In our opinion, the testimony supports the conclusion of the Board that "UHDOF FEQ (Forward Headquarters? vere aware that the road from ; Aarne to Pitulim Camp had not yet been cleared of mines". "She testimony also indicates that information to this effect vas passed by the Israeli .J..V Liaison Officers to USDOF FHQ on 2k June* although, as you point out» there may have been some officers on the UEDOF staff vho vere not aware of that fact and assumed that the road had been fully cleared* The testimony further indicates that information that the Aarae-Pitulis -•' Hoad vas not safe on account of mines vas relayed to the Austrian battalion or at least to some of its officers. Indeed, UMDQP FHQ assumed, incorrectly, that another road running through Israeli-controlled territory would fee used by the Austrian search party* The fact is that vital information about the condition of the road did not reach members of the Austria^ battalion vho vere organizing the search pa^ty, but there is nothing in the report of the Board to indicate that the Austrian battalion alone vaa responsible for the failure to channel that information to all concerned* This vas one of the w "basicfflisunderstandings 11referre d to in paragraph (B) of the Board of Inquiry findings. The fcther "basic misunderstanding** concerns the exchange of messages on 2k June 1971* between the Austrian battalion and the UUDOF Chief Engineer Officer concerning the condition of the Aarae-Pitulim Camp Hoad. It is evident that that exchange of messages lent itself to tragic misunderstand- ings and that in fact both messages vere misunderstood by their respective ~ recipients. I fully agree vith you in this connexion that there is no ;^ basis for suggesting that the Austrian battalion alone vas responsible for :\, ;'"those misunderstandings. ' In short, there occurred a combination of human errors by a number of . -*.'. >r ._ persons, all of whom vere working under great pressure in a genuine effort 9'r-;;^.";,-•• ,-'-•£ ; x • to fulfil their important responsibilities in difficult circumstances. Further to my note MPP 3^0 of 15 October 197^, concerning the withdrawal of the Panamanian contingent of UNEF in the Middle East, I have the honour to communicate to you herewith a photocopy of the cable we have received on the subject from Colonel Rodrigo Garcia Ramirez, Second-in-Command of the Guardia Nacional of Panama. As you will be aware, the advance group of the Panamanian contingent proceeded to the Middle East on 19 November 1973 and the main body of troops on 10 December of that year. Since it is my Government's intention to withdraw its contingent from the area after the completion of one year's service, I request you to issue the appropriate instructions to ensure that the operations shall be brought to a happy conclusion. He also submitted a report on the destruction and pillaging of buildings, sites and monuments of archaeological, cultural, religious and historical interest' carried out by the Israeli occupation authorities in the liberated area of Syria. The representatives of the non-aligned countries consider that these acts perpetrated by the Israeli forces, without any reason or justification, constitute a flagrant violation of international law, humanitarian principles, the values of civilization and the Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 19^9, as well as a total violation of the Convention for the Protection of Cultural Property in the Event of Armed Conflict adopted at The Hague, on Ik May 195^, and ratified by numerous parties, including Syria and Israel. Moreover, international law views the acts committed by Israel as war crimes. Under the terms of the Charter of the Nuremberg International Military Tribunal, wanton destruction of cities, towns or villages, or devastation not justified by military necessity are considered to be war crimes. The General Assembly has been continuously seized with the problem of Palestine since April 19^7- In consequence of some of the early resolutions of the General Assembly regarding this issue, a great number of Palestinians have been displaced and forced to endure the status of refugees, and the Palestinian people have been prevented from exercising its inalienable rights, including the right to self-determination, in accordance with the Charter of the United Nations and the recognized norms of international law. 2. Nevertheless3 for more than 20 years, the question of Palestine as such and the question of the status and fate of the people of Palestine as such have not appeared on the agenda of any session of the General Assembly, even though the Assembly and other organs of the United Nations have dealt with various aspects, ramifications or consequences of the Palestine problem throughout this period. 3. Since 19^-8, however, the General Assembly has recognized and reaffirmed the right of the Palestine refugees to repatriation and, since 1970, has recognized and reaffirmed the inalienable rights of the people of Palestine, including its right to self-determination. In addition, the international community outside the framework of the United Nations has, in recent years, recognized these rights through various forums. h. As the United Nations has borne since its inception an historic, political and juridical responsibility regarding the problem of Palestine, it is, therefore, incumbent upon the General Assembly to consider the question of Palestine in its true nature and proper form, and to inscribe an item entitled "Question of Palestine" as a separate item on the agenda of its twenty-ninth session. AUSTRIAN FEDERAL CHANCELLOR VISITS UNEF HEADQUARTERS (The following was received from the Chief Information Officer of UWEF in Cairo.) The Federal Chancellor of Austria, Bruno Kreisky, paid a call today, 11 March, to the headquarters of the United Nations Emergency Force (UNEF) on the outskirts of Cairo where he was greeted by the UNEF Commander, Lieut. Gen. Ensio Siilasvuo. This was announced by Rudolf Stajduhar, Chief Information Officer of UNEF at his press briefing today. Accompanying the Austrian Chancellor was Ron Hayward, Secretary-General of the British Labour Party, and the Austrian ambassador in Cairo, Heinz Standenat. During his talks with Chancellor Kreisky, the UNEF Commander summarized the process of disengagement and the overall situation of UNEF. He expressed great satisfaction with the performance of the Austrian battalion with UNEF and said the Austrians were doing an excellent job. Chancellor Kreisky complimented the successful mission of UNEF and the results it had achieved thus far. The Federal Chancellor is currently visiting Egypt as the Head of the Delegation of the Socialist International, comprising leaders and secretaries of the socialist parties in Europe. From the UNEF headquarters in Heliopolis (Cairo outskirt), the Chancellor left by car for Ismailia where he will visit the Austrian battalion. Mr. Stajduhar announced that the UNEF Commander thio morning had an appointment with the Permanent Representative of Panama to the United Nations, Aquilino Boyd, and the Panamanian charge d'affaires in Cairo, J.A.R. Batista. Mr. Stajduhar recalled that the UNEF Commander, from time to time, was in touch with diplomatic representatives of the countries contributing troops to UNEF and with members of the Security Council. Answering another question, he said he did not have information about the arrival, of the Kenyan battalion. Mr. Stajduhar stated that the two Peruvian soldiers seriously injured in a mine accident had remained in the same condition, while five other slightly injured Peruvian soldiers were doing well. In reply to a question if there had been any incursions into the UNEF zone since the completion of the disengagement, Mr. Stajduhar answered that since the UNEF Zone had been established, there had been on several occasions incursions into the Zone by soldiers and vehicles of the Israeli and Egyptian Armed Forces. The object of these efforts is to develop a reasonable and equitable system acceptable to fill the Governments. De Lauro The Foreign Minister conveyed the wishes of President Kenyatta for all success in the new year. He said the President recalled vith pleasure the Secretary-General's visit to Mombasa and Nairobi and hoped that it -would be possible for the Secretary-General to visit Kenya again in the future. The Foreign Minister said that Kenya was ready and willing to provide a contingent of troops for the United Nations Emergency Force in the Kiddle East. He said that Kenya was prepared to send a battalion of six hundred troops as suggested by the Secretary-General in his message to the President. However, there were tvo natters which required clarification at this stage: 1. What'proportion of the cost vould be borne by the United Tfations in the transportation and naintenance of the battalion; 2. On vhat basis would Kenya be reimbursed with regard to'equipment and transport used by the battalion while in the field. The Foreign Minister wanted to know what were the reasons which allowed for the nayr.ent by the United Nations of different rates to states providing contingents. Ke understood that Swedish troops were receiving as much as eicht hundred dollars (3300) a month more while troops fron other countries were being paid less than one quarter of that amount. The Foreign Minister explained that while Kenya was prepared to provide a contingent, it could only be brought about by fresh recruitment since the existing standing army was only sufficient to cone with the'internal defence needs of Kenya. Since Kenya would have to recruit an entire battalion to replace that to be sent to u"TZ?, he hoped that the United Nations would be able to bear the full cost of that new unit. The Secretary-General exnlained that the varying rates' paid to different continents hadA established in the past but that it vras evident that there should be a new formula which would make the rates uniform. He said that - 2 - he was aware that some states had expressed concern on this natter but UIIE? was a departure from trie past nince it vas the first time that states frcn all five regions wero participating in a common .operation. The Cecretary-leneral then invited Mr. Liu and Mr. De Lauro to join the r.eetin-3 in order to answer the questions posed by the Foreign Minister. Mr. Liu explained that there vas a Secretariat paper which outlined the costs to be net by the United Nations and by the states concerned. The principle was that a state would be reinbursed the extra cost incurred by sendin3 n. contingent out of its homeland by the United ".rations. On the question of enuinnent, Mr. Liu said that each contingent would. come with its cvn transport and other equipment and that the United Nations would reimburse the cost of usage which includes depreciation. For example, with regard to transport, the United ITations would meet the cost of gasoline, spare parts, etc. There vas a formula for calculating depreciation on the capital cost of the transport which took account not only of the condition of the vehicle at the tine of its entry into the area of operation, but also of the terrain on which it had been employed. Mr. De Lauro confirmed that if a state was obliged to recruit army personnel in order to send a contingent abroad for service in the United Nations, that additional personnel would be considered as an extra cost and the state concerned could be reimbursed accordingly. He explained that there had been precedents for this practice and cited the case of Sweden. He also confirmed what Mr. Liu had said regarding a formula which allowed for a contributing state to receive a depreciation allowance on all transport and equipment used by the contingent in the field of operations, The Foreign Minister said that he was quite satisfied with the infor- mationvhich he had received and said that his Government would now be in a position to complete arrangements for the dispatch of the Kenya battalion to the Middle East. He said that he would convey the information to President rlenyatta and that the exact date of departure would be conveyed to the Secretary-General in the near future. He added that on the information given,his Government would claim the pay allowances of the Kenya contingent as s.n "extra and extraordinary cost". Furthermore, he explained the intention of raising the question of the rates of reimburse- ment by the United Ilations at the next session of the General Assembly. Mr. De Lauro remarked that the Federal Republic of Germany, which was air-liftinp; the contingents from Ghana and Senegal, had confirmed that it would also be able to provide transport nlanes for the Kenya contingent -about the 28th of January. The Secretary-General asked the Foreign Minister to convey to President Kenyatta his warmest regards and best wishes for the future.
