1.0 EXECUTIVE SUMMARY

KAS, Inc. (KAS) conducted a Phase I Environmental Site Assessment (ESA) of a 0.016 acre parcel located at 23 West Main Street in the Town of Wilmington, Vermont. The ESA was conducted pursuant to the American Society of Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM E 1527-05). The work was commissioned by the Windham Regional Commission (WRC), using funding from the US Environmental Protection Agency Brownfields Grant # BF-96151401. The warranty deed holder of the property is the Mount Snow Regional Chamber of Commerce and the property is subject to a 99-year lease which began in 2009 and was amended in 2013. The lessees are Joseph Specht and Ann Coleman Specht. The user of this document is Ann Coleman Gallery.

The Phase I ESA is being performed in response to the discovery of an apparent subsurface void space surrounded by metal, below the property’s ground surface. The Phase I ESA is a required first step in the Brownfields Assessment process of making a determination of what this space consists of.

The property consists of an approximately 0.016 acre parcel which is completely surrounded by lands of the Mount Snow Regional Chamber of Commerce. As of April 2013 the property was vacant and not in use. The property reportedly hosted a single-story building last used as an art gallery, which was destroyed by Tropical Storm Irene. Historically, the property and the adjacent property were both part of a gasoline filling service station. The property’s other documented historic use has been as a storage building/livery stable, auto storage garage, vacant land, a school and an art gallery.

KAS has identified one REC on the property as defined by ASTM, the historic use of the property as part of a service station/filling station operation. The void space found below the property needs to be further investigated to determine if there is an UST on the property. If an UST is found then it would be considered to be a REC per ASTM.

2.0 INTRODUCTION

KAS, Inc. of Williston, Vermont (KAS) conducted a Phase I Environmental Site Assessment (ESA) of a 0.016 acre parcel1 located at 23 West Main Street in the Town of Wilmington, Windham County, Vermont (property; see Appendix A Site Location Map and Appendix B Site Plan). The ESA was conducted pursuant to the American Society of Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM E 1527-05). The work was commissioned by the Windham Regional Commission (WRC), using funding from the US Environmental Protection Agency Brownfields Grant # BF-96151401. The warranty deed holder of the property is the Mount Snow Regional Chamber of Commerce2 and the property is subject to a 99-year lease which began in 2009 and was amended in 2013. The lessees are Joseph Specht and Ann Coleman Specht.3 The user of this document is Ann Coleman Gallery.

2.1. Purpose

The purpose of this ESA was to identify recognized environmental conditions (RECs), historic RECs and de minimis conditions in association with the property as defined and described in the ASTM standard.

2.2. Detailed Scope-of-Services

KAS was engaged by client to conduct a Phase I ESA as defined in ASTM E 1527-05. The Phase I ESA work scope included the following elements:

 A general description of the site and vicinity, current property and adjoining property uses, description of improvements.  An evaluation of user supplied information including land records, liens, limitations, specialized knowledge, and valuation information.  A review of practically reviewable regulatory and historic records in connection with the property.  A site reconnaissance including general site setting, interior and exterior observations.  Interviews with owner, site manager, occupants, local government officials and others as available.  Presentation of Findings, Opinion, Conclusions, Deviations and the results of any out of scope contract obligations between client and KAS.

Unless otherwise stated in Section 12.0 of this document, no invasive environmental testing was conducted, and no assessment or testing of asbestos, lead paint, radon or other structural environmental hazards was conducted. If any of these tasks were contracted between KAS and

client, the methodology, limitations and results of such tasks may be presented in Section 12.0 of this document.

3.0 SITE DESCRIPTION

3.1. Location and Legal Description

The property consists of an approximately 0.016 acre parcel which is completely surrounded by lands of the Mount Snow Regional Chamber of Commerce. The property coordinates are 42° 52’ 9’’ north latitude and 72° 52’ 21” west longitude.4 The property is a 99 year leasehold of land owned by the Mount Snow Regional Chamber of Commerce. There is more information regarding the property legal description in Section 4.0.

3.2. Site and Vicinity General Characteristics

The property is on the north side of the , on an apparent first-level river terrace. No surface water was noted on the property, the river is the closet surface water approximately 100’ to the south. No wetlands or exposed bedrock were noted. The estimated depth to groundwater is less than 10’ based on the property’s proximity to the steep bank to the north and the Deerfield River to the south. Groundwater was encountered during the removal of a nearby underground storage tank (UST) at 8-13’ depth.5 The groundwater flow direction beneath the property is most likely toward the south based on nearby investigations, the surface topography and the location of surface waters. The depth to groundwater and predicted flow direction were not confirmed during this Phase I ESA.

3.3. Current Use of the Property

As of April 2013 the property was vacant and not in use. The property reportedly hosted a single- story building last used as an art gallery, which was destroyed by Tropical Storm Irene.

3.4. Descriptions of On-Site Structures, Roads and Other Improvements

There were no on-property structures, roads or other improvements at the time of the site reconnaissance in April 2013. West Main Street (Vermont Route 9) is approximately 10’ south of the property’s southern boundary. The area is served by buried water and sewer service, and by overhead electric lines. None of these utilities were actively serving the property during the site reconnaissance.

3.5. Current Uses of Adjoining Properties

North, south, east and west the property is surrounded by lands owned by the Mount Snow Regional Chamber of Commerce. Beyond the boundaries of the Chamber’s land the following land uses were noted. Differing historic land uses on adjoining properties were not visually evident. • North: a steep bank upward to undeveloped land and residences • East: a book store and other historic buildings along West Main Street. • South: West Main Street and a restaurant, real estate office, gift shops and the Crafts Inn. • West: a gift shop.

4.0 USER SUPPLIED INFORMATION

4.1. Title Records

KAS reviewed chain of title information for the property at the Wilmington Town Clerk’s office on April 9, 2013. The property transactional history was ascertained as follows.

A 1959 property survey was found in the town land records and it shows the property and the abutting property and the nearby properties at the time.13 Specifically, the property is shown as part of the same property as the historic garage/service station. Only a small portion of the garage building is shown on this survey plan. A copy of this property survey is included in Appendix B.

4.2. Environmental Liens or Activity and Use Limitations

No environmental liens or activity and use limitations were discovered during review of land records. User did not indicate knowledge of the existence of environmental liens or activity and use limitations in connection with the property.

4.3. Specialized Knowledge

4.5. Valuation Reduction for Environmental Issues

User identified the property owner, manager and occupants as follows: Mount Snow Regional Chamber of Commerce is the property owner and manager. The property is presently unoccupied.

5.0 RECORDS REVIEW

5.1. Standard Environmental Record Sources

5.1.1 Regulatory Database Search

KAS contracted with Environmental Data Resources Inc. (EDR) to perform a review of state and federal regulatory records during this Phase I ESA. A copy of the EDR Report is included in Appendix E. A summary of the pertinent data contained in the EDR report is presented below. Note that the EDR report is labeled 21 West Main Street and the property is designated as 23 West Main Street; this will not affect the results or interpretation of the data.

Property

The property is not included in the EDR report for the searched environmental database categories.

Immediately Adjacent Sites

The immediately adjacent property (Mount Snow Region Chamber of Commerce) is not included in the EDR Report for the searched environmental database categories.

Other Sites

There are several nearby properties included in the EDR report. These are summarized as follows.

The Karla Simpla property at 17 West Main Street (0.02 miles east) is included in the EDR report as a pulled UST site and a leaking UST site. Two 1,000-gallon fuel oil USTs were removed in 2002 reportedly in poor condition. Contamination was found during the UST removal. A site assessment was performed in 2009 and groundwater contamination was found off the property in excess of state standards. Routine monitoring is underway to track the decline of the contamination concentrations. There is more information concerning this property presented in Section 5.2.

The Incurable Romantic at 16 West Main Street (0.025 miles southeast) is included in the EDR report as a removed UST site. A 500 gallon fuel oil UST was removed in 2009 and reportedly was in good condition. Contamination was not reported.

The former Jug Barn at 36 West Main Street (0.05 miles southwest) is included in the EDR report as a pulled UST site and an inactive state hazardous site. Two gasoline USTs (4,000 and 5,000 gallons) installed in 1960 were removed in 2006. Contamination was encountered during the removal. A site investigation was performed and no detectable petroleum was found in the groundwater at 10’ depth. The site was granted Sites Management Activity Complete (SMAC) status. There is more information concerning this property presented in Section 5.2.

Nido’s Service Station at 77 West Main Street (0.2 miles west) is included in the EDR report as a leaking UST site, a RCRA conditionally-exempt small quantity generator of hazardous waste, a Vermont manifest property, and a UST registry site (non-geocoded). The Vermont manifest information indicates that 440 gallons (8 drums) of gasoline waste were shipped in 2008 to a disposal facility in Connecticut. The leaking UST listing indicates that a gasoline release was discovered in 2002, contaminated soils were excavated and stockpiled, and that further investigation is needed. There is more information concerning this property presented in Section 5.2.

There are approximately 50 other properties in the Town of Wilmington included in the EDR report, which are not thought to present tangible environmental risk to this property.

5.2. Additional Environmental Record Sources

Karla Simpla Property 17 West Main Street (DEC Site 2003-3074)

KAS reviewed a letter summarizing the results of the UST removal in December 2002. Field readings of contamination using a portable photoionization detector (PID) were up to 100 parts per million and the removed USTs were described as “riddled with holes.” Groundwater was encountered at 10’ depth. Further work was requested.14

KAS reviewed the most recent available environmental report for the former Karla Simpla property.15 This report indicates that four monitoring wells were installed and sampled as part of a continuing groundwater investigation. State groundwater standards were exceeded, and the groundwater contamination plume appears to have crossed West Main Street and migrated in a southeasterly direction toward the Deerfield River. This migration direction is away from the property and indicates that the documented contamination has little chance of affecting the property. This opinion was confirmed by the DEC’s site manager in an electronic mail message.16

Former Jug Barn, 36 West Main Street (DEC Site 2006-3606)

KAS conducted a closure assessment of two gasoline USTs at a former filling station at 36 West Main Street in November 2006. The USTs, which were 4,000 gallon and 5,000 gallon capacity, had been out of service approximately 40 years and were owned by A.R. Sandri, Inc. of Greenfield, MA. Field observations and measurements indicated that no measurable release was associated with the 4,000 gallon UST, and that a measurable release was associated with the 5,000 gallon UST. Evidence of a gasoline release was noted at the south end of the 5,000 gallon UST. Strong aged gasoline odors were noted and a peak PID reading of 649 ppm was encountered at 11’ below grade. The water table was encountered at approximately 10’ depth. The North Branch of the Deerfield River is approximately 30’ south of the former UST.17

KAS subsequently completed an Initial Site Investigation at the former Jug Barn (known as the Rice Family Gift Outlet in 2007). The Site had been utilized as a gasoline retail station. Three monitoring wells were installed. Soil samples were collected from the borings, logged by the supervising geologist and screened for volatile organic compounds (VOCs). VOCs were measured above background concentrations. No petroleum odors were noted. Bedrock was not encountered. Groundwater was encountered at approximately 10 to 12’ below grade. Groundwater was flowing towards the northwest. KAS collected groundwater samples on February 26, 2007. The laboratory report did not indicate a presence of VOCs or petroleum hydrocarbons in the groundwater samples. KAS recommended that the Site be considered for SMAC status and be removed from the VTDEC Active Sites list.18 A July 13, 2007 letter from the DEC conferred SMAC status on the property.19 In light of the property’s SMAC status and non-detectable groundwater concentrations the former Jug Barn property is not thought to represent an environmental threat to the property.

Nido’s Service Station, 77 West Main Street (DEC Site 2002-2959)

Contamination was discovered during piping replacement associated with five petroleum USTs on this property in 2001. Groundwater was encountered at a depth of 4’ below grade. PID readings up to 390 ppm were reported in the shallow soils. A subsequent subsurface investigation was performed and confirmed the presence of contamination at depths up to 17’ below grade. Groundwater was encountered between 1-3’ below grade. Some of the reported contamination concentrations exceeded state groundwater standards. However, the soils were reportedly fine grained and the site is proximal to the Deerfield River so it appears unlikely that the reported contamination has potential to impact the property.

5.3. Physical Setting Sources

5.3.1 USGS Topographic Maps

The most recent USGS topographic quadrangle map was reviewed during this assessment and depicts the property developed with a structure.20

5.3.2 State Geological Maps

Bedrock in the vicinity of the property consists of Precambrian aged crystalline rocks.21 The overburden deposits in the area of the property are mapped as glacial fluvial outwash gravels.22 5.4. Historical Use Information on the Property and Adjoining Properties

5.4.1 Standard Historical Sources

Aerial Photographs

KAS reviewed aerial photographs from 1962,23 199324 and 2010.25 The 1962 photo shows the property and the adjoining Chamber of Commerce property developed with one structure encompassing both properties. The property appears to be developed with one structure in the 1993 and 2010 photos.

Fire Insurance Maps

Sanborn insurance mapping for the years 1901, 1906, 1925 and 1941 were examined during this assessment.

Historic USGS Topographic Maps

Historic USGS topographic quadrangle maps were reviewed during this assessment including the 1899 and 1954 maps.26 Both maps show the property in a developed state.

6.0 SITE RECONAISSANCE

6.1. Methodology and Limiting Conditions

On April 9, 2013, Alan R. Liptak, CPG, EP of KAS conducted a site reconnaissance to inspect the property for indications of environmental risks or hazardous conditions. A completed site inspection checklist is included in Appendix G. KAS was accompanied by Ms. Cullen Meves of the Windham Regional Commission and by Ms. Sarah Daniels of the Mount Snow Regional Chamber of Commerce during the site reconnaissance. Photographs of the property are included in Appendix C.

6.2. General Site Setting

6.2.1 Current Uses

Property consists of a 24’ x 30’ rectangular parcel under 99-year lease to Joseph Specht and Ann Coleman Specht. The property is entirely within the boundaries of a 0.15 acre parcel owned by the Mount Snow Regional Chamber of Commerce. The property is not developed and is currently used as an earthen driveway between the adjoining gift shop and the Regional Chamber of Commerce building on the north side of West Main Street in Wilmington. The property slopes gradually southward. There are no structures or other improvements on the property. Reportedly there was a building on the property which was occupied by an art gallery. The building was

6.2.2 Past Uses

There is no visual indication of past property use.

6.2.3 Current and Past Uses of the Adjoining Properties

North, south, east and west the property is surrounded by lands owned by the Mount Snow Regional Chamber of Commerce. Beyond the boundaries of the Chamber’s land the following land uses were noted.

North: a steep bank upward to undeveloped land and residences East: a book store and other historic buildings along West Main Street. South: West Main Street and a restaurant, real estate office, gift shops and the Crafts Inn. West: a gift shop.

Differing historic land uses on adjoining properties were not visually evident.

6.2.4 Current and Past Uses in the Surrounding Area

The general area development is a historic village downtown area. Houses on small downtown lots have been converted to businesses. The ground slopes upward steeply toward the north behind the property and the property is between the steep slope and the Deerfield River such that the probable upgradient uses are undeveloped land or residential properties.

6.2.5 Geologic, Hydrogeologic and Topographic Conditions

The property is on the north side of the Deerfield River, on an apparent first-level river terrace. No surface water was noted on the property, the river is the closet surface water approximately 100’ to the south. No wetlands or exposed bedrock were noted. The estimated depth to groundwater is less than 10’ based on the property’s proximity to the steep bank to the north and the Deerfield River to the south.

6.2.6 General Description of Structures

There are no structures on the property.

6.2.7 Roads

There are no roads on the property. West Main Street abuts the Chamber’s property and is close to the property (approximately 10’ away).

6.2.8 Potable Water Supply

There is no potable water supply presently in use on the property. Reportedly, municipal water is present in the area.

6.2.9 Sewage Disposal System

There is no sewage disposal system presently in use on the property. According to the town’s wastewater treatment plant operator, this property is within the sewered area of Wilmington.

6.3. Exterior Observations

6.3.1 Current Usage

Presently the property is undeveloped and is used to park vehicles for the adjoining enterprises.

6.3.2 Hazardous Substances and Petroleum Products

7.0 INTERVIEWS

7.1. Interview with Property Owner

Mr. Adam Grinold of the Mount Snow Regional Chamber of Commerce completed KAS’ property owner questionnaire on April 29, 2013. Mr. Grinold indicated that the property is currently undeveloped, there was a building on the property which washed away in 2011, and used to be a garage before the 1960’s. Mr. Grinold is not aware of any use, storage or disposal of hazardous substances or petroleum products on the property during the Chamber’s ownership, but that the presence of underground tanks was likely during previous use as a garage. He is not aware of any specific environmental problems with the property, nor is he aware of pending, past or threatened environmental enforcement actions, lawsuits, or spills of hazardous substances or petroleum products. A copy of the interview form is included in Appendix F.

7.2. Interview with Document User

Mr. Joe Specht of Ann Coleman Galleries, Document User, completed KAS’ document user questionnaire on April 24, 2013. Mr. Specht indicated no specific knowledge of environmental problems in connection with the property. He indicated that gasoline was once present at the property and that the property was once a gasoline station. Probing the grounds revealed a hollow metal object and a metal detection survey revealed the presence of metal at several locations. A copy of the interview form is included in Appendix F.

7.3. Interview with Occupants

There are no structures on the property and the property is not occupied.

7.4. Interview with Local Government Officials

KAS interviewed Ms. Alice Herrick via telephone on April 12, 2013. Ms. Herrick is the Town of Wilmington’s zoning administrator (6 ½ years) and health office (4 years). Ms. Herrick told KAS that recently while searching for a building sewer connection, the Wilmington Town Wastewater Operator was probing the ground on the property and encountered a void space.

KAS interviewed Mr. John Lazelle via telephone on April 24, 2013. Mr. Lazelle is the Town of Wilmington’s wastewater treatment plant operator. Mr. Lazelle stated that while excavating to find the building sewer connection, a void space and buried steel were encountered. They were able to push a shovel in 3-4 feet and then did no further exploration. He did not smell or see any petroleum. The location was staked and no further work was done. The stake has apparently since been removed.

8.0 FINDINGS

KAS has identified one REC on the property as defined by ASTM, the historic use of the property as part of a service station/filling station operation. The void space found below the property by the town sewer department needs to be further investigated to determine if there is an UST on the property. If an UST is found then it would be considered to be a REC per ASTM.

9.0 OPINION

The property’s documented historic use has been as a storage building/livery stable, auto storage garage, vacant land, a portion of a filling station/service station property, a school and an art gallery. There may have been other historic uses which were not identified during KAS’ research. Data gaps exist in the historical record which may obscure historic uses of the property. The property was part of a service station for many years and while the historic record does not contain any specific features (USTs, etc.) of environmental concern, the property may have been used to support the service station operations. Subsurface contamination may exist as a result of this historic use. The town sewer department’s investigation of the property discovered a subsurface void space which may or may not be related to a UST. There could have been USTs on this property in connection with the property’s past use as part of a service station. Alternatively, there is a cistern shown on the 1901 map of the property and it is possible that the cistern is still present below grade and this could account for the void space that the town sewer department encountered. Or, the void space may be unrelated to the cistern or a UST. Further investigation into the nature of the void space is warranted.

Nearby properties of known environmental concern have been reviewed and do not appear to present a risk of environmental contamination to the subject property. These include Nido’s Garage, the former Jug Barn, and the former Karla Simpla property. Groundwater contamination at these locations is either non-detectable or else is flowing in a direction not toward the property.

9.1 Additional Investigation

An additional investigation is deemed necessary to ascertain the presence or absence of RECs. Specifically, investigation into the nature of the void space encountered during the Wilmington Sewer Department’s findings to determine whether a fuel UST is present on the property. Per ASTM E 1527-05, this opinion regarding additional investigations is only intended to convey those additional investigations that may be necessary to ascertain the presence or absence of a REC. It does not convey any recommendation relative to the need to evaluate identified RECs at the property.

10.0 CONCLUSIONS

We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527 at 23 West Main Street, Wilmington, Vermont. Any exceptions to, or deletions from, this practice are described in Section 11.0 of this report. This assessment has revealed no evidence of recognized environmental conditions in connection with the property except for the following: historic use of the property as part of a service station/gasoline filling station.

A recognized environmental condition is defined in ASTM E 1527 as “the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release, or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de minimis conditions that generally do not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies. Conditions determined to be de minimis are not recognized environmental conditions.”

11.0 DEVIATIONS

11.1. Deviations/Data Gaps

Noted deviations to the ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process (ASTM E 1527-05) included: none.

Data gaps were identified as follows: inability to determine property uses in no more than 5-year intervals as required by ASTM. This data gap may affect KAS’ ability to accurately determine the presence or absence of RECs in association with historic property usage. 11.2. Significant Assumptions

KAS undertook performance of this Phase I ESA according to the following assumptions: None. 11.3. Limitations and Exclusions

KAS has prepared this Phase I ESA report in accord with ASTM E 1527-05 using the best efforts of Environmental Professionals and information available at the time of preparation. This report is intended to convey a point-in-time environmental evaluation of the property, as well as relevant information on past uses.  This document does not address regulatory compliance issues and KAS makes no assurances relative to the federal, state or local regulatory compliance of the property (ref. Section 1.4).  All appropriate inquiry as defined by ASTM E 1527-05 is not an exhaustive assessment of a clean property (ref. Section 4.5.2).  A variable level of inquiry may be conducted depending on the specific characteristics and features of the property and the information developed during the course of the assessment (ref. Section 4.5.3).  An assessment meeting or exceeding the requirements of ASTM E 1527-05 and completed less than 180 days prior to the date of acquisition or intended transaction is presumed to be valid (ref. Section 4.6).  All appropriate inquiry as defined by ASTM E 1527-05 is not exhaustive and does not require assessment of historic uses more frequently than every five years (ref. Section 8.3.2.1).

John said they dug and hit something steel in the ground and were able to push a shovel 3-4 feet into the ground. He did not see or smell any petroleum. Section 1. General Site Setting (ASTM E-1527-05 Section 9.4.1)

A. Current uses of the property (Section 9.4.1.1): Describe current property uses with emphasis on those likely to involve use, treatment, storage, disposal and/or generation of hazardous substances and/or petroleum products. Generate site sketch map (or obtain existing site plans). Include an estimate of the subject property boundaries. Include detail sketches if appropriate. Describe structures and other improvements on the property.

Property consists of a 24’ x 30’ rectangular parcel under 99-year lease to Joseph Specht and Ann Coleman Specht. The property is entirely within the boundaries of a 0.15 acre parcel owned by the Mount Snow Regional Chamber of Commerce. The property is not developed and is currently used as an earthen driveway between the adjoining gift shop and the Regional Chamber of Commerce building on the north side of West Main Street in Wilmington. The property slopes gradually southward. There are no structures or other improvements on the property. Reportedly there was a building on the property which was occupied by an art gallery. The building was destroyed by Tropical Storm Irene in 2011. There is no visual expression of the former building on the property.

B. Past uses of the property (Section 9.4.1.2): To the extent visually evident, describe past property uses with emphasis on those likely to involve use, treatment, storage, disposal and/or generation of hazardous substances and/or petroleum products.

There is no visual indication of past property use.

C. Current and past uses of adjoining properties (Section 9.4.1.3 and 9.4.1.4.): To the extent visually identifiable from the subject property, list current uses of adjoining properties with emphasis on those likely to indicate recognized environmental conditions on the subject property. If past uses of adjoining properties with such potential are evident list these also.

North, south, east and west the property is surrounded by lands owned by the Mount Snow Regional Chamber of Commerce. Beyond the boundaries of the Chamber’s land the following land uses were noted.

North: a steep bank upward to undeveloped land and residences East: a book store and other historic buildings along West Main Street. South: West Main Street and a restaurant, real estate office, gift shops and the Crafts Inn. West: a gift shop.

Differing historic land uses on adjoining properties were not visually evident.

D. Current or past uses in the surrounding area (Section 9.4.1.5): To the extent visually identifiable from the subject property and public thoroughfares in the vicinity, describe general area development with potential to indicate recognized environmental conditions with the subject property.

The general area development is a historic village downtown area. Houses on small downtown lots have been converted to businesses. The ground slopes upward steeply toward the north behind the property and the property is between the steep slope and the Deerfield River such that the probable upgradient uses are undeveloped land or residential properties.

E. Geologic, Hydrogeologic, Hydrologic and Topographic Conditions (Section 9.4.1.6): Describe the overall property setting. Describe natural bodies of water (including springs and seeps) and possible wetlands on subject property and indicate location(s) on site sketch map. Note presence of exposed bedrock on property grounds and indicate general location(s) on site sketch map.

The property is on the north side of the Deerfield River, on an apparent first-level river terrace. No surface water was noted on the property, the river is the closet surface water approximately 100’ to the south. No wetlands or exposed bedrock were noted. The estimated depth to groundwater is less than 10’ based on the property’s proximity to the steep bank to the north and the Deerfield River to the south.

F. General Description of Structures (Section 9.4.1.7): Describe structures or other improvements on the property including number and size of buildings, footprints, number of stories each, approximate age of buildings, occupancy status, pavement, fences, foundations/ruins, utilities, product pipelines, and ancillary structures such as railroad spurs and power transmission lines.

No structures on the property.

G. Roads (Section 9.4.1.8): List public thoroughfares, roads, streets and parking facilities adjoining / on the subject property.

There are no roads on the property. West Main Street abuts the Chamber’s property and is close to the property (approximately 10’ away).

H Potable Water Supply (Section 9.4.1.9): Identify potable water supply source(s) for the subject property as apparent from visual inspection.

There is no potable water supply presently in use on the property. Reportedly, municipal water is present in the area.

I. Sewage Disposal System (Section 9.4.1.10): Identify current sewage disposal system as apparent from visual inspection.

There is no sewage disposal system presently in use on the property. Reportedly, this property is within the sewered area of Wilmington.

Presently the property is undeveloped and is used to park vehicles for the adjoining enterprises.

RE: Monitoring Report for Former Klara Simpla Store, 17 West Main Street, Wilmington, VT (VTDEC #2003-3074)

Dear Mr. Taylor and Ms. Sullivan:

DB Environmental Consulting (DBEC) has prepared this Monitoring Report on behalf of 72 Acres, LLC for the above reference property (“the site”). The property was formerly operated as Klara Simpla. A Site Location Map is provided as Figure 1.

The site is located to the north of West Main Street (Route 9) in an area of commercial businesses and restaurants with the area Chamber of Commerce (#21 West Main Street) abutting to the site to the west. The site is abutted to the north (upgradient) by a steep hill with woods and residential properties at the top. Immediately to the east of the site is The Vermont House (#15 West Main Street) that serves as an inn, tavern, and restaurant. Downgradient to the south beyond West Main Street is Fennesseys Restaurant (#20 West Main Street). To the southwest is Pickwell’s Barn (#22 West Main Street) that contains a real estate office, art gallery, and an apartment in the southern end of the building. To the southeast is The Incurable Romantic (#16 West Main Street) gift shop. Further to the south beyond the commercial properties is the North Branch of the Deerfield River located approximately 300 feet downgradient. A Groundwater Contour Map is provided as Figure 2.

On November 22, 2002, during removal of two 1,000 gallon #2 heating oil underground storage tanks (USTs) groundwater and soil contamination was observed. Based on indications of impact to groundwater within a surficial aquifer and close proximity to a water service line and sewer mainline, no contaminated soil was excavated from the tank grave. On June 24, 2009 four monitoring wells were installed, with two at the site and two at down gradient properties.

Date of Groundwater Sampling and Method: On June 19, 2012 the four monitoring wells, MW-1, MW-2, MW-3, and MW-4 were gauged using a Solinst water level meter and samples collection via PVC disposable bailers. Approximately 1/2 inch of Free Product was noted in monitoring well MW-2.

Laboratory Analytical Method: EPA Method 8260 (VT VOC Scan).

Groundwater Flow Direction: Southerly, in the direction of the North Branch of the Deerfield River located approximately 300 feet to the south.

Groundwater Table Trends: The groundwater table was encountered at between approximately 8 to 13 feet below ground surface (bgs). Table 1 provides a summary of the groundwater elevation and analytical results. Dissolved VOC Concentrations: Primary Groundwater Quality Standard (PGQS) for Naphthalene, and combined Trimethylbenzenes (TMBs) were exceeded in the samples collected from monitoring well MW-4 (see attached laboratory results). PGQS exceedance for Naphthalene was also reported in the sample collected at monitoring well MW-2. Levels of Ethylbenzene, Naphthalene, and TMBs were reported below PGQS in the sample from MW-3. No compounds were reported above the minimum detection limits for the samples collected from MW-1 (upgradient). A Total Benzene, Toluene, Ethylbenzene, and Xylenes (BTEX) map is provided as Figure 3.

Date of Indoor Air Sampling: On November 22, 2002, and June 24, 2009 the site and Chamber of Commerce building indoor air was screened for VOCs using a PID. On October 29, 2009 the two downgradient properties were screened for VOCs. No VOCs were detected above the minimum detection limit of the PID (0.1 ppmv). No petroleum odors were noted within the buildings.

Sensitive Receptor Survey: The site and neighboring properties are connected to municipal water and sewer systems. There are no water supply wells within 500 feet of the site. The North Branch of the Deerfield River was inspected on November 22, 2002, June 24, 2009, and October 29, 2009 with no evidence of impact from the petroleum release. Neither schools nor daycares are located within 1,000 feet of the property.

CONCLUSIONS

DBEC provides the following conclusions:

A) Groundwater table elevation is located at approximately 8 to 13 feet bgs; B) Groundwater flow direction has been determined to be southerly toward the North Branch of the Deerfield River; C) Naphthalene, and TMB concentrations detected in the groundwater samples collected from MW-3 were above PGQS with a PGQS exceedance for Naphthalene at MW-2;

RECOMMENDATIONS

Based on field screening and laboratory results of samples collected from the monitoring wells DBEC makes the following recommendations:

1) Upon approval of the VTDEC, groundwater should be gauged and sampled at monitoring wells MW-1, MW-2, MW-3, and MW-4 for analysis of VOCs via EPA Method 8260 (VT VOC Scan) in Summer 2012. 2) A monitoring report should be prepared to summarize the results of the sampling event and conclusions with recommendations to address remaining exceedances of the VT PGQS. 3) As an exceedance of PGQS has been noted in both the downgradient monitoring wells (MW-3 & MW-4), additional subsurface investigations should be conducted in a downgradient direction towards the North Branch.

Laboratory Control Sample (LCS): A known matrix spiked with compound(s) representative of the target analytes, which is used to document laboratory performance.

Matrix Duplicate: An intra-laboratory split sample which is used to document the precision of a method in a given sample matrix.

Matrix Spike: An aliquot of a sample spiked with a known concentration of target analyte(s). The spiking occurs prior to sample preparation and analysis. A matrix spike is used to document the bias of a method in a given sample matrix.

Method Blank: An analyte-free matrix to which all reagents are added in the same volumes or proportions as used in sample processing. The method blank should be carried through the complete sample preparation and analytical procedure. The method blank is used to document contamination resulting from the analytical process.

Method Detection Limit (MDL): The minimum concentration of a substance that can be measured and reported with 99% confidence that the analyte concentration is greater than zero and is determined from analysis of a sample in a given matrix type containing the analyte.

Reportable Detection Limit (RDL): The lowest concentration that can be reliably achieved within specified limits of precision and accuracy during routine laboratory operating conditions. For many analytes the RDL analyte concentration is selected as the lowest non-zero standard in the calibration curve. While the RDL is approximately 5 to 10 times the MDL, the RDL for each sample takes into account the sample volume/weight, extract/digestate volume, cleanup procedures and, if applicable, dry weight correction. Sample RDLs are highly matrix-dependent.

Surrogate: An organic compound which is similar to the target analyte(s) in chemical composition and behavior in the analytical process, but which is not normally found in environmental samples. These compounds are spiked into all blanks, standards, and samples prior to analysis. Percent recoveries are calculated for each surrogate.

Continuing Calibration Verification: The calibration relationship established during the initial calibration must be verified at periodic intervals. Concentrations, intervals, and criteria are method specific.
