surrounding natural environment. Please submit drawings or photographs of the mobile food and beverage unit you propose to use. Please be sure to include dimensions of the mobile food and beverage unit you propose to operate. Standard 2 – Sustainability The Park prefers vendors that offer: 1. Eco-friendly alternatives for food and beverage preparation and mobile operations including such as use of biodegradable materials or packaging (paper goods, utensils, paper straws). 2. Energy Star or similar efficient appliances, or systems that incorporate environmentally friendly green products in their preparation and operations.
