THE ASTRO-NOMOS: ON INTERNATIONAL LEGAL PARADIGMS AND THE LEGAL STATUS OF THE WEST BANK ORNA BEN-NAFTALI RAFI REZNIK ABSTRACT The continuous Israeli occupation of the Palestinian territory may well have exhausted the international community and exasperated the Palestinians, but it still stimulates the Israeli legal imagination. In 2012, the Israeli government established an expert committee to examine the status of Jewish construction in the West Bank. The committee’s report concluded that from an international legal perspective, the West Bank is not occupied territory; the law of belligerent occupation is not applicable to the area; the “prevailing view” is that Jewish settlements are lawful; and that Israel has a valid claim to sovereignty over the territory.

  • Why Israel Signed the International Criminal Court Statute and What the Signature Means
RECENT DEVELOPMENTS THE POLITICS OF JUSTICE: WHY ISRAEL SIGNED THE INTERNATIONAL CRIMINAL COURT STATUTE AND WHAT THE SIGNATURE MEANS DanielA. Blumenthal* I. INTRODUCTION On December 31, 2000, Israel followed the United States' lead and signed the Statute of the International Criminal Court (ICC).' This was materially the same statute that Israel had refused to sign for more than two years, despite having been one of the most vocal and ardent supporters of the creation of the ICC.' There were several reasons for Israel's change in position. On August 21, 2000, Alan Baker, Israel's Chief Foreign Ministry Legal Advisor, announced that Israel was considering signing the Statute of the proposed ICC.a Up to that point, the Palestinian Authority, a logical proponent of the provision in the Statute that caused Israel's initial opposition," had voiced support for the creation of the ICC5 implying a desire for Israel to become a party to the Court. This note will provide brief summaries of the development of the ICC and the background of the Israeli-Palestinian situation and will then examine Israel's potential motives for signing the treaty and predict the consequences of the signature on the State of Israel, the Israeli people, the Palestinian National Authority, and the peace process itself. * J.D. 2002, The University of Georgia; B.A. International Affairs 1997, The George Washington University. INTRODUcTION In an attempt to protect civilians from the dangers of armed conflict, various international bodies have attempted to codify harmful actions against innocent civilians into violations of international law. 1 While people in one state often commit crimes against people in another state, nation-states have had numerous difficulties in prosecuting those responsible for trans-border crimes before national criminal courts. On July 17, 1998, one hundred and twenty countries voted to adopt a multilateral treaty establishing the world's first permanent international criminal court to try individuals accused of genocide, war crimes, and crimes against humanity.2 The International Criminal Court (ICC) adheres to the notion that individual government officials, and not just the states they govern, could be responsible, under 1.
