Executive Summary

1.0 Introduction: The Government of India (GOI) and Government of Assam (GOA) have requested Asian Development Bank (ADB) to provide $200 million in loan funding via a multi-tranche financing facility (MFF) to support continued investment in the state power sector, specifically for transmission and distribution system expansion and upgrades. GOA and APDCL will be the Executing Agencies for the MFF.

As a part of the reforms program, GoA has unbundled ASEB into three companies: Assam Power Generation Corporation Limited (APGCL), Assam Electricity Grid Corporation Limited (AEGCL) and Assam Power Distribution Company Limited (APDCL). Assam Power Distribution Company Ltd. (APDCL) the successor company of unbundled ASEB is the Implementing Agency (IA) for distribution system of Tranche-III of the MFF

The MFF will partly finance the expansion and augmentation of the transmission and distribution (T&D) networks. The investments are necessary to: (i) facilitate increased power transfers to accommodate increased demand and economic growth; (ii) improve supply-side energy efficiency by system de-bottlenecking and reducing technical losses; (iii) reduce the intensity of greenhouse gas (GHG) and other emissions via improved system efficiency; (iv) support expanded private sector participation in distribution system operations and other energy services; and (v) facilitate poverty reduction via improved electricity services and economic growth.

Tranche III subproject has 29 new substations and 87 distribution lines of which 33kV lines have a length of 620.30 km and 11kV lines have a length of 307 km. The applicable Environmental Acts and Legislation are being complied along with Environmental covenants in ADB loan agreement for the project. In order to have a sustainable development in the project the emphasis on the implementation of EMP has been given top most priority. Environment and Social Cell has been constituted for closely monitoring of implementation of EMP. A grievance redressal committee has also been constituted to address the concerns of the impacted stakeholders. The Implementing Agency APDCL giving full attention towards the implementation of EMP.

An environmental assessment and review framework (EARF) was prepared during Tranche I and is applicable for any investment that will be financed through the MFF which includes Tranche III. The EARF provides for the policy requirements, procedures, and institutional arrangements relevant for all the tranches.

The sub project Tranche III is classified as Environment Category B based on their potential environmental impacts as indicated in ADB’s Safeguard Policy Statement 2009 (SPS 2009). Following the SPS 2009 and EARF, IEE is prepared by APDCL as per ADB’s guide lines. The IEE describes the screening of potential environmental impacts due to i) project location and design ii) during construction and operation iii) proposed mitigation measures through implementation of EMP iv) public consultations and information disclosure and v) grievance redress mechanism

M/s SMEC India Pvt Ltd contract No. PMU 02/2009 -10 with APDCL to provide “National Consultant Assignment for Individual National Expert for Implementation Support for Social & Environmental Activities” has been extended and contract agreement was signed on 4th of November 2011 between Project Management Unit (PMU), Assam State Electricity Board and SMEC. Hence, the revised consultancy service will end on June 30, 2014. The scope of work defined in earlier contract remains same. 4

5.0 Safeguards Monitoring Results and Unanticipated Impacts

A. Environmental Monitoring Schedule:

In order to comply to requirements of Environmental monitoring an external environmental monitoring agency has been hired by PMU to carry out the environmental monitoring with regards to air quality, water quality and noise levels during preconstruction, construction and post construction stage. The primary responsibility of the environmental monitoring agency are for testing, analyzing and reporting impact of transmission lines & substation projects on air, ground & surface water and noise levels.

Although the civil construction works under the project are very meager, however, the environment monitoring for ambient air quality, water quality and noise levels during pre- construction period (Jan. to June,2013) are being monitored for Tranche III as per below schedule. (Refer Table 8.0)

Ambient air quality monitoring has been conducted on 24 hourly basis with respect to the following parameters

1. Particulate matter (Size less than 10 µm) or PM10

2. Particulate matter (Size less than 2.5 µm) or PM2.5

3. Sulphur dioxide (SO2)

4. Nitrogen dioxide (NO2)

The summary of results of Ambient Air Quality of 42 locations of transmission lines are presented in Annexure - 1. The results were compared with National Ambient Air Quality Standards, 2009 as specified by CPCB (Ref. Annexure -2). Air monitoring location maps are provided in Annexure-7.

D. Water Quality Parameter:

The details of monitoring of Surface/Ground Water Quality of 55 locations are presented in Annexure – 3.1, while the summary of the results are presented in Annexure 3.2. The results of ground water quality parameters were compared with Indian Standard IS: 10500 and the surface water quality results were compared with Class C standards as per Indian Standard IS: 2296 (Ref. Annexure – 4). Water monitoring location maps are provided in Annexure-7.

E. Ambient Noise Levels:

In the study area of Tranche-III, locations were selected based on the sensitivity and habitations. Noise monitoring were done at various proposed locations to identify the existing noise level and to suggest mitigation measures or other control measure to reduce the impacts during the construction period, though construction activities of transmission lines doesn’t create major noise impacts at the surroundings. The monitoring of Noise Levels was undertaken at 42 locations. The frequency of monitoring was set at an interval of 30 seconds over a period of 10 minutes per hour for 24-hours. The results of Noise Levels of 42 locations are presented in Annexure - 5. In India, the Noise Pollution (Regulation and Control) Rules, 2000 have been framed under the Environment (Protection) Act, 1986. These are a set of guidelines for regulation and control of noise. The ambient levels of noise for different areas/zones specified in the rules are indicated in Annexure - 6. Noise monitoring location maps are provided in Annexure-7.

6.0 Implementation of Grievance Redress Mechanism and Complaints Received from Stakeholders

There are 19 circles under APDCL for substations and distribution line. One Grievance Redressal Committee (GRC) cell at each circles level has been formed (i) to provide support to affected persons (AP’s) on problems arising from the environmental activities. (ii) record grievances of the AP’s and resolve them; and (iii) review grievances involving benefits like compensations for private tree loss and assistance to AP’s. A directive in this regard from Director (PMU), ASEB dated January 19, 2012 have been issued to APDCL, who are the Implementing Agencies of the MFF. GRC at circle levels are formed and Project Authorities are the Chairman of respective circles to comply the grievances in regard to environmental activities if any.

The GRC constitutes representatives of i. Concerned Project Authority (IA) Chairman of the committee ii. One official from the o/o the concerned District Magistrate or SDM (Civil) Member iii. Concerned Circle Officer or his representative Member iv. Concerned Project Manager (IA) Member v. Deputy General Manager (PMU), APDCL Member vi. Grievance Redress Committee (GRC) set up at circle level to monitor subproject implementation for each subproject affected area. The GRC will determine the merit of each grievance, and resolve grievances within an outer time limit of three months of receiving the complaint. The AP has the right to refer the grievances to appropriate courts of law if not satisfied with the redress at any stage of the process. The set up GRC has the system of records keeping, contact details of complainant, date of the complaint received, nature of grievance etc. if any for the ongoing project and taking the necessary action against the complaint.

During this reporting period no formal complaint or grievances from have been registered.

7.0 Conclusion and Recommendations

In order to have a sustainable development in the project the emphasis on the implementation of EMP has been given top most priority. The EMP prepared for the project was made part of the bid document and the contractor was made responsible for the implementation of EMP. The bid conditions require the contractor to adopt best construction practices which include most of the mitigation measures suggested in the EMP. Environment and Social Cell (ESMU) was constituted for closely monitoring of implementation of EMP by the contractor. A grievance redressal committee has been constituted with due representation to the people residing near to the project site. Complaints, if any, received will be recorded. The copy of the complaint together with the corrective action taken by the contractor will be placed before the committee immediately. The contractor will implement the decision taken by the committee. No complaint has been recorded during this period. Proper training on environmental issues during project implementation and EMP implementation are being organized for the staff and officers of the contractor and implementation agency. The implementing Agency, APDCL, will give more attention towards the implementation of EMP and project will be implemented in compliance with environmental regulations of the country and environment covenant of Loan Agreement.
