APPLICATION PACKET / INSTRUCTIONS

KEEP INSTRUCTIONS PORTION OF THIS PACKET FOR FUTURE USE AND REFERENCE

The Mount Washington/Glassell Park Specific Plan sets forth provisions regulating development within the Specific Plan area. These regulations are in addition to those in the Los Angeles Municipal Code* (LAMC), as amended, and do not convey any rights or privileges otherwise granted under the provisions and procedures contained therein, except as specifically provided herein.

PLEASE NOTE: It is very important that you read this entire document prior to preparing the Project Permit Compliance Determination application. Failure to become acquainted with these requirements will result in processing delays, even termination of the subject request.

A. APPLICATIONS REVIEW AND SUBMITTAL.

G 1. Call ahead and make arrangements to submit the completed application along with all required materials for a preliminary review and the issuance of an “Authorization Referral Form” in order to submit the application at the Department Public Counter. Call Cherry Yap at 213.978.6364, located at 200 North Spring Street, Room 667, City Hall, Los Angeles CA 90012. In one to two days, you will be notified that your application is ready for a pick up. It may include a list of any missing items and/or special instructions.

G 2. If there are any Native “Protected” Trees on the subject site, an Arborist (Tree) Report will be required, per Ordinance No 143,476 and to the satisfaction of the Urban Forestry Division (UFD) of the Bureau of Street Services. Two copies of the Tree report will be included along with the Project Permit Compliance application at the time of submittal to Planning Public Counter. Otherwise the application will be considered incomplete. Within five days of application submittal, one copy of the Arborist Report, which includes the PPC administrative case number, will be submitted for review and approval by UFD.

G 3. The application is then submitted at the Planning Department’s Public Office and Construction Services Center, located at 201 North Figueroa Street, 4th Floor (213.482.7077). Counter staff will assign a case file number at the time of filing, however, they will keep the file for their initial case processing. Once the processing is completed, the Project Permit case file will be forwarded to the Eastside Unit staff for compliance determination.

PLEASE NOTE: All questions regarding the project’s consistency with the Los Angeles Municipal Code (LAMC) are referred to the Department of Building and Safety. Prior to filing the subject application, the applicant is responsible for the proposed project’s compliance with the Specific Plan and all applicable provisions of the Los Angeles Municipal Code.

B. AFTER APPLICATION SUBMITTAL.

G Notice of Intent. A “Notice of Intent” poster and posting instructions will be provided once the application has been approved for filing. The applicant must post the notice in a conspicuous place on the subject property, within five days after the application has been filed with the Department of City Planning and the applicable fees have been paid.

C. PROJECT APPROVAL. Once the request for determination and Project Permit application has been approved, the applicant/representative is required to review the “Conditions of Approval” for full compliance. A noncompliance will result in further delays that will affect being able to obtain all necessary permits for the subject project.

G 1. Make any required modifications and/or corrections, as specified on the Project Permit Compliance Determination report.

G 2. Follow the additional instructions as indicated in the subject grant.

G 3. If applicable, a Mitigation Measures Compliance Report must be prepared by the applicant / owner during each stage of the project’s implementation and must be submitted to the Community Planning Bureau, after each phase, as noted in the Project Permit Compliance determination when a Mitigated Negative Declaration has been approved for the subject project.

D. APPEAL PERIOD. After the fifteen (15) day appeal period has expired, you will be required to do, but not limited to, the following:

G 1. Obtain approval for the Covenant and Agreement by the Community Planning Bureau staff before recording it. This document will be mailed to you along with instructions for filing the form at the same time the copy of the determination is mailed. Call ahead to notify staff you need approval to record documents.

G 2. Return the Certified (purple stamped) copy of the Covenant and Agreement to the Community Planning Bureau, to be included in the subject case file.

G 3. Prior to scheduling an appointment with the Plan Checker of the Department of Building and Safety, submit a minimum of three complete sets of final plans to this Department’s Community Planning Bureau-Eastside Unit, for compliance with the Project Permit Determination approval.

Staff will confirm that this final set of plans conform to the subject project grant and compliance with Exhibit A, attached to the case file. All three sets will be returned to you for Building and Safety use.

G 4. Return the set of plans labeled FOR PLANNING USE ONLY, once the Department of Building and Safety gives the final approval, stamped approved and signed by the Plan Check Engineer of that Department, to be added to the Planning Department administrative case file.

G 5. Review the Conditions of Approval of the subject grant, some conditions require full compliance prior to the issuance of a Building Permit and/or Grading Permit.

MOUNT WASHINGTON/GLASSELL PARK SPECIFIC PLAN SUMMARY Ordinance No. 168,707

MOUNT WASHINGTON /GLASSELL PARK SPECIFIC PLAN ORDINANCE.

The Mount Washington/Glassell Park Specific Plan was adopted on April 2, 1993, (Ordinance No. 168,707, effective May 10, 1993). The purpose for the Plan is to encourage the preservation and enhancement of the community’s varied and distinctive residential character; to encourage preservation of the hills and canyons, vegetation, wildlife habitats, natural open space, views, and trails that characterize the area; to limit residential projects to a scale compatible with the hilly terrain, rustic nature, and architectural diversity already existing; and, to ensure that residential development is compatible with access limited by narrow hillside streets heavily used for parking.

RELATIONSHIP TO OTHER PROVISIONS OF THE LOS ANGELES MUNICIPAL CODE.

The regulations set forth in the Mount Washington/Glassell Park Specific Plan are in addition to those set forth in the Los Angeles Municipal Code (LAMC), as amended, and do not convey any rights or privileges not otherwise granted under the provisions and procedures contained therein, except as specifically provided herein.

Wherever the Specific Plan contains provisions which require more or less restrictive front yards, less restrictive height, more restrictive Floor Area Ratios, more restrictive landscaping requirements, or other greater restrictions or limitations on development than would be required by the provisions contained in the LAMC Chapter 1, the Specific Plan will prevail and supersedes the applicable provisions of the Code (per Section 2 of the Specific Plan).

The procedures for the granting of exception to the requirements of this Specific Plan are set forth in LAMC Section 11.5.7.D. In approving an exception to this Specific Plan pursuant to Section 11.5.7.D, the Area Planning and the City Council on appeal may simultaneously approve any conditional use under their jurisdiction. Only one fee will be required for a joint application. An application for an exception to this Specific Plan pursuant to Section 11.5.7.D does not require any additional application pursuant to the provisions of LAMC Section 12.24 B.

PROHIBITIONS

One-Family Project. No building or grading permit shall be issued for a one-family project unless it (1) meets the requirements of Section 6 of the subject Specific Plan and (2) the Director of Planning or his or her designee has issued a Project Permit pursuant to Section 8 of this Ordinance for the Project.

No person shall alter, add or construct a building or structure on a lot in the Specific Plan area pursuant to a building permit issued prior to the effective date of this ordinance unless a vested right has occurred prior to the effective date of this Ordinance. For the purposes of this Ordinance, a vested right shall be deemed to have accrued when construction pursuant to the building permit has proceeded to a point at which an authorized Department of Building and Safety employees has approved the foundation. This foundation approval must occur after the excavation for footings and footing forms is complete and required reinforcing steels are in place, and concrete is subsequently poured.

SPECIFIC PLAN PROCEDURES

The application for a Project Permit consists of a request for determination, together with plot plans and elevations for the Project, a survey of all trees on the lot or lots, a map showing all existing land uses on the abutting lots and lots along the same right-of-way for a distance of 200 feet on either side of the side lot lines of the Project, two sets of mailing labels listing property owners of all lots abutting, across the street or alley from or having a common corner with the Project.

The application will not be considered complete unless and until the form has been properly completed, all required information has been provided and the fee has been paid. Once the Project Permit application case file is received by the Community Planning Bureau, staff will determine if any additional information or materials are required or will deem the application as complete.

ACTION OF THE DIRECTOR

The Director shall make a written decision approving, disapproving, or approving with conditions a Project Permit Compliance application within 75 days AFTER the date the application IS DEEMED COMPLETE by the Community Planning Bureau. This time limit may be extended by mutual consent of the Director and the applicant.

The application is not complete until; 1) the subject site is posted with a Notice of Intent, from the Planning Department; 2) the Certificate of Posting is returned to the Planning Department, along with the pictures and newspaper; 3) all materials and information identified during the processing of the subject application as missing or in error, is corrected and submitted to be included in the subject case file and; 4) the file is formally deemed complete.

PROJECT PERMIT REVIEW

In making a determination to approve or disapprove a Project Permit application the proposed project will be reviewed in relation to all buildings located on adjacent lots and lots along the same right-of-day for a minimum distance of 200 feet in both directions.

DESIGN VARIATION.

In approving a Project Permit the Director shall find that the Architectural Design Elements of the front and rear building elevations v a r y from the adjacent buildings, based on design guidelines which include, but are not limited to, the following:

1. Articulation of facades with Architectural Design Elements, including shape, type, details and the location of windows, doors, columns, and balconies;

2. Modulation of facades by offsetting portions of the facade from the remainder of the facade, or curves, insets and transparent openings; and

3. Variety of roof treatments, including roof type, shape and pitch.

APPEAL PROCESS.

The East Los Angels Area Planning Commission shall make the determination on an appeal of the determination of the Director of Planning, considering the report on the public hearing by a hearing examiner. The City Council shall make the determination on an appeal of the determination of the East Los Angels Area Planning Commission.

1. An applicant or any other person aggrieved by a determination of the Director of Planning may appeal to the East Los Angels Area Planning Commission and thereafter to the City Council.

2. The appeal shall be in writing and will set forth specifically the reasons why the determination should not be upheld.

3. Appeals shall be filed in any public office of the Department of City Planning, upon forms provided by the Department and accompanied by a fee.

4. Appeals must be filed within 15 days of the mailing of the Determination to the applicant.

PROJECT PERMIT APPLICATION REQUIREMENTS LIST

INSTRUCTIONS.

Please use this list of requirements as a checklist in order to help you determine that all required material and information is being provided. Become familiar with the list of definitions below, to help you determine the appropriate information that must be provided.

Only the original copy of the application forms that are included with this application package, will be accepted. Please make a copy for your use before and/or after it is completed. Certain documents will be scanned in order to add them on this department’s web site.

Irrespective of the fact that your Project Permit Application is initially approved for filing purposes, further processing of the subject application will be suspended if is determined to be improperly prepared, incomplete or any required information is missing.

I. DEFINITIONS

Architectural Design Elements: Shape, type and details of windows, balconies, columns and doors; architectural offsets; exterior or finishing building materials; roof treatments, including roof type, shape and pitch; exterior wall surface treatments; decorative elements; and color.

Building Frontage: The exterior wall of a building or structure which is within a horizontal angle of 45 degrees from any lot line adjoining a public street. A building may have more than one Building Frontage.

Building Height: Notwithstanding LAMC Sections 12.21 A 17 (c) and 12.21.1 to the contrary, no building or structure shall exceed 45 feet in height.

Building Stepbacks: No portion of a building or structure, including any retaining wall, shall exceed a height of 15 feet within six feet of the front lot line, and between six and 12 feet of the front lot line, no portion of a building or structure, including any retaining wall, shall exceed a height of 24 feet above the street curb elevation at the centerline of the front lot line. If the adjacent street does not have curbs, then height shall be measured from the lowest grade adjacent to the exterior wall of the building.

Design Variation: In approving a Project Permit determination must be made that the Architectural Design Elements of the front and rear building elevations of the propose building varies from other buildings on adjacent lots.

This determination will be based on design guidelines which include, but are not limited to the following:

Floor Area (Gross) as defined by the Mount Washington/Glassell Park Specific Plan: Notwithstanding LAMC Section 12.03, Floor Area is that area in square feet confined within the exterior walls of a building of a One-Family Project, including the area of stairways, shafts, covered automobile parking areas and basement storage areas, and excluding uncovered outdoor decks.

Floor Area (Net) as define in Section 12.03 of the Los Angeles Municipal Code: Floor Area is that area in square feet confined within the exterior walls of a building, but not including the area of the following: exterior walls, stairways, shafts, rooms housing building-operating equipment or machinery, parking areas with associated driveways and ramps, space for the landing and storage of helicopters, and basement storage areas.

Floor Area Ratio: The ratio between the total floor area of all buildings on a lot and the total area of the lot.

Landform Grading Manual: "Planning Guidelines - Landform Grading Manual", prepared by the Department of City Planning and adopted by the , June, 1983, a copy of which is located in Council File No.82-0557.

Native Plants: Any (plant) species listed in Phillip A. Munz’ “A Flora of Southern " (or its successor standard reference as adopted by the Director) and identified as indigenous to the Los Angeles area.

Native (Protected) Tree: Any of the following native tree species, which measures four inches or more in cumulative diameter, four and one-half feet above the ground level at the base of the tree:

(a) Oak tree including Valley Oak (Quercus lobata) and California Live Oak (Quercus agrifolia), or any other tree of the oak genus indigenous to California but excluding the Scrub Oak (Quercus dumosa).

(b) Southern California Black Walnut (Juglans californica var. californica)

(c) Western Sycamore (Plantanus recemosa)

(d) California Bay (Umbellularia californica)

This definition shall not include any plant being grown or being held for sale by a licensed nursery within the Specific Plan area while the plant remains at the nursery, and shall not include street trees.

One-Family Project: Construction, alteration or addition to a one-family dwelling or any accessory building, for which a building permit is required, on a lot located in whole or in part within the Specific Plan area.

Prevailing Front Yards: Notwithstanding LAMC Section 12.21 A 17 (a), a front yard shall be provided which is equal to the average depth of the front yards for lots along the same right-of-way for a distance of 200 feet on either side of the side lot lines of the lot on which the dwelling is located. In determining the prevailing front yard, the calculations shall include the measurements between the front lot line and the main building located closest to the street; but excluding: (1) 20 percent of the lots with the largest and 20 percent of the lots with the smallest existing front yards; (2) existing vacant lots; and (3) all lots which do not provide the required parking spaces in accordance with LAMC Section 12.21 A 4 (a).

This requirement shall not apply where a driveway cannot be created in accordance with LAMC Section 12.21 A 5 (g) without building a retaining wall or other structural wall of more than five feet in height measured from the natural grade, or where there are not at least two remaining lots to use for the calculation. In those cases, the front yard shall be as required in the applicable LAMC Sections.

Retaining wall: all retaining walls must comply with the new retaining wall regulations - Building and Safety.

Significant Tree: Any tree which measures 12 inches or more in diameter at four and one-half feet above the average natural grade at the base of the tree and/or is more than 35 feet in height.

Standard Hillside Limited Street: A street (public or private) with a minimum width of 36 feet and paved to a minimum roadway width of 28 feet, as determined by the Bureau of Engineering.

Substandard Hillside Limited Street: A street which does not meet the minimum requirements of a Standard Hillside Limited Street.

Tree Expert –– A person with at least four years of experience in the business of transplanting, moving, caring for and maintaining trees and who is (a) a certified arborist with the International Society of Arboriculture and who holds a valid California license as an agricultural pest control advisor or (b) a landscape architect or (c) a registered consulting arborist with the American Society of Consulting Arborists. (Amended by Ord. No. 177,404, Eff. 4/23/06.)

Tree Relocation and Removal: any Significant or Native Tree(s) removed as a result of any act which will cause a native or significant tree to die, including but not limited to, acts which inflict damage upon the root system or other part of the tree by fire, application of toxic substances, operation or equipment or machinery, or by changing the natural grade of land by excavation or filling dripline areas around the trunk, or by changing the local drainage pattern, either inside or outside the dripline, such that it significantly affects the amount of water that reaches the tree root.

II. PROJECT PERMIT APPLICATION/DETERMINATION REQUEST.

G A. Floor Area Ratio (FAR) Determination Worksheet (page 25). First, complete this worksheet in order to determine the maximum total (gross) floor area (see definition) permitted, using the applicable formula based on the size of the subject site. The total floor area of the proposed project cannot exceed this maximum permitted gross floor area.

If the project exceeds the total (gross) floor area permitted, the project must be modified by reducing the floor area of the proposed project in order to comply or you must apply for an Exception from a Geographic Specific Plan (LAMC Sec. 11.5.7) then file the Project Permit Application.

G B. Master Land Use Application. This form must be filled out completely, typed or printed in black ink, with full answers to every statement and question. The application must be signed by the property owner or owners, authorized agent of the owner with power of attorney, or officers of a corporation (submit proof), and must be notarized.

A copy of the GRANT DEED is needed if the ownership does not match City Records. Ownership on the deed must correspond EXACTLY with the ownership listed on the application. The owner must provide a Letter of Authorization (LOA) to anyone other that the owner who is the applicant and signs the application. The authorized person on the LOA must correspond EXACTLY with the applicant listed on the application.

G C. Color Renderings. These renderings are required for all New Construction projects of two or more projects on contiguous lots.

III. REQUIRED DOCUMENTS AND EXHIBITS. The following submittals shall include all of the required information as indicated below.

A. A MT. WASHINGTON SPECIFIC PLAN COVER SHEET (see sample for format on page 17), TOPOGRAPHIC SURVEY MAP, SITE/PLOT PLAN, FLOOR PLANS FOR ALL STORIES (LEVELS), AND ELEVATIONS (IN THIS ORDER).

TWO (2) SETS OF COMPLETE AND DATED PLANS. Quality blue or black line drawings with uniform and light background color. Maximum 36" x 48" size with minimum 1/8 lettering size. Sticky back details must produce prints without contrasting shades of background color.

C. PLOT PLAN. The Plot Plan shall comply with the following specifications. Additional materials and/or information may be required.

Counter staff will not review or accept an application if it determines that the Plot Plan is not legible or is otherwise inadequate. Include only information necessary to depict the project and its setting (do not include mechanical drawings). A Plot Plan that does not substantially conform with these instructions, or is unclear or unreadable, will result in an application being deemed incomplete and suspend its processing.

Provide a fully dimensioned plot plan to scale. The Plot Plan shall include all property in the project site or ownership (whichever is larger) unless written permission has been obtained from a Public Counter staff supervisor to include an area less than the entire site or ownership.

The Plot Plan must clearly and completely show the intent of the project and its uses and their locations on the site. Clearly identify and differentiate the following features (and include imensions for important distances).

1. VII. PHOTOGRAPHS. One set of color photographs mounted on 8 ½ x 11-inch card stock or the paper equivalent. It is very important to take as many pictures to illustrate the property and issues involved that are helpful to the decision maker and are requested exhibits with this application. They should include pictures of every lot for a distance of 200 feet, as described above, with an index map indicating where the photographs were taken. A photograph is needed;

VIII. ABUTTING OWNERS MAILING LABELS. Names and addresses of property owners are to be obtained only from the City Clerk’s Land Records Division, 7th floor, 201 N. Figueroa Street.

Names and addresses of abutting property owners, include owners of properties adjacent, across the street or alley or having a common corner with the subject property and to the rear of the subject property. Be sure to include the applicant’s and the representative’s names on the labels. A number next to each name on the list keyed to the required district map, must be indicated.

IX. ENVIRONMENTAL CLEARANCE. All new construction will require the filing of an Environmental Assessment Form (EAF). Additions to an existing building will get a Categorical Exemption.

X. REFERRAL FORM. A copy of the Department of Department of Public Works, Bureau of Engineering’s Referral Form indicated the following:

XI. TREE REPORT. A Tree Report will be required for a project on a site with Native Plants and/or Native Trees. Clearance of these plants and/or any Native or Significant Tree from the subject site prior to obtaining Project Permit Compliance approval, is in violation of the Mount Washington / Glassell Park Specific Plan. The illegal removal will result in the owner/applicant being be cited, and/or the withholding or revocation of building permits.

XII. GEOTECHNICAL REPORT. If a Soil and Geology investigation report is required for the proposed project, a copy must be submitted along with the Project Permit Compliance application request. Failure to do so will cause a delay in the processing of the Environmental Assessment Form.

XIII SOILS REPORT DETERMINATION APPROVAL LETTER. Once the soils report is approved and a determination has been issued, a copy of the approval letter must be submitted to the Community Planning Bureau for the processing of the Environmental Assessment Form. Not providing the Community Planning Bureau with a copy of the approval letter will result in undue delay of the environmental clearance that will affect the continued processing of the Project Permit Compliance application.

XIV. REQUEST FOR “NOTICE OF COMPLIANCE.” Do not file this form until the project has been completed. The Department of Building and Safety will not issue a Certificate of Occupancy and/or act on your final inspection request, until you submit the “Notice of Compliance Request” (see page 32) with the Community Planning Bureau of the City Planning Department, along with all the required photographs. It is important to note that in submitting this request you are certifying that all conditions of approval for the proposed project, that were required to be satisfied prior to the issuance of a “Certificate of Occupancy”, have been complied with.

XV. DUPLICATE COPY OF CASE FILE: (1) A duplicate copy of a case file is required by the Department of City Planning in order to accept all applications; (2) each copy needs to be in its own separate envelope; (3) the envelope needs to be addressed to the Certified Neighborhood Council (CNC) for the area in which the project is located, postage affixed, and your own address as the return address CNC names and addressed can b e obtained from ZIMAS; (4) Projects in an area served by more than one Certified Neighborhood Council must provide a file for each CNC. TREE REPORT REQUIREMENT

PLEASE SHOW THIS FORM TO THE TREE EXPERT TO PREPARE THE TREE (ARBORIST) REPORT

If a tree report is required, said report must be prepared by a Tree Expert. A Tree Expert is a person with at least four years of experience in the business of transplanting, moving, caring for and maintaining trees and who is (a) a certified arborist with the International Society of Arboriculture and who holds a valid California license as an agricultural pest control advisor or (b) a landscape architect or (c) a registered consulting arborist with the American Society of Consulting Arborists.

The tree report shall include, but not limited to, the following:

5. TREE EVALUATION CHART AND ACCOMPANYING MAP SURVEY

A Health and Aesthetic rating inventory of all trees.

* Significant Tree: Any tree which measures 12 inches or more in diameter at four and one-half feet above the average natural grade at the base of the tree and/or is more than 35 feet in height.

** Native Plants: Any (plant) species listed in Phillip A. Munz’ “A Flora of Southern California" (or its successor standard reference as adopted by the Director) and identified as indigenous to the Los Angeles area.

*** Native (Protected) Tree: Any of the following Southern California native tree species, which measures four inches or more in cumulative diameter, four and one-half feet above the ground level at the base of the tree:

a. Oak tree including Valley Oak (Quercus lobata) and California Live Oak (Quercus agrifolia), or any other tree of the oak genus indigenous to California but excluding the Scrub Oak (Quercus dumosa).

b. Southern California Black Walnut (Juglans californica var. californica)

c. Western Sycamore (Plantanus recemosa)

d. California Bay (Umbellularia californica)

This definition shall not include any plant being grown or being held for sale by a licensed nursery within the Specific Plan area while the plant remains at the nursery, and shall not include street trees.

**** Tree Relocation and Removal: any Significant or Native Tree(s) removed as a result of any act which will cause a native or significant tree to die, including but not limited to, acts which inflict damage upon the root system or other part of the tree by fire, application of toxic substances, operation or equipment or machinery, or by changing the natural grade of land by excavation or filling dripline areas around the trunk, or by changing the local drainage pattern, either inside or outside the dripline, such that it significantly affects the amount of water that reaches the tree root.
